THE MARICOPA COUNTY LIBRARY DISTRICT AND TOWN OF GILBERT FOR
OPERATION OF THE SOUTHEAST REGIONAL LIBRARY AND PERRY BRANCH
LIBRARY
The Town of Gilbert, an Arizona municipal corporation (“Gilbert”), and the Maricopa
County Library District, a political subdivision of the state of Arizona (“Library District”)
(collectively, the “Parties”), enter into this Renewal of Gilbert Contract #319000372/Maricopa
County Agenda #C-65-16-024-M-00 (“Intergovernmental Agreement”) for the operation of the
Southeast Regional Library and Perry Branch Library.
WHEREAS, the Parties have the legal capacity to renew this Intergovernmental
Agreement pursuant to Arizona Revised Statutes (“A.R.S.”) §§ 11-951, et seq., and
WHEREAS, A.R.S. § 48-3901 provides for the establishment of a free county library
district within Maricopa County and permits cities and towns within the County to become part
of or to participate in the county free library district; and
WHEREAS, on May 5, 2016, Gilbert and Library District entered into the
Intergovernmental Agreement for the operation of the Southeast Regional Library and Perry
Branch Library for a term of five (5) years commencing in July of 2016; and
WHEREAS, participation by Gilbert with the Library District in this Intergovernmental
Agreement provides expanded benefits to residents of Gilbert including expanded library
services and materials, specialized library programs, and other services which might not
otherwise be available; and
WHEREAS, the Library District benefits from this Intergovernmental Agreement by
being able to continue to provide library services to Gilbert and Maricopa County residents and
by the use of space which is provided by Gilbert; and
WHEREAS, the Intergovernmental Agreement provides that it “may be renewed by
mutual agreement of the Parties for one (1) additional (5) five-year term;” and
WHEREAS, the Parties have mutually agreed to renew the Intergovernmental Agreement
for this additional five-year term as specified below;
NOW, THEREFORE, the Parties agree as follows:
1. Contingent on funds being appropriated or budgeted for the renewal term,
Contract #319000372/Maricopa County Agenda #C-65-16-024-M-00 entered into by Gilbert and
Library District on May 5, 2016 is renewed for a period of five (5) years, commencing on July 1,
2021 and continuing through June 30, 2026.

2. As part of this renewal, Contractor shall provide Gilbert with current insurance
certificates and any other required documents in accordance with Contract
#319000372/Maricopa County Agenda #C-65-16-024-M-00.
3. All other provisions of Contract #319000372/Maricopa County Agenda #C-65-
16-024-M-00 shall remain in full force and effect.
