Having considered the entire record herein and being fully advised in the premises, the
Commission finds, concludes, and orders that:
10 FINDINGS OF FACT
11 Background
12 1. Liberty Litchfield Park is an Arizona corporation that provides public water and
13 wastewater utility service, pursuant to CC&N authority granted by the Commission, in communities
14 within the cities of Litchfield Park, Goodyear, and Avondale. Liberty Litchfield Park also provides
15 utility services in adjacent unincorporated areas of Maricopa County in the west Phoenix valley, west
16 of the Agua Fria River and north of Interstate Highway 10. Liberty Litchfield Park has approximately
17 19,600 water customers and approximately 23,300 wastewater customers. !
18 z. Liberty Litchfield Park is owned by Liberty Utilities (Sub) Corp., a Delaware
19 corporation, through its operating subsidiary, Liberty Utilities Co. Liberty Litchfield Park’s ultimate
20 parent, Algonquin Power & Utilities Corp., is a Canadian corporation whose shares are traded on the
21 Toronto Stock Exchange.?
22 3. On June 3, 2019, Liberty Litchfield Park filed an application for an extension of its
23 CC&N to provide wastewater service to the Maryland Ridge Estates development located in certain
24 defined portions of Maricopa County, Arizona, the legal description of which is set forth in Exhibit A,
25 attached hereto and incorporated by reference.
26 4, Maryland Ridge Estates is on the southeast corner of 127" Avenue and Maryland

Avenue. The proposed extension area is approximately 19.1 acres and is anticipated to have 60
residential units at build-out,? with sewer facilities expected to be completed by March 2021."
5: Liberty Litchfield Park has received a request for service from El] Mirage to provide
wastewater services to the proposed extension area.
6. The proposed extension area is within Valley Utilities, Inc.’s (“Valley”) service area
and Valley will provide water service to the Maryland Ridge Estates development.®
Fe At hearing, Liberty Litchfield Park’s witness, David Heighway, testified that an
agreement existed between the Company and Valley which would allow for disconnection of a
customer’s water service from Valley ifa wastewater customer fails to pay their bill.’ The Company’s
post-hearing filing dated October 2, 2019, corrected the record to indicate that the agreement between
the two utilities does not impact disconnections. The Company stated that each residential connection
in the proposed extension area will be equipped with a sewer shut-off valve.
Existing/Proposed System
8. Liberty Litchfield Park owns and operates the Palm Valley Water Reclamation Facility
(“PVWRE”), which has a permitted capacity of 6.55 million gallons per day (“(MGD”).8
9, According to Staff's Engineering Report, the PVWRF experienced a peak flow of
approximately 5.5 MGD, or 84 percent of permitted treatment capacity, in November 2018, Mr.
Heighway testified at the hearing that Liberty Litchfield Park was presently looking to either expand
the PVWRF or build a new wastewater reclamation facility to provide for future capacity.” Staff's
Engineering Report determined that Liberty Litchfield Park can serve an additional 3,000 connections.
As a result, Staff concluded that the PVWRF has adequate treatment capacity to serve the proposed
extension area.! 0
10. According to Liberty Litchfield Park’s application, wastewater from Maryland Ridge

Estates is designed to flow north to connect with a sewer main through a sewer manhole that was
installed as part of the Falcon View residential development, and will connect with existing sewer
mains along El Mirage Road. The new facilities required include approximately 3,368 linear feet of 8-
inch polyvinyl chloride (“PVC”) sewer pipe, 60 4-inch PVC sewer pipe, and 14 manholes.!'!
11. Liberty Litchfield Park estimates the total costs for wastewater facilities needed to serve
the requested extension area to be $150,644."
12. Liberty Litchfield Park proposed to finance the facilities with a combination of
contributions via hookup fees, advances in aid of construction, and equity."°
13. Staff concluded that Liberty Litchfield Park’s proposed costs to construct facilities to
10 serve the proposed extension area are reasonable. However, Staff stated that it did not make a “used
and useful” determination for the proposed plant and that no conclusions should be inferred for
12 ratemaking or rate base purposes.'4
13 14. Liberty Litchfield Park will charge its existing wastewater rates for service to the
14 customers in the proposed extension area,"
15 15. According to Staffs Engineering Report, Liberty Litchfield Park has no delinquent
16 Commission compliance items.'®
{7 16. Staff's Engineering Report indicated that an Arizona Department of Environmental
18 Quality (“‘ADEQ”) Wastewater Compliance Report, dated July 9, 2019, stated that the PV WRF was in
compliance for the period of April 1, 2018, to March 31, 2019,"
20 17. Liberty Litchfield Park has an approved Offsite Hookup Fee Tariff on file with the
