5. RECOGNITION OF JOHN LEWIS, CHIEF FINANCIAL OFFICER
Recognition of John Lewis, Chief Financial Officer, for 26 years of dedicated service to
Maricopa County. (C-06-21-280-X-00)

time at Maricopa County. Mr. Lewis is currently the Chief Financial Officer and is

over the past years including:
 Originally hired as a fiscal management analyst
 Was promoted into supervisory positions within the Department of Finance
 Later promoted to Chief Financial Officer upon Ms. Scharbach’s retirement.
 He has also served on the Internal Audit Committee and the Deferred
Compensation committee (now called Smart Savings).

exceptional service in so many areas.

expertise. He also commented that in speaking with a fellow board member on one of
the Boards, she stated that he was highly regarded, and he would be missed.

g. The following Luke Air Force Base condition shall apply:
SimonCRE Saltair IV, LLC shall notify future occupants/tenants that they are located near a
military airport with the following language:
Luke Air Force Base executes an average of approximately 165 overflights per day. Although
Luke’s primary flight paths are located within 20 miles from the base, jet noise will be
apparent throughout the area as aircraft transient to and from the Barry M. Goldwater
Gunnery Range and other flight areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours and
during most weekends.
For further information, please check the Luke Air Force Base website at

j. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the Military Compatibility Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either revocation
due to the failure to comply with any conditions, or the expiration of the Military Compatibility
Permit, does not reduce any rights that existed on the date of application to use, divide, sell
or possess the property and that there would be no diminution in value of the property from
the value it held on the date of application due to such revocation or expiration of the Military
Compatibility Permit. The Military Compatibility Permit enhances the value of the property
above its value as of the date the Military Compatibility Permit is granted and reverting to the
prior zoning results in the same value of the property as if the Military Compatibility Permit
had never been granted.
k. The Military Compatibility Permit shall be limited to the following uses as per UC2019008:

Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to
solicit comments on incorporating federal standards into Maricopa County Air Pollution
Control Regulations: Rule 360 (New Source Performance Standards), Rule 370 (Federal

16. AQ-2017-009: MARICOPA COUNTY AIR POLLUTION CONTROL REGULATION III -
RULE 350; RULE 351; RULE 352; RULE 353
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to
solicit comments on the proposed revisions of Maricopa County Air Pollution Control
Regulation III – Rule 350 (Storage and Transfer of Organic Liquids (Non-Gasoline) at an
Organic Liquid Distribution Facility), Rule 351 (Storage and Loading of Gasoline at Bulk
Gasoline Plants and Bulk Gasoline Terminals), Rule 352 (Gasoline Cargo Tank Testing and
Use), and Rule 353 (Storage and Loading of Gasoline at Gasoline Dispensing Facilities) and
the associated proposed revision to the Arizona State Implementation Plan (SIP). Following
the public hearing, the Board is requested to adopt the proposed revisions to the rules and
to approve submission of the revised rules as a revision to the Arizona SIP.
Rule 350 limits emissions of volatile organic compounds (VOCs) from organic liquids (non-
gasoline) during the storage and transfer of an organic liquid at an organic liquid distribution
facility. Rule 351 limits emissions of VOCs from gasoline during the storage and loading of
gasoline at bulk gasoline plants and at bulk gasoline terminals. Rule 352 limits emissions of
VOCs from gasoline cargo tanks. Rule 353 limits emissions of VOCs during storage and
loading of gasoline at a gasoline dispensing facility.
The MCAQD is proposing to revise Rules 350, 351, 352, and 353 to address rule deficiencies
identified by the Environmental Protection Agency (EPA). The proposed revisions are
required to secure the rules’ approval as part of the Arizona State Implementation Plan under
the federal Clean Air Act. The MCAQD is also proposing revisions to address rule
recommendations provided by the EPA, incorporate revisions recommended by
stakeholders, and make other revisions to improve and clarify the rules.

17. AQ-2019-005-P-7 (MARICOPA COUNTY TRIP REDUCTION ORDINANCE)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to
solicit comments on the proposed revisions of Maricopa County Air Pollution Control
Regulations, Ordinance P-7 (Maricopa County Trip Reduction Ordinance). Following the
public hearing, the Board is requested to adopt the proposed revisions to the ordinance.
The MCAQD first adopted Ordinance P-7 on November 24, 1992 to reduce traffic impacts
on air pollution and emissions within Maricopa County. Ordinance P-7 applies to major
employers and schools with 50 or more employees or students at any single work or school
site and requires them to develop, implement, and maintain a travel reduction program.
Employers and schools subject to Ordinance P-7 are required to maintain a reduction of
single occupant vehicle (SOV) trips and/or miles traveled to either their school or work site
by 10 percent each year for a total of five years, and then five percent for three additional

years, or until a 60 percent rate of SOV travel is reached. Progress is tracked through an
annual commuter survey of employer/school sites. The results of the survey are used to
develop an annual travel reduction plan that commits the employer/school to implementing
and documenting various strategies to reduce SOV trips or miles traveled.
The MCAQD is proposing to revise Ordinance P-7 to update and clarify the ordinance by
removing language repeated from state statute, condensing information in the Equivalent
Emissions Reductions and Plan Development sections, identifying new technologies for the
implementation of the Maricopa County Travel Reduction Program (TRP) by both program
staff and employers, and by incorporating six (6) existing Substantive Policy Statements into
the ordinance. In addition, the ordinance will be restructured for consistency with MCAQD’s
other adopted ordinances.

27. AMENDMENT TO AGREEMENT FOR DONATION FROM THE ARIZONA PROPANE
GAS ASSOCIATION (APGA) FOR THE PROPANE FIRE PIT PROGRAM
Approve and authorize the Chairman to execute an Amendment 2 to the Agreement between
the Maricopa County Air Quality Department (MCAQD) and the Arizona Propane Gas
Association (APGA) for APGA to provide a restricted donation of matching funding to
MCAQD for the Propane Fire Pit Program and accept the funds.
This Agreement will provide for continued matching funds to support MCAQD’s Propane Fire
Pit Program which encourages the exchange of wood burning fire pits for cleaner burning
propane gas devices, to aid in the reduction of particulate matter 2.5 (PM 2.5) during the
wood burning season. This program will be marketed to all County residents and will offer
through e-mail a voucher which can be taken to select Home Depot stores within Maricopa
County for a discount on a propane fire pit. There will be a $50.00 discount provided by the
County and a $25.00 discount provided by the APGA, for a total of $75 per program
participant. The term of this Amendment shall commence on the Effective Date and end no
later than April 1, 2021.
PM 2.5 is an EPA pollutant that is known to cause damaging health issues, including acute
asthma symptoms leading to hospitalization and heart disease, as the tiny pollutant can
deposit deep into the lungs and enter the blood stream. If PM 2.5 should exceed the EPA 24
hour or annual standard, this could lead to more stringent regulations and negative economic
impact for Maricopa County.
Donation revenue funds of $30,000 are deposited into Fund 504 as they are received.
Donation funds are not local revenues for the purpose of the constitutional expenditure
limitation; therefore, expenditures of these revenues are not prohibited by the budget law.
The approval of this action requested does not alter the budget constraining the expenditures
of local revenues duly adopted by the Board pursuant to ARS 42-17105. This county-wide
program is in all districts. (C-85-21-018-X-00)

not alter the budget constraining the expenditure of local revenues duly adopted by the Board
pursuant to A.R.S. §42-17105.
Election offices can use the funds to enhance CY 2020 mandated early voting services the
department is required to perform. Due to increases in early ballot demand, Maricopa County
is providing attended drive-thru drop boxes at 14 locations throughout the County, primarily
located in well-known large Sporting venue parking lots. Voters will be able to return their
ballot with confidence with the added benefit of convenience and limited public exposure. All
locations will be staffed by a team of bipartisan poll workers who will be donning face masks,
face shields, and gloves.
The grant does not allow for indirect costs for which the County is eligible. The Maricopa
County Elections Department composite indirect cost rate for FY 21 is 68% or $28,463. The
recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost
is $28,463. Non-recoverable indirect costs will be covered by the departmental general fund
budget. This grant is non-competitive and does not require a match or on-going cash
contributions after the grant period end date. The grant award is nonrecurring and has not
been awarded to the department in past years.
The total amount of funds requested is $28,463 $41,857. The grant period will cover the
periods November 1, 2020 through November 30, 2020.

74. IGA WITH THE CITY OF AVONDALE FOR THE EXCHANGE OF SERVICES (ENTENTE)
Approve the Intergovernmental Agreement (IGA) between Maricopa County and the City of
Avondale for the exchange of services or reimbursement of services (Entente). This
Agreement shall become effective as of the date it is approved by the Maricopa County
Board of Supervisors and remain in full force and effect until either Party terminates it. Either
Party may terminate this Agreement at any time before the expiration date of this Agreement
by furnishing the other Party with a thirty (30) day written notice.
The purpose of this Intergovernmental Agreement is to identify and define both Parties'
respective roles in the execution of the responsibilities of specific maintenance tasks in areas
that cross jurisdictional boundaries.
The Agreement provides the opportunity to focus on specific maintenance tasks or
emergency highway projects and the availability of the most economical resources by
extending beyond jurisdictional or geographical boundaries. The Agreement's application will
benefit areas in the County and the City where the other Party could complete specific types
of routine maintenance or emergency highway project activities based on scheduled work
within the area. Individual tasks performed by either Party will be executed upon completing
a Letter of Agreement (LOA) approved and signed by the County Department of
Transportation Director and the City Manager, or their designees.
If the value of goods or services exchanged by the Parties is not of equal value, the total
aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If
no services are exchanged, there is no financial impact. An accounting mechanism will be
utilized to track each LOA, as applicable, to identify specific tasks and services and ensure
the exchange of these services is of similar value. Supervisory District No. 4 (C-64-21-071-

SUMMARY OF CURRENT EVENTS - EL RESUMEN DE TEMAS DE
ACTUALIDAD
109. Supervisors'/County Manager's summary of current events - Resumen de temas de
actualidad de los Supervisores/Administrador del Condado
Supervisor Sellers noted that he had met with the Mayor and staff of Queen Creek
regarding plans for an extension of prop 400, and some water issues they are dealing
with. They also wanted to be sure we are coordinating with them related to some issues
dealing with San Tan Park.
He also mentioned that he was a speaker at the Bridge forum which was celebrating
veterans and discussing ways to support veterans. In addition, they presented me with
an award called, “Leading by Example.” There were many positive comments about
work that the County is doing in so many areas in support of veterans. Over 10% of
the County workforce are veterans.
Supervisor Gallardo commented on the recent Nascar race held in the west valley. The
number of attendees had to be limited, but it was still a great event. He congratulated
the west valley cities and the raceway for hosting that great event.
In addition, Supervisor Gallardo wished everyone a Happy Thanksgiving. Even though
Thanksgiving gatherings will differ quite a bit this year, it is still a time to relax a bit, and
even chat with family members by phone or on-line. He noted that it may still be a
tough winter, but hopefully, we can look forward to some more normal events in the
coming year.
County Manager Joy Rich also commented on the commendable job that John Lewis
has done over the years as a great leader in the Finance Department.
Supervisor Gates also wished everyone a Happy Thanksgiving and extended his
thanks to all Maricopa County employees for the work they have done during these
times, but they have all continued to provide excellent service.
Supervisor Chucri also wished everyone a Happy Thanksgiving. He commented that
even though we are not yet able to have people attend the meetings, the Board is still
hard at work on so many issues. In addition, he commented that the procurement
process for the voting technology equipment followed the requirements and the RFP
process was thorough. He ended by again thanking County employees for their hard
work and wishing all a Happy Thanksgiving.
Chairman Hickman commented that the following day Supervisor Gallardo would be
installed as the President of the County Supervisors Association of Arizona. Along with
his colleagues he congratulated him and stated that he was confident that Supervisor
Gallardo would do an awesome job in that role.
The Chairman concurred with Supervisor Chucri’s comments about the election issues,
saying that the County is always prudent and diligent regarding procurement issues.
Finally, the Chairman also wished everyone a Happy Thanksgiving noting how hard
County employees have worked to keep things running smoothly, and how welcome it
would be for a little bit of relaxation time.
