This Temporary Construction Easement is entered into by and between Jack John McNamara, an
unmarried man and Lisa Zanin and Henry Zanin, Jt., wife and husband, hereinafter referred to
as GRANTORS, and the FLOOD CONTROL DISTRICT OF MARICOPA COUNTY, a political
subdivision of the State of Arizona, its officers, agents, contractors, assigns, heits, and successors in
title or interest, hereinafter collectively called GRANTEE, as of the last date signed below.
GRANTORS heteby grant a Temporary Construction Easement (“TCE”), together with the
tight and privilege of entering upon the area subject to said temporary easement, on, over, under and
actoss that portion of GRANTORS' property located at APN# 300-81-018B desctribed/depicted on
Exhibit “A”, which is attached to, and made a patt of, this temporary easement (“TCE Area”), for the
purpose of facilitating construction of the project known as PCN117.01.31 (“Project”).
1. Term and Consideration. This TCE is hereby granted for the stated purpose for a
period of Twenty-Four (24) months (“Term”) which shall commence on February 1, 2023.
GRANTEE estimates that the period set forth above will be sufficient time for completion of the
work needed for construction of the Project. The consideration for the use of the TCE Area shall be
Ten and No/100 Dollars ($10.00) paid by the GRANTEE to the GRANTOR. This consideration
shall be for the full Term desctibed. In the event GRANTEE determines that additional time is
needed for completion of the Project construction, GRANTEE shall be permitted to extend the term
of this TCE by paying, additional consideration, the sum of Three Hundred Sixty-Nine Dollars
and No/100 Dollars ($369.00) for each month of the required extension.

2. Damages. The GRANTEE shall be liable for any permanent damage to the TCE
Atea, and/ot any improvements therein, caused by GRANTEE during the Term of this TCE. Any
improvements damaged because of GRANTEE?’S use of the TCE Area will be replaced in kind.
3, Indemnification. GRANTEE agtees to indemnify GRANTORS for all direct
damages to the real property, personal property, or physical injury to persons on the TCE Atea, caused
by or atising from the sole negligence of GRANTEE in the exercise of GRANTEE'S tights pursuant
to the terms of this TCE. All claims shall be submitted in accordance with the requirements of A.R.S.
§12-821, et seq.
4. Extinguishment. Upon completion of the Project construction, GRANTEE shall
record a document extinguishing this TCE in the office of the Maricopa County Recorder.

LEGAL DESCRIPTION FOR TEMPORARY CONSTRUCTION EASEMENT
A Portion of “Lot 15”, SUNSET COVE, according to Book 21 of Maps, Page 29 records of
Maricopa County, Arizona, lying within the Southwest quarter of Section Fifteen,
Township One South, Range Two East of the Gila and Salt River Meridian, and being
more particularly described as follows:
A Portion of Assessor parcel 300-81-018B;
Commencing at the Southeast corner of “Lot 9” of said SUNSET COVE, said Southeast
corner also being a point on the North line of “Lot 15” of said Subdivision;
Thence South 89°54'58" West to the Northeast corner of that certain parcel of land
described in document 2011-0353364, Records of the Recorder of said Maricopa County,
for a distance of 191.45 feet;
Thence from said point and along the East line of said parcel, South 00 °07'02"East to
the Southeast corner of said parcel, a distance of 227.48 feet;
Thence, continuing along the Southerly extension of the East line of said parcel a
distance of 187.20 feet to the Point of Beginning:
Thence South 89°58’02” West, a distance of 216.10 feet;
Thence South 00 °07'02"East, a distance of 30.00 feet to a point on the Easterly
extension of the South line of “Lot 12” of said Subdivision;
