March 21, 2021 Andrea & James Nelson 32793 N. 66th street Cave Creek, AZ 85331 RE: Abandonment of easement APN# 216-50-186A To whom it may concern, Our lot is diagonal or adjacent to the property listed above. We are writing this letter to OBJECT to the request by the homeowner at APN# 216-50-186A, to abandon their easement for the following reasons: e This abandonment would severely affect our property and lifestyle. e According to neighbors; the property owners requesting the abandonment do not want the vacant lot owner to have access via their easement (lot just south of them) and has told prospective buyer’s they will need to access the lot via Maria & 66th St, which is impossible. e Access to the vacant lot has always been 67th Street & Maria that was previously established. e Logically the access to the vacant lot via 66th Street has always been nonexistent & should continue to be. In addition, half of the easement has been abandoned on the west end of Maria making a pretty narrow area. e The owners of the lot applying for this abandonment have a lot that is scraped of all natural vegetation. It would not change the look of their property to allow driving access. Whereas, the west half of Maria has a very deep wash with beautiful, lush natural Sonoran Desert vegetation & is in keeping with the integrity of the desert. e Our portion of Maria has an engineered culvert running east to west that cannot be driven over. e Our property & our neighbor's to the North of us have custom homes that have been here for over 30 years & in keeping with the natural surroundings. e Access via 66th st would require removal of thousands of dollars worth of mature landscape trees — cacti -hardscape planted and maintained the last 20 years. Replacement of indigenous plants can be very costly. | HAVE ATTACHED PHOTOS TO MY EMAIL FOR REFERENCE. Thank you for your consideration.
