Re: — Assessor Parcel No. 216-50-151A; Proposed Abandonment of Easement
(PAB-0150) — Assessor Parcel No. 216-50-186A
Dear Ms. Brinton:
As you know, we represent the owner (Judi Pierce) of Assessor’s Parcel No. 216-
50-151A (the “Subject Parcel’). Next week the Maricopa County Board of Supervisors will
consider the proposed abandonment of the easement referenced above. I previously sent my
March 31, 2021, letter to you opposing the abandonment. I was contacted by Mitch Wagner at
your office regarding a potential compromise of the abandonment which would be agreed upon by
owners’ of the parcels adjacent to the abandoned easement.
This letter is to confirm that our client agrees with the following proposal for the
easement. Our client will agree with the proposed abandonment so long as a 15-foot wide
easement on the south side of Parcel No. 216-50-186A (owned by Scott Equities Trust) and a 15-
foot wide easement on the north side of Parcel No. 216-50-151B (owned by James and Marie Erb)
are retained and are in effect after the abandonment. This will give our client a 30-foot wide
easement from 67" Street all the way west to the east property line of our client’s Subject Parcel.
The 30-foot wide easement would be on the center line of the current easement (15 feet on each
side of the center line). The 30-foot wide easement should remain clear with no gates, walls or
landscaping within the 30-foot easement. Our client will agree to the 30-foot easement so long as
the easement provides unimpeded access to its Subject Parcel.

If you have any questions about this letter or the compromise that our client is
agreeing to in order to resolve the abandonment dispute, please call me. We appreciate the work
of your office to resolve this matter between all of the land owners.
Very truly yours,
James R. Hienton
