That for the consideration of One Dollar ($1.00) and other valuable consideration, Maricopa County, a political
subdivision of the State of Arizona, GRANTOR(s), hereby grants to the City of Phoenix, a municipal corporation of
the State of Arizona, GRANTEE, a permanent easement for water purposes within that certain real property situated in
Maricopa County, Arizona, described as follows:
FOR LEGAL DESCRIPTION SEE EXHIBIT "A" ATTACHED
HERETO AND MADE A PART HEREOF BY REFERENCE.
Subsequent to the recordation of this easement in the Office of the Maricopa
County Recorder, neither GRANTOR nor GRANTEE shall construct or place any
structure of any kind within the areas subject to this easement except water
lines and appurtenances, wooden, wire or removable section type fencing and/or
paving, nor shall any vegetation be planted therein except grass. Upon the
GRANTEE’S completion of the initial installation and/or construction of its
water facility, GRANTEE shall restore the areas subject to this easement in
accordance with GRANTEE’S approved construction plans dated June 26, 2020, and
to a clean and safe condition. The GRANTEE shall not be required to repair or
replace any structure or obstruction installed in the areas subject to this
easement by the GRANTOR subsequent to the recordation of this easement.
GRANTOR’S use of the easement area shall be limited to those areas not in use
by GRANTEE and shall not interfere with GRANTEE’S facilities.
IN WITNESS WHEREOF, MARICOPA COUNTY, a political subdivision of the State of Arizona, has caused its name
to be executed by its duly authorized representative as of the date set forth below.
