RESOLUTION ROAD FILE NO. 5904-R C64-16-067-M-02 Page 2 RESOLUTION ROAD DECLARED (ROAD FILE NO. 5904-R) C64-16-067-M-02 WHEREAS, on the 9th day of March, 2016, the Board adopted a Resolution designated Road File No. 5904 (C64-16-067-M-01), declaring said road into the County Highway System; and WHEREAS, on the 16th day of March, 2016, the Clerk of the Board recorded the minutes of the Board action to adopt said Road File No. 5904 (C64-16-067-M-01) in Maricopa County Recorder Number 2016-0169683, and WHEREAS, the construction of the Department of Transportation project TT0612 (University Drive - Higley Road to Power Road) now requires the portion of roadway that was excepted in Road File No. 5904, and WHEREAS, the Department of Transportation has determined that it is in the best interest of the County to alter the roadway as adopted on the 9th day of March, 2016, in Road File No. 5904 (C64-16-067-M-01); and WHEREAS, that, pursuant to A.R.S. §28-6701, the Board may establish, alter or abandon a highway in the county; said Resolution is being revised to alter the legal description and map approved on the 9th day of March, 2016; Legal Description identified as Exhibit “A” and Map are attached. and WHEREAS, the Board believes that altering Road File No. 5904 (C64-16-067-M-01) is in the County’s best interests; NOW, THEREFORE, BE IT RESOLVED that the public streets and roads more fully set forth hereinabove are hereby declared altered and identified as Road File No. 5904-R, and BE IT FURTHER RESOLVED that the County Engineer is hereby directed to make a plat of the survey of said highway and cause the same to be recorded in the Office of the County Recorder of Maricopa County as provided by law. 1 RESOLUTION ROAD FILE NO. 5904-R C64-16-067-M-02 Page 2 PASSED AND ADOPTED by the Board of Supervisors, Maricopa County, Arizona, this ______ day of ________________________, _______________.
