Jefferson, 10th Floor Phoenix, AZ 85003, with the following members present: Jack Sellers, Chairman, District 1; Bill Gates, Vice Chairman, District 3; Steve Chucri, Supervisor, District 2 (remote); Clint Hickman, Supervisor, District 4 (remote); Steve Gallardo, Supervisor, District 5. Also present: Juanita Garza, Clerk; Kelly Gardiner, Minutes Coordinator; Joy Rich, County Manager (remote); Andrea Cummings, Legal Counsel (remote). 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Executive Agenda dated Tuesday, February 02, 2021, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Pursuant to A.R.S. § 38-431.02(D), notice is hereby given that an emergency session of the Maricopa County Board of Supervisors was held February 2, 2021 at 11:00 am, at 301 W. Jefferson – 10th floor, Phoenix, AZ, 85003. The meeting was held with the following members attending: Jack Sellers, Chairman, District 1; Bill Gates, Vice-Chairman, District 3; Steve Chucri, Supervisor, District 2, (remote); Clint Hickman, Supervisor, District 4 (remote); Steve Gallardo, Supervisor, District 5. Also, present were: Juanita Garza, Clerk of the Board; Joy Rich, County Manager (remote); Andrea Cummings, Legal/Counsel (remote); Kelly Gardiner, Minutes Coordinator. Andrea Cummings stated that the Emergency was due to a new demand by the Arizona State Senate regarding the Board’s audit of elections equipment and software. The Senate required a response by 12:00 pm on Tuesday, February 2, 2021. Bill Gates, Vice Chairman made a motion for the Board to convene in Executive Session. The motion was seconded by Supervisor Gallardo. Motion carried unanimously: Ayes: Sellers, Chucri, Gates, Hickman, and Gallardo. At the emergency Executive and possible Open session, the Maricopa County Board of Supervisors considered information and/or legal advice regarding Board responsibilities and authority re: Elections, election equipment, audits, and Senate subpoenas. BOARD RESPONSIBILITIES AND AUTHORITY RE: ELECTIONS, ELECTION EQUIPMENT, AUDITS, AND SENATE SUBPOENAS; LEGAL ADVICE AND LITIGATION Take possible action as directed in February 2, 2021, Executive Session re: Election equipment audit and Senate Subpoenas.
