Jefferson, 10th Floor, Phoenix, AZ 85003, with the following members present: Jack Sellers, Chairman, District 1; Bill Gates, Vice Chairman, District 3 (remote); Steve Chucri, Supervisor, District 2 (remote); Clint Hickman, Supervisor, District 4 (remote); Steve Gallardo, Supervisor, District 5 (remote). Also present: Juanita Garza, Clerk; Joy Rich, County Manager(remote); Andrea Cummings, Legal Counsel (remote); Maria Ceaglske, Minutes Coordinator. 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Executive Agenda dated Thursday, February 04, 2021, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Pursuant to A.R.S. § 38-431.02(D), notice is hereby given that an emergency session of the Maricopa County Board of Supervisors was held February 4, 2021 at approximately 3:30 pm at 301 W. Jefferson - 101h floor, Phoenix, AZ, 85003. The meeting was held with members attending either telephonically or in person. The meeting was held with the following members attending: Jack Sellers, Chairman, District 1; Bill Gates, Vice-Chairman, District 3 (remote); Steve Chucri, Supervisor, District 2, (remote); Clint Hickman, Supervisor, District 4 (remote); Steve Gallardo, Supervisor, District 5 (remote). Also, present were: Juanita Garza, Clerk of the Board; Joy Rich, County Manager (remote); Andrea Cummings, Legal/Counsel (remote); Maria Ceaglske, Minutes Coordinator. Andrea Cummings stated that the Emergency was due to the need to get Legal advice regarding recent and ongoing events in the state legislature related to Elections and potential related legal ramifications. Bill Gates, Vice Chairman made a motion for the Board to convene in Executive Session. The motion was seconded by Supervisor Gallardo. Motion carried unanimously: Ayes: Sellers, Chucri, Gates, Hickman, and Gallardo. Special Meeting Minutes Thursday, February 04, 2021 Page 2 of 2 OPEN SESSION 2. POSSIBLE ACTION RE: BOARD RESPONSIBILITIES AND AUTHORITY RE: ELECTIONS, ELECTIONS EQUIPMENT, AUDITS, AND SENATE SUBPOENAS Take possible action as directed in the February 4, 2021, Emergency Executive Session re: Board Responsibilities and Authority re: Elections, Elections Equipment, Audits, and Senate Subpoenas (C-06-21-475-X-00) After a briefing from the attorneys re: Board responsibilities and authority re: Elections, election equipment, audits, Senate subpoenas, and litigation, the Board reconvened in Open Session. Motion was made by Supervisor Gates and seconded by Supervisor Gallardo to authorize the County Attorney's office to take action as directed by the Board of Supervisors in executive session including seeking to protect the integrity of the electoral process and the privacy of the ballots and the voters of Maricopa County in the courts. The motion carried unanimously: Ayes: Sellers, Chucri, Gates, Hickman and Gallardo.
