Also present: Fran McCarroll, Clerk; Joy Rich, County Manager (telephonically); Andrea Cummings, Legal Counsel (telephonically); Maria Ceaglske, Minutes Coordinator. 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Executive Agenda dated Wednesday, December 16, 2020, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Motion to approve by Supervisor Jack Sellers, seconded by Supervisor Steve Gallardo Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Bill Gates, Steve Gallardo MEETING RECESSED Chairman Hickman recessed the Board of Supervisors to convene in Executive Session. MEETING RECONVENED After discussion on the executive items, Chairman Hickman reconvened the Board of Supervisors in Open Session. OPEN SESSION 2. INTERIM MARICOPA COUNTY CLERK OF THE BOARD APPOINTMENT Pursuant to A.R.S. § 11-422, approve the appointment of an Interim Maricopa County Clerk of the Board effective December 28, 2020 until the appointment of a new Clerk of the Board. Also approve the salary for the appointee during this interim assignment as discussed in Executive Session. (C-31-20-039-X-00) Special Meeting Minutes Wednesday, December 16, 2020 Page 2 of 3 Motion was made by Supervisor Jack Sellers to appoint Juanita Garza as Interim Clerk of the Board of Supervisors with an effective date of December 28, 2020, until the appointment of a new Clerk of the Board, and set Ms. Garza’s salary at $57.70 per hour, seconded by Supervisor Steve Chucri Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Bill Gates, Steve Gallardo 3. EXTEND EXCEPTION TO THE TELEWORKING POLICY (HR2409) TO ADDRESS THE COVID-19 VIRUS Extend the exception to the Teleworking Policy (HR2409) that was approved by the Board on March 25, 2020 until further notice. This exception allows employees who are authorized to telework by their Appointing Authority to watch their dependent children at the same time. This exception applies to all employees of Maricopa County appointed departments as well as the Flood Control District of Maricopa County and the Maricopa County Library District (Special Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the Special Districts under the Intergovernmental Agreement, C- 06-18-393-6-00, approved on April 11, 2018. This exception also applies to employees of County elected offices unless the elected official has implemented a similar policy specific to his or her office. (C-31-20-040-X-00) Motion to approve by Supervisor Jack Sellers, seconded by Supervisor Bill Gates Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Bill Gates, Steve Gallardo 4. MULTHAUF V. MARICOPA COUNTY, CV 2017-002731, CJ 2016-0049 Take action as directed in December 16, 2020 Executive session regarding Multhauf v. Maricopa County, CV 2017-002731, CJ 2016-0049. (C-06-20-352-X-00) Motion was made by Supervisor Jack Sellers to approve a settlement agreement in the case of Multhauf v. Maricopa County in the amount of $500,000 according to the terms and conditions set out in the settlement agreement, seconded by Supervisor Bill Gates Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Bill Gates, Steve Gallardo 5. POSSIBLE ACTION RE: DISCUSSION RELATED TO ELECTION LITIGATION AND OTHER RELATED ELECTION MATTERS Take action as directed in the December 16, 2020, Executive Session regarding Election Litigation and other related Election matters. (C-06-21-351-X-00) No action was taken on the item.
