THIS IS A COMPETITION IMPRACTICABLE PROCUREMENT BECAUSE (attach additional page if needed):
Design work for the removal of the intake structure and replacement with a slide gate intake on the
slope of the dam was initiated under another District contract with Black & Veatch. That contract
could not be modified to add time or funds. This is due to the fact that the contract was procured
using the register selection process. This new contract will provide the needed time and funds to
achieve ADWR approval to proceed with construction and post design services during the
construction time frame, utilizing the present EOR for this work,
SEARCH
A search was conducted consisting of: (check all that apply) RESULTS
["] Market research [7] Public notice given, list [_] no alternatives were identified
O Other vendors contacted C Other <7 nO alternatives were deemed acceptable
because {explain below):
Describe the search from above in detail:
The design Is proceeding to the 90% level and to maintain design continuity and to keep the design
team as the engineer of record for the project it is necessary to retain Black and Veatch to complete
the project. It is required that the design engineer (Black and Veatch) perform post design services
during construction as the Engineer of Record. This Competition Impracticable Procurement will
allow that to occur.
After thorough consideration the Flood Control District has reasonably determined it is impracticable,
unnecessary, and contrary to the public interest to hire another firm and/or have another engineer of
record, other than Black and Veatch, for the remaining portions.

Other, explain:
Describe methodology and results (attach any written supporting data, e.g., survey or market analysis);
Past experience in working with ADWR (Arizona Department of Water Resources) as the regulatory
agency for all of the Flood Control's Dam Projects has shown that considerable time and money is
needed to get through all the questions and comments the agency asks of us and our design teams.
As such the Flood Control is requesting 4 years and $400,000 to complete the design and produce a
completion report based upon the construction and the production of construction as-builts.
