5. RESOLUTION DECLARING MARICOPA COUNTY A SECOND AMENDMENT
PRESERVATION COUNTY
Approve and Adopt a Resolution of the Maricopa County Board of Supervisors supporting
the Second Amendment to the United States Constitution and Article II Section 26 of the
Constitution of the State of Arizona, and declaring Maricopa County a “Second Amendment
Preservation County”. (C-06-20-408-7-00)
Chairman Hickman Introduced the next agenda item Regarding a resolution about a
Second Amendment preservation County. The Chairman explained the resolutions are
not bound by law but are often brought forward to the Board of Supervisors regarding
concerns that community members have brought to their attention. The Chairman
explained that the Board of Supervisors often deals with issues related to the
unincorporated areas of the County. He commented that he had received a number of

inquiries from constituents in his district regarding this particular issue. The Chairman
also commented that he had been the president of the County Supervisors Association,
and that it was widely known that he comes from a rural area of Maricopa County. He
also explained that his district shares a border with Yavapai and with La Paz counties.
All of these factors show that his district has a unique character as it deals with both
urban and rural areas.
The Chairman than asked the Clerk, Fran McCarroll, to read the resolution. (Full text of
the resolution can be found below.)
After the Clerk read the resolution, the Chairman further explained the role of the
Chairman of the Board to place items on the agenda. He also explained that items on
the agenda are sent to the County Attorney’s Office for review. As such, he invited Tom
Liddy, Director of the County Attorney’s Civil Division to come forward to answer any
questions Board members may have. Chairman Hickman stated that this time would be
for Board members to comment and/or ask questions. Any public comments on this
item would be taken at the end of the meeting under the heading of Public Comment.
The Chairman then asked if there were any questions from the Supervisors.
Supervisor Gallardo asked Mr. Liddy if there were currently measures in place that if
any type of a governing body violated Second Amendments rights, the matter could be
taken to court. Mr. Liddy replied that the statement was correct. Supervisor Gallardo
then questioned why there would be a need for this action. He further commented that
he felt if there was a need for such action that it would be best handled at the state
legislature.
Supervisor Gallardo then asked a question related to the Heller case which dealt with
the ability of governing bodies to prohibit bringing firearms into public buildings. Before
the response, Supervisor Gates commented that this type of question should be
discussed in an executive session meeting. Supervisor Gallardo responded that he
agreed with this statement and commented that the item should be tabled until the
Supervisors could meet in executive session regarding the issue and discuss possible
related constitutional issues.
Attorney Liddy commented that the County Attorney’s Office does not deal in
hypotheticals, but also commented that the case, District of Columbia v. Heller, deals
with more than the limited mention of it in this Resolution. An important point was the
Supreme Court recognizing the right to keep and bear arms belongs to an individual as
opposed to a state. Many have argued that the right to bear arms was regarding a state
that had a militia. However, the Supreme Court stated that it was an individual right as
are all of the rights in the Bill of Rights. The Heller case has several ramifications, but it
is clear that state and federal governments can place some limitations on rights to bear
arms as in the case of the rights of a felon.
Supervisor Gallardo further stated that the Heller case dealt with the right of an
individual to bear arms in their own home. The Supreme Court broadened their
response in this case to other issues related to bearing arms. Mr. Liddy responded that
it was a broad case and he would be happy to meet with the Board regarding these
issues to provide a more thorough review.
Supervisor Gallardo indicated that some of his concerns dealt with the language in
some of the “…be it further resolved,” statements. He felt that some of those statements
raised some questions for him, and possibly for other County-wide electeds. Mr. Liddy
further commented that the County Attorney’s Office did not draft the Resolution, and
noted that three times the Resolution refers to Supreme Court decisions related to his

issue. He said that this indicates the Resolution recognizes the importance of Judicial
review which come from the Marbury v Madison case from 1803. The principle in this
case is a question of whether a particular statute runs afoul of the Constitution belongs
to the judiciary. He further stated that there was nothing in this document, if the body
were to approve it, “that would be substituting its own analytical ability in front of the
Courts.”
Chairman Hickman thanked Mr. Liddy for his comments and then recognized Supervisor
Chucri.
Supervisor Chucri stated that he wanted to make a motion to approve this item, but with
an amendment. He commented that the Board often approves a Proclamation or
Resolution memorializing certain issues. Equally, he recognized that at times there are
disagreements on particular issues among Board members, however, in many ways
Maricopa County is one big family. He noted that he had also heard from a number of
his constituents regarding this particular issue. He commented that this issue reminded
him of his oath of office taken for each term which oath confirms the defense of the
Constitution of the United States and the Constitution and laws of the State of Arizona.
Supervisor Churci further stated that he has heard from a number of constituents and
even from members of law enforcement regarding this issue. He continued by stating a
concern he and others may have about a possible unintended consequence which is
found in the final, “be it further resolved.” This section deals with the Board not
appropriating government funds, resources, etc. He indicated that he was making a
motion to adopt the Resolution with the amendment to strike that section. He stated
that this resolution is a step to memorialize the Oath of Office he took for each of his
terms on the Board of Supervisors.
Chairman Hickman seconded the motion.
Supervisor Gallardo commented that he agreed there has been a wonderful working
relationship among the Board members, often similar to one big family. He stated that
the Board has always tried to consider what is best for the County, whether it is an
appointment or other resolutions. However, he felt that this issue was more than just a
disagreement. He stated there are two types of resolutions; one that brings the body
and the community together. It states, “this is where Maricopa County stands on this
issue.” He stated that those are the types of resolutions that he supports, but felt this
one could not be compared to resolutions regarding the Boy’s Club or Domestic
Violence. He felt that this resolution goes to core values of many people. He felt the
Board should slow down and take more time to consider this resolution and meet with
the County Attorney as well as other County Officials. He further commented that he is
proud to put aside partisanship to stand with County Attorney Bill Montgomery regarding
issues related to children and to stand with Governor Ducey regarding domestic
violence.
Supervisor Gallardo stated that he did not feel that resolutions should be partisan,
mean-spirited or divisive. He reminded the Board that in 1997 a former Board member
was shot as she exited the chambers. She was shot by a person who did not go
through a background check or a mental health evaluation. He stated that he felt the
discussion should include a dialog about the root cause of gun violence. But he also
stated that he felt individuals have the right to bear arms, and that he supports the
second amendment. He felt there should be a “common sense approach” to the issue to
make sure that “bad guys” are not in possession of guns. Finally, he commented that if
anything, this issue should be dealt with at the legislature as he did not feel this is a
County issue. There is an avenue through the courts to deal with these issues.

Chairman Hickman thanked Supervisor Gallardo for his comments. He also stated that
this is a resolution that basically reaffirms the Board’s support of the Constitution in its
entirety. He reiterated that his district includes many rural areas and that a number of
constituents had called or commented that they want to be sure that their rights are not
infringed upon. They want to be secure in their right to bear arms to protect their
property and their families.
Supervisor Chucri stated that he supported the idea of resolutions and did not mean to
compare this one with things like domestic violence. He agreed that the Board is a
group who works well together and have at times been recognized for that cooperative
approach to issues. Recognizing those points, he reiterated that this issue is important
to many people and that he had heard from citizens in his district.
Supervisor Sellers commented that he was one who might have desired to have a more
thorough discussion with legal staff regarding this issue. However, he stated that he
now feels more comfortable moving forward with the amendment made by Supervisor
Chucri, and that he is now ready for the vote on this issue.
Chairman Hickman called for the vote on the Resolution as amended by Supervisor
Chucri. (Motion to approve as amended by Supervisor Chucri. Second by Chairman
Hickman.)
Ayes: Hickman, Gates, Chucri, Sellers

PLANNING AND ZONING AGENDA
AGENDA DE PLANIFICACIÓN Y ZONIFICACIÓN
***The Board of Supervisors will now consider matters related to Planning and Zoning***
CONSENT AGENDA - AGENDA DE CONSIENTA
Chairman Hickman stated that the Board would consider Planning items PZ-1-4 and PZ-6-9, and
that they would take item PZ-5 separately.
PZ-1. JY ENERGY SOLAR PROJECT
Case #: CPA2019003
Supervisor District: 5
Applicant / Owner: Mike Jang, JY Energy LLC / Juyun Lee
Request: General Comprehensive Plan Amendment to change the land use designation
from Rural Densities (0-1 d.u./ac.) to Utilities. CPA case approval is by Resolution,
attached.
Site Location: Generally located at the southwest corner of the 571st Avenue and Northern
Avenue alignments in the Harquahala Valley area
Commission Recommendation: On 1/30/20, the Commission voted 7-0 to recommend
approval of CPA2019003 subject to conditions ‘a’ – ‘b’:
a. Development and use of the site shall comply with the narrative report entitled “Project
Narrative Report for JY Energy Tonopah Solar Plan General Comprehensive Plan
Amendment (Revised)” consisting of 8 pages, including all exhibits, dated November 5,
2019 and stamped received November 8, 2019 except as modified by the following
conditions.
b. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the uses existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the land use designation that existed on the date of application.
It is, therefore, stipulated and agreed that either revocation due to the failure to comply with
any conditions, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such change of the land
use. The land use enhances the value of the property above its value as of the date the
land use change is granted and reverting to the prior land use designation results in the
same value of the property as if the land use change had never been granted. (C-44-20-

e. The IUPD overlay is applied to restrict the use of the site. Until such time as the site is
served by sewer, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems. A public water system and public sewer system shall be required prior to
establishment of any non-residential use that requires potable water.
f. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and
ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each
subsequent phase, within which time the initial building permit or construction permit must
be obtained. The applicant shall submit a written report every five years from the date of
Board of Supervisors approval of Z2019008 which details the status of this project,
including progress on obtaining building and/or construction permits. The status report to
be administratively reviewed by Planning and Development with the ability to

i. The granting of this change in use of the property has been at the request of the

the property shall revert to the zoning that existed on the date of application. It is, therefore,
stipulated and agreed that either revocation due to the failure to comply with any
conditions, does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation of the Zone
Change. The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted. (C-44-20-075-M-00)

Commission Recommendation: On 1/30/20, the Commission voted 7-0 to recommend
approval of Z2019031 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Site Plan for Petra Contracting”, consisting of 3 full-size sheets, dated April 2019, and
stamped received August 9, 2019 except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Petra Contracting”, consisting of 6 pages, dated April 2019 and stamped received
August 9, 2019, except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
1. As noted in the Pre-Application summary, there are several open (unresolved)
Floodplain Use Permits on this site. The recommended solution is that a single site-wide
floodplain use permit be initiated for this site to encompass all prior work performed on the
site, including unpermitted work, and that the open permits be subsequently closed.
2. As part of the overall Floodplain Use Permit, elevation certificates (ECs) will be required
for any buildings that do not already have them, including buildings 4 (enclosed metal shop
building) and 5 (enclosed metal storage building) as shown on the Site Plan. If the building
6 (covered open air storage) has more than 1 wall, it will also need an EC, if it is supported
by posts and a maximum of 1 wall, then it will not. There is already an EC for 8 (modular
office building).
3. All development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
4. Engineering review of planning and/or zoning cases is for conceptual design only and
does not represent final design approval nor shall it entitle applicants to future designs that
are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and
Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the
MCDOT Roadway Design Manual.
5. Detailed Grading and Drainage Plans showing the new site improvements must be
submitted for approval and acquisition of building permits.
d. This Special Use Permit shall expire on February 26, 2030.
e. Prior to occupying the existing residence or any portion thereof for any use associated
with the Special Use Permit, the applicant shall obtain Building Permits to retrofit the
existing buildings to meet current commercial building code requirements as applicable and
shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,

and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted. (C-44-20-076-M-00)

d. Unless annexed the applicant/property owner shall submit a ‘will serve’ letter for fire
protection services for the project site. A copy of the ‘will serve’ letter shall be required as
part of the initial construction permit submittal.
e. Prior to approval of the initial final plat, precise plan of development approval, or zoning
clearance for any construction permits, the applicant shall provide the Maricopa County
Planning and Development Department with an executed pre-annexation service
agreement with the City of Phoenix that identifies the detail for when the proposed project
will be annexed and the provision of water and sewer service. In lieu of a pre-annexation
service agreement the developer must provide a ‘will serve’ letter from the certificated
water and sewer provider.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
g. The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the zoning that existed on the date of application.
(C-44-20-077-M-00)

Those in favor:
 Nga Thi Thuy Nguyen
 Joel Jungkas
Those registered opposed:
 Teresa L. Neiberg
 Jessica Catlett
Chairman Hickman then called on those who had registered to speak on the same
agenda item:
Gary Larson: Mr. Larson spoke in favor of the resolution. He commented that he felt it
was important to keep the freedom citizens have in America and not do anything that
would infringe on those right. Also important to “maintain the freedoms we have.”
People who might be unstable should be dealt with. That issue should be dealt with,
that but not make it apply to all others.
Daniel McCarthy: Mr. McCarthy spoke in favor of the resolution. stated that he is
currently running for a seat in the U.S. Senate. He said that constituents are probably
calling regarding this matter because they are concerned about possible “overstepping”
by state and federal government bodies. He commented that he felt the resolution had
been “watered down,” and aske the Board to consider reviewing other ordinances
similar to what Yavapai and Mohave counties are doing. He stated that he felt this was
a God-given right and that no government body had the right to limit “bearing arms.” He
asked the Board to consider taking a second look and possibly doing a stronger
resolution.
Geraldine Hills, founder and president of the organization: Arizonans for Gun Safety,
and a member of other gun safety organizations: Ms. Hills spoke in opposition to the
resolution. She commented that she felt there were unintended consequences in the
resolution. She stated the “illegal nullification movement” is being pushed by the
“extremist gun lobby.” She felt that this action could hinder events that would consider
coming to Maricopa County. She felt that the Board should be concentrating more on
the upcoming elections and making sure that all have the right to vote in those elections.
Laura Hudson: Ms. Hudson registered in opposition to the resolution. Ms. Hudson
stated that she is a volunteer for “Moms Demand Action for Gun Sense in America,”
also stating that she is a “gun violence survivor.” She stated that “Moms Demand
Action” supports the Second Amendment. She felt that the resolution as passed leaves
a decision about “what is Constitutional up to a personal opinion, undermines the rule of
law, and sets a dangerous precedent.” She felt this statements in this resolution makes
the citizen “less safe.” She stated that law enforcement officers need to enforcement
gun safety laws that have been shown to be constitutional. She also stated that she felt
this resolution puts constituents’ “lives at risk.”
Garrich McFadden: Mr. McFadden registered in opposition to the resolution. Mr.
McFadden began by stating that he appreciated the amendment to the resolution. He
asked if members had reached out to members of the Black community, noting that
there are 30 handgun deaths each day in America, and 15 of those are Black people.
He stated that he too, as an attorney, takes an oath to defend the Constitution, but felt it

Formal Meeting Minutes

is important to note that he felt Black persons were more often adversely affected by
gun violence. It is important to make sure that everyone is protected. He felt it is
important to reach out to members of various communities in addition to those persons
who contacted the Supervisors.
Randy Miller: Mr. Miller registered in favor of the resolution. Mr. Miller stated that he is
the Director for the Constitutional Sheriffs and Peace Officers Association. Mr. Miller
stated that he was surprised to hear speakers using the words, “illegal nullification.” He
stated that in the Arizona Constitution there was a process for nullification if a law or
process is illegal. He did not feel that there was anything illegal about the resolution.
He commented that all elected officials take the oath of office. He stated that a
Supreme Court ruling in an issued opinion, not law; legislators make law. Mr. Miller cited
sections of the United States and Arizona Constitutions stating that political power is
inherent in the people, and that the power “comes from the consent of the governed.”
He also commented that statements about the militia are found elsewhere, not in the
second amendment.
Jerry Sheridan: Mr. Sheridan registered in favor of the resolution. He stated that he is a
Republican candidate for Sheriff in Maricopa County. He felt he had a unique
perspective on this issue as he had spent approximately 18 years of his 38-year career
in the Maricopa County Sheriff’s Office as a patrol officer. Mr. Sheridan commented that
the second amendment is a guarantee to all citizens given by the founding fathers of
their right to carry a firearm. His experience was that all citizens in either rural or urban
areas of the county had this right and it was not to be infringed upon.
Marie Thearle: Ms. Thearle registered in opposition to the resolution. Ms. Thearle also
registered as a member of “Moms Demand Action.” She stated that she has no issue
with the second amendment or the right to own firearms. She commented that she was
thankful the Board removed the last section in the resolution. Ms. Thearle commented
that ASU research stated that 80% of Arizonans support common sense gun laws,
especially background checks. She also stated that firearm-related deaths are the
second most common cause of death of children in Arizona. Ms. Thearle urged the
Board in the future to take the time to fully discuss complicated issues such as this one.
For example, she felt it would be important for the Board to pass a resolution regarding
the safe storage of firearms.
Bob McWhirter: Mr. McWhirter registered in opposition to the resolution. Mr. McWhirter
first wanted to clarify the exact motion of the Board on this matter. Attorney Andrea
Cummings clarified that the motion and second was to approve the resolution with the
final “be it further resolved” paragraph stricken from the resolution. Mr. McWhirter then
stated that he was a candidate for Maricopa County Attorney, and that part of that job is
to make people safe from crime. However, he felt that this resolution did not do that.
He also stated that he was a Constitutional historian and author. He has written
extensively about the Bill of Rights and especially about the Second Amendment. He
agreed with Supervisor Gallardo regarding his comments about the Heller decision.
Mr. McWhirter stated that he agreed that citizens have the right to bear arms, but as in
all rights, they are subject to limitation and he provided an example. However, he felt
that this resolution does not make people safer. As an example, he talked about an
officer of the law having to go into a situation where everyone was armed. He stated
that there are individual rights, but they must be balanced by other people’s rights. He
felt that this resolution was only “eye candy for an extremist position.”
Edith Smith: Ms. Smith registered in opposition to the resolution. Ms. Smith stated that
she supports the 2nd amendment, however, this none of the amendments are unlimited.

She felt that the Board’s approval of the resolution was a response to an
unsubstantiated fear that guns would be removed. She also stated that she felt the
Board’s responsibility was to calm people’s fears. She also expressed her
disappointment that the Board did not consult with lawyers first or allow people to
express their thoughts or concerns prior to the Board’s vote.
Nancy Doyle: Ms. Doyle registered to speak in the public comment section of the
meeting. Ms. Doyle wished to speak regarding issues related to Animal Care and
Control. She stated that she had been a volunteer there for 4½ years. Ms. Doyle
referenced the issue of air conditioners for the animal shelter. She stated that at the
time, ½ of the new coolers had been installed, but, although the remainder of the
coolers had been purchased and paid for, there would need to be a delay in installing
them so that the whole system would not have to be taken down during installation.
Later she received a report that there was an engineering issue causing the delay in the
installation. She asked the Board to press for a resolve to this issue and get the units
installed before the summer heat.

with the County working within District 5. He noted his appreciation to Ms. Arzaga-
Williams and thanked her for her continued years of hard work. He also commented

was so thankful for all of her work on a number of issues.

anniversary with the County and noted that he owed some pins to his staff also. He
thanked Supervisor Sellers on his work with MAG and all his work on a number of
transportation issues. Supervisor Chucri also commented on the new ITR (Intake-
Transfer-Release). A tour of the building showed the thought and planning that went
into the placement of the court areas, general holding areas and the secure holding
areas, and it can truly be labeled “state of the art.” He thanked Sheriff Penzone, Reid
Spaulding and Joy Rich for their planning and subsequent work on the plans and the
buildings.

prioritized to fit the available funds. He also complimented Ms. Arzaga-Williams on her
