Formal Meeting Minutes

Request: Zone change from Rural-43 to C-2 CUPD
Site Location: Located at the southwest corner of Riggs Rd. and Hawes Rd. in the Queen
Creek area
Commission Recommendation: On 3/12/20, the Commission voted 7-0 to recommend
approval of Z2018083 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in conformance with the Narrative Report entitled
“Purpose of Request”, consisting of 2 pages stamped received December 13, 2019 except
as modified by the following conditions.
b. The applicant/property owner shall submit a ‘will serve’ letter from Queen Creek County
Island Fire District for fire protection services for the project site. A copy of the ‘will serve’
letter shall be required as part of the initial construction permit submittal.
c. A CUPD overlay is applied to limit the land uses to auto and tire service and repair.
d. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to drainage design, access and roadway
alignments. These items will be addressed as development plans progress and are
submitted to the County for further review and/or entitlement.
2. A traffic impact study must be submitted with any future site plan application.
3. All development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
e. The C-2 CUPD zoning approval is conditional per Maricopa County Zoning Ordinance
Article 304.6. Within five (5) years of Board of Supervisors’ approval there shall be
administrative approval of a Plan of Development for the commercial site or the zoning may
be considered for reversion to Rural-43 at public hearing of the Board of Supervisors after
recommendation by the Planning and Zoning Commission, unless within such time the
property is annexed by the Town of Queen Creek.
f. Noncompliance with any Maricopa County Regulation or condition of approval shall be
grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance. The property owner and their successors waive claim for diminution in
value if the County takes action to rescind approval due to noncompliance with conditions.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the zoning existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition, a hearing shall be scheduled with the Board of Supervisors for consideration to
revert the zoning that existed on the date of application. It is, therefore, stipulated and
agreed that either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or possess the
property and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation of the Zone Change. The Zone

Change enhances the value of the property above its value as of the date the Zone
Change is granted and reverting to the prior zoning results in the same value of the
property as if the Zone Change had never been granted. This item was continued from the
April 8, 2020 meeting. (C-44-20-097-M-00)
Jen Pokorski, Director, Planning and Development Department, introduced this item
indicating that it is a request to rezone a property from R-43 to C1-RUPD overlay. She
said that this was an appropriate request as the property is at the junction of two arterial
streets. The Planning Commission unanimously recommended approval of the request.
The C2-RUPD overlay limits the use to an auto repair shop. Although the site plan
shows a restaurant, that restaurant has since been removed from the plan, and it will be
limited to the auto repair shop.
Ms. Pokorski commented that the only known opposition is from the town of Queen
Creek stating concerns about how the site would be accessed, screening, landscaping,
how materials would be stored on-site and some parking concerns. She indicated that
the department had worked with the applicant to address these concerns and added
several stipulations to the case. The new stipulations address site access, the
screening of the site including an 8-foot wall along certain sections of the property which
are adjacent to homes. The changes also include a 10-foot wide landscaping buffer
along Riggs and Hawes Roads. The department received an additional letter from
Queen Creek yesterday asking for a 30-foot buffer along the major roads. Staff is of the
opinion that this change would render the property undevelopable. She also stated that
staff felt the 10-foot buffer adequately addressed the original concerns. Therefore, Ms.
Pokorski stated that staff is still recommending approval consistent with the Planning
Commission’s recommendation of approval.
Supervisor Sellers thanked the town and the developer for working together on those
issues. He also thanked Ms. Pokorski for specifically addressing the latest letter from
the town as they wanted to be sure that letter was noticed in the meeting.
Motion to concur with the Planning Commission’s recommendation for approval by
Supervisor Sellers, second by Supervisor Chucri.
Ayes: Sellers, Chucri, Gates, Hickman, Gallardo.
Clerk’s note: To clarify that approval of this item should include the four additional
stipulations (“h” through “k”) as outlined by Ms. Pokorski, please see item number 39 of
the minutes of the Board of Supervisors’ May 6, 2020 meeting.

Chairman Hickman reflected on Mr. Haas resignation. He stated that Mr. Haas has
given 30 years to the County. He started as a trial attorney and quickly moved through
the ranks to be appointed as the Public Defender in 2001. He has continually provided
support, inspiration and motivation to the Office. During his tenure he has trained
thousand of defense attorneys, created specialty units to better meet the needs of the
clients, and provided numerous community service programs. He is respected by his
staff while staying true to his commitment to “do more with less.” Mr. Haas will be
greatly missed. Thank you, Jim Haas for you service to so many in the County.
The Chairman introduced Chris Phillis, the Director of Public Defense Services. He
noted that she oversees this large office of 488 employees, with this Office providing
Indigent Defense. She is here to thank Mr. Haas for his years of service.
The Chairman then introduced Mr. Gary Kula, the new Public Defender. Mr. Kula is
also a leader well known in the Arizona defense community. He stated that Mr. Kula
has earned his reputation based on his legal knowledge, innovative approach to
mentorship and community outreach. He has been leading the City of Phoenix’s Public
Defense Office for 20 years. He co-founded the Arizona Public Defenders Association,
a non-profit association dedicated to providing low-cost training to criminal, juvenile and
mental health attorneys. Mr. Kula is also responsible for the legal community’s
involvement in the “Veteran’s Standdown.” He brought together the Courts, Prosecutors
and Defense Attorneys at the annual Standdown to assist Veterans resolve outstanding
legal matters that inhibit their ability to obtain driver’s licenses, housing or employment.
Mr. Haas addressed the Board, thanking them for all of the opportunities he has been
given. He has been able to spend his career doing very important work for so many
people. The work has been challenging but rewarding. He also expressed his
appreciation to the attorneys and staff in the Public Defenders Office and the related
Indigent Defense Offices for their dedication to what is often a thankless job. They
provide compassion to the underprivileged, are able to give a voice to the voiceless and
make sure that a person in the justice system does not have to depend on how much
money they have. He stated that he has never worked with a more dedicated group of
people and he is very proud of all of them.
The Chairman noted that the Public Defender’s Office is not often highlighted, but it is a
very key part of the justice system. He again thanked Mr. Haas for his dedicated
service.
Supervisor Chucri concurred that Mr. Haas job is often thankless. He stated that the
amount of time and years of service that you have dedicated to the County is amazing
and the Board is certainly thankful for your years of service.
To Mr. Kula, Supervisor Chucri commented he comes highly recommended. He said
that the County Manager always has the right mindset in hiring decisions and she brings
talented people to the County. He stated that he wished Mr. Kula much success in this
new job.
Supervisor Sellers offered this thanks to Mr. Haas and concurred with the previous
statements of appreciation. He commented that he had met Mr. Kula and stated that
they have a mutual friend, David Fuller, who is the Magistrate in Chandler who concurs
that Mr. Kula is the right choice for this position.

56. AGREEMENT WITH GOLDWATER AIR NATIONAL GUARD BASE – 161ST AIR
REFUELING WING
Approve an agreement between Maricopa County, by and through the Department of
Public Health (MCDPH), and Goldwater Air National Guard Base – 161st Air Refueling
Wing (ARW). The agreement recognizes that in the event of a Public Health Emergency,
the 161 ARW will operate their own Point of Dispensing (POD) operation and MCDPH will
issue the 161 ARW the Strategic National Stockpile (SNS) items required to run the site. In
the context of the COVID-19 response, the 161 ARW POD site and this agreement will be
a critical piece of the vaccination program whenever that may be initiated. The 161 ARW
possesses their own internal Medical Group and Logistical support to set up mass
vaccination PODs on site to handle their own population. This capability significantly
supports MCDPHs ability to support “Open” POD operations by decreasing the number of
individuals MCDPH has to vaccinate. In addition, military personnel are typically given a
higher priority along with first responders and healthcare workers. The main complication to
any future POD operations is that the PPE that is typically part of the SNS, has now been
depleted nationally because of the recent distribution for COVID-19. With or without the
PPE, this agreement is still critical in dispensing vaccine (possible COVID-19 or Pan-Flu)
or prophylaxis (Anthrax). (C-86-20-051-3-00)

the concerns related to the virus, this day was being celebrated in different ways than
previous celebrations. She thanked all of the County Administrative Professional and
commented that they continue to be the backbone of the work in the County.
Supervisor Sellers: He mentioned that he had been with the Mayor Chandler to accept
1000 masks to be given to the Chandler police department from the Taiwanese

and other telephonic means.
Supervisor Gates: Mr. Gates also thanked Administrative Professionals such as the
ones who have worked creatively in order for the Board to continue county business
using means such as the webinar for this Board meeting. And there are other
innovative ways that a number of County departments have worked to provide services
in new ways to continue to meet business needs of the citizens.
Additionally, Supervisor Gates commented that this is Earth Day. He noted that over
the decades as the County population and businesses have grown, due to the diligent
work of departments such as the Air Quality Department, the air quality has continued to
improve.
Supervisor Chucri commented on all of the donations that were listed on the agenda
today. Even in these tougher times, so many people continue to be generous in making
donations for which the County is so grateful. He noted that although conference calls
and webinars are a bit more difficult, he thanked all those who have made it possible to
keep the Supervisors connected through these technology means.
Chairman Hickman thanked Ms. Rich and her team for all of the work they are doing to
make sure the Supervisors are kept up to date on all of the issues related to the
pandemic and how various needs either change or arise day to day. He thanked Fields

F-1. CHANGE ORDER TO ON-CALL CONTRACT FOR THE MCMICKEN DAM
REHABILITATION PROJECT
Approve Change Order No. 8 to On-Call Contract FCD 2011C030 for design services of
McMicken Dam Rehabilitation Project. Change Order No. 8 for On-Call Contract
FCD2011C030 adds funds in the amount of $6 million to the existing contract increasing the
value of the contract to $12 million. The additional funds are required to complete Phase 2
and Phase 3 Plans and Specs and related documents, Phase 3, 4, and 5 geotechnical
investigations and for post design service for Phase 1 and Phase 2.
Dam safety deficiencies have been identified at McMicken Dam and overall rehabilitation of
the dam is necessary to meet District goals and objectives related to dam safety and public
safety. Phase 1 design is nearing completion and construction will start in the fall of 2020.
Phase 2 design is at the 30% design level with construction of Phase 2 slated for spring
2022. Phase 3, 4 and 5 geotechnical investigations will start by the fall of 2020. This item

F-2. AMENDMENT TO AUTHORIZATION TO AWARD CONTRACT FOR MANDAN STREET
DRAINAGE IMPROVEMENTS
Authorize the Director of the Flood Control District of Maricopa County (DISTRICT), through
the Maricopa County Office of Procurement Services, to award contract FCD 2019C013 for
the Mandan Street Drainage Improvements (Project [#630]) to the lowest bidder, whose bid
amount is 45.6% above the engineer’s estimate, and who is responsible and responsive in
meeting the contract requirements. The original authorization for award of the contract
requires that the award be to the lowest responsible bidder if the bid is not more than ten
percent (10%) over the engineer’s estimate. The costs of various construction components
have increased recently and construction constraints (limited work hours, site access
challenges) are leading to increased costs.
This Construction Contract will result in a drainage channel that will provide flood protection
for seventeen homes along the west side of Mandan Street in the Ahwatukee Foothills area
of southeast Phoenix.
The project partners are the Flood Control District of Maricopa County and the City of
Phoenix, with 50%/50% cost sharing. The City of Phoenix will own the project right-of-way
and be responsible for the project maintenance. The District will provide the contract
administration and construction management.
This Agenda Item impacts Supervisor Districts 1 and 5. (C-69-19-028-5-01)
