Twelfth Amendment
WHEREAS, Maricopa County (“the County”) maintains The Maricopa County Benefits Plan
(Eleventh Amendment and Restatement) (the “Plan”), dated October 29, 2020; and
WHEREAS, the County desires to amend the Plan to extend the grace periods of its Dependent
Care Spending Account Plan, Health Care Spending Account Plan, and Limited Purpose Health
Care Spending Account Plan to twelve (12) months for the plan years beginning July 1, 2019 and
July 1, 2020, respectively, pursuant to the Consolidated Appropriations Act, 2021;
NOW, THEREFORE, by virtue and in exercise of the power reserved to the Maricopa County
Board of Supervisors, the Plan is hereby amended effective as of July 1, 2019, by removing the
last sentence of Section 6.2 of Appendices A, B, and C, and replacing each with the following
sentence:
Notwithstanding the foregoing, for purposes of the plan years beginning July 1, 2019 and
July 1, 2020, any claims for benefits that are incurred on or before June 30, 2021 and
June 30, 2022, respectively, may be submitted for payment no later than 45 days after
such dates; provided, however, that the Outbreak Period shall be disregarded for
determining the 45-day deadline, if the Outbreak Period otherwise impacts these 45 day
deadlines.
IN WITNESS WHEREOF, the County has caused this Amendment of The Maricopa County
Benefits Plan (Eleventh Amendment and Restatement) to be executed by its duly authorized
