Site Location: Generally located approx. 770’ south of Joy Ranch Rd. on the west side of
11th Ave.
Commission Recommendation: On 11/7/19, the Commission voted 7-0 to recommend
approval of Z2019044 subject to conditions ‘a’ – ‘f’:
a. Development of the site shall be in substantial conformance with the site plan entitled
“Special Use Permit for Copper Ridge Equine Large Animal Veterinary Clinic”, consisting of
2 full-size sheets, stamped received on October 4, 2019, except as modified by the
following conditions.
b. Development of the site shall be in substantial conformance with the narrative report
entitled “Copper Ridge Equine”, consisting of 4 pages, stamped received on October 3,
2019, except as modified by the following conditions.
c. This Special Use Permit shall expire 20 years from the date of approval by the Board of
Supervisors. All of the improvements and equipment associated with this Special Use
Permit shall be removed within 60 days of such expiration, or upon termination of the use
for a period of 90 days or more.
d. The following Maricopa County Engineering (Drainage, Flood Control, and MCDOT)
conditions shall apply:
1. The retention calculation must include the barn plus disturbed areas that are proposed
as part of this application. This includes the new driveway, the channel and the retention
basin. Use a C coefficient of 0.95 for the barn and the driveway and a coefficient of 0.50 for
the channel and the basin.
2. The retention system shall be designed to drain within 36 hours in accordance with the
Maricopa county Drainage Policies and Standards, Sections 6.10.10 through 6.10.13.
3. The site must be graded so that the barn plus the disturbed area drain into the proposed

driveway into the basin.
4. Any construction within the floodplain would require a floodplain use permit; the
floodplain use permit would be processed and issued by Planning and Development along
with the building permit.

8. Detailed Grading and Drainage Plans and Final Drainage Report showing the new site
improvements must be submitted for approval and acquisition of building/floodplain use
permits.
e. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
f. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted. This item was continued from the December 11, 2019 meeting. (C-44-
20-037-M-00)
Chairman Hickman called upon Jen Pokorski, Director of Planning and Zoning, and

Supervisor Gates thanked Mr. Kimball for his presence and for his work with the County.
He said he would like to keep the focus on land use and asked for clarification on Mr.
Kimball’s concerns on the response of Environmental Services regarding complaints.
Mr. Kimball responded with the following: the County had said there were complaints
concerning the property; the property use as a business and private household; equine
veterinarian procedures that are not being followed at the location per local
veterinarians; concerns on how the animal waste is handled now and in the future.
Supervisor Gates asked how the allegations on regulation concerns regarding the
property were handled.
Darcy Kober, Environmental Services Director, explained the department will respond to
complaints following the approval and permitting of a septic system. The Department
operates under the authority of Arizona Department of Environmental Quality. On
conventional waste site water systems Maricopa County Environmental Services
Department does not have the authority to respond to complaints after the approval of
the permit and the system is in operation. However, the department does have the
authority to respond to public health nuisances such as the failing of a system and
sewage seepage.
Supervisor Gates clarified if there were complaints regarding the septic system
Maricopa County Environmental Services Department can respond. Ms. Kober
responded that is correct.
Cindy Morton representing self and lives in Desert Hills, spoke in opposition of the item
noting the following: her background in hospitals and the facility being an emergency
center; Desert Hills as heavily equine area; traffic concerns; negative impact to
neighbors; and change in property value.
Chairman Hickman asked if those registered to speak have anything to add not
pertaining to what has already been said.
The following residents approached and stated the following:
Barbara Johnson, resident, spoke in favor of the item and stated the following: she has

been under the care of the veterinarian for the last 2-3 years; has never witnessed
individuals driving fast in the area; the property is great for the community.

safety of drivers especially those with trailers who must drive slower than normal;

S-1. AUTHORIZATION TO REMIT CAR RENTAL SURCHARGE REVENUES TO THE
ARIZONA SPORTS AND TOURISM AUTHORITY AND INCREASE IN BUDGET
AUTHORITY
Approve and direct the Maricopa County Stadium District (District) Executive Director to
remit to the Arizona Sports and Tourism Authority (Authority) Car Rental Surcharge
Revenues in accordance with Section 3.2(b) of the Intergovernmental Agreement dated
October 22, 2003 (“Agreement”). As of June 1, 2019, there are no District Bonds
outstanding and any remaining Car Rental Surcharge Revenues are due to the Authority
under the Agreement terms. Car Rental Surcharge Revenues for FY 2020 are estimated to
be approximately $6.2M.
Authorize an increase in the Stadium District (680) Cactus League Operations Fund (250)
operating revenue budget by $6.2M and an increase in expenditure authority in the Stadium
District (680) Cactus League Operations Fund (250) Operating Budget (0000) by $6.2M.
This action will adjust the District budget to reflect the receipt of Car Rental Surcharge
Revenues from the State of Arizona Treasurer in compliance with A.R.S. §48-4234
Paragraph G directing the State Treasurer to remit to the District Treasurer the net Car
Rental Surcharge Revenues collected during the preceding month. The increase in
expenditure authority will allow for the disbursement of Car Rental Surcharge Revenues to
the Authority in accordance with the Agreement between the District and Authority dated
October 22, 2003. The Department of Finance will facilitate the monthly wire transfers.
District revenues are not local revenues for the purpose of the constitutional expenditure
limitation and therefore expenditures of these revenues are not subject to the constitutional
expenditure limitation. The approval of this action requested does not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S.
§42-17105.
On October 22, 2003, the District entered into an Intergovernmental Agreement with the
Authority, assigning Cactus League Operations responsibilities and Car Rental Surcharge
Revenues to the Authority, with exception to Car Rental Surcharge Revenues securing
outstanding District bonds. Under the Agreement, the assignment of revenues was subject
to and subordinate to any bond indentures or agreements. In accordance with Section 3.2(b)
of the Agreement, at such time there are no District bonds outstanding and no remaining
bond indentures, Car Rental Surcharge Revenues received from the Arizona State
Treasurer are to be promptly remitted to the Authority. As of June 1, 2019, the District’s
Cactus League Revenue Refunding Bonds, Series 2012, were fully retired and no
outstanding bonds remain. Car Rental Surcharge Revenues to be remitted to the Authority
during FY 2020 are estimated to be $6.2M. (C-18-20-015-2-00)
