Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: December 11, 2019
Case #/Title: Z2019044 – Copper Ridge Equine
Supervisor Districts: 3
Applicant/Owner: Ed Bull, Burch & Cracchiolo, P.A./Justin McCormick
Request: Special Use Permit (SUP) for a large animal veterinary clinic
including surgery and hospitalization within the Rural-43
zoning district
Site Location: Generally located approx. 770’ south of Joy Ranch Rd. on the
west side of 11th Ave.
Site Size: Approximately 3.77 acres
County Island Status: N/A
Additional
Comments: The proposed veterinary clinic is existing and sits behind the
property owner’s residence. There is an approved Home
Occupation Permit for the clinic. The subject SUP is to add a
surgical component to the clinic. There are no outstanding
concerns from reviewing agencies. Staff provided a memo at
the Commission hearing (attached) which included 15
additional documents of support and 2 additional
documents of opposition. There were a total of 30 individuals
(15 spoke) in support and 3 individuals in opposition that filled
out speaker cards at the Commission hearing. After the
Commission hearing, staff received 1 additional support
document which is also attached. One of the project’s
opponents filed an appeal of the Commission’s
recommendation, attached, and thus this matter is on the
Board’s regular agenda for discussion.
Commission
Recommendation: On 11/7/19, the Commission voted 7-0 to recommend
approval of Z2019044 subject to conditions ‘a’ – ‘f’:
a. Development of the site shall be in substantial conformance with the site plan
entitled “Special Use Permit for Copper Ridge Equine Large Animal Veterinary
Clinic”, consisting of 2 full-size sheets, stamped received on October 4, 2019,
except as modified by the following conditions.

b. Development of the site shall be in substantial conformance with the narrative
report entitled “Copper Ridge Equine”, consisting of 4 pages, stamped received
on October 3, 2019, except as modified by the following conditions.
c. This Special Use Permit shall expire 20 years from the date of approval by the Board
of Supervisors. All of the improvements and equipment associated with this Special
Use Permit shall be removed within 60 days of such expiration, or upon termination
of the use for a period of 90 days or more.
d. The following Maricopa County Engineering (Drainage, Flood Control, and
MCDOT) conditions shall apply:
1. The retention calculation must include the barn plus disturbed areas that
are proposed as part of this application. This includes the new driveway,
the channel and the retention basin. Use a C coefficient of 0.95 for the barn
and the driveway and a coefficient of 0.50 for the channel and the basin.
2. The retention system shall be designed to drain within 36 hours in
accordance with the Maricopa county Drainage Policies and Standards,
Sections 6.10.10 through 6.10.13.
3. The site must be graded so that the barn plus the disturbed area drain into
the proposed retention basin. Grading is needed along the new driveway
to drain runoff from the driveway into the basin.
4. Any construction within the floodplain would require a floodplain use
permit; the floodplain use permit would be processed and issued by
Planning and Development along with the building permit.
5. The proposed work within County right-of-way along 11th Avenue will
require a MCDOT right-of-way permit. The right-of-way permit will be
processed and issued by Planning and Development along with the
building permit.
6. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies
and Standards; Floodplain Regulations for Maricopa County; MCDOT
Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.
7. Engineering review of planning and/or zoning cases is for conceptual
design only and does not represent final design approval nor shall it entitle
applicants to future designs that are not in conformance with Section 1205
of the Maricopa County Zoning Ordinance and Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; and the MCDOT
Roadway Design Manual.
8. Detailed Grading and Drainage Plans and Final Drainage Report showing
the new site improvements must be submitted for approval and acquisition
of building/floodplain use permits.

e. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa County
Zoning Ordinance.
f. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, and at the time of expiration of the Special Use Permit, the
property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to
comply with any conditions, or the expiration of the Special Use Permit, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation
or expiration of the Special Use Permit. The Special Use Permit enhances the value
of the property above its value as of the date the Special Use Permit is granted
and reverting to the prior zoning results in the same value of the property as if the
Special Use Permit had never been granted.

Project Summary:
1. The applicant, Ed Bull of Burch & Cracchiolo is proposing a Special Use Permit (SUP) to
allow for a large veterinary clinic including surgery and hospitalization known as Copper
Ridge Equine. The requested specific “special use” category is listed under Maricopa
County Zoning Ordinance (MCZO) 1301.1.20. “Farm animal (horse, cattle and other farm
animal) medical clinics and surgical referral hospitals, subject to the following standards:
1. Animals shall not be boarded or lodged except for short periods of observation
incidental to care or treatment.
2. Any building or corral for the keeping of animals shall maintain a minimum setback of
40 feet from any property line.
3. All refuse and animal wastes shall be stored within an enclosed building or within odor-
proof closed containers.”
2. The subject 3.77-acre SUP area would be for the entire parcel (211-51-027B) addressed
at 37506 N. 11th Ave. As part of the SUP, there are 5 parking spaces proposed (including
1 ADA and 1 trailer). There is an existing barn (3,750 sq. ft.) where the surgery would take
place. It should be noted that there is an approved Home Occupation Permit (HOP)
under LU20190009 for Copper Ridge Equine where no surgery would be allowed with this
HOP (only currently used for storing equipment and supplies, exams, diagnostic imaging,
and other treatments). The surgical component is why the SUP is being requested.
Surgeries would be performed Monday-Friday between the hours of 8:00 a.m. to 5:00
p.m. where 2-3 staff members would be needed for anesthesia and recovery. Access to
the site is through a private driveway to 11th Ave. to the east of the subject site.

Proposed Site Plan for Subject Site
3. The applicant is not proposing any signage, there are no freestanding poles or lights.
There is a request as mentioned within the narrative and shown on the site plan to waive
the 25’ x 25’ Site Visibility requirement on the southern portion of the driveway. They
mention that the parcel to the south of the subject site (APN 211-51-027F) is also owed by
the owner of the subject parcel. It should be noted that the subject site and this parcel
to the south have an Agricultural Exemption under LU20190029 for equine boarding and
breeding. This exemption would not be associated with the SUP operation where permits
would still be required for related structures, drainage, etc.

classification based upon the Maricopa County Department of Transportation (MCDOT)
Major Streets and Routes Plan.

Adopted Plans:
7. New River Area Plan (adopted January 13, 2016): The subject site is designated as Rural
Development Area (0 – 1 d.u./ac.), the proposed land use (large animal veterinary clinic)
is not consistent with the land use designation.
8. City of Phoenix 2015 General Plan (adopted April 2018): The City of Phoenix 2015 General
Plan designates the site as an “undesignated area”.
Public Participation Summary:
9. The applicant complied with the Maricopa County Public Participation Process with the
required posting of the property and notification by first class mail to the adjacent
property owners within 300’ of the subject site and interested parties. There is no known
opposition for the request.
10. Staff was provided a Citizen Participation Results Report from the applicant on October
17, 2019. Within the report it is mentioned that there was a neighborhood meeting held
on June 27, 2019 at the Daisy Mountain Fire Station 145 where ten neighbors attended
and questions were asked and answered. There were some concerns at this meeting
such as product delivery, trailers stopping on 11th Ave., potholes, medical waste, traffic,
security, dust, and boarding services. The report also included approximately 123 people
in support with correspondence and petitions (attached). These include 6 adjacent
neighbors to the subject site.
11. The New River Desert Hills Community Association (NRDHCA) provided a comment memo
received on October 15, 2019 (attached). They recommend that the SUP request be
approved and mentioned a concern with 3 motion lights on the corners and possible
arena lights where the dark sky ordinance must be enforced. It should be noted that
within the narrative report, the lighting includes fully shielded and would meet the dark
sky ordinance requirements.
12. Staff also received an opposition email (attached) from Mike Freeland. Mr. Freeland
mentions that they don’t want this requested land use in their residential neighborhood.
Outstanding Concerns from Reviewing Agencies:
13. N/A
Z2019044

Staff Analysis:
14. Staff is in support of the request for an SUP for Copper Ridge Equine. The subject site is
located in a rural area where surgery and other operations of the veterinary hospital
would take place indoors within the existing working barn building. The veterinary clinic is
otherwise existing other than for doing surgeries and other related operations. With the
provided support of neighbors and others, as well as keeping with the rural character of
the area where the work barn is located behind the existing residence, staff will
recommend a 20-year entitlement for this SUP. Staff is in agreement with the waiver of
the southern SVT requirement. Not only is this property owned by the same owners as the
subject site, but there is pipe rail fencing where vehicles can see through for visibility while
exiting the property.
2019 Google Street View of Subject Site
15. There are no outstanding concerns from reviewing agencies; the Environmental Services
Department (MCESD) commented that with no objections and more details about how
there is no drain within the work barn where medical waste cannot enter the septic
system. Engineering review mentioned no objection to the request and included
recommended conditions. Lastly, the Daisy Mountain Fire and Medical Department
(DMFD) has no objections but would require an operational permit with a fire life safety
inspection.
Recommendation:
16. For the reasons outlined in this staff report, staff recommends the Commission motion for
approval with conditions ‘a’ – ‘f’, of Z2019044.

Z2019044

with any condition, and at the time of expiration of the Special Use Permit, the
property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to
comply with any conditions, or the expiration of the Special Use Permit, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation
or expiration of the Special Use Permit. The Special Use Permit enhances the value
of the property above its value as of the date the Special Use Permit is granted
and reverting to the prior zoning results in the same value of the property as if the
Special Use Permit had never been granted.

B. Purpose of Request
This is a request on behalf of Copper Ridge Equine (CRE) to perform farm animal (equine) surgery and
hospitalization in an existing building on APN 211-51-027B at 37506 N 11th Ave Phoenix AZ 85086 for 20
years. During Pre-Ap meeting PA 2018210 it was indicated that for equine hospital services to be
provided, a special use permit would be required. CRE currently maintains an agricultural exemption on
the property that allows boarding and breeding of horses, as well as home occupation permit
LU20190009 which allows veterinary services to be performed in the building.
C. Description of Proposal
Copper Ridge Equine is a large animal veterinary practice started in 2016 by Drs. Justin and Christine
McCormick. Dr. Justin McCormick is a second-generation Arizona veterinarian providing care to the
horses of Arizona for collectively over 40 years. Dr. Justin McCormick is one of only 10 board certified
surgeons in the state of Arizona and is highly accomplished and published in orthopedic surgery. He
served as the personal surgeon to the Sheik of Dubai for several years before returning to Arizona to
start CRE. General practitioners refer surgical cases to Dr. Justin McCormick. Dr. Christine McCormick is
the only veterinarian in Arizona certified in Equine Rehabilitation, specializing in treatment post injury
and post-surgery. Currently the existing building "work barn" is used for outpatient appointments
(Home Occupation Permit LU20190009), and surgery is performed in a leased surgery suite on Bell Road.
Surgical patients are transported after surgery to .a barn in Desert Hills for aftercare which is very
difficult on the horses.
CRE would perform surgeries Monday through Friday between the hours of 8:00am and 5:00pnn,
emergency surgery would also take place when necessary. Equine surgery takes roughly 3 hours from
start to finish, so generally 2-3 would take place in one day. There would also be days of no scheduled
surgeries. Anticipated generated traffic to the property for surgery would be almost unnoticed. Surgery
generally requires 2-3 staff members to facilitate anesthesia and recovery.
The proposed building for surgery is existing on the property. It lies west of the home residence and
besides the home is the only building on the property. The building is a steel frame tin building with a
beautiful rusted metal patina to blend well with the southwestern motif of Arizona. The building is 50 ft
wide x 75 ft long with 16 ft eave height and roof slope of 2. It includes 3 roll up doors, 2 windows, and 5
personal doors. The building has been landscaped on all sides and is aesthetically clean and pleasing.
Landscaping includes quarter-minus laid down on the majority of the property and approximately 25
trees planted. No additional landscaping is planned. The building is screened from 11t h Avenue by the
home residence so that nothing is in public view. Lighting includes fully shielded dark sky ordinance
motion detection lights on 3 corners of the building. There are no free standing poles with lights. There
will be no signage. Dedicated parking spaces will be constructed on the south side of the building with
one longer space to accommodate a truck and trailer. Fencing currently exists along the north and west
property lines that is a 5.5 foot tall pipe rail fence with 4 cable rails below the top pipe rail ( see
pictures). A wall along portions of the 11t h Avenue frontage (outside of the floodway), although not
required by this SUP, may be constructed in the future subject to obtaining the appropriate wall permit.
If the SUP is granted, the building will then have to be inspected and meet the standards of the Arizona
Veterinary Medical Board.

D. Relationship to Surrounding Properties
As indicated on the attached aerial, the property has vacant lots to the south and north. To the west is
an inhabited property, yet much of the land that borders the McCormicks is undeveloped. Due to
minimal development around the McCormicks, Tom Cox to the north is the only neighbor that would
potentially be affected. He is in support of the McCormicks SUP, as is all of the neighbors with land
bordering the McCormicks. All the letters of support can be found later in this application. The property
also lies within a heavily equestrian area with 2 horse farms with over 50 horses each within a 2 block
radius. On average 5-10 horses trailers are already traveling down 11 th Avenue daily. All other lots within
close vicinity are inhabited by residents who own horses and use Copper Ridge Equine as their
veterinarian.
Desert Hills is primarily a rural area with over three quarters of the residents owning horses. There is an
estimated 2000 horses in Desert Hills, including several large scale horse farms with over 50 horses each
in which Copper Ridge Equine is the attending veterinarian. Surgical services provided pursuant to this
SUP will benefit the horses of Desert Hills and elsewhere in the state of Arizona. There is an estimated 2
million horses in Arizona with currently only 4 hospitals able to provide surgery by a board certified
surgeon (1 Tucson, 1 Gilbert, 2 Cave Creek). There is a dire need for more equine hospital options and
availability to the horse owners of Arizona. The Cave Creek/Desert Hills area is centrally located
between Prescott and Tucson with easy access off 1-17 for horses traveling to have surgery. It is a highly
equestrian area that is overwhelming supportive of an additional surgical service.
In Summary, CRE believes that the request to perform surgery in the existing building will have no
negative impact on any of the surrounding properties and will only benefit the horse owners of Desert
Hills and the entire state of Arizona.
E. Location and Accessibility
Parcel 211-51-027B is located at 37506 N 11 th Ave Phoenix AZ 85086. The intended building for this use
is accessible by a short driveway that bypasses the home residence. The parcel is approximately one
block south of Joy Ranch Road, and approximately 3 blocks west of 7t h Avenue, both of which are arterial
streets.
F. Circulation System
All traffic will use the dedicated driveway on the south side of the residence and building to enter and
exit the property. There is ample room for trucks to come in and turn around on the west side of the
building, out of public view. This whole area on the west side of the building (and the majority of the
entire property) has had quarter-minus gravel laid down for dust control.
CRE would like to request a waiver of an easement for their south Sight Visibility Triangle (SVT). A
request is proposed to allow the south sight visibility triangle (SVT) to partially lie within APN 211-51-
027F (the parcel to the south of SUP parcel) without an easement. The McCormick family owns this
parcel as well with no intentions to ever separate the two parcels. The McCormicks were in serious
pursuit of purchasing this south lot for many years, and now that they own it, are developing the whole

9+ acres as one contiguous horse farm. The McCormicks will sign any necessary contract stating that for
the life of SUP, they will not sell the south lot separately.
G. Development Schedule
There is no further phasing needed as the proposed building for surgery already exists on the site.
H. Community Facilities and Services
The property is in the Deer Valley Unified School District. Desert Mountain School services K-8 for the
area. For high school, area children attend Boulder Creek High. There are no parks or amenities in the
general area. CRE will not have any negative impacts on the school district, parks, or amenities.
I. Public Utilities and Services
The property's water and waste is serviced by a well and 2 septics. The police jurisdiction is MCSO
(Maricopa County Sheriff) and fire is provided by Daisy Mountain Fire and Medical. Refuse disposal is
provided by Republic.
J. Additional Supporting Information
As is shown in the attached aerial maps and site pictures, Copper Ridge Equine surgical facility is a high
quality, well screened, and low intensity facility that will be compatible with the area. For example, the
existing building is well-located, appropriate in its size and architectural finish, and nicely landscaped.

Subject: Special Use Permit at 37506 N. 11th Avenue, Phoenix, Arizona, 85086
The Maricopa County Environmental Services Department has received a request to review the proposed Special
Use Permit Z2019044 for a property located at 37506 N. 11 th Avenue, Phoenix, Arizona, 85086. The request is to
determine potential requirements by the Department for potential impacts to the private domestic well and septic
system associated with the existing building "work barn" where the intended practice of equine surgery is proposed.
The Special Use Permit Z2019044 receives Maricopa County Environmental Services Department's approval by
adhering to the following as described by the letter of explanation provided by Christine McCormick dated
06/27/2019:
Private Domestic Well
According to the Safe Drinking Water Act (SDWA), a public water system is any water system that supplies at least
fifteen service connections or regularly serves at least twenty-five individuals. SDWA further divides public water
systems into community water systems (CWSs) and non-community water systems (NCWSs).
• CWSs include public water systems that serve 25 people or 15 connections year-round. Examples of CWS
include municipal water system or water system that serve a mobile home park or other groups of residents
New CWS Permit Application.
• NCWSs are PWSs that do not serve a permanent resident population and includes two water system types.
The first, non-transient, non-community (NTNCWSs) includes systems serving at least 25 people
(the same people) at least six months of the year, such as some churches, schools, and factories,
etc. NTNCWS Application.
• The second, transient non-community (TNCWSs) includes facilities such as roadside stops,
commercial campgrounds, hotels, and restaurants that have their own water supplies (not connected
to PWS, etc.) and serve a transient population at least 60 days per year. The public water system
may be publicly or privately owned. mcws Application.
In order to not be required to have a public water system approval, the facility will need to limit both employees and
clients served at the facility to 24 people or less per day. The Department does not object based on the explanation of
expected use as detailed by the applicant:
"The well on the property services a) the residential home on the property b) the sinks and toilets in the work
barn and c) drinking water for horses. In compliance with CDC recommendations and EPA guidelines, this
well services fewer than the max 25 allowable people. It services 3-4 people with a few additional livestock."
Onsite Wastewater
The Maricopa County Environmental Health Code and the Arizona Administrative Code requires that flows to the
onsite wastewater treatment facility consist of typical sewage and do not include any motor oil, gasoline, paint,
varnish, solvent, pesticide, fertilizer, or other material not generally associated with toilet flushing, food preparation,
laundry, or personal hygiene. Flows to the onsite wastewater treatment facility shall not include wastewater
resulting from animal care or surgery, medicines or chemicals related to animal care or surgery, nor chemicals or
RECEIVECI JUL Z 2 Z019.,
7.201Pn 0 .. i'--.1. 4

wastes related to the cleaning of animal care or surgery. The Department does not object based on the explanation
of expected use as detailed by the applicant:
"Wastewater produced by the work barn is currently processed by a separate, permitted septic system. The
work barn houses 2 restrooms, as well as 3 hand sinks. Due to zoning regulations no floor drains are
present in the building. All medications are disposed of following FDA and AZVMl3 (Arizona Veterinary
Medical Board) statutes, any expired or excess medication is taken to a human pharmacy for proper
disposal. Any biologic waste (urine, blood, etc..) as well as disinfectants are wiped up with towels and
disposed of in the trash. Due to the lack of floor drains, no medical waste can enter the septic system. In
the rare occurrence a horse is bathed, it is done in the west end of the property not involving the work
building."
This approval is contingent upon adherence to the practices related to the private domestic well and onsite
wastewater treatment facility as expressed in this letter and compliance with this Department's regulations.

Dear Ray,
For case Z2019044 on the parcel 211-51-027-B owned by Justin and Christine McCormick DVM, The New
River- Desert Hills Community Association Board recommends that the request be APPROVED.
The only concern we have is:
The application mentions that there are 3 motion lights on the building corners and possible arena lights, but
the description is limited.
- The dark sky ordinance must be enforced.
Any other issues or questions that were brought to our attention have been addressed by the Applicant
and/or administrative laws set forth by the Arizona Veterinary Medical Board which gives them the ability to
practice and hold a premise license. They were just inspected a few months ago and have met all the criteria to
be a full service hospital.
Thank you for your consideration.

Dear Maricopa County Board of Supervisors:
I am writing to support Dr Justin McCormick's application for a special use permit to
perform surgery on his property where he now has an existing rehabilitation facility under his
business Copper Ridge Equine. I have been to the property to discuss horses we have both
worked on as equine veterinarians. I have been an equine veterinarian in Arizona in the Phoenix
area since I got out of veterinary school in 1985. I went to work for Dr. Clay Posey at Southwest
Equine Hospital that also olierated under a special use permit at 6001 E Bell Rd. I was very
fortunate to go to work at such a great place and get to do surgeries right after I graduated from
veterinary school that many veterinarians would never have an opportunity to do. Dr.
McCormick is as talented at doing surgery on horses as any veterinary surgeon I have ever
known and I was able to see some very talented surgeons when I worked at Southwest Equine
Hospital. I knew his dad well who was also an excellent equine veterinarian that worked at the
Turf Paradise racetrack. He and Dr. Lori Walker did orthopedic surgery on the racehorses they
worked on that needed surgery at Southwest Equine Hospital and I often assisted with the
anesthesia.
I have known Dr. McCormick since before he went to veterinary school at UC Davis. I
don't know anyone who has worked any harder to accomplish his goals of becoming a very good
equine surgeon working on many very talented equine athletes that are involved with racing,
western performance sports, and other upper level equine events. When you go to his property it
is very clean and functional and fits in architecturally with the other properties in in that area that
are generally horse facilities. His property has made the area look better already and will be a
real asset to the horse and veterinary community. Please feel free to contact me if I can answer
any estions regarding this application for a special use permit.

Members,
I am writing In extend my support of the Special Use Permit listed above to allow farm animal (equine) surgery within the existing building located at 37506 N. 11th Avenue. l am a hor
owner, have boarded my horses for over 10 years at Carefree Farms on 7th Ave In the area. (36412 N 7th Ave). Drs Justin and Christine McCormick have been my vets for many years. TT*
are excellent practitioners, and have been a great asset for horse owners In the area. I am fully in support of their proposed equine surgical suite at their existing property. In the past, wher
my home required surgery, It required a 30 to 40 minute trailer ride to the facility where Dr. McCormick was contracted. This added some unnecessary stress to my horse. Tnere are a grin
many horses in the area of the proposed surgery, having a closer facility would be a tremendous asset 10 horse Owners in the area, as well as helping to eliminate the stress of a long trails
ride to already injured or ill animals. I have watched the McCormIcks practice for many years, they always display the highest degree of professionalism, their practice and the animals In 8
care are always maintained to the highest standards I have no doubt that the surgical facility would be maintained to these high standards as well. Please add me to the list of people givir
my enthusiastic support to this proposal. Thank You.

Good evening,
I am absolutely in support your proposed surgical facility. The ability for southern Arizona practitioners to
have access to a modern state of the art facility either for referral or their own use is not only innovative but
a much needed advancement for Arizona's veterinary community.
Please count on me for any additional support you many require to complete your proposed facility.

To Whom it Concern,
I have engaged and entrusted Dr. Christine McCormick and Dr. Justin
McCormick with the care and welfare of all of my horses over the past 5
years.
In my experience they have done excellent work and demonstrated the care,
attention and professional competency that has left me with a high
confidence in their capability. Further, Dr. Justin McCormick is a brilliant
surgeon and given the opportunity can benefit many equine in his own
facility.
It is my opinion and recommendation that the Doctors and the Community at
large would benefit with an animal equine surgery placed in the existing
building at 37506 N. 11 th Avenue.

Re: Copper Ridge Equine
Hello,
I would like to show my support for Copper Ridge Equine as they go through the steps with you to
complete the permitting process along with finalizing their amazing project. Copper Ridge Equine is well
known all over the state and quite honestly the nation as a place where your horses whether athletic, or
just pets can get the best care possible. Their location is perfectly accessible and easy to commute to for
those of us coming out of northern Arizona. Copper Ridge Equine has always shown to keep their property
clean and their staff buy into Justin, and Christine's beliefs that a clean and efficient property/business will
always show professionalism and display transparency which in-turn give us as clients a warm feeling that
our horses are in the best hands. I would also like to remind you of the revenue this business will bring your
area, we travel a long way to get to Copper Ridge Equine and spend money in your restaurants, hotels(if
needed), and gas stations when we make the trip. I can guarantee you we are not the only clients who
make this trip to this outstanding facility. I again wish to show my support for Copper Ridge Equine, if you
have any questions please feel free to contact me at the information below.

Maricopa County Planning and Zoning,
This letter is in support of Case # Z2019044 for Copper Ridge Equine. As a Planning and
Zoning Board, you are most certainly aware of the growth in this area that Copper Ridge Equine
is located, especially in the growth of equine properties. Copper Ridge Equine employs one of
the top equine surgeons in the Western United States and what a positive element this provides to
the equine community in Maricopa County. I can see no negative impacts on the approval of
this special use permit. On the flip side, the beneficial and positive points are too many to list in
this letter. Please approve this special use permit so those of us in Maricopa County can benefit
from the services offered by Copper Ridge Equine.
Thank you in advance for your consideration of approval for case # Z2019044.

Dear Mr. Banker and colleagues;
I have recently been made aware of this application for Special Use Permit for Copper Ridge Equine and
do not support its approval.
A brief introduction is that I am a board certified veterinary surgeon and have a successful equine practice
here in the greater Phoenix area. I have centers of work in Buckeye, Cave Creek, Wickenburg, Phoenix
and Scottsdale that I've called on for over 12 years. I have no previous or current business relations with
Copper Ridge Equine, nor either of the doctors of the practice.
I have performed elective and emergency surgeries since our business began here in Arizona. These
surgeries are performed at either Chaparral Animal Hospital (Cave Creek Rd, Phoenix) or Cave Creek
Equine Surgical and Imaging Center (Carefree Hwy, Phoenix). At different times throughout my career in
the valley I've also performed procedures at Southwest Equine (Bell Rd, Scottsdale) and Arizona Equine
Medical and Surgical Centre (Ray Rd, Gilbert)
The purpose of this basic information is to ensure that you are aware I am very experienced in this field,
have worked in many surgical facilities, and have no business conflicts with this company or its owners.
My conflict and disapproval is with the application contents and some of the answers or solutions provided.
As a basic introduction to my disapproval, allow me to address the overall misconduct of this project. The
building in question is a barn, permitted under a residential building permit not to be used for commercial
purposes Feb 6, 2018 (tracking #B201705139). Basically described as a metal sided barn with a cement
pad. Some months thereafter, an application was submitted for an SUP. From the documents I've
received there is a letter dated May 28, 2019 produced by the Maricopa County Environmental Services
that addresses water treatment. There is (and was) a plethora of photos, client reports, etc. of this facility
being used as a veterinary business after the residential permit was awarded and prior to the application
of the SUP. Simply stated it is very obvious that this entire project has been purposely
constructed and construed to avoid proper permitting from the start. There must be a degree of
conscious principles that the board members experience when reviewing such an unethical and
unprofessional approach for establishing a commercial business property.
As previously mentioned I have surgical privileges at multiple locations in this valley. I would encourage
you and your colleagues to join me for a tour of one or more hospitals so you can see first hand what
happens before, during and after a surgical procedure on a horse or other large animal (regardless of
elective or emergency or orthopedic or soft tissue, in-patient or out-patient) All veterinary hospitals and
surgical centers have been required to have proper sewer hook-ups to handle waste associated with these
procedures as well as general case work and hospitalized patients. This is an obvious public health issue.
On June 28, 2019 Thomas Hanson, Maricopa County Environmental Services Dept produced a document in
which the second to last paragraph describes how waste will be handled. In summary the waste from
procedures (blood, feces, urine, antiseptics, etc) are going to be sopped up with towels and
discarded. The thought that the waste material at a large animal veterinary surgical hospital
can be sopped up with towels and discarded in the trash is not only unacceptable and highly
unlikely, but just plain bizarre. I hold current licences and perform surgeries in remote areas of
Alaska, Montana, and Wyoming and can inform you with direct knowledge that even the most remote
1

bush hospitals still wash the surgical table, general operating space (urine, feces, blood, dirt, etc),
instruments, patient's surgical area etc with water and various soaps/ antiseptics. This material drains
somewhere in all situations.
I have contacted the Arizona Board of Veterinary Medicine to inquire how a premise license could be
issued for this building as a veterinary hospital (no floor drain??) and was informed that this board does
not inspect the building for suitability for a veterinary business, however after being informed of this
particular situation they are currently reviewing the documents associated with the SUP. This information
is now being shared with the board after which we expect the board to be asking questions of the Zoning
Commission. Please direct your attention to Section C of the proposal: "If the SUP is granted, the building
will then have to be inspected and meet the standards of the Arizona Veterinary Medical Board." This is a
false statement because the building is not inspected by this board. Victoria Whitemore, Executive
director of the Arizona Veterinary Medical Board, was notified of these conditions on 11/4/2019 by email
and phone call. Please decline this SUP and address the questions of the Arizona Veterinary
Medical Board.
Other inconsistency's in the proposal;
Section B last sentence"... home occupation permit LU20190009 which allows veterinary services to be
performed in the building."
*Be advised that the entrepreneur does not reside in the dwelling in which the business operates. This is
a violation of the qualifying standards for a home occupation as printed in the application packet and
should nullify the permit.
*Be advised that at a veterinary facility we generate radiation. Our xray generators produce ionizing
radiation when used. This should nullify this permit because according to the qualifying standards section
of this application it specifically states that "No. ..,radioactive or similar material shall be used, sold or
stored on site."
*Be advised that at this facility there are greater than 1 vehicles used in this commerce activity. This also
should nullify the home occupation permit as it clearly states that the maximum vehicle allowance under a
home occupation is limited to 1 and it must be stored inside at all times.
When applying for a home occupation the applicant must sign that they understand these requirements
and will abide by these rules. I would like the board to address these discrepancies because it is
apparent that this veterinary surgical facility does not comply with the standards of a home
occupation as defined by the Maricopa County Planning and Development Department.
Section C states that Dr. Christine McCormick is the only veterinarian in Arizona certified in equine
rehabilitation specializing in treatment post injury and post surgery... Allow me to introduce the fact
that there is a veterinary College of Sports Medicine and Rehabilitation. This specialty college exists to
further train and certify veterinarians that have successfully completed additional training and hence are
deemed specialists in the field (ie "Boarded") Dr. Christine McCormick is not a member of this college,
Dr. Martin Vidal (Cave Creek Equine Surgical and Imaging Center, Care Free Hwy) is however a diplomate
of this college and hence a specialist in the field. This is comparable to the college of veterinary surgeons
of which Dr. Justin McCormick and myself are diplomates (ie Boarded Surgeon, aka specialists).
Section D 2nd paragraph describes a "dire need of more hospital options". I am not sure how to judge
what -exactly "dire need" means; but I can advise you that there are 2 referral equine surgical centers
within a few miles of the proposed SUP. I personally would not define this area as in "dire need" when
compared with pretty much any other area within this state.
This SUP should not be a popularity contest. I feel that the issues I have brought forth are serious
concerns of our community and clearly show why this SUP should not be granted.
I want to be absolutely clear that I have no personal, professional, or business conflicts with this company
nor any intent to disrupt a fellow colleague from performing business in an ethical and legal manner. It is
obvious that this project has had the intent to circumvent the permitting process of establishing a
commercial business. I am asking the board not to approve this SUP and to further review the
requirements put on the adjacent hospitals in this area and apply those same criteria to this
2

business and property. I am also asking the board to address any questions produced by the
Arizona Veterinary Medical Board after they have had proper time to review the SUP
applications documents.

Dear Mr. Ray Banker,
I plan to attend the planning and zoning meeting Thursday morning and respectfully ask that you accept
this letter as a request for your attention to an important issue in the Desert Hills community. I am
expressing concern with an application for a special use permit at the location of 37506 N 11 th Avenue in
Desert Hills (case # Z2019044) as a nearby resident. The owner of this property has requested a special
use permit to operate a large animal veterinary hospital in a rural residential area. The permit was
requested after the applicant already constructed the building. The wording in the application leads the
reader to believe that this is a longstanding pre-existing building which they retrofitted to make a
hospital when in fact this building was permitted in 2018 and was used to circumvent commercial
building codes and in hopes to forgo the expense of a SUP altogether.
Currently, Copper Ridge Equine (CRE) is operating as a veterinary hospital purporting to be a home
occupation. A veterinary hospital cannot be operated as a home occupation because it cannot comply
with at least three of the home occupation requirements:
• The entrepreneurs of a home occupation shall reside in the dwelling in which the business
operates;
• No toxic, explosive, flammable, radioactive, or other similar material shall be used, sold, or
stored on site (g); and
• No non-resident employees, customers, clients or students shall be permitted on the
premises for business purposes between the hours of 10 pm and 7 am (k).
A brief glimpse at the website and the Facebook page certainly supports that they are currently
performing surgeries and diagnostic imaging in violation of the home occupation requirements.
Specifically, I and nearby residents have concerns with
• the location of the structures within the floodplain and adjacent to the floodway; what this
means for the downstream homes as well as the safety of surgeries and other procedures
occurring within the buildings;
• the potential for the leaching of biological waste and chemicals that routinely occur in
equine surgeries into the aquifer (Salmonella, E. Coli, C Diff, etc.), and what this means for
the surrounding wells;
• The operation of a clearly commercial business in a heavy residential area in a facility which
was built to residential code permitted in February of 2018 which circumvented having to
meet more stringent requirements of a commercial permit.
1 have visited the Maricopa County website and reviewed the SUP application on file for Copper Ridge
Equine. This application is full of contradiction and the response to the communities concerns listed
above are completely unrealistic and absurd. There is absolutely no way an equine hospital can operate
without a floor drain and soak all of the waste up in towels. I am certainly willing and wanting to
RECEIVED NOV 0 6 2019,

entertain realistic and logical solutions to keeping the ground water safe, however, reading this
proposed method has increased my concern to a level that I am writing to you.
The large majority of the recorded SUP supporters are from an hour to several hours away and will not
be affected by biohazardous waste leaching into their water supply. I feel those in the community,
which are currently in support of this project, have not been provided the full picture of how an equine
hospital operates and the biohazardous waste which is associated. Yes, a healthy animal can defecate
and the manure picked up and placed in a container for disposal. Even the bedding/shavings which are
used can be swept up and hauled off. A hospital and/or surgical facility however, MUST be disinfected
between patients. These horses are not healthy and many are given intravenous fluids and have high
urine output and oftentimes watery diarrhea. Infectious diarrhea! The plan put forth by CRE leaves
them either washing liquefied contaminants and disinfectant chemicals on and into the ground or they
are not planning to disinfect and clean the facility appropriately. Neither is acceptable and neither
scenario is what they are representing in their application.
The application states that they will accept referrals and do some emergency work. The standard of care
of such facilities has been set by the four other equine referral and emergency hospitals in the area (one
of which is in Desert Hills that the applicants have listed as in Cave Creek). All of these hospitals are held
responsible for what happens to biological waste produced at their facility. All of these hospitals meet
commercial code. The unrealistic solution to disposing waste from CRE insinuates that the applicants of
this SUP do not take the potential of infectious waste contaminating much of Desert Hill's ground water
seriously. I fear that if this project is to go forward as proposed, CRE will dispose of the large waste
material and then wash the liquefied microscopic infectious waste out of the hospital onto the
surrounding ground for the rain and floodwater to carry and leach deeper into the ground. As you are
aware, there is already well water in Desert Hills which has been contaminated with Salmonella by
leaching of animal waste. Furthermore, we are only discussing those patients housed within the
hospital building; the same scenario holds true for those high risk horses hospitalized in outdoor pens.
Veterinarians take an oath to practice conscientiously and promote public health. They are obligated to
uphold regulation and operate in a professional manner. This building was built with the intent of using
it as a commercial hospital and appropriate regulations have been bypassed. We all have a duty to
educate the community about the type of biological waste and potential infectious agents our business
generates and exposes to the community. I do not feel CRE has been transparent concerning this.
Desert Hills is full of small business owners and entrepreneurs. They build and run their business with
regard for appropriate permitting and responsibility to safety regulations placed on the community for a
reason. I am respectfully asking that CRE be held to the same standards.
CRE is operating a commercial business in a rural residential area, and to date has shown a willingness to
cut corners and bypass the normal procedures required to build and operate a commercial business.
We hope that County planning staff will carefully review what is occurring on site today, as well as
provide the community with some certainty regarding the specific issues outlined above as this
application is processed. To me and many residents who pull their water from that major aquifer, it
seems most fare that CRE build and conduct their commercial business in a more appropriate location.
Because a very high percentage of CRE clientele and supporters are from outside the Desert Hills area, it
makes sense that an alternative location will work well for this business.

Finally, I would like to invite you to visit an equine hospital during a surgery and/or disinfection process
to provide you a better understanding of what is required to meet the standards of patient care and
sanitation. I am confident that anyone with a thorough understanding of what is required to clean,
disinfect and control biohazardous waste will not support this business operating over this major water
source.
Thank you for your time and consideration.
Respectfully,
Renee Andrea, BS in Animal Science, DVM, DACVS

Hi Steve,
There are 2 hearings coming up on Nov. 7th and Dec. 11th for my vet to to allow animal surgery within his
existing building.
I personally know the vets who own this clinic, the McCormicks, and they run a first class operation. I don't
live in that area, I'm still in the Rio Verde Foothills area, but I've been over there numerous times with my
horses and it's quiet and professional every time I've been there. I think they would be a great asset to that area
because of the numerous horse facilities surrounding them.

My name is Erika Rodenski and I am unfortunately unable to attend the planning and
zoning meeting for Copper Ridge Equine referral large animal surgery clinic in person
due to my profession, but I feel that having a facility like this would be beneficial to my
community. Being a horse owner and observing the lack of large animal surgery centers
in the West Valley, Copper Ridge Equine having this capability would put my mind at
ease knowing if my horse is ill and in need of surgery he can receive immediate care
because I would have a large animal surgery clinic within minutes of him. Dr. Justin

Planning & Zoning November 7, 2019
Commission Hearing Date
Reason for the Appeal of The staff and commission failed to place stipulations on the
the Subject Case SUP that would protect the area residence, but instead
accepted the approval of environmental that was given
misleading information by the applicant on how bio-waste
would and could be handled.
The Commission ruled against the Area residence that signed
petitions against the project in a 2 to 1 ratio compared to area
residence who signed petitions for the project.
The property adjacent to the south property line of the SUP
application completely accessible from the SUP property will be
used in direct conjunction with the SUP was not included in the
1

application. The rehabilitation of clients will take place on this
property and in such the property should have to be covered by
all stipulations and convents of the SUP. Ag Exempt is not
designed to cover commercial business of a Veterinary
Hospital/Rehab Facility. Both are promoted on the Website as
a single business.
MCDOT/Traffic Division was mislead about the amount of
traffic that will be in and out of the facility. 90% of the
supporters are traveling from outside of the area and out of
state to the facility.
Applicant built the building under a residential building permit in
2018 knowing it would be a commercial building use. Only after
being reported for a zoning violation did they apply for a home
occupation permit. Only then did they apply for the needed
SUP stating that the new building was an existing building.
Then only when they learned about our complaints to Maricopa
County about constructing the building under a non commercial
permit did they apply for a commercial building permit 3 days
before the hearing.
The Commission never addressed the fact that employees will
have to be at the business overnight doing treatments and
observation of patients and how they will be housed or if this
will be allowed.
If the applicant want's to put in writing that no emergency
surgeries or abdominal surgeries will ever take place at the
facility then many things such as night works and other
concerns from area residence may be able to be dampended,
but it must be in writing as the applicant has shown the history
of circumventing the system and procedures.
Statements by the commission members that these items will
be handled in permitting does not make sense since the
building has had its final and without stipulations place on SUP
the Commercial permit that was just applied for could very
easily be glossed over.
The final object is to the statement by the commission member
just before the vote that "he spoke to his buddy who likes the
applicant and that was good enough for him." His beliefs of his
"buddy" has no bearing on this SUP and we believed it to be
very inappropriate and prejudicial.
We believe the Commission granting their recommendation
was premature and they should have at a minimum placed
stipulations on the SUP to cover items brought up in this
appeal and at the hearing.
