Formal Meeting Minutes

1. Development and engineering design shall be in conformance with the Maricopa County
Stormwater Quality Management and Discharge Control Regulation. The owner/developer
shall prepare a Stormwater Site Plan and obtain approval by MCESD prior to construction
(a separate submittal to MCESD is required).
2. Upon completion of construction, the owner shall fulfill MCESD post-construction
requirements. This will include appropriate operation and maintenance requirements.
3. Prior to construction obtain Notice of Intent to Discharge (NOID) approval from MCESD
on-site program.
d. The following C-3 CUPD standards shall apply:
1. Screening: 8’ (h) solid wall offset from property lines as provided in the site plan exhibit.
2. Parking: 7 regular and 1 ADA parking spaces.
e. The CUPD overlay is applied to restrict the use of the site. Until such time as the site is
served by sewer, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems. A public water system and public sewer system shall be required prior to
establishment of any non-residential use that requires potable water.
f. The 3 subject parcels must be combined into a single parcel prior to building permits
being completed for development of the subject site.
g. The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the zoning that existed on the date of application. It is, therefore,
stipulated and agreed that either revocation due to the failure to comply with any
conditions, does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation of the Zone
Change. The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted. (C-44-19-044-M-00)
Matthew Holm, Planning Supervisor, explained this is a request for a zone change from
Rural-43 to C-3 Commercial Unit Plan of Development (CUPD). He stated the
department received 21 letters of opposition, but this does not trigger a super majority
vote.
Chairman Chucri noted the amount of work that went into this item to strike a balance
between the applicant and residents.
Jennifer Pokorski, Director, Planning and Development, read into the minutes the added

stipulations for this item and stated this addressed the concerns of the residents.
Language to be added is underscored and language to be deleted is struck-through:
a. Development of the site shall be in general conformance with the narrative report
entitled “Palacios Storage”, consisting of 6 pages, stamped received on June 27, 2018.
Within 30 days the narrative shall be revised consistent with the CUPD development
standards and use regulations listed in condition d’ below.
d. The following C-3 CUPD standards shall apply:
1. Screening: Min. 8’ (h) solid wall offset from property lines as provided in the site plan
exhibit. setback a minimum of 35’ from the south and west street lines and a minimum
of 12’ from the north and east lot lines. Landscaping shall be provided external to the
wall with xeriphytic tree species (minimum 15 gallon) spaced approx. 20’ on center
around the entire length of wall perimeter.
2. Parking: 7 regular and 1 ADA parking spaces.
3. Building/structure heights shall be limited to a maximum of 30’. All buildings greater
than 18’ in height shall have a 360 degree architectural treatment acceptable to the
Maricopa County Planning & Development Department in order to soften appearance
external to the site.
4. Freestanding signage shall be limited to a maximum of 12’ height and no electronic
message display (EMD) is allowed on any signage.
5. Lighting shall be fully shielded.
e. The CUPD overlay is applied to restrict the use of the site. Until such time as the site
is served by sewer, uses on the site shall only be those acceptable to the Maricopa
County Environmental Services Department (MCESD) that can be accommodated by
septic systems. A public water system and public sewer system shall be required prior
to establishment of any non-residential use that requires potable water. Further, the
UPD overlay shall prohibit adult-oriented businesses, medical marijuana operations, and
billboards.
i. The property owner shall have granted an Aviation Easement and Release to the City
of Mesa pertaining to Phoenix-Mesa Gateway Airport, which will be prepared and
recorded by the City prior to issuance of zoning clearance for any construction permit.

Ridge Estates 195/Northern
Request: Zone Change from Rural-43 RUPD to R1-6 RUPD
Site Location: Generally located 2,900’ west from the corner of Perryville Rd. and Northern
Ave. in the Waddell area
Commission Recommendation: On 9/6/18, the Commission voted 7-0 to recommend
approval of Z2018051 subject to conditions ‘a’ – ‘e’:
a. Development and use of the site shall comply with the Narrative Report entitled “White
Tank Vistas”, consisting of 10 pages, dated stamped received July 13, 2018, except as
modified by the following conditions.
b. The following Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to drainage design, access and roadway
alignments. These items will be addressed as development plans progress and are
submitted to the County for further review and/or entitlement.
2. Right-of-Way dedications for perimeter streets will be required as follows with plat
approval, unless otherwise waived by MCDOT:
Northern Avenue: 65 feet
Jackrabbit Trail: 70 feet
191st Avenue: 40 feet
3. Development of the site will require offsite right-of-way acquisition and roadway
improvements to provide a minimum two (2) paved points of access. Road improvements
shall meet the minimum requirements of MCDOT for each respective road classification.
4. A Traffic Impact Study to address traffic impacts and (additional) roadway improvements
required to support the proposed development must be submitted with the Preliminary Plat
application.
5. If required, submission of a CLOMR application to the Flood Control District must be
made prior to or concurrent with the application for Preliminary Plat.
c. The following R1-6 RUPD standards shall apply:

each subsequent phase, within which time the subdivision infrastructure permit or
construction permit for each phase must be obtained.

(C-44-19-045-M-00)
Supervisor Hickman thanked everyone in attendance for this item.
Jennifer Pokorski gave the background on this item and explained this item is a request
for zoning change from Rural-43 RUPD to R1-6 RUPD which has a density of
approximately three houses per acre. To-date, 70 letters of opposition have been
received with concerns about the density. Based on opposition there may need to be
more stipulations added or more time needed to work out a balance between the
community and developer.
Supervisor Hickman asked about plat development. Ms. Pokorski responded that the
plat is the next phase of the zoning so there is not one available at this time.
Supervisor Hickman said he has spent time on this issue and he thinks it is appropriate
to spend a little more time on this item to address the concerns in the area. He has had
discussions with the people in the area and thought progress was made. He
recommended this item be continued to November 28, 2018 and believes the applicant
is amenable to the continuation.
Motion to continue by Supervisor Hickman, seconded by Supervisor Gallardo

18. AGREEMENT AND GRANT FUNDS FROM DRUG ENFORCEMENT ADMINISTRATION
Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Drug
Enforcement Administration, Organized Crime Drug Enforcement Task Force (OCDETF)
Investigative/Strategic Initiative # MN-17-0012/SWAZP0826 in the amount of $451,128.53
for the award period beginning October 1, 2018 and terminating on September 30, 2019.
This Agreement may be terminated by any of the parties by written notice to the other
parties ten (10) business days prior to termination.
The funding award is recurring and has been awarded to the Sheriff’s Office the past seven
years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY19 is
18.3%, applicable to the award amount of $451,128.53 less capital expenses of
$34,003.40 for an indirect cost base of $417,125.13 and indirect costs of $76,333.90.
Indirect costs are unallowable by the terms of this Agreement (paragraph 16) and
$76,333.90 in indirect costs will be absorbed by the General Fund. There are no future or
ongoing contributions required after the grant period ends; however, property (items)
purchased with these funds must remain available to the Strike Force/Strategic Initiative for
the duration of its existence.
This is not a mandated function although it supports the MCSO public safety mandate and
provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in
Maricopa County and the State of Arizona resulting in a more safe and secure community.
This is a non-competitive award. The Maricopa County Sheriff’s Office is one of several
local law enforcement agencies in the Phoenix metro area that participate in this effort.

A that was distributed in February 2018 with an original total of $6,350,815.11 to a new
total of $6,383,019.90. This amendment is effective retroactive to July 1, 2017. The term of

places per A.R.S. §38-538.03 because these vehicles will be used to provide surveillance
and supervision of convicted felons residing in the community. Markings are detrimental to
the mission. These will be take home vehicles because surveillance and apprehension are
not regularly scheduled assignments with set hours. The vehicle information, including
make, model, year, color and VIN number will be provided to the Clerk of the Board upon
approval of this agenda and purchase of the vehicles.
These vehicles were previously leased by the state. They are now past their useful life,
have not been replaced by the state and were never part of the County’s vehicle fleet. They

In following the Policy, all easements, even those needed to provide utilities for the benefit
or support of park lands and facilities have been subject to the extensive public hearing
process. All facilities developed in a park must be in accordance with a park master plan,
which already includes a thorough public input and vetting process, including hearings by
the County Parks and Recreation Commission and approval by the Board of Supervisors.
In an effort to avoid duplication of efforts and potential results through the policy process
that may contradict with a park’s master plan, it is requested that these park specific
easements be exempted from the Policy.
The Policy was originally recommended by the Maricopa County Parks and Recreation
Commission on September 8, 1992 and approved by the Board of Supervisors on April 21,
1993 (PR-93-279). The current Policy was recommended by the Parks and Recreation
Commission on October 8, 1996 and approved by the Board of Supervisors on January 8,
1997 (C-30-97-017-6-00). The Parks and Recreation Commission recommended this
revision for approval by the Board of Supervisors at their August 21, 2018 meeting. This
revised Policy shall supersede all previously adopted Park Land Disposal policies. (C-30-

Isela Blanc, Arizona State Representative, commented on the Brett Kavanaugh
hearings and appointment on the national level. She stated Arizona was spotlighted
because the Maricopa County Attorney sent one of the County prosecutors who works
on sex crimes to the hearing. She questioned the intention of why she was sent. She
said the Board of Supervisors has the opportunity to hold the County Attorney
accountable.
Nicole Hill, resident, is concerned about Bill Montgomery who puts his politics before
justice and before his job. She said a recent example was his decision to send a County
prosecutor to the Kavanaugh hearings. Ms. Hill stated Mr. Montgomery has the power to
decide who or who does not get prosecuted. She said data shows increasing
incarcerations are not due to growth in population but because of bad policy decisions.
She quoted incarceration statistics and asked the Board to hold Mr. Montgomery
accountable with an investigation of his office.
107. SUPERVISORS'/COUNTY MANAGER'S SUMMARY OF CURRENT EVENTS
Resumen de temas de actualidad de los Supervisores/Administrador del Condado
Supervisor Gallardo noted the County Administration Building is being lit with purple
lighting at night in recognition of Domestic Violence Awareness Month. He noted his
concern about a hyper-partisan employee being sent to Washington D.C. He said there
is a need to look at what is in the best interest of the County and stay out of the issues

in Washington. He noted the first Coffee for Domestic Violence Awareness Month will
be Friday on the second floor of the Administration Building.
Supervisor Hickman thanked the inter-government staff for a good County Supervisors
Association (CSA) meeting in Yuma. There were discussions about rural issues and
plans to do something about them. He commented on his family business building an
inmate housing facility at their Arlington Farm. He stated some inmates being released
from prison were unable to provide probation officers information about where they are
going to live. The facility gives them a place to go and an address to use upon leaving
prison. He named several people he had invited to visit the facility and thinks this effort
comports with Smart Justice and is having an impact on people coming out of prison.
Supervisor Gates said he was in Washington D.C. last week representing Maricopa
County by serving on an intergovernmental advisory committee of 50 people from
around the country to advise the Federal Communications Commission (FCC) on the
development of 5G technology. The County is well-positioned to accommodate 5G
technology. He joined the Chairman with his comments about the Flood Control District
and their efforts during the record breaking rains in the month of October. They did an
amazing job.
Supervisor Barney commented that Maricopa County has become a leader in the area
of 5G technology. One of the communities was recognized when one of the
Commissioners from the FCC came into town to present an award to Mayor Jenn
Daniels of Gilbert for the work that is happening there. Governments are getting out of
the way for the expansion of 5G technology. He said 5G is going to be 100 times faster
than the current generation technology. He noted how united this Board is when it
comes to heightening awareness of Domestic Violence. He thanked Supervisor
Gallardo for his efforts in this area. The County is large and diverse, but he has
confidence the Board can unite on issues. Supervisor Barney noted the County civil
servants dedicated to working and serving the County residents. He noted Candice
Copple, Chief of Staff for District 1, is resigning and will become Chief of Staff for the
Mayor of the City of Mesa.
Chairman Chucri thanked the people in attendance today. He noted he attended his first
Vendor University meeting and thanked Kevin Tyne, Director, Procurement Services, for
attending. He recognized the Flood Control District efforts during recent rains. He
congratulated Candice Copple for her new position and wished her success.

08-034-1-01) dated June 3, 2009, executed administrative changes of the primary source
of water to be used in support of recreation and irrigation. Amendment Two (C-30-08-034-
1-02) dated June 23, 2010, executed administrative changes to the development, features
and phasing of the aquatic and amusement park, revised the legal description and
permitted the sale of alcohol to the general public. Amendment Three and additional
documentation provided (C-30-08-034-1-03) and C-30-08-034-1-04) dated November 26,
2013 effectuated the assignment from Harvest Family Entertainment – Arizona LLC to CLP
Phoenix AZ Waterpark LLC (CLP). By Consent to Assignment and to an Amended and
Restated Sub-Use Agreement (C-30-08-034-1-05 and C-30-08-034-1-06) dated November
16, 2016 and March 22, 2017, respectively, Maricopa County consented to the assignment
from CLP to EPR Parks, LLC and to an Amended and Restated Sub-Use Management
Agreement between Arizona Parks Holding, LLC and EPR for the operation of Wet’n Wild.
All underlying property interests will remain with Maricopa County and the District in
accordance with the Agreement. All terms and conditions of the Agreement remain
unchanged and in full force and effect. Six Flags Phoenix LLC has the management and
operations experience so that the aquatic and amusement park concession will continue to
be a viable recreational asset open to all persons of Maricopa County. Initial term of the
Agreement is from October 1, 2008, through September 30, 2033, with one (1) twenty-five
(25) year renewal option remaining remains unchanged. This is located in Supervisory
District #3. (C-69-17-023-8-01)

SERVICES FOR WHITE TANKS FRS NO. 4 OUTLET FACILITY PROJECT
Approve Change Order Number 2 for this Competition Impractical Procurement contract,
with Olsson Associates, in accordance with Maricopa County Procurement Code MC1-351,
which adds $200,000 and 230 days to the contract.
This project is a large diameter storm drain, approximately 3 miles long that will convey
stormwater flows from the District’s White Tanks FRS #4 dam to the District’s Loop 303
Outfall channel. Olsson Associates completed the Final Design plans and specs in 2012 for
the project under contract FCD2010C029. Due to the lack of funds for construction at the
time, the Design was “placed on the shelf” and the contract was closed in 2012.
The Competition Impractical Procurement process is necessary and practical to make the
Engineer of Record for construction the same as the Engineer of Record of the engineer-
sealed design documents. The current Competition Impracticable contract, for $150,000
with a 730 day duration, was established on December 6, 2017 for various post-design
activities. So far, this contract has been used to update plans and specs to address various
changed conditions and changed requirements of the cities of the project corridor.
The addition of $200,000 will provide for post-design support activities during construction.
The additional time will accommodate the delays of various utility companies in their
relocations for the project. This Agenda Item impacts Supervisorial District 4. (C-69-18-
017-5-01)
