AGREEMENT WITH THE ARIZONA DIAMONDBACKS FOR LAW ENFORCEMENT SERVICE Approve an Agreement for Law Enforcement Service between Maricopa County on behalf of the Sheriff’s Office and AZPB Limited Partnership, A Delaware limited partnership and AZPB FM Limited Partnership, A Delaware limited partnership retroactive to May 1, 2018 with updated costs that are effective December 1, 2018. This agreement ends December 31, 2019 with one automatic renewal period from January 1, 2020 through December 31, 2020. This Agreement reimburses the County for law enforcement service at events held at the Major League Baseball stadium and related grounds in downtown Phoenix, known as Chase Field. This is a labor-intensive agreement and costs recovered are for overtime and benefits; additional resources such as canines, horses, and specialized equipment; plus, an administrative charge of 3% applied to the monthly personnel total to support costs to manage and maintain this Agreement. The Diamondbacks are billed monthly for services incurred the previous month. The estimated annual value of this Agreement is $732,225. This contract may be terminated for cause with resolution within 30 days, and either party may cancel with 30 days written notice to terminate without cause. This agreement for law enforcement service is the successor to the agreement between Maricopa County and the Maricopa County Stadium District that was initiated with the opening of the stadium in 1998. (C-50-19-046-3-00) Motion to approve by Supervisor Hickman. Supervisor Hickman asked if the contract amount of $732,225 is the same as the previous year. Jim Prindiville from the Sheriff’s Office responded that the cost this year is slightly higher. The contract is not going through the Stadium District so direct costs were added to the agreement which may include the use of horses or any kind of equipment. Also, a 3% administrative fee was added which was not in previous contracts. Supervisor Chucri indicated his concern was that the contract be revenue neutral, which he had confirmed was the case. ~ Supervisor Gallardo entered the meeting in person ~ Motion seconded by Supervisor Chucri. ACCEPT FY2017 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) FUNDS Approve acceptance of $859,765 Federal FY2017 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-18- 054-M-00), on March 7, 2018. This has been a reoccurring grant for nearly 20 years and there is no cash or in-kind matching requirement. Indirect costs are not recoverable since the reimbursement formula calculation only allows for staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates. This funding is not competitive. There are no future or ongoing contributions required. This grant reimburses a portion of the costs for a mandated requirement--incarcerating undocumented criminal aliens who are convicted of felony offenses. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as determined by the Office of Management and Budget, will be stated in the electronic request to drawdown the funds not later than February 1, 2019. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. NON-BINDING MEMORANDUM OF UNDERSTANDING FOR THE CONCEPTUAL DESIGN OF THE EL RIO LAKE AT THE CONFLUENCE OF THE AGUA FRIA AND GILA RIVERS Execute the Non-Binding Memorandum of Understanding between the Flood Control District of Maricopa County (District), Maricopa County (County) and other partners for the Conceptual Design of the El Rio Lake at the Confluence of the Agua Fria and Gila Rivers, authorizing District to fund and manage consultants’ efforts in the preparation of preliminary concept schematics to include river stabilizing structures, subject to the availability of funding to the District. The County will 1) review project submittals; 2) participate in the permit process, scoping, consultant progress, stakeholder and public meetings; and 3) provide a no-cost right-of-way entry at Estrella Mountain Regional Park during project planning and designing. The District, in cooperation with its project partners, including the County, developed the El Rio Watercourse Master Plan (the “WCMP”) in 2006. The WCMP is a blueprint for flood mitigation, economic development, recreational amenities and habitat restoration on the Gila River between its confluence with the Agua Fria River and SR 85. Building on the WCMP, the District, Maricopa County and the Cities of Avondale, Goodyear and Buckeye cooperated in the development and approval in 2016 of the “El Rio Design Guidelines and Planning Standards” to supplement current development regulations with techniques that can increase awareness and appreciation of, as well as access to, the Gila River. The creation of the El Rio Lake is one of many recommendations developed as part of the WCMP. WCMP implementation activities have indicated the potential for previously mined areas adjacent to the river to capture sediment loads during flood events and thus endanger critical infrastructure both upstream and downstream by erosion and headcutting. By providing grade control and sediment management, the Lake would offer important public safety benefits. The Lake is envisioned as a demonstration project of components for the overall WCMP and El Rio Design Guidelines and Planning Standards. These components will include flood control elements, riparian habitat and river function enhancements, and active and passive recreational facilities developed through local and Federal partnerships. AMENDMENT TO AGREEMENT FOR RELOCATION OF MARICOPA WATER DISTRICT FACILITIES: CAMELBACK ROAD AT BEARDSLEY CANAL Approve an amendment to a Maricopa County Department of Transportation agreement with the Maricopa Water District (MWD) in order to establish and fund a draw account in the amount of $1,503,840.00 for MWD. This is for construction, construction observation and administration services necessary to relocate the irrigation facilities. This work must occur during this season’s scheduled canal dry-up in order to be out of conflict with Maricopa County Department of Transportation project TT0520 Camelback Road at Beardsley Canal. Maricopa Water District (MWD) has agreed to construct their own irrigation structure and well improvement in order to relocate their facilities outside the County’s road improvement project limits. An initial agreement was signed in March of 2017 in order to obtain MWD’s design/construction approval. Initially the Maricopa County Contractor was to construct these facilities for MWD as part of the road project. However, due to time constraints and construction logistics, having MWD forces construct during their scheduled dry-up was determine to be a best approach. In order to proceed they have provided an amendment to the initial contract and based on the final costs, requires formal Board approval. All other elements of the original agreement remain in place, the amendment provided by MWD allows them to perform the necessary construction work. The lowest responsive bidder exceeded the Engineer’s estimate by 11 percent. Per the original Board approval to construct: “Award the contract to the lowest responsive bidder, provided that the lowest bidder does not exceed the Engineer’s estimate by more than ten percent" (April 25, 2018, C-64-18-111-5-00). The Engineer’s estimate was $2,439,067. The low bid was $2,730,992, a difference of $291,925. County staff and consultants have reviewed the lowest bidder and have determined that the increase is due to regional cost increases to concrete, aggregates, asphalt, trucking expenses, and skilled labor costs. (C-50-19-043-G-00) Formal Meeting Minutes Wednesday, January 16, 2019 Page 46 of 63 The funding award is non-recurring and future operation funding for this program is not guaranteed beyond the date of the grant term. There is no match requirement. The Sheriff’s Office indirect cost rate for FY19 is 18.3% and is not applicable to the award as the total amount will be utilized for the design and construction expenses. In accordance with ARS 41-1706(B), authorize the following revenue and expenditure budget adjustment to the FY 2019 Adopted Budget: 1) Create a new Project MASH Building PetSmart Charities Design (MBPCD) in the Sheriff’s Office (D500) Donations Fund (203); 2) Increase the revenue and expenditure authority in the Sheriff’s Office (D500) Donations Fund (203) Non Recurring Non Project (NRNP) in the amount of $1,425,000 3) Decrease the revenue and expenditure authority in the Non Departmental (D470) Non Departmental Grant Fund (249) Non Recurring Non Project (NRNP) Unit 4711 in the line “Unassigned Contingency” by $1,425,000. These actions will have a net zero impact on the overall County budget. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. Sheriff Penzone explained that the Sheriff’s Office has been active in investigating cases of animal cruelty. The animals are evidence as part of a case, and it takes a special skill set to care for the animals. For nearly 20 years, the animals have been housed within the aging First Avenue jail facility. Sheriff Penzone presented photos of some of the animals housed at the facility and a video of an inmate program where they care for the animals at the facility. The program has proven to be beneficial to the inmates promoting rehabilitation of care and compassion for the animals, and a skill set that may provide opportunities for a future job. There have been many types of animals including cats, dogs, birds, horses, etc. Some of the animals have become adoptable. Sheriff Penzone explained the opportunity to provide a new environment for the animals and the foundational funding that would finance and build a new facility without the use of taxpayer dollars. The plan is to build the facility on the County’s Durango property. The location is beneficial because it is close to a large inmate population and additional inmate programs could be developed. The inmates involved could be suffering from post-traumatic stress disorder (PTSD) or recovering from drug addiction. Some of the inmates are juveniles who have been remanded as adults. The plan provides space for veterinary care on site. He spoke of an opportunity for inmate family visitations around the care of the animals. Sheriff Penzone noted his commitment to pursue the project. PetSmart Charities representatives were also present. Consultants reviewed the plans for the project including the feasibility of sustainability. The project will have a long-term benefit for the community. Chairman Gates thanked Sheriff Penzone for the presentation and explained that the Board is voting on an agreement that allows the acceptance of a grant from PetSmart Charities, Inc. There are a few minor details that still need work so an amended agreement will come back to the Board at a later date. He noted the importance of moving the item forward due to time constraints. Motion to approve by Supervisor Barney. Supervisor Barney thanked PetSmart Charities, Inc. He spoke about the program running for two decades, the importance of Smart Justice and fiscal planning. He noted the investment of a private donor to build a world-class state of the art facility without the Formal Meeting Minutes Wednesday, January 16, 2019 Page 47 of 63 use of taxpayer dollars. It will help to protect animals that were victims of criminal activity, but also help create runways of success for those that are incarcerated. Supervisor Barney spoke of how unique the project is, and the Board is choosing to move forward in a positive way. Supervisor Chucri echoed Supervisor Barney’s comments. He spoke of the County being one of the largest counties in America and the Board looking to be the Amazon of government by being agile and nimble to make projects such as this happen. He gave credit to Sheriff Penzone for bringing a case study of what government should be doing. He said this is a true partnership between private and public entities. He thanked PetSmart Charities, Inc. for their continued generosity. Supervisor Hickman said he appreciates the inmates’ testimonies and spoke of his experience of working with inmates for 22 years at Hickman Farms. He asked Sheriff Penzone if they have recidivism figures for the M.A.S.H. unit effects on the inmate participants. Sheriff Penzone responded they do not because most of the program ran on the heart of the employees with no established baseline. He said the collection of data would be conducted throughout the duration of the project to show the direct impact on recidivism and smart justice contributors. He noted the Sheriff’s Office becoming more data specific to understand what is and is not effective. Supervisor Hickman spoke of the importance of recidivism and smart justice to the Board. He asked if there are any inmate programs that may be incorporated into the County Animal Care and Control facility as well. Sheriff Penzone said the facility would be designed to facilitate positive programs as part of the Sheriff’s Office. He said as a County, it would be shortsighted not to invest in other programs that benefit the community by sharing resources and programs. Creating opportunities of crossover is part of the forward-thinking goals although the core responsibilities of the facility directly align with the mission of the Sheriff’s Office. Supervisor Hickman thanked PetSmart Charities, Inc. for their continued support. He spoke of his support on future necessary funds. He asked what changes are being considered to the Memorandum of Understanding. Chairman Gates said the changes are some minor word changes or clarifications to make sure everyone is in alignment with the expectations moving forward and noted the amendments will not be far from what has been provided in the past briefings. Supervisor Hickman asked “the changes are not substantive?” Chairman Gates and Sheriff Penzone agreed that the changes are not substantive. Supervisor Gallardo expressed his support and noted that it is a great step in moving forward with this project. He asked about the timeline and start date. Sheriff Penzone said an estimated cost of building the facility was previously done. With the acceptance of the grant funds from PetSmart Charities, Inc. it gives a platform to review the architecture and programmatic design options that meet the expectations. Once the Sheriff’s Office is able to raise 80% of the total amount then Stage 1 can proceed with development of groundbreaking. He is hopeful that within 90 days solicitation of the funds may begin. He envisions the facility will be completely built within 18 months to two years. Formal Meeting Minutes Wednesday, January 16, 2019 Page 48 of 63 Supervisor Gallardo concurred with the statement that this is a unique project. He spoke of the questions and thoughts when it was first introduced. He thanked staff for tackling the questions to make sure everyone was on the same page moving forward. He spoke of the great work of PetSmart Charities, Inc. throughout the valley. He spoke of the M.A.S.H. program and the project development outcomes. The program is being moved to the next level with this project by bringing in private donors to be a part of it. He noted the importance of seeing the final language moving forward. He is looking forward to the development of the project and thanked PetSmart Charities, Inc. for everything they have done for the County as well as many great organizations throughout Arizona. He noted the importance of the inclusion of smart justice and recidivism as part of the project. He also thanked all of the other funders that have noted interest in the project as well. Chairman Gates concurred with the previous comments and noted how grateful the Board is to PetSmart Charities, Inc. and the public/private partnership. This is a great example of smart government and smart justice focus. He thanked Sheriff Penzone for his leadership and willingness to obtain the funding so taxpayers do not have the burden. He said it is a great project that will benefit the public and will open additional opportunities for repurposing the current building being utilized by the program. The motion was seconded by Supervisor Chucri Ayes: Barney, Chucri, Gates, Hickman, Gallardo Chairman Gates noted the item passed unanimously. He thanked Sheriff Penzone and PetSmart Charities, Inc. NON-BINDING MEMORANDUM OF UNDERSTANDING FOR THE CONCEPTUAL DESIGN OF THE EL RIO LAKE Execute Non-Binding Memorandum of Understanding for the Conceptual Design of the El Rio Lake at the Confluence of the Agua Fria and Gila Rivers, authorizing the Flood Control District of Maricopa County (District) to fund and manage consultants’ efforts in the preparation of preliminary concept schematics to include river stabilizing structures, subject to the availability of funding to the District. The District, in cooperation with its project partners, developed the El Rio Watercourse Master Plan (the “WCMP”) in 2006.
