Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: October 9, 2019
Case #/Title: Z2019052 – The Element on Euclid
Supervisor District: 5
Applicant/Owner: William Lally, Tiffany & Bosco P.A/Ernest Linsenmeyer
Request: Zone change from Rural-43 to R1-6 RUPD
Site Location: Generally located at the northwest corner of 43rd Ave. and
Euclid Ave. in the Laveen area
Site Size: Approximately 21.9 acres
County Island Status: City of Phoenix
Additional
Comments: The purpose of the rezone with overlay is to accommodate a
future subdivision, which will have a density of 4.8 dwelling
units per acre. A RUPD overlay to allow for smaller lots than
what is traditionally found in the R1-6 zoning district. The RUPD
overlay request will allow for reduced minimum lot sizes,
reduced minimum lot widths, increased maximum lot
coverages, reduced minimum front yard setbacks, and
reduced minimum rear yard setbacks.
Staff received 11 letters of opposition. At the September 12th
Commission hearing a total of four (4) neighbors and two (2)
members of the Laveen Planning Committee spoke about
their opposition. The majority of their opposition centered on
the proposed 4.8 du/ac density and small lots with narrow
widths of the proposed subdivision.
Two (2) of the neighbors who spoke at the Planning & Zoning
Commission hearing mentioned the future subdivision would
be too close to their properties and that the proposed density
would be incompatible to the adjacent Rural-43 zoned
properties. Discussion at the Commission included proposal
to include an 80-foot wide landscape buffer with multi-use
trails along the northern and southern property perimeter.
In addition, during the September 12th Commission hearing
staff received an opposition petition with 34 signatures, in
oposition. Staff also received an Appeal of Planning & Zoning

Commission Recommendation signed by Laveen Planning
Committee Member, Phil Hertel.
Staff has calculated the support and opposition received,
and notes that a Super Majority Vote has been triggered. The
trigger is when 20% or more of property owners within a 300’
radius of the subject site, by number and area register
opposition to the case. The opposition received accounts for
14 property owners with an area of 498,029 sq. ft.
The calculations for The Element on Euclid are as follows:
42.07% opposed parcel acreage within 300’ buffer
22.95% opposed parcel numbers within 300’ buffer
Commission
Recommendation: On 9/12/19, the Commission voted 6-0 to recommend
approval of Z2019052 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall comply with the Zoning Exhibit entitled “The Element
on Euclid“, consisting of one (1) full-size sheet, dated July 9 ,2019, and stamped
received July 10, 2019, except as modified by the following conditions.
b. Development of the site shall comply with the Narrative Report entitled “The
Element on Euclid”, consisting of 13 pages, dated July 10, 2019, and stamped
received July 10, 2019, except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
1. A traffic impact study must be submitted with the preliminary plat
application.
2. Dedication of right-of-way along Euclid Avenue of 20 feet (to provide a
total width of 50 feet) and along 43rd Avenue of 55 feet (ultimate half-
width). Note that the above widths are considered minimum widths.
Additional dedication may be required pending improvements that may
be required by the Maricopa County Department of Transportation
approved Traffic Impact Study.
3. The preliminary plat application must indicate the realignment of Euclid
Avenue west of 43rd Avenue to better align with Euclid Avenue on the east
side of 43rd Avenue. Any associated right-of-way required to accomplish
this realignment must be dedicated as part of the subdivision plat.
d. The following R1-6 RUPD standards shall apply:
1. Minimum lot area of 4,600 square feet
2. Minimum lot width of 40 feet
3. Maximum lot coverage of 60%
4. Minimum rear yard setbacks of 20 feet
5. Minimum front yard setbacks of 18 feet for front facing garages

and 15 feet to livable or side loaded garages
e. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article
304.6 and A.R.S. § 11-814 for five (5) years for the initial phase and additional five
(5) years for each subsequent phase, within which time the subdivision
infrastructure permit for each phase must be obtained.
f. Prior to the issuance of residential construction permits, the applicant shall provide
Maricopa County Planning and Development Department with an executed pre-
annexation or service agreement with the City of Phoenix that identifies the
provision of water and sewer service. In lieu of pre-annexation or service
agreement, the developer must provide a ‘will serve’ letter from the certificated
water and sewer provider(s).
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, does not reduce any rights that existed
on the date of application to use, divide, sell or possess the property and that
there would be no diminution in value of the property from the value it held on the
date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.

Project Summary:
1. The applicant is requesting a zone change with overlay for an approximately 22-acre
vacant parcel from Rural-43 to R1-6 RUPD (Residential Unit Plan of Development). The
purpose of the rezone with overlay is to accommodate a future subdivision, which will
have a density of 4.8 dwelling units per acre. Another part of this request is to propose
variations to the R1-6 development standards, in order to allow a developer an
opportunity to create a neighborhood, which will be in concert with the preferences of
today's homebuyer in regards to property styles and amenities. To accommodate these
variations of the R1-6 development standards, the future developer will allocate
approximately 4.5 acres (20% of the entire parcel) of dedicated passive and active open
space, which will include a centralized park and a multi-use trail. The active open space
could allow for ramadas, barbeque area, or playground.
2. The site is located at the northwest corner of 43rd Ave. and Euclid Ave. in the Laveen area.
Currently, there is a pending Preliminary Plat (S2019026) for the subject property. The
applicant proposes a density of 4.8 du/ac, but the Laveen Area Plan designates the
subject parcel as Rural Density (0 - 1 du/ac). However, since the subject parcel is less
than 40 acres in size there is no need to amend the current Comprehensive Plan
designation.
3. The applicant is requesting, in addition to a zone change, a RUPD overlay to allow for
smaller lots than what is traditionally found in the R1-6 zoning district. The RUPD overlay
request will allow for reduced minimum lot sizes, reduced minimum lot widths, increased
maximum lot coverages, reduced minimum front yard setbacks, and reduced minimum
rear yard setbacks (see below).

4. The property itself has been farmland for over 90 years. There was a single-family home
on the subject parcel, which was removed from the property sometime in 1978. The
subject property is surrounded by established subdivisions. The subdivisions to the east
and west are in the City of Phoenix with average lot sizes of 8,000 square feet. Moreover,
the subdivision to the south and the lot splits to the north are in the County with average

lot sizes of 43,560 square feet (1 acre). On July 2, 2019, staff met with the applicant and
engineering firm in a Technical Advisory Committee (TAC) meeting to discuss this zone
change with overlay.

Adopted Plans:
9. Laveen Area Plan (adopted February 18, 1992): The subject property is designated as
Rural Densities (0- 1 du/ac), which is intended to foster single-family residences on large
lots and agricultural uses.
10. City of Phoenix General Plan: The subject site is designated as Residential (1 -2 du/ac),
which is intended to accommodate single-family residences on large lots.
Public Participation Summary:
The applicant completed the requirements for notification to all of the property owners
within 300 feet of the subject property and stakeholders. In addition, the applicant has
held neighborhood meetings to discuss this zone change with overlay and future
subdivision. During the applicant's public participation process, staff received four (4)
letters of opposition from neighbors and stakeholders. The majority of their concerns
center on overall density and lot sizes. The applicant has addressed these issues by
illustrating that this request is consistent with the development of this area and market
demand for this type of development. Other concerns concentrated on fears that dense
development adjacent to their parcels would invite crime or a large amount of rented
properties. The applicant countered these concerns by the fact that more housing and
active open space will add more witnesses to act as deterrent to prevent crime, fostering
a stronger sense of community.
Outstanding Concerns from Reviewing Agencies:
12. Planning staff received opposition from the Laveen Planning Committee. Their
opposition centers on the proposed higher density and preference to keep the density
at one (1) to two (2) dwelling units per acre. The applicant has been diligently working
with the Laveen Planning Committee to address their concerns.
Staff Analysis:
13. The proposed zone change with overlay request proposed by the applicant would be
situated in an ideal location for a medium density subdivision. One benefit is that the site
is adjacent to an arterial roadway. Another benefit is that the site is located within a half
a mile of Caesar Chavez Park with a variety of recreation areas and sports facilities. In
addition, the site is a mile from Caesar Chavez High School and quarter mile from
Cheatham Elementary School. This is a fast growing part of the Phoenix Metropolitan
area with shopping located two (2) miles northwest of the site and will be only 2.3 miles
away from the future South Mountain Freeway opening next year. The future subdivision
will be the perfect bridge between the Cheatham Farms Subdivision to the west and the
Z2019052

Montana Vista Subdivision to the east all with average lot sizes of 8,000 square feet.
Moreover, the future subdivision would follow the pattern of the Laveen area with low-
density residences mixed with higher density neighborhoods to allow for more diversity in
regards to housing stock, which has a tendency of increasing house values.
14. Many of the objections voiced by the concerned citizens and stakeholders centered on
the proposed density of the future subdivision. The applicant has addressed these
concerns in their public participation process, by demonstrating that there is a market
demand for this type of density. Many of the homebuyers surveyed mention they value
living in a place with a sense of community with a variety of amenities, in addition to a
variety of housing product. This is the intention of the applicant and the future developer,
to create a community, rather than a subdivision, which will offer over 4.5 acres of open
space offering a multi-use trail and a centralized park with amenities. Moreover, there
will be a variety of housing stock and floor plans. Many of the different house products
will contain many of the features homebuyers are looking for.
15. Both County engineering and environmental services have provided memos concerning
this request with no objections. Engineering had conditions for approval and are
included in the recommendations from staff. The City of Phoenix has been contacted
concerning this zone change with overlay request, but has not received any comment
for this request.
Recommendation:
16. For the reasons outlined in this report, staff recommends the Commission motion for
Approval, subject to conditions 'a' - `g'.
a. Development of the site shall comply with the Zoning Exhibit entitled "The Element
on Euclid", consisting of one (1) full-size sheet, dated July 9 ,2019, and stamped
received July 10, 2019, except as modified by the following conditions.
b. Development of the site shall comply with the Narrative Report entitled "The
Element on Euclid", consisting of 13 pages, dated July 10, 2019, and stamped
received July 10, 2019, except as modified by the following conditions.
Z2019052

In lieu of pre-annexation or service
agreement, the developer must provide a 'will serve' letter from the certificated
water and sewer provider(s).

1. Introduction and Purpose of Request
The developer, Meritage Homes, desires to develop a single-family residential subdivision located on
the northwest corner of the intersection of 43' Avenue and Euclid Avenue within unincorporated
Maricopa County. The site is identified as Maricopa County Assessor Parcel Number (APN) 300-12-016,
(See Appendix A: Parcel Map). The site is approximately ±22 gross acres of undeveloped land and is
currently zoned Rural-43 (RU-43). The site is a County island within the Laveen Area Land Plan, with
residential development to the east and west within the City of Phoenix.
To facilitate the development of the property, this application requests a rezoning from the current
zoning designation to Single-Family Residential Zoning District with a Residential Unit Plan of
Development (RUPD). (See Appendix B: Zoning Exhibit). The rezoning and development of this property
will expand housing opportunities for residents in an established and mature area of the County where
resources and infrastructure are in place to facilitate orderly and efficient growth.

2. Description of Proposal
The proposed deviations from the R1-6 development standards will allow the developer to create a
community that meets today's buyer preferences with respect to both product and community
amenities. In exchange for the proposed modifications to the development standards, the developer
will be able to allocate approximately 4.5 acres of dedicated open space. The open space will be a
combination of active and passive space, with a centralized park that may include a tot lot, ramada,
barbeque and other centralized amenities. The community will also feature a system of sidewalks that
promote walking and interconnectivity that lead to the centralized amenities. The community will also
feature significant buffers to the large lot residential to the north and south of the project, with a multi-
use trail planned for the south side of the project along Euclid Avenue.
This rezoning proposal will allow for residential development of the property, which is now an
underutilized and vacant field. (See Appendix C: Residential Unit Plan of Development). Below is a table
of the R1-6 development standards compared to the proposed R1-6 RUPD development standards:
1

** Lot Area per Dwelling Unit = total area of lots and open spaces, excluding all public and private
streets, divided by the total number of lots.
*** 10' Landscape tract provided at street-side yard between property line and Right of Way.
3. Relationship to Surrounding Properties
The proposed residential development will compliment these existing land uses by serving as a
transition between the residential development on the east and west sides of the property within the
City of Phoenix, and the unincorporated larger lot residential development on the north and south sides
of the property. This is because the proposed development standards will allow the developer to create
generous buffers around the community on the north and south sides, while creating a vibrant
residential community similar to those on the east and west sides.
The proposed development has been designed to be compatible with the below listed existing
surrounding developments. (See also Appendix D: Regional Context Map).
North: Residential lots (County, RU-43)
South: Residential lots (County, RU-43)
East: Monte Vista Subdivision (Phoenix, R1-8)
West: Cheatham Farms Subdivision (Phoenix, R1-8)
Location and Accessibility
This site is located at the northwest corner of Euclid Avenue and 43rd Avenue and is within close
proximity to the future Loop 202 freeway connection (See Figure 1), multiple schools, and various
recreational sites such as the Cesar Chavez Park to the northeast, South Mountain to the south, and the
Aguila Golf Course to the east.

4. Circulation System
The existing circulation system of the area supports the proposed single-family residential development
at this location. A Traffic Impact Study will be required at the time of Preliminary Plat. Access to the
public, internal streets will be provided via 43' d Avenue and Euclid Avenue. MCDOT is also requiring
realignment of Euclid Avenue at the intersection of 43' d Avenue and Euclid Avenue. The east half-width
right-of-way for 43"d Avenue will be 55-feet and the north half width right-of-way for Euclid Avenue will
be 20-feet wide (total of 50' Right of way). Additional improvements are anticipated along 43rd Avenue.
Please see the Appendix C for further detail.
Development Schedule
A phasing plan has not been established at this time; however, it is anticipated that this development
will be built in one phase.
5. Open Space and Amenities
This development will provide a centralized open space and amenity area, as well as large landscaped
areas along the northern and southern border to provide a buffer from the adjacent developments.
Amenities may include a tot lot, ramada, barbeques, and/or recreational fields. The site will also provide
an internal circulation system via sidewalks and pedestrian trails to promote walking and
interconnectivity. A multi-use trail is also planned to the south of the project along Euclid Avenue. The
proposed development will have one entry monument located at the 43' d Avenue entry unto the site.
the proposed monument will be designed and constructed per Maricopa Zoning Ordinance
regulations.
6. Community Facilities and Services
This development will be part of a Home Owners Association, which will be created at the time of Final
Plat. This association will own, manage, and maintain all common areas and open space facilities within
the development.
3

7. Public Utilities and Services
This application request will not adversely affect municipal and private facilities and services and will
not have an adverse effect on existing or future public and private open space, recreation, schools or
library facilities. The following list identifies public and private services for the development:
Water - City of Phoenix Telephone - CenturyLink
Sewer- City of Phoenix Cox Communications
Electric - Salt River Project (SRP) Cable/Internet - CenturyLink
Natural Gas - Southwest Gas Corporation Cox Communications
Police - Phoenix PD South Mountain Precinct Refuse - City of Phoenix
Maricopa County Sheriff's Office Schools - Phoenix Union High School Dist. #10
Fire - Laveen Fire District Laveen Elementary School District
8. Conclusion
Meritage Homes is excited to present what will be a vibrant residential community in Maricopa County,
offering a variety of housing types opportunities for families and individuals. The development team is
committed to ensuring the creation of a high-quality neighborhood. We look forward to working with
Maricopa County and progressing with this exciting project. The development team respectfully
requests your favorable consideration of this zone change request.

RE: Z2019052 - 43rd & Euclid Avenue
Dear Mr. Martell:
Hoping this communication finds you well. I'm writing to you regarding the proposed mass-
development planned at 43rd Ave and Euclid here in Laveen, AZ. Since this has been received
before the 10:00am Planning and Development meeting on July 2n 1 I hope this will be taken into
consideration along with the discussion.
Given the limited information I've been provided about the mass-development planned for the
said identified proposal I must advise against the proposition. Basic reasons being:
• Crime related to mass-development
• Traffic Infrastructure
• Responsible citizenship
• Economic Outlook
• Flood Management
Crime related to mass-development:
If you've noticed in Cheatham Farms, Montana Vista, Estrella Mountain View, Paseo Pointe,
Villages Of Laveen Ranch, Colvin Park Ranchettes, Rogers Ranch, Rancho Verde Estates,
Laveen Crossing, Montana Vista and several others have experienced its share of crime (see
statistics below). The key identifying facts of those communities lies within the fact that each of
them have tall —8-12ft walls surround the developments and homes on less than 7,000 sq ft lots.
Based on these two factors alone by allowing a development with a gross volume square foot of
land not exceeding 6,000 square feet is not an appropriate segue to the north/south development
of —1 acre parcels. The 8-12 ft walls allow for people to hide — which is rather contrary to
Laveen Estates and Laveen Estates East and several other subdivisions which are zoned RU-43
and further rural. Laveen Estates and Laveen Estates — East do not have high block walls and the
crime rates are generally lower (see statistics snipped below). All of these subdivisions have
noticeable increases in crimes — Burglary, Assault, Vehicle Theft, Theft, along with a share of
registered sex offenders.
Traffic Infrastructure:
Right now, the traffic on 43 1d Avenue generally isn't bad — overall. Have you been on 51'
Avenue and Baseline, 35 th Avenue and Baseline and 19rh Avenue and Dobbins Road at the peak
of "Rush Hour"? How about during the Holiday season? Locals are currently dealing with
"transplants" who are not familiar with local traffic, don't follow standard road rules and most of

all, who believe they can get away with texting, putting on makeup, shaving and general not
paying attention to the road or going 5-15 MPH slower than the posted speed limit. Additional
mass-development will exacerbate the existing issues with people moving to this area. Have you
been at 51st Ave and Baseline at 5:00pm on a Friday or any other day of the work week? Have
you experienced drivers being discourteous and moving through 43 11 Ave and Dobbins because
they cannot tolerate waiting in line? Have you been at 19t 1 Ave and Dobbins by the Montenegro
home at 6:45 am, waiting in a line with somewhere between 10-20 vehicles — and a majority
who're not quite sure what to do because they weren't paying attention? Let's talk Loop 202... I
am in full-support of South Mountain Loop 202 and have always been. However, that progress
solves a North-South Matter and will serve as a nice bypass to Phoenix. This does not solve the
East-West traffic issues we still expect to occur on the north side of South Mountain.
Have you recently been to Fry's Grocery at 51s t Ave & Baseline? How about after work hours
and Saturday afternoons? I prefer to shop there for reasonable prices on groceries, though the
volume of people is chaotic. Now I go to Safeway, where I can walk in, get what I need and walk
out. Given that Fly's is a choice location for grocery shopping adding additional mass-
development is only going to make shopping for good prices more difficult. And no, I refuse to
go to WalMart unless I absolutely require it.
Responsible Citizenship
If you've driven along Dobbins Road during "Irrigation", then you've surely seen the volume of
Polar Pop Cups gathered in the irrigation ditches along the abundance of debris collected unable
to pass through. As mass-residential comes into play I expect this to get worse. Quite frankly it's
disgusting as it is now. That irrigation water ridden with debris — yeah, I use that for my
property.
Let's discuss Fast Food. Laveen has KFC, Burger King, TWO Starbucks, TWO McDonalds,
Applebees, Popeye's Chicken, Church's Chicken, Dairy Queen, Sonic, Taco Bell, Papa John's,
Pizza Hut, Jack-In-The-Box, Dunkin-Donuts, Firehouse Subs, Subway... I'm not sure what else
I'm missing. The point being — how is having mass-residential development any different from
having mass commercial existent in the area — especially if Laveen's claim is [Close enough to
the city, but far enough away to be in the country]? That phrase is pointless should we continue
to allow for mass-development. I don't know many people in their right mind who would rely on
fast-food dining for a majority of their diet. Laveen needs more mass-residential development
just like it needs more fast food (Hint, it doesn't).
Economic Outlook:
2006-2008 found the mass construction happening in Laveen yielded many empty homes for a
few years. Developers were desperate due to the economy quickly falling into decline. As a
result investors had buyers who ultimately bought-out into selling-out to renting and/or Section 8
renting to mitigate their economic circumstances. The section 8 renting continues to this day
which I suspect has some volume to do with the crime increases over the last decade. As the
national debt is reaching its peak, the economy is bound to reach a drop. That among all is a
clear reason not to make haste with regards to development.

Flood Management
In Monsoon season, have you been on 47 th Avenue? As my neighbors who have been here since
the mid-1970's the flooding my neighborhood encountered has been at its peak in the recent
years with the increase in development. While I don't deny the expertise of the Flood District,
what I see is the long-term residents who have experienced the differences where the only
variable has been an increase in population. Given this is a predominant concern among my
long-standing neighbors it sounds as this is a call for a re-evaluation for more effective flood
water management. It's rough on 43r d Ave during July — September — how is having more
residents at that location going to circumvent existing issues? Every year, there are several
drivers who believe they can cross a flood — the most laughable was last year when I witnessed a
corvette stuck slightly due east of Del Monte Market at 27 th Ave & Dobbins.
Subjective and Conclusion:
If a development is going to happen at 43' Ave and Euclid Ave, then IF it cannot be at an Acre
parcel development level then I would hope that it would be double than the existing Proposed
RU 1-6 RUPD. Property being at 6,000 sq ft lots to me reflect something that of what I would
find in Central Phoenix (such as 20th Street and Campbell) — where we moved from to get away
from neighbors being that close to us — and, to be in the country where we can be more
encumbered from tractors traveling along Dobbins Road versus an increase in people. We moved
out here to get away from crime and the city life — not to have it eat us up. Laveen was and is
meant to be a place where it should be a get-away from City Life, and to allow 6,000 square foot
parcels to further encumber the area will ensure the death of the vibrancy of the area. The
vibrancy of the area relies on it being classified as "rural". Like the Laveen claim, [Close enough
to the city, but far enough to be away in the country].

Dear Mr. Martell,
My family and I have been proud residents of Laveen for 15 years and in the South Mountain area for nearly
20. With some of the recent rezoning we feel the need to share our voice with many of those that moved here in
the first place.
I grew up in the Phoenix area (nearly 50 years) and Laveen has always been known in the Phoenix area as the
'rural' part of town. I know first hand how Laveen residents have grown to love the last stronghold of rural
living in the area, just come to our annual parade and see!
The radical, high density being proposed lately by developers attempting to stay "in-town" is
unacceptable. We're not opposed to development but a proposal of one acre, single family density to over 10
single family units per acre is RADICAL!
We oppose this proposition and we wanted you to know how we feel about it.
Sincerely,

Hi Martin,
I would like to voice our concerns about the rezoning of this area.
First this area of laveen and Maricopa county is very unique. It has managed to maintain rural character and a country
small town feel, where you know your neighbors. We have a sense of pride for the community; unfortunately as more
houses are being built and the density increases this has mostly had a negative impact with the area. We have higher
crime rates; especially burglaries.
We urge you to maintain this rural community by lowering the density allowed to be built in this new development.
Keeping in a line with the larger lots in the immediate area. Many people are looking for larger lots and they are far and
few between these days with all the new developments being built.
We are residents in this area and own two properties.
We are also concerned about our property values changing with all the new developments.
Please consider maintaining this rural community and maintain the standard of larger lots.
Respectfully,
Thomas and Nicole Glasgow

Subject: Re: Z2019052 Zoning Change at 43rd Ave 8t Euclid
Mr. Martell,
I am emailing prior to the July 2nd meeting as I am unsure if I will be able to attend due to an out of town work
commitment; however, I felt the need to state my objection to this rezoning at least in this manner in hopes it
will help persuade the county to reconsider this effort.
While it is true that the site is partially bound by R1-8, due to the site shape and orientation, only about 1/3 of
the total site perimeter actually abuts this zoning. The remainder is either RU-43 or is buffered from R1-8 by
43rd Avenue. This rezoning, given the adjacent RU-43, is not in keeping with the neighborhood character.
Ideally this area would be preserved as RU-43 to push developers to move outside the bounds of the cramped
subdivisions and instead explore larger lots for the growing demographic of urban farmers that are desperately
seeking these kinds of properties.
Laveen and this portion of Maricopa County has never been like the other Phoenix "suburbs". We are the rural
child, and it's time the boom in development is held to that ideal. The coming of the 202 has opened up this
portion of the valley like never before, but it does not mean we need to cave to the developments seen in other
areas. This area has the potential to become so much more than infill and as a resident I hope the County will
consider this potential before proceeding. As a resident living in this area and experiencing the push by
developers, our neighborhood has seen many changes relating to these kinds of developments. They have not
largely been a positive experience. I understand that RU-43 may not be possible for the County to maintain, but
the community hopes that if rezoning is imminent, it will include R1-35 & 18 as an alternative in order to
maintain the feel of the community and provide a more gradual transition zone.
All the best and thank you for your time.

Mr. Martell,
This is regarding the case at 43rd Ave and Euclid in Laveen that you have recommended approval on.
There are several issues with this case that I don't believe have been considered or maybe you have
received the wrong information on.
To begin with, the Laveen Planning Committee has not received notice of, nor reviewed this case and
the applicant has not presented to us. In the staff report under number 12 it states that the "applicant
has been working diligently with the LPC to address their concerns". This is absolutely false. The fact
is a few of the LPC members have met with the applicant in a casual setting to discuss the case. The
applicant was told that 45 foot wide lots were not acceptable for this area the that the density had to
be significantly lower. They were told that in fact that 45 foot wide lots were not currently being
approved anywhere in Laveen especially in the middle of an area that has 1 to 2 acre ranchettes. The
applicant responded with a new site plan with 40 foot wide lots. This hardly addresses out issues.
That is the ONLY thing the applicant has offered.
Contrary to your item 11, this is NOT consistent with development in the area. There is nothing with
this kind of density currently, nor is there anything like this being built. Additionally your County plan
shows this for 0-1 DUA and the City municipal plan shows this as 1 to 2 DUA. As a member of the
City's Laveen Village Planning Committee, we planned the surrounding developments on those
numbers and have approved cases accordingly.
You item number 14 states that the applicant has demonstrated there is a market demand of this
future subdivision. That is not accurate. In fact at the most recent LVPC meeting realtors spoke to the
market demand in Laveen. These were not comments about market demands in general but were
specific to Laveen. These realtors spoke of home buyers wanting properties with large lots and a
feeling of openness. Both new and pre-owned home buyers did not show and interest in small lots
with small yards but wanted back yards large enough for swimming pools and generous side yard
setbacks.
I will provide you with a petition that every single adjacent occupied resident, EVERY one, has signed
in opposition to this application. That is 100% surrounding opposition.
There is no mass transit (City buses) along 43rd avenue to serve this community and all retail is
around two miles or further away. And there is no opportunity for any to build.
1

I have discussed with the various City departments annexation of this site. Planning, Water and
Streets have all told me this property could easily annex into Phoenix if they want to develop it.
So I am requesting that this case be denied as filed and that the property should be required to annex
into the City for obvious reasons including not adding a further burden to the Sherriff's Department
and other County services to monitor it.
This case has not been formally presented to any community groups or had any public meetings in
Laveen. Therefore I am not sending this letter as representing any group. I am submitting this
personally but with my years of experience I would expect that the opinions of these groups would be
very similar to what I have stated.
If you have any questions I can be reached at: 602-276-3200 office, 602-397-3200 cell, or

Subject: Zoning case Z2019052
I oppose the development of this area in small lots of less than 2 houses per acre. This is a county island that will be
surrounded by 1 to 2 acre properties and should remain larger lots for both the strain on the local fire, Sheriff's
department and the neighborhoods surrounding it. Placing such high density housing in this area will cause 43rd Ave to
be inundated with heavy traffic and lead to possible safety issues with the local schools and residents. This area was just
hit by the City of Phoenix packing people into tiny houses just north of this property and that looks as though the area
will already have an additional 600 households occupying the area. I would have attempted to oppose that but didn't
even receive notification that it was being rezoned. I was told when I bought my place that the surrounding areas
around these properties would be scaled to match the larger properties we own and would not exceed 2 per acre per
the Laveen planning committee now I find that was not correct and can be changed to high density housing on a whim. I
believe that this type of housing should remain closer to the new freeway and in fact is being placed there now with the
multiple developments I see popping up. Please stop overcrowding this area.

As owner of one acre adjacent property, R-43, I object to the proposed density of case Z2019052-The
Element on Euclid. If the zoning is changed to R1-6, it would cause irreparable damage to the quality
of life and value of adjacent properties.
The property under consideration is surrounded by rural properties with livestock, which will conflict
with a high density development. We hereby protest the request to change the zoning from R-43 to
R1-6.
The proposal to build this development in the middle of a county island will create many problems for
surrounding property owners, Laveen village, and the city of Phoenix.

Dear Mr. Martell,
We are writing to express our opposition to the upcoming zoning case listed above. The proposed lot sizes are
too small. Surrounding lot sizes are either 60 foot lots in the City or 1-2 acre lots in the County. The proposed
development would be better positioned near the new loop of the 202 freeway.

Subject: Opposition to case #22019052
For reference: I own the property located at 4335 West Ardmore Rd., Laveen AZ 85339
I would like to express my opposition to this rezoning for several reasons.
I do not approve of the apparent fact that the Laveen Village Planning Committee has not been involved in this
development at all.
I feel the density is adding far too much stress to an already overpopulated and over traveled 43rd ave. It is
very difficult at peak time to get out of our street as it is during peak times.
I feel the lot sizes are far to small to be compatible with the surrounding neighborhoods and recent approved
developments nearby have substantially lower densities than what is being proposed.
I am not aware of one adjoining property owner that is not in opposition to this rezoning.
I will be out of the state on the 12th of September as I am taking my 5 year old son to Disneyland on his
birthday. Should you have any questions or concerns please let me know via my cell phone at 602-370-4847 or
via email.
Thank you for your attention to this matter.

Subject: Opposition Statement Z2019052
Mr. Martell,
As a resident living directly across the street south of the 43rd Avenue and Euclid rezone property, we strongly
oppose the current plan. Following reflect our concerns:
• The lot sizes are significantly smaller than the norm in Laveen and will decrease value of homes in the
surrounding area.
• Density is not compatible with the immediate area which is larger lot/ranch style homes with horse
property. Density of the type suggested is more appropriate for newer developments closer to the new
freeway.
• The Laveen Village Planning Committee has publically stated that they are against this development
based on the suggested density. Further, public hearings have been held to allow the Laveen community
to provide input.
Again, we oppose this rezoning as currently planned.
Thank you
