Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: August 21, 2019
Case #/Title: MCP2018006 – GT Hauling
Supervisor District: 4
Applicant/Owner: John Shinske, Desert Development Engineering, LLC/Grady
Watkins
Request: Military Compatibility Permit (MCP) with a precise Plan of
Development (POD) for commercial storage of vehicles
Site Location: Generally located approximately 1,230’ west of the SWC of
Olive Ave. & Litchfield Rd. in the Glendale area
Site Size: Approximately 2.5 acres
County Island Status: City of Glendale
Additional
Comments: There was one document of opposition received from the
adjacent neighbor to the west of the subject site. There are
no outstanding concerns from reviewing agencies.
Commission
Recommendation: On 7/25/19, the Commission voted 6-0 to recommend
approval of MCP2018006 subject to conditions ‘a’ – ‘f’:
a. Development of the site shall comply with the Site Plan entitled “Site Plan - GT
Hauling”, consisting of 2 full-size sheets, stamped received May 31, 2019, except
as modified by the following conditions.
b. Development of the site shall be in general conformance with the Narrative Report
entitled “GT Hauling Narrative Report”, consisting of 6 pages, stamped received
May 21, 2019, except as modified by the following conditions.
c. The following Engineering condition shall apply:
1. The owner shall provide and dedicate to the public a total half-width of
right-of-way for the following roadway:
Olive Ave. 65 feet
d. The owner shall construct a minimum 6’ (h) solid wall along the east, west, and
south property lines.

e. The applicant/property owner shall submit a ‘will serve’ letter for fire protection
services for the project site. A copy of the ‘will serve’ letter shall be required as
part of the initial construction permit submittal.
f. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due
to the failure to comply with any conditions, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held
on the date of application due to such revocation of the MCP. The MCP enhances
the value of the property above its value as of the date the MCP is granted and
reverting to the prior zoning results in the same value of the property as if the MCP
had never been granted.

Project Summary:
1. The applicant is requesting a MCP with a precise POD for commercial storage of vehicles.
The site is an approximately 2.5 acre parcel (501-42-027A) and is located west of the SWC
of Olive Ave. and Litchfield Rd. in the Glendale area. The subject site has an existing
single-family residence and accessory structures to remain.
2. The site is zoned Rural-43, with Military Airport and Ancillary Military Facility (MAAMF)
Overlay Zoning District. The site is also within the statutorily defined high noise or accident
potential zone of LDN 80-84 noise contours for Luke Air Force Base (AFB). A Use
Compatibility and Consistency Determination (UCCD) has been issued for the proposed
land use with UC2016011, determining the proposed land use is compatible and
consistent with the high noise or accident potential of the military airport or ancillary
military facility.
3. The proposed operation would consist of 12 large commercial parking spaces located
at the southwest portion of the parcel. There are a total of 10 employees. Business hours
will be from 6:00 a.m. to 4:00 p.m. Monday-Friday. There will also be 10 parking spaces (1
ADA) for employees to leave their personal cars on-site while they are off-site with the
commercial vehicles. Compacted gravel will be used for all parking areas where there
will be an asphalt driveway (32’ wide) connecting to Olive Ave.
4. The applicant/owner have agreed to construct a 6’(h) block wall along the west, east,
and southern portion of the property to help mitigate noise and visual disturbance from
the proposed operation to the adjacent neighboring properties. There will be no
monument signage proposed and no light poles on site. It should be noted that the
property has had previous code violations for having a business on-site without
entitlements but those violations have since been closed.

Right-of-Way:
7. The following table includes existing and proposed half-width right-of-way and the future
classification based upon the Maricopa County Department of Transportation (MCDOT)
Major Streets and Routes Plan.
Street Name Half-width Existing R/W Half-width Proposed R/W Future Classification
Olive Ave. 33’ 65’ Principal Arterial
Adopted Plans:
8. White Tank/Grand Avenue Area Plan (Adopted 2000): The subject site is designated as
Military Compatible, the proposed uses for the site are consistent with the land use
designation.
9. City of Glendale General Plan (Adopted 2016): The City of Glendale General Plan
designates the site as Luke Compatible Land Use Area. The land use designation is
described as areas that are delineated by the 1988 JLUS 65-70 Ldn noise contour. The
plan supports the state legislation related to the operations of the military facility and
discourages residential and other noise sensitive land uses within the Luke Compatible
Land Use.
Public Participation Summary:
10. The applicant has complied with the Maricopa County Citizen Review Process with the
required posting of the site. The applicant did not receive any inquiries from the public.
Lastly, the applicant provided staff with a “Citizen Participation Results Report” which
explains that all requirements were met. Staff sent notifications to 300’ neighbors
regarding the case specifics and the related hearing information.
11. Staff received 1 document of opposition (attached) on 7/12/19 from the adjacent
neighbor to the west of the subject parcel. They stated issues with a commercial truck
business being in a residential area, noise from the trucks, and working on the trucks when
they need repairs.
Outstanding Concerns from Reviewing Agencies:
12. As part of the MCP process, County agencies review the site plan for technical details
associated with their discipline. With respect to the site plan MCESD and MCSO had no
comments or concerns regarding the site plan (attached). Engineering provided a
condition of approval to dedicate a total half-width right-of-way of 65’ where 33’ half-
width is existing.
Staff Analysis:
13. Staff recommends approval of the MCP application. Luke AFB determined the proposed
use is compatible and consistent with the high noise or accident potential of the military
airport or ancillary military facility. Staff appreciates the applicant working with staff to
help mitigate noise and visual disturbance of the commercial vehicles by including a 6’
(h) solid wall. There are existing residences to the west and south of the subject site. Also,
MCP2018006

the proposed land use would otherwise need industrial zoning or entitlement where it
would be required by the zoning ordinance to have screening between the subject site
and rural and residential zoning districts.
14. The property to the east of the subject site is currently undeveloped agricultural land
where further development of the parcel would not allow residential due to LAFB
restrictions. Staff is thus not concerned with such a large undeveloped 72-acre parcel
being affected by the subject request. Staff understands that there is opposition from the
neighbor to the west, which is closest to the proposed commercial parking area and has
an existing residence. However, this residence is currently located closer to the north side
of the property and not immediately adjacent to the parking area where there would
be screening between the two properties.
15. As stated within the narrative report, there are no on-site operations other than
employees parking their personal vehicles to take the commercial vehicles offsite for their
jobs. Thus, there is no need for water services. The existing house on the property will
remain as a residence.
Recommendation:
16. For reasons outlined in this report staff recommends the Commission motion for approval
with conditions ‘a’ – ‘f’ of MCP2018006.
MCP2018006

of application.

1.0 Purpose of Request
This report has been prepared to assist GT Hauling in obtaining a Military Compatibility
Permit with a Precise Plan of Development. This report addresses proposed site design
and uses. Refer to the Site Plan when reading this report.
2.0 Description of Proposal
GT Hauling is a cargo and freight company with ten (10) employees. Their operating
hours are Monday — Friday, 6:00am to 4:00pm. The project will include a gravel parking
area, approximately 256'X51' in size, along the southwest fence. This area is large
enough to hold a maximum of twelve (12) large commercial vehicles. Additional
compacted gravel will cover the remaining site except basins will not have gravel and
existing residence will not have gravel. No additional dust control needed. Gravel is a
significant improvement over existing conditions which has almost no dust control. A 32'
paved commercial driveway will be added to tie into Olive Avenue. Two (2) existing,
non-livable, storage trailers will be permitted with this request as well.
There will be no monument signage on-site. Owner will place a small sign on the north
portion of property to include emergency contact information if needed by the Maricopa
County Sheriff's Office.
There will be no light poles on-site, as this site is for commercial vehicle storage only.
Ten (10) parking spaces will be provided for employee parking. Nine (9) of these spaces
will be gravel parking and standard 18'X9' in size. One (1) space will be asphalt paved
and 18'X12' to satisfy ADA requirement. Employees will leave their personal cars on-
site while they are off-site with the commercial vehicles.
6' block walls will be constructed along the west, south and east property lines to
provide visual screening and noise mitigation.

3.0 Relationship to Surrounding Properties
The existing site zoning is RU-43 Military Airport and Ancillary Military Facility Overlay
Zoning District 80 LDN. The north portion of this site houses a single-family residence.
The single-family residence and its associated improvements are to remain. The
remaining portion of the site is undeveloped. GT Hauling purchased this property in
October 2012 for the sole purpose of parking commercial vehicles. There have been no

Re: Case 1/MCP2018006, GT Hauling (APN 501-42-027A)
Dear Mr. Banker
Thank you for the opportunity to provide comments on the Military Compatibility Permit
Application Case IIMCP2018006, GT Hauling. The site is located on 2.5 acres at 14103 W. Olive Ave. in
Waddell, AZ. The proposed use of the property will be for storage of large commercial vehicles. The site
is located inside the 1988 JLUS 80 LDN, "high noise or accident potential zone" as identified by
A.R.S. § 28-8461 and is within the "territory in the vicinity of a military airport" also defined by
A.R.S. § 28-8461.
As described, this facility will not negatively impact the flying operations at Luke AFB. Since
the storage facility will be located within the "territory in the vicinity of a military airport," it will be
subjected to approximately 170 over flights per day. We recommend you review the sound attenuation
requirements found in A.R.S. § 28-8482. We also recommend a strong notification program on the part
of the applicant to inform any potential tenants about Luke AFB operations.
If you have any questions, please contact my Community Planner, Mr. Christopher Toale, at
(623) 856-6175.
Sincerely
JAMES R. MITCHELL

Ray,
Luke AFB does not find it necessary for the applicant to apply for a new UCCD to request up to 12 vehicles. The ARS 28-
8481 authorizes vehicle parking at his site and does not place any restrictions on the number of vehicles. No further
information is required for Luke. Thanks.

Violation Description Case # MCP2018006 - GT Hauling This home is next door to
my home. We are to be residential acres here, and business's
are moving in each side of me. If parking commercial trucks,
they need to rent or buy a commercial piece of land, zoned for
that purpose. G T Hauling owners are probably very nice
people, but they have had their trucks here before! What
happens is all the drivers arrive or people drop them off early,
early mornings, ...then if a truck won't start or has a flat tire
their shop opens and mechanics WORK on them, soon after
they had a full shop going out back. A truck has run thru my
fence in past years, hitting my water line and putting my home
OUT of water while repairs are made. The noise is unreal at all
hours of the day and night. I can not be at the hearing in
downtown Phoenix because of health issues, just want to voice
our objections to this being next to my HOME for over 30yrs!
