For the Maricopa County Board of Supervisors Hearing for August 21, 2019 regarding the proposed formation of the Nancy Kay Irrigation Water Delivery District Good Morning. My name is Janice Mannke and I have owned and resided at 3634 N. 28 th Place, Phoenix, AZ 85016 since August 1994. I am registering my opposition to the formation of the proposed Nancy Kay Irrigation Water Delivery District (IWDD) at a hearing on August 21, 2019 to determine whether the creation of the proposed district will promote public health, comfort, convenience, necessity or welfare. The reasons for my opposition are as follows: • It does not promote public health, comfort, convenience, necessity or welfare for all owners; • It benefits the owners that have access to the irrigation pipes by offering water at a very low price to water their yards; • It benefits those owners that flood their yards covered with grass and encourages owners to maintain grass yards rather than converting to desert landscaping; • It promotes the use of our water that is scarce and this water should be provided to farmers for their crops as originally provided when the irrigation system was created. If owners desire grass yards and irrigation they should maintain the system at their expense. Even if the irrigation pipe runs across a property that owner should not be obligated to make repairs for the benefit of the neighbor that desires access to the irrigation pipe to water their yard. I supposedly have an irrigation pipe across my front yard (I have desert landscaping—rock yard) but it stops at my property line to the South. I do not want the iffigation water for my yard. My previous neighbors (Dave and Linda Grate) attempted to locate and hook up to the irrigation pipe that ends in my yard but were unable to locate the pipe after digging with a ditch witch. On many occasions I have seen the irrigation water running like a river out of the owners' yards and down the street (Weldon and 28 th Street). Specifically on 8/7/19 at 8:06 am water was flooding the south side of Weldon and continued south on 28th Street. This is a waste of valuable water and this occurs often when the owners do not manage their time to take the water delivery. I would like to see a corrected packet of information to include the Exhibits marked properly as B, C, and D. They are currently unmarked in the packet we were sent on 8/1/19. QUESTIONS FOR THE MARICOPA COUNTY BOARD OF SUPERVISIORS: Please explain why there is conflicting information regarding the Special Taxing District Impact Statement Paragraph "A", fourth paragraph. ....the location at which irrigation water will be obtained will be on the South West corner of 30th St. and Clarendon Ave." but SRP states through its representatives Aaron Day, Field Service Liaison and Sonia Lipkin, the water is delivered to 32n d St. and Clarendon Ave. All repairs to the pipes from 32nd St. and Clarendon to our neighborhood would be the responsibility of the neighborhood and the IWDD funds for repairs could not be used. It would have to be covered as it is now—the individual owners. Any required repairs to the pipes from 30 th St. and Clarendon through the neighborhood would be covered by the IWDD funds. This is important because it needs to be correct as to how many feet of irrigation pipes the owners and the IWDD must be responsible for and not SRP. This Impact Statement bases its estimates of the change in tax rate on the pipes being 5,515 feet when in fact, it may be much more depending on where SRP delivers the water. If the Nancy Kay Irrigation Water Delivery District is created I am requesting that it be required that the Bylaws must set a ceiling on the amount the taxes can be increased annually for the delivery system. I also am requesting that my property be excluded from this Special Taxing District due to the facts that the pipe cannot be located in my front yard and I do not use the irrigation water and the line stops at my southern property line. No one benefits from this pipe south of my property. Thank you for your time and consideration to determine whether the creation of the proposed district will promote public health, comfort, convenience, necessity or welfare for the owners of property in that district.
