AUTO BODY REPAIR; CARS AND LIGHT TRUCKS (190233-S) Approve the contract for award at an estimate of $1,600,000.00 over two (2) years until May 31, 2021 with four (4) additional years of renewal options. The effective date of the contract will be May 8, 2019. The purpose of the contract is to provide to Maricopa County a multi-vendor contract with qualified providers for automobile repair for County owned passenger cars and light trucks. This contract will cover all accident claims over one- thousand dollars per vehicle. However, the County may at its option choose to utilize this contract for vehicle repairs under one-thousand dollars. (C-73-19-027-3-00) It is requested by the Risk Management that the Board of Supervisors approve the subject award to the Lowest Responsible Responsive Bidder as recommended. Courtesy Chevrolet GMPH One, Inc. DBA: Southwest Collision Chairman Gates stated there was a speaker request form in opposition from Mr. Raymond Mobilia. Raymond Mobilia, Ace Auto Collision and Paint Services, stated his company has had the Auto Body Repair contract with Maricopa County for the last 5 years. When the Request for Proposals (RFP) was opened, he was unable to attend the pre-bid mandatory meeting, and consequently, Procurement Services rejected his bid. He stated that only two companies bid on the contract and believes that Procurement should resubmit the RFP to attract additional qualified contractors. He stated that the two bids received were very high and Mr. Mobilia believes that Maricopa County would save money if they solicited additional bids. Chairman Gates asked if his colleagues had any questions. Supervisor Hickman asked if there was a representative from Procurement Services available to speak. Supervisor Hickman asked to have the process explained. Joey Molina, Supervisor with Procurement Services, came forward to explain the online BidSync program that the County uses to solicit bids. The Bidsync application generates thousands of invitations for vendors to respond to open bids and is usually open for 14 days. There is a mandatory pre-bid meeting the vendor must attend in order to submit bids under the BidSync program. Supervisor Hickman asked what the reasoning was that Mr. Mobilia’s bid was rejected. Mr. Molina reiterated that part of this solicitation process is a mandatory pre-bid meeting the vendor must attend that gives more details of the specific job to be conveyed to the end user. Chairman Gates asked Mr. Molina if it would create any problem if one of the Supervisors asked to have this item continued to the next meeting. Mr. Molina responded that it would not create any major problems. Formal Meeting Minutes Wednesday, May 08, 2019 Page 28 of 42 Mr. Mobilia acknowledged that it was the mandated pre-bid meeting that he missed which caused the bid to be disqualified. Supervisor Hickman said he is familiar with the BidSync process and acknowledged there are two valid bids in place. He commented on the possibility of an unfair advantage for a vendor who has seen the other bids and is allowed to rebid, putting the other vendors at an unfair disadvantage. He agrees on the importance of getting multiple bids for contracts. He acknowledged that Ace Auto Collision has had the County contract for a number of years and has participated in the BidSync program. Supervisor Hickman does not want to create an unfair “rebidding” process. Supervisor Hickman asked Joy Rich, County Manager, for her input. Ms. Rich is in favor of a continuance in order to review the circumstances with an eye toward fairness. She said this topic has come up in her office in the past and this will offer an opportunity to review the process. She acknowledged that she does not want to create a disadvantage for those who have complied with the process. Supervisor Chucri commended Supervisor Hickman for his insight on the subject. There is a process for bidding set out by Procurement Services. He agrees on the importance of not giving unfair advantage to one vendor over another and supports a continuance to review the nuances of the item. Supervisor Gallardo echoed the comments of Supervisors’ Hickman and Chucri. Motion to continue to the May 22, 2019 meeting by Supervisor Hickman, seconded by Supervisor Chucri Ayes: Sellers, Chucri, Gates, Hickman, Gallardo 34.
