Report to the Board of Supervisors Prepared by the Maricopa County Planning and Development Department Board Hearing Date: July 31, 2019 Case #/Title: Z2019005 – I-10 & Citrus IUPD Supervisor District: 4 Applicant/Owner: Tiffany & Bosco P.A. / Nora Jo Beth and Charles R Sullivan Request: Zone change from Rural-43 to IND-2 Industrial Unit Planned Development (IUPD) for outdoor storage and billboard Site Location: Generally located 320’ northeast of Latham St. and 182nd Dr. in the Goodyear area Site Size: Approx. 1.84 acres County Island Status: N/A Additional Comments: There was one letter of opposition received. There are no outstanding concerns from reviewing agencies. The Commission recommendation included revised language to condition ‘e’ and new conditions ‘j’ and ‘k’: e. The IUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. A Plan of Development application for outdoor storage shall provide a private access easement to the property to the east or west, and additional landscape buffering along the east and west property lines including a mix of 2-inch and 3-inch caliper trees placed every 20-feet with 5 shrubs per tree. j. A Plan of Development shall be applied for only a billboard or outdoor storage as allowed by the IUPD overlay. No other commercial or Industrial uses are permitted. July 31, 2019 Z2019005 Page 1 of 3 k. No access other than for single family residential uses or for the construction and maintenance of outdoor advertising shall be off of 182nd Drive. Commission Recommendation: On 6/13/19, the Commission voted 8-0 to recommend approval of Z2019005 subject to conditions ‘a’ – ‘k’: a. Development of the site shall comply with the conceptual Site Plan entitled “I-10 & Citrus Billboard”, consisting of two full-sized sheets, stamped received May 29, 2019, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “I-10 & Citrus Rd.”, consisting of seven, dated May 17, 2019, and stamped received May 29, 2019, except as modified by the following conditions. c. The following Planning Engineering condition shall apply: 1. A single Plan of Development must be submitted to include the billboard and the outdoor storage use. The Plan of Development application must include an engineered grading and drainage plan and a signed and sealed Traffic Statement. d. The following IND-2 IUPD standards shall apply: 1. Side Yard abutting Rural zoning: 3’ 2. Maximum Off-Site Sign height: 61’ 3. Maximum Off-Site Sign area: 672 sq. ft. 4. Illuminated Sign to Rural Residential Zoning: 0’ 5. Screening waived along north property boundary e. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. July 31, 2019 Z2019005 Page 2 of 3 h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. j. A Plan of Development shall be applied for only a billboard or outdoor storage as allowed by the IUPD overlay. No other commercial or Industrial uses are permitted. k. No access other than for single family residential uses or for the construction and maintenance of outdoor advertising shall be off of 182nd Drive. Owner: Nora Jo Beth and Charles R Sullivan Request: Zone Change from Rural-43 to IND-2 Industrial Unit Planned Development (IUPD) for outdoor storage and billboard Site Location: Generally located 320’ northeast of Latham St. and 182nd Dr. in the Goodyear area Site Size: Approx. 1.84 acres Density: N/A County Island: Goodyear County Plan: White Tank/Grand Ave. – Industrial Municipal Plan: Goodyear – Neighborhood Municipal Comments: None received to date Support/Opposition: None known Recommendation: Denial Z2019005 Page 1 of 9 Project Summary: 1. The applicant is requesting to rezone the subject site from Rural-43 to IND-2 IUPD for outdoor storage and a billboard. The purpose of the Industrial Unit Plan of Development (IUPD) zoning overlay is to vary certain standards, as well as limit the uses to those permitted IND-2 uses that do not require sewer. On November 16, 2016 a complaint was submitted regarding a business being run in a residential area and a violation case was initiated by staff (V201601686). The complaint was verified shortly thereafter and the matter was brought before a Civil Hearing Officer on September 28, 2017, wherein the respondent was found responsible with fines imposed. A Compliance Agreement was later executed on April 19, 2019 to include that by May 31, 2019 the Respondent submit all applications necessary to resolve commercial business issues on the property. In filing for the requested rezone on January 9, 2019 the Respondent met this deadline. Lastly, the Compliance Agreement included the payment of a compromised fine amount and investigation fees on April 30, 2019. The applicant is resolving a long term zoning violation created by the property owner. 2. It should be noted that conditions of approval from engineering include that as part of any approval, a precise Plan of Development be submitted to include an engineered grading and drainage plan for retention, as well as a Traffic Statement. The current application proposes outdoor storage for construction vehicles, boom trucks, drill rigs, pump rigs, semi-trucks with trailers, boats, and equipment. Vehicles will range from 6-12’ (h) and stored equipment not to exceed the height of view obscuring fencing. Some materials will be kept in the shop/warehouse. 24 10’ x 50’ parking spaces are provided. No employee parking spaces are needed as there will be no employees. The outdoor storage facility would be available from 5:30 a.m. to 5:00 p.m. The southeast portion of the property contains a residence and accessory building with parking related to the residence. 3. The property currently includes an approximately 2,839 sq. ft. residence, 1,821 sq. ft. garage/shop, and 933 sq. ft. shop totaling 5,593 sq. ft. The lot coverage as proposed would be approximately 7%. No outdoor lighting is being proposed. An illuminated off- site billboard is also being proposed to be located in the northeastern portion of the property to setback 0’ from the north property line. The applicant is also requesting a total sign height of 61’ and sign area of 672 sq. ft. One parking space will be provided for the billboard tech. 4. The proposal includes a 6’ CMU wall along the along the east, west, and south property boundaries. The proposal seeks a waiver of required screening and to allow the existing chain link fence to remain along the north property boundary, where a 6’ CMU wall is required by the MCZO. The site currently abuts Rural-43 zoned property to the north, east, west, and south. Site access will be provided from 182nd Drive to the southwest. Z2019005 Page 2 of 9 Site Plan excerpt 5. Water: Arizona American Water Co. Wastewater: Septic School District: Buckeye Union Fire: City of Goodyear Police: City of Goodyear Right-of-Way: 8. No additional right-of-way is required, as the subject site is lot 21 within the Marwest Estates subdivision. Adopted Plans: 9. White Tank/Grand Avenue Area Plan (Adopted on December 6, 2000): The area plan designates the site Industrial, which allows for industrial uses. The proposed base zoning of IND-2 (Light Industrial Zoning District) is in concert with the land use designation. In addition, based on the limitation of the permitted uses with the IUPD, staff considers the Z2019005 Page 5 of 9 request to be inconsistent with the general policies requiring urban services for urban uses within an existing residential subdivision. 10. City of Goodyear General Plan: Staff notes that the Goodyear General Plan designates the subject property as Neighborhood. As of the writing of this report, the City of Goodyear did not send a response for this application. Public Participation Summary: 11. The applicant has complied with the Maricopa County Citizen Review Process with the required posting of the property and notification by first class mail to adjacent property owners within 300’ of the subject parcel and interested parties. The applicant did not receive any opposition to the proposal during the public participation process. Staff has received no calls or letters of support/opposition as of the writing of this staff report. Outstanding Concerns from Reviewing Agencies: 12. Engineering Plan Review has no objections provided conditions are made part of any approval. Those conditions have been added at the end of this report for the Commission’s consideration. Staff Analysis: 13. This is a request for an industrial zone change with varied development standards relating to setbacks, screening, and signage abutting rural/residential. The subject site is located within a county island surrounded by the City of Goodyear which, per Arizona Revised Statutes, requires that the County consider the Goodyear General Plan and related standards as a guideline when evaluating requests for zoning changes and land subdivision. ARS §11-814 G – The rezoning or subdivision plat of any unincorporated area completely surrounded by a city or town shall use as a guideline the adopted general plan and standards as prescribed in the subdivision and zoning ordinances of the city or town after April 10, 1986. 14. Staff sent Goodyear materials detailing this request and no comments were received. The City of Goodyear General Plan shows the site and surrounding area to be ‘neighborhood’. The Neighborhoods Category within Goodyear’s General Plan is described to include a wide range of densities and is broadly defined to include ‘public and community facilities that support and compliment the neighborhood such as schools, places of worship, parks, public safety facilities, and commercial uses at appropriate intensities and locations’. Staff believes that allowing the rezoning request to IND-2 within a platted residential subdivision be contradictory to the City’s General Plan. 15. A purpose of this Industrial Unit Plan of Development (IUPD) zoning overlay is to limit the uses to those IND-2 permitted uses that do not require sewer, such as the proposed use of the subject site. Typically, the County requires that urban rezoning projects be serviced with urban services such as sewer. The IUPD will also deviate IND-2 development screening standards along the northern property boundary that is adjacent to a strip of Rural-43, but also adjacent to the I-10. The IUPD will also include a 3’ side yard setback Z2019005 Page 6 of 9 where the base standard is 5’. The existing garage is 3’ from the side property boundaries, which is allowed under the current Rural-43 zoning; however, the rezoning of the property to IND-2 brings with it the increased side yard setback of 5’. The proposed billboard will also require deviations from standards in that the setback from the north property line that abuts Rural-43. The proposed illuminated billboard will be 0’ from the north property line when such billboards are required to be 150’ from Rural-43. Staff notes however that the 150’ is met to the west/Rural-43 boundary where there are single-family residences. The proposed would be 96.57’ from the east/Rural-43 property boundary; however, while the property to the east is zoned Rural-43, there is also a Special Use Permit (Z2010082) covering the site for a mini-storage facility. Lastly, the applicant is requesting the proposed billboard to be 61’ in height and 672 sq. ft. in area, as the proposed would be adjacent to an elevated freeway, thus the need for increased height. The increased area is requested to allow safer visibility and to be consistent with a number of similar billboards in other jurisdictions. 16. Staff is of the opinion that especially as the request stems from a zoning violation, a more appropriate request would be for a Special Use Permit (SUP) for interim industrial uses with a 10 year timeframe, which would not allow the proposed billboard, but would be more appropriate due to no entitlement obtained for use. Staff met with the applicant on December 11, 2018 and informed the applicant that a rezoning request would not be supportable and further suggested application for a SUP for interim industrial with a maximum 10 year timeframe for the interim industrial use. It is also worth noting that the southeast portion of the parcel would remain residential and the request is essentially spot zoning on a single parcel within a platted residential subdivision that was recorded on July 3, 1972. The rezoning to industrial would also create a situation wherein industrial uses would be utilizing streets within a residential subdivision. Therefore, staff is unable to support the request. 17. Staff is concerned the verified violation was for the commercial storage of RVs and automobiles without proper zoning entitlement. The IND-2 IUPD proposes continued storage of industrial vehicles. Staff is also concerned with the industrial vehicle traffic accessing the site through local residential streets. The only access to the site is from a cul-de-sac. Recommendation: 18. For the reasons outlined in this report, staff recommends the Commission motion for Denial of Z2019005. 19. However, if the Commission choses to recommend approval, staff offers the following conditions ‘a’ – ‘i’ for Commission consideration: a. Z2019005 Page 7 of 9 c. The IUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. f. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. Cannelback Rd., Phoenix, AZ 85016 TABLE OF CONTENTS 3 THE PROPERTY 3 PURPOSE OF REQUEST 3 DESCRIPTION OF PROPOSAL 5 THE IUPD REQUEST MEETS MCZO REQUIREMENTS 5 PROPOSED IUPD DEVELOPMENT STANDARDS 5 RELATIONSHIP TO SURROUNDING PROPERTIES 6 BENEFIT TO SURROUNDING AREA 6 RECENT DEVELOPMENTS IN THE AREA 7 LOCATON AND ACCESSIBILITY 7 DEVELOPMENT SCHEDULE 7 COMMUNITY FACILITIES 7 PUBLIC UTILITIES AND SERVICES TB TIFFANY & BOSCO 2 The Property The property address is 1135 N 182nd Dr. Goodyear, AZ 85338 and is identified as Maricopa Assessor Parcel Number 502-37-154A (the "Property"). The Property is 80,166 square feet (1.84 acres) in size and is generally located along the Interstate 10 Freeway (the "1-10") just west of Citrus Rd. Nora Jo Beth and Charles R. Sullivan own the Property and there is currently a residence at the Property. The Property is located within unincorporated Maricopa County (the "County") and is zoned as RU-43. Please see Exhibit la and lb for aerial of the Property. Purpose of Request Tiffany & Bosco (the "Applicant") requests a rezoning from RU-43 to 1nd-2 IUPD to operate an outdoor storage use and to construct an off-site advertising sign (the "Billboard") with: 1) an increased height of the off-site sign (Maricopa County Zoning Ordinance (the "MCZO" §1404.3.2(2)) from the allowed 30' to 61'; 2) an increased area of the sign from the allowed 300 square feet (MCZO §1404.3.2(1)) to 672 square feet; 3) a decrease in the required rear yard setback from 25' to 0'; 4) a reduction of the setback from a rural zoning district from 100 feet to 0 feet (north); and 5) a reduction in the setback for an illuminated off-site sign when adjacent to rural or residential zoning from 150 feet to 0 feet (north). Description of Proposal The majority of the Property will be utilized as an outdoor storage use, which will include the storage of construction vehicles, trailers, boats and equipment. Construction vehicles shall include but not be limited to: • Pickup trucks • Semi-trucks with trailers • Pump rigs • Drill rigs • Boom trucks (truck mounted crane, single unit vehicle). • Vehicles will range from six to twelve feet in height and twelve to twenty five feet in length. • Stored equipment shall not exceed the height of a view-obscuring fencing. • The stored equipment shall include but not be limited to 1" x 20" pipe, small material relating to pumping industry to be housed in the warehouse, and small drill tools to be kept in the back of the trucks or on trailers in the yard. • There will be no additional buildings at this time. Any driveway and parking areas will be treated for dust suppression with gravel or decomposed granite per County standards. The parking on the southeast portion of the site will only be used for the residential. No outdoor lighting is proposed for the outdoor storage use since all activities will take place during the daylight hours. The Billboard lighting will be powered by standard electrical lines and will be equipped with down lighting. The down lighting adds an extra 6-feet in height to the board and is included in the requested height. The apex of the sign is less than 54" and the outside "v" is 45 degrees. TIFFANY TB & 0 S 0 3 P. A. Typical hours of operation for the proposed outdoor storage use will range from 5:30 am to 5:00 pm in the summer, and from 7:00 am to 5:00 pm in the winter. Under the MCZO, the development of a Billboard is limited to 30' in overall height, 300 square feet in size and must maintain a 25' setback from the southern property line. Due to the unique surrounding conditions of the Property, the 1UPD requests that the Billboard be allowed a modification of the development standards so that it is more compatible with surrounding properties and more viable for the owners as described below. Billboard Height The 1-10 Freeway adjacent to the Property is already elevated above the height of the Property grade. Additionally, there is a freeway center median barrier wall and ADOT freeway signage in the view corridor of the billboard. The elevation of the 1-10 Freeway with respect to the grade of the property, the ADOT signage, and the center median barrier creates a visibility issue that makes it extremely difficult to see a 30' billboard placed on the Property for traffic heading westbound and eastbound. Additionally, the property is located approximately 150' away from the eastbound lanes and 215' away from the westbound lanes of the 1-10 (See Exhibit 2). In order to make the Billboard visibility effective, the Applicant requests to increase the height of the sign to 55'. The request for the sign to be 61' in height includes the 6' down lighting structure on top of the sign. This requested height allows the Billboard to be read from traffic traveling along the mainline of the 1-10, thus protecting its intended use. Exhibit 3.a through Exhibit 3.c demonstrates various crane tests showing the lack of visibility of a 16' billboard sign to both east and west bound traffic on the 1-10 as described above. The crane was placed out at the Property at 16' and 41' in height to measure the necessary height of the Billboard. The crane top was not visible to passing traffic heading northbound until the crane reached 41' in overall height. The requested height is the minimum sign height for the sign to be read safely by passing traffic. Furthermore, the exhibit demonstrates that the crane at a 16' height is barely noticeable for traffic heading westbound. When the crane was lifted to 50' (See Exhibit 4.a & Exhibit 4.b), it was adequately visible for traffic heading westbound. The County recently changed the requirements for illuminated off-site signs to require down lighting. The lighting arms that are installed on the off-site signs are required to be 6' above the off-site sign in order for the lights to properly light the off-site sign face. This results in the lowering of the sign structure by 6 feet to make the entire structure conform to the any required heights. Based on the crane test described above, a reduction of the actual Billboard signage below 50' would create visibility issues for the Billboard due to the location of the sign. Thus, the requested height increase is 61' to accommodate the additional lighting arms above the 55' actual signage face. As described herein, the location of the Property and increased levels of the 1-10, ADOT freeway signage and freeway center median requires the additional height requested. Billboard Size The request to increase the size of the Billboard to 672' square feet and a reduction in the setbacks to 0' will allow for the Billboard to be safely viewed by passing traffic. The sign at 300 square feet is not visible to traffic heading both east and west bound for the distance away from the traffic TIFFANY TB & BOSCO 4 P. A. lanes. The increased size of the Billboard faces will increase the visibility of the sign, making it safe for passing traffic to read the sign with minimal effort. This request would allow the Billboard to be the same size as the recently constructed billboard signs located to the north adjacent to the I- 10 & Perryville. (Z2013033). Setback Reductions The reduction of the setback from a rural zoning district from 100 feet to 0 foot (north) and the reduction in the setback for an illuminated off-site sign when adjacent to rural or residential zoning from 150 feet to 0 feet is necessary for the Property to accommodate a Billboard with viable visibility from the 1-10 freeway. These setbacks will be 0' to the north, 96' to the east and 150' to the west. The Billboard will be a center mount design, and will be constructed out of steel. As explained above, the Property is ideally located for off-site advertising due its proximity to the I- 10 freeway and located near U-Haul's new outdoor storage and indoor storage facility located to the adjacent property to the east. Having a residential use along a major freeway, and near an outdoor/indoor storage creates a unique circumstances where reducing the setback has no effect on the rural (RU-43) zoned property to the east since the use on the property is also industrial in nature. The purpose of this setback requirement is to protect residential homes that exist and that may be developed in the area. The existing industrial use will not be negatively affected by a reduction of this setback request. Billboards in Surrounding Area The closest billboard is approximately 1,500 feet north across the freeway, and to the west. The closest billboard on the south side of the freeway is approximately 4 miles to the east on City of Goodyear property. The IUPD Request Meets MCZO Requirements The requested height and size increase is permitted by the IUPD process. Specifically, the MCZO states "the purpose of the Industrial Unit Plan of Development is to allow variations in development standards in industrial projects that require special design techniques or flexibility due to topography, innovative project design, or other considerations." The Billboard at 30' in height is not visible to passing traffic due to the construction of the raised 1-10 freeway and the additional elevation of the freeway center barrier wall. The unique circumstance requires a special design technique in order for the Billboard to be visible to its intended audience (passing traffic along the 1-10). Increasing the height of the Billboard to 61', allowing the increase in size to 672 square feet and reducing the required setback will restore the intended use of the off-site sign. No additional deviations are necessary and the MCZO will be complied with in all other respects. The location of the Property is compatible with these requirements and is supports this IUPD request. Proposed IUPD Development Standards Industrial Unit Plan of Development Base Zoning District Proposed Zoning District Regulation Regulations (1ND-2) Regulations (IND-2 1UPD) Off-Site Sign Height 30' 61' Off-Site Sign Max Size 300 square feet 672' Rear Yard Setback 25' 0' Setback to RU-43 100' 0' Setback to RU-43 for illuminated off-site sign 150' 0' 6' CMU Wall adjacent to East, West, and South Property Lines 6' CMU Wall Adjacent to — screening waived along north Screening Residential Zoning property line adjacent to 1-10 Relation to Surrounding Properties The surrounding parcels of the Property consist of RU-43 and industrial zoning uses and districts. The surrounding uses of the Property are industrial and residential uses. The development of the outdoor storage and Billboard will be consistent with the surrounding industrial uses and typical along freeways. The Billboard will help benefit local businesses in the area by providing them with an advertising display to target vehicular traffic in the general area. North —1-10 Freeway. No adverse effects are expected. South — Residential. No adverse effects are expected. East — U-Haul outdoor/indoor storage facility. No adverse effects are expected. West — Residential. No adverse effects are expected. There are no other off-site advertising signs located within 1,000' along the I-10Freeway. Benefits to Surrounding Area The approved Plan of Development and 1UPD will benefit surrounding properties and the valley in general by taking large construction equipment off freeways during peak driving times, and otherwise eliminating unnecessary vehicle trips that currently emanate from an east valley location. The Billboard will serve the purpose of an identification sign for businesses by targeting traffic along the 1-10 Freeway coming into Phoenix Metro and going out of Phoenix Metro. Businesses TIFFANY & BOSCO 6 that are located in the Buckeye, Goodyear and Avondale areas will now be able to advertise its location to this potential traffic and receive the benefit of more business. Recent Developments in the Area This area has been a mix of industrial (Waste Management Recycling Facility, U-Haul Storage Facility) and residential for a long period of time. Recently, there have been properties to the north and east that have been rezoned or have received Use-permits for various industrial uses have been developed along the 1-10 freeway. Waste Management and other industrial users have developed various types of industrial uses in the area. It is anticipated that this area will continue to be developed with other industrial uses over time. Location and Accessibility The Property access is located along N 182nd Drive and is approximately 80,166 square feet in size. The Property has full access with a cul-de-sac at the end of 182nd Dr, from Citrus Rd which is an exit from the 1-10 Freeway, which allows for vehicles to have accessible ingress and egress to the Property. The tech parking for the Billboard does not need to be close to the Billboard since all the tech needs is the vinyl to install the new billboard ad. The tech can simply carry the vinyl from the parking that will located on the property to the Billboard location to install the ad. Development Schedule The applicant anticipates that site development will occur as soon as possible. Once the permit is issued by the County, the structure will be ordered and delivery will be within 4 weeks of the order date. The construction process can be done in two days. The Billboard structure itself is delivered fully fabricated and will need to be installed. The Billboard will be built in two days, and in one phase. The outdoor storage facility will be constructed and the property will be fenced in with additional screening. Community Facility and Services N/A Public Utilities and Services Sewer — The Property currently does not have any sewer source. An onsite septic system that meets all the County requirements will ultimately service the project for those uses that require it. Water—The subject site is within the service area of Goodyear. Power — Salt River Project is the electricity provider for the area. M TIFFANY &BOSCO 7 T. A.
