AMENDMENT NO. 1 TO
FACILITIES USE/REVOCABLE LICENSE AGREEMENT
BETWEEN
TEMPE UNION HIGH SCHOOL DISTRICT NO. 213
AND
MARICOPA COUNTY
RECITALS
A. This Amendment No. 1 (“Amendment”) to that certain Facilities Use/Revocable License
Agreement No. P-50308 dated June 14, 2017 (“Agreement”) is made and entered into by
and between Maricopa County, a political subdivision of the State of Arizona (“Licensee”)
and the Tempe Union High School District No. 213, a political subdivision of the State of
Arizona (“Licensor”). The Agreement is for premises located at 500 West Guadalupe
Road, Tempe, AZ 85283, (the “Property”), consisting of two classrooms, playground
space, and meeting/common area on the Property (the “Premises”) for Early Head Start
Program use.
B. The term of the Agreement expires on June 30, 2019.
C. Licensor and Licensee now mutually desire to enter into this Amendment to extend the
term of the Agreement, update Licensee notice address and Licensor notice and remit
address, and revise Article 4 of the Agreement.
NOW THEREFORE, Licensor and Licensee in consideration of the foregoing and other good
and valuable consideration, the sufficiency and adequacy of which the parties acknowledge,
Licensor and Licensee agree to amend the Agreement as follows:
AGREEMENT
1. The Recitals, by this reference, are hereby incorporated into this Amendment.
2. Capitalized terms used in this Amendment without definition shall have the meanings
assigned to such terms in the Agreement, unless the context expressly requires otherwise.
3. The term of the Agreement is hereby extended two (2) years, from July 1, 2019 to June 30,
2021. The Amendment is effective upon the full execution by the parties. This Agreement
is subject to termination pursuant to the provisions of A.R.S. §38-511, the provisions of
which are incorporated herein by this reference.
4. Section 4.1 of the Agreement is deleted in its entirety and replaced with the following:
4.1 Licensor agrees to provide Licensee use of the Premises for an annual cost of:
4.1.1 $1,560.00, which represents costs for custodial and site supervision
service during summer closure periods; and

4.1.2 $968.00, which represents costs for HVAC during summer closure periods
5. In the event of any program changes or modifications that may be agreed to by both parties
pursuant to the Agreement, the annual cost specified above may be adjusted and modified
by written amendment to the Agreement signed by both parties.
6. All notices herein required shall be in writing and transmitted by certified mail, return
receipt requested and sent to the following addresses. Requests for payments to be given
to Licensee and all payments herein required shall be sent to Licensor at:

7. This Amendment may be executed in one or more counterparts and the signature pages
combined shall constitute one document.
8. The foregoing paragraphs contain all the changes made by this Amendment. All other
terms and conditions of the original Agreement shall remain the same and in full force and
effect.
