Lease L-7459 Amendment No. 2 C-86-15-094-4-02 AMENDMENT 2 TO LEASE AGREEMENT L-7459 Between RANDOLPH P. HIGH and KATHLEEN M. HIGH, Trustees of the HIGH REVOCABLE TRUST, U/T/D August 4, 1992, as amended and restated, LESSOR And MARICOPA COUNTY, LESSEE RECITALS A. Lessor and Lessee are parties to that certain Lease Agreement No. L-7459 dated April 26, 2015 approved by the Maricopa County Board of Supervisors and subsequently amended June 14, 2018 by the Maricopa County (the “Lease”). The Lease is for premises at 6641 E. Baywood Avenue, Mesa, AZ 85206, consisting of approximately 4,000 square feet of office and clinic space. B. The term of the Lease expires June 30, 2019. C. Lessor and Lessee now mutually desire to exercise the 2nd Option Term to the Lease, extend the term of the Lease and adjust the annual rent schedule. AGREEMENT NOW THEREFORE, in consideration of the foregoing and other good and valuable consideration, receipt and sufficiency of which is hereby acknowledged, Lessor and Lessee agree as follows: 1. The term of the Lease is hereby extended three (3) years commencing July 1, 2019 and shall expire June 30, 2022. This Lease is subject to termination pursuant to A.R.S. § 38- 511, the provisions of which are incorporated herein by this reference. This Lease may be terminated by Lessee at the end of any fiscal year due to non-appropriation of funds without any penalty or liability to Lessee. County and state fiscal years end June 30, Federal fiscal year ends September 30. 2. Lessee agrees to pay as rent, in equal monthly installments, the sums as follows: Year Rate __ Monthly Annual Period Five $16.00/sf $5,333.33 $64,000.00 7-1-2019 to 6-30-2020 Six $16.50/sf $5,500.00 $66,000.00 7-1-2020 to 6-30-2021 Seven $17.00/sf $5,666.67 $68,000.00 7-1-2021 to 7-30-2022 The above rent includes applicable taxes and operating expenses. 3. The effective date of this amendment is the date of execution by Maricopa County. Lease L-7459 Amendment No. 2 C-86-15-094-4-02 4. The foregoing paragraphs contain all the changes made by this amendment. All other terms and conditions of the original agreement and subsequent amendments thereto will remain the same and in full force and effect.
