Dear Ms. McCarroll:
Pursuant to Arizona Revised Statutes § 16-558(A), a sanitary district may conduct its board of
directors' elections by mail ballot if the governing board of the district obtains approval from the
board of supervisors of the county in which the district is located, prior to publishing the call of
election. Fountain Hills Sanitary District hereby requests permission from the Maricopa County
Board of Supervisors to conduct a mail ballot election for the November 5, 2019 Fountain Hills
Sanitary District election of directors.

RESOLUTION NO. 277
A RESOLUTION OF THE
FOUNTAIN HILLS SANITARY DISTRICT,
BOARD OF DIRECTORS
CALLING FOR A NON-PARTISAN ELECTION
ON NOVEMBER 5, 2019
WHEREAS, Title 16, Chapter 2 of the Arizona Revised Statutes requires Sanitary
Districts to call for an election at least 120 days in advance and that Sanitary District
elections be conducted on one of four dates during the year; and
WHEREAS, an election is necessary for the purpose of filling three directors seats
whose terms are due to expire December 31, 2019.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE FOUNTAIN HILLS SANITARY DISTRICT, as follows:
1. Purpose and Date. A non-partisan election of the Fountain Hills Sanitary
District is called for November 5, 2019 (the first Tuesday after the first Monday in
November) for the purpose of electing three persons to the Board of Directors of the
Fountain Hills Sanitary District, Maricopa County, Arizona for a term of four years to
commence January 1, 2020.
2. Nominating Petitions. All candidates for directors shall file nominating
petitions with the District Secretary at 16941 E. Pepperwood Circle, Fountain Hills,
Arizona, no later than Wednesday, August 7, 2019 at 12:00 p.m. Nominating petitions
will be made available at the District Office commencing May 22, 2019.
3. Voter Registration. The last day to register to vote in this election is
Monday, October 8, 2019 at 11:59 p.m.
4. Publication of Notice. The District Secretary shall prepare, publish and
post such notices as required by law, and take such steps and perform such acts as may
be necessary to duly conduct said election.
5. Cancellation of Election. The election is subject to cancellation pursuant to
A.R.S. § 48-2010 in the event only one person or no person files a nominating petition for
each opening on the Board of Directors.
PASSED AND ADOPTED by the Board of Directors of the Fountain Hills
Sanitary District on the 22 nd day of May 2019.
