BOARD OF SUPERVISORS - JUNTA DE SUPERVISORES
Chairman Chucri took a moment to acknowledge the death of U. S. Senator John
McCain. He invited the Board Members to share their experiences with Senator McCain.
Supervisor Gates stated how thrilled he was when he received a phone call
from Senator McCain when Supervisor Gates was appointed to the Phoenix City
Council in 2009. He shared the visit Senator McCain made to PING and the amount of
time he spent talking and connecting with the production employees.
Supervisor Barney stated he has had the privilege of knowing Senator McCain for a
number of years. He said that as much ground as he covered, Senator McCain had the
unique ability to bring people together. The Senator had the ability to stay focused and
objective in his endeavors and Supervisor Barney stated he learned so much from
Senator McCain’s great example and tireless service.
Supervisor Hickman stated Senator McCain was the dominant example when he was
beginning to frame how he viewed politics and government service. Supervisor Hickman
shared when he first met the Senator visiting his office and discovered the Senator
knew more about agriculture than he himself did. He said he appreciated the Senator’s
service and offered his condolences to his family.
Supervisor Gallardo noted he had a professional relationship with Senator McCain. He
noted how the Senator took on some of the most controversial issues in our time. His
allegiance was to human decency and not to a political party. He did not cave to political
pressure and probably did more for the State of Arizona than any other elected official
he can think of. Supervisor Gallardo stated it is up to us all to teach the McCain legacy
to our youth. He offered his condolences to Cindy McCain and the family.
Chairman Chucri shared when he was a young staffer on capitol hill working for Matt
Salmon in the late 1990s and the Senator announced his first run for the Presidency
and Mr. Salmon had not yet endorsed McCain. Chairman Chucri barged into Mr.
Salmon’s office interrupting a robust discussion. He remembers when the Senator left
the office, he tapped on his desk and winked and let him know it was okay. He then

shared that he was in the Senator’s office in his role as the President of the Restaurant
Association about a year and a half ago discussing policy and the Senator said he had
one question and asked why Burger King was now making hot dogs. Chairman Chucri
stated the Senator will be missed and his legacy will endure for a very long time.
At this time a memorial video was shared and a moment of silence was held to
remember Senator John McCain.

Jim Hagedorn, resident, spoke in opposition to this item. He and his neighbors are
concerned about increased traffic near N. 175th Avenue and W. Olive Ave. He
expressed concerns about Cheryl Dr. as it is a private road. He claimed it is being used
as a shortcut to Citrus Dr. He said Cheryl Dr. is a dirt road and drivers are not adhering
to the posted speed limits. He explained that the Sheriff’s Department will not enforce
the speed limit on Cheryl Dr. because it is a private road. Mr. Hagedorn proposed that
Cheryl Dr. be closed at N. 177th Ave. to eliminate potential dust problems, accidents,
etc. He further explained the traffic flow if Cheryl Dr. were to be closed.
Supervisor Hickman noted there is growth in this area and asked that the item be
continued to the September 19, 2018 formal meeting in order for the applicant to
provide proper public notice with postings on the site with at least a 15 day notice prior
to the board meeting. The posted notices must adhere to the guidelines of the Planning

date of application, subject to conditions. In the event of the failure to comply with any
condition, a hearing shall be scheduled with the Board of Supervisors for consideration to
revert to the zoning that existed on the date of application. It is, therefore, stipulated and

approval of Z2017115 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Special Use Permit Recycling Collection Center”, consisting of one (1) full-size sheet,
dated January 16, 2018 and stamped received January 16, 2018, except as modified by
the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “January 16, 2018”, consisting of 4 pages, stamped received January 16, 2018,
except as modified by the following conditions.
c. This Special Use Permit shall expire 10 years (August 29, 2028) from the date of
approval by the Board of Supervisors or upon termination of the use, whichever occurs
first. All of the site improvements that do not meet C-2 zoning district standards and cannot
be readapted to a permitted use shall be removed within 60 days of such termination or
expiration.
d. The following Engineering condition shall apply:
1. Storage of materials, walls/fence/ parking and storm water retention are prohibited in the
right-of-way.
e. The applicant shall obtain a driveway permit from ADOT within 60 days of approval of
the Special Use Permit.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted. (C-44-19-029-M-00)
Jennifer Pokorski, Director of Planning and Development, provided a background on
this case. The Arizona Ave. Recycling Center is requesting a Special Use Permit (SUP)
in a C3 zoning district. The Recycling Center is a one-man business and operates
between 8:00 a.m. and 5:00 p.m. every day. They sort, collect and distribute metal
recyclables. The Recycling Center has been operating for approximately one year
without proper zoning. She explained there have been seven letters of opposition
expressing concerns about traffic, noise and the visual appearance of the site.
The Planning Commission approved this item subject to conditions ‘a’ – ‘g.’ Staff
followed up with a site visit and found additional zoning violations.
Supervisor Barney asked if anyone requested to speak on this item and Ms. McCarroll
stated there were registered speakers. He said it is the Board’s responsibility to

consider and protect the property rights of both the applicant and those of area property
owners. This has been done with conditions ‘a’ – ‘g.’ He stated he wanted to add
additional stipulations ‘h’ – ‘m’ to be read into the record.
Ms. Pokorski read the following stipulations into the record:
h. Hours of operation shall be limited between 8:00am and 5:00pm daily.
i. Within 30 days of SUP approval, the property owner shall install a fence to
screen the property from adjacent properties and the street. The fence shall be
block, wood or chain-link with mesh or slats. The screening material shall be
maintained for the duration of the SUP.
j. Material may not be stored higher than the screen.
k. The use of machinery for crushing, cutting or processing metal and of
mechanical equipment (other than for cooling or heating) shall be prohibited.
l. Recyclable material collection shall be limited to non-ferrous metals.
m. All accumulated materials and junk, trash and debris not related to the metal
recycling operation including the plastic containers for liquid storage and the

These actions will have a County-wide impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. §42-17105.
The Juvenile Probation Department has identified two projects that require additional
funding in order to better meet the needs of juveniles/families and enhance efficiencies.
The first project supports the Community Alternatives and Restoration Services (CARES)
unit. Currently, the CARES staff are located at four separate locations on the Durango
campus. Juvenile Probation management has identified an area within the Durango
campus that is large enough to house all CARES staff. The co-location of staff is expected
to improve teamwork and enhance service delivery. In addition, youth and families can
access the targeted space for training and community service projects, where now we
would be using space that is shared with Staff Development. Juvenile Probation requests
the appropriation of $200,000 in Fee Fund balance to cover the direct and ancillary
expenses associated with this renovation.
The second project is a component of long-term IT system enhancements within the
Juvenile Probation Department. Juvenile Probation has made great efforts toward
migrating from the legacy JOLTS system to the iCIS environment, however migration to
iCISng system utilized by other Branch departments has yet to begin. Using iCISng as the
system of record allows integration of data from the Courts and also provides users with
enhanced data entry and retrieval capabilities. While grant funds from the Administrative
Office of the Courts were utilized for the data-mapping portion of this IT project in FY 2018,
grant funds for the completing the data mapping project were not available. Juvenile
Probation requests the appropriation of an additional $200,000 in Fee Fund balance in
order to cover the costs associated with data mapping. (C-27-19-001-2-00)

These actions will have a County-wide impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. §42-17105.
The Judicial Branch recently completed a zero-based budget analysis and adopted
substantial revisions to the methodology used to allocate indirect costs among and within
Judicial Branch departments. The re-drafted budget requires the transfer of expenditure
authority between the Superior Court, Adult Probation, and Juvenile Probation General and
Detention funds. These transfers will necessitate an adjustment to the Above Base
Maintenance of Effort fund transfer from the General Fund to the Detention Fund as well as
offsetting adjustments to the Eliminations Fund.
In addition, the Superior Court requests approval to complete the following appropriation
adjustments in order to better align resources with departments:
1.Transfer General Fund appropriation authority for one FTE ($45,277) from the Superior
Court to the Clerk of the Superior Court due to the transfer of duties associated with the
adoption process.
2. Transfer General Fund appropriation authority for four FTE’s ($294,566) from the
Juvenile Probation Department to the Superior Court for Juvenile Court conciliation

services.
3. Transfer General Fund appropriation authority of $651,505 from the Adult Probation
Department to the Superior Court. This net amount is comprised of the following actions:
a. Transfer General Fund appropriation authority for one FTE ($48,495) from the Superior
Court to the Adult Probation Department to support tax intercept revenue collection duties.
b. Transfer General Fund appropriation authority of $700,000 from the Adult Probation
Department to the Superior Court to support identified deficiencies in the Court Technology
Services Division
4.Move the entire revenue and expenditure appropriation authority for the Spousal
Maintenance Enforcement Fund (276) from the Superior Court to the Clerk of the Superior
Court, as statute dictates that the Clerk of the Superior Court should control this fund.
Lastly, the Superior Court requests that the board of the Supervisors adopt a resolution to
transfer surplus funds from the Law Library Fund to the Superior Court building
improvement fund, as allowing in A.R.S. §12-305C. The Presiding Judge concurs with this
action (see Budget Transmittal Letter dated February 8, 2018). (C-80-19-001-2-00)

Approve and authorize the Chairman to execute Amendment 1 to Intergovernmental
Service Agreement ADEQ18-182669 between the Maricopa County Air Quality Department
(MCAQD) and the Arizona Department of Environmental Quality (ADEQ) for ADEQ to
provide matching funds to MCAQD for the EPA FY18 Arizona State Clean Diesel Grant
Program. There are no costs that will need to be absorbed by the department’s operating
budget.
This IGA Amendment will provide matching funds to support MCAQD’s FY18 DERA Work
Plan to retrofit or replace diesel powered vehicles through annual sub-award agreements
until September 30, 2021. An annual Amendment will be required to update the Work Plan
and any future match funding dollar amounts. The Work Plan for Amendment 1 will expire
on September 30, 2019 and will provide for $276,588 in “matching” funds to allow
additional DERA funding in the amount of $138,294 from the EPA.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditures of these revenues are not prohibited by the budget
law.
Title VII, Subtitle G, Section 793 of the Diesel Emissions Reduction Program (DERA) in the
Energy Policy Act of 2005 authorizes the U.S. Environmental Protection Agency (EPA) to
support grant, rebate, and loan programs, administered by eligible states or territories,
which are designed to achieve significant reductions in diesel emissions. This program is
referred to as the State Clean Diesel Grant Program. The grant program is reoccurring and
has been awarded to the department in previous years. Cash, indirect costs or in-kind
match are not applicable as this amendment is for the “matching” funds required for the
state program. The matching funds will be passed thru to sub-recipient(s) and is not
subject to indirect cost recovery. The annual grant program is non-competitively bid and is
based on population. There are no costs that will need to be absorbed by the department’s
operating budget.

63. DECLARE PERSONAL PROPERTY SURPLUS TO COUNTY NEEDS
Pursuant to A.R.S. § 11-251 (9), declare one hundred feet (100’) of dock of little value and
surplus to the County’s needs, approve the transfer of this surplus dock to Jack D. Church,
Inc., dba Bartlett Lake Marina, and execute a Bill of Sale.
This item is located in Supervisory District 2.
Jack D. Church, Inc., dba Bartlett Lake Marina (Marina) provides the Maricopa County
Sheriff’s Office Lake Patrol with mooring services for a floating boathouse along with 24-
hour per day, seven-day per week access via License Agreement P-50230 (C-18-13-029-
3-00). Due to lake fluctuations, the County’s boathouse and appurtenances must be moved
to a new location so that it can remain in operation. As a result of this move, one hundred
(100) feet of the County’s dock will no longer be needed. There is no market for used dock,
so the surplus personal property of little value is deemed unauctionable. In addition, the
cost to disassemble, remove and dispose of the surplus dock exceeds its depreciated
value. This portion of dock can however be of use to the Marina in that it can be used to
provide a public mooring for the County’s boathouse at its new location. Therefore, it is the
recommendation of County Real Estate that the surplus dock be transferred to the Marina
to facilitate the mooring of the County’s relocated boathouse and public access. (C-18-13-

Motion to approve by Supervisor Hickman, seconded by Supervisor Barney
Ayes: Barney, Chucri, Gates, Hickman, Gallardo

Approve and authorize the Chairman to execute Amendment No. 1 to License Agreement

Lake Marina, (“Licensor”), to extend the term of the License for five (5) years to provide
continued access to, and use of, dock space for the Maricopa County Sherriff’s Office
boathouse and appurtenances (“Lake Patrol Facilities” or “Facility”) at Bartlett Lake Marina
located at Bartlett Lake, AZ, relocate the Facility, and authorize the FMD Director or
Designee to approve emergency expenditures to repair/move the Facility as needed, not to
exceed twenty thousand ($20,000) dollars per fiscal year.

The new License term, if approved, will commence retroactively as of July 1, 2018 and
expire June 30, 2023. Due to lake water level fluctuations, the County’s boathouse must be
moved to a new location so that it can remain in operation. This Amendment will provide for
a one-time move of the Facility, provide continued 24/7/365 access and use, and allow for:
(1) emergency moves, recovery and/or repair (“Repairs”) of the Facility when imminent
property damage is likely; and (2) reimbursement to the Licensor for the Repairs. Licensor
may effect Repairs as needed however, the fees for such Repairs shall not exceed five
thousand ($5,000) dollars per Repair without prior written authorization of the FMD Director
or Designee, and shall not exceed a total of twenty thousand ($20,000) dollars per license
year. The annual fee for use of the Facility remains at five thousand ($5,000) dollars per
year, paid annually, and is prorated in FY2019 from October 1 to June 30. The one-time
cost to move the boathouse and appurtenances is thirty-seven thousand, eight hundred
and ninety-one dollars and forty cents ($37,891.40). One-hundred (100) feet of dock,
deemed surplus to the County’s needs and of nominal value, will be transferred,
simultaneous to the execution of this Amendment, to the Licensor via a separate Bill of
Sale (Agenda C-18-13-029-3-02) for use as a new public mooring for the Facility as well as
public access. Either Party may terminate the License with 180-day prior written notice to
the other. (C-18-13-029-3-01)

74. TRANSFER OF EXPENDITURE AUTHORITY
In accordance with A.R.S. §42-17106(B), approve the transfer of expenditure authority
between the Department of Transportation’s Capital Project Fund and the Department’s
Transportation Operations Fund.
This action will require the following expenditure appropriation adjustments to the FY 2019
budget:
Decrease expenditure authority for the Transportation Capital Project Fund (234) System
Preservation and Reconstruction (SPAR) Project reserve in the amount of $400,708 and
increase expenditure authority for the Transportation Operations Fund (232) Non Recurring
Non Project (NRNP) by the same amount for a net financial impact of zero.
The reason for the request to transfer funds is the unexpected delay by the manufacturer of
two aerial lift trucks, and one low profile heavy equipment transport trailer, costing a total of
$400,708, that were included in the Board approved Department’s FY 2018 operating
budget but not delivered.
MCDOT FY2018 budget included the two aerial lift trucks and the one low profile heavy
transport trailer as replacement equipment. The aerial lift trucks are required equipment for
the department’s traffic signal technicians to inspect, maintain and repair traffic signals
essential to the safety of the traveling public. The low profile heavy transport trailer is used
by Roadway Maintenance crews to transport heavy equipment that usually cannot be
driven on the roadway.
Due to unforeseen manufacturer delays in procuring the aforementioned equipment,
approval of this request will authorize the Equipment Services Department to proceed with
the procurement of these three pieces of equipment. Supervisory District No. All (C-64-19-
