Site Location: Southwest corner of El Mirage Rd. and Maryland Ave. in the
Glendale area
Site Size: 36.7 acres
Density: 3.43 d.u./ac
County Island Status: Glendale
Additional
Comments: The site is within a City of Glendale county island, the city’s
general plan designates the site and surrounding
neighborhood for Medium Density Residential land uses of
2.5-3.5 du/ac, and the proposed R1-6 RUPD zoning has a

outstanding concerns from reviewing agencies. Four
individuals spoke in opposition before the Planning and
Zoning Commission and numerous items of opposition were
received prior to, as well as at hearing.
Staff has calculated the support and opposition received,
and notes that a Super Majority Vote has been triggered. The
trigger is when 20% or more of property owners within a 300’
radius of the subject site, by number and area register
opposition to the case. The opposition received accounts for
15 property owners with an area of 372,048 sq. ft.
The calculations for Seasons at Riverside are as follows:
21.61% opposed parcel acreage within 300’ buffer
42.86% opposed parcel numbers within 300’ buffer

g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due
to the failure to comply with any conditions, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held
on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.
h. All habitable buildings constructed within this subdivision shall be constructed to
attain a noise reduction level as per ARS § 28-8482(B).

Project Summary:
1. This request involves the rezoning of approx. 36.7 acres from R1-10 RUPD to R1-6 RUPD for
a 126 lot, single-family residential subdivision with an overall density of 3.43 d.u./ac. The
site is located at the SWC of Maryland Ave. & El Mirage Rd. in the west Glendale area on
vacant land. The site is essentially a collection of 6 parcels totaling just under 37 ac. in size
bounded on the east by El Mirage Rd. and on the north by Maryland Ave. El Mirage Rd.
is an existing 2-lane paved arterial located within an existing 66’ full-width right-of-way
(ROW), while Maryland Ave. is a 2-lane paved road with an existing 40’ full-width ROW.
Primary access to the subdivision will be directly from El Mirage Rd. with secondary access
from Maryland Ave.
2. The applicant requests an RUPD overlay that will allow an increase in lot coverage,
decreased lot width, decreased lot area, and decreased front and rear setbacks, along
with increased sign area, monument height, and wall columns. The two lot sizes are
proposed, with 45’ x 115’ lots along El Mirage, the south boundary, and within the interior.
Much wider 90’ x 115’ lots are proposed along the north and west boundaries.
3. The general area is characterized by eclectic development patterns. Dysart Ranch is a
29-lot R1-18 gated subdivision located west of the subject site. Northwest of the subject
site is Capistrano South, an R1-18 subdivision, while Capistrano North is to its north and is
an R-2 RUPD subdivision. To the southwest of the subject site are existing site-built homes
on large-lots zoned Rural-43 and large tracts of vacant land. The master-planned
community of Wigwam Creek North is located south of Bethany Home Rd. A sparse
scattering of industrial uses is located along the south side of Glendale Ave. Luke Air
Force Base (LAFB) is located approx. one-mile to the west of the site, while Glendale
Municipal Airport is located approx. 1 mile to the east of the site. While the site is located
within the state-defined Territory in the Vicinity of a Military Airport, the subject site lies
outside of the 65 Ldn and meets the Graduated Density Concept established by LAFB.

classification based upon the Maricopa County Department of Transportation (MCDOT)

El Mirage Road 33-feet 65-feet Urban Principal Arterial
Maryland Avenue 40-feet 40-feet Urban Major Collector
Adopted Plans:
7. White Tank/Grand Avenue Area Plan (Adopted 2000): The Area Plan designates the site
for Rural Densities (0-1 d.u./ac.) Appropriate uses include low-density single-family
residential development and agricultural uses. This request, at 3.43 d.u./ac., does not
comply with the County Area Plan. However, while the proposed density is greater than
that identified in the County Area Plan, the proposed R1-6 RUPD zoning is similar to the
approved land uses and existing development patterns in the immediate area. A
Comprehensive Plan Amendment (CPA) is not required as the subject request is less than
40 acres.
8. City of Glendale General Plan: The General Plan designates the subject site as Medium
Density Residential (2.5 – 3.5 du/ac.)
Public Participation Summary:
9. Staff mailed out Commission and Board hearing notification postcards to property
owners within 300’. Significant opposition materialized very early on with the application
and the applicant has had meetings with the opposition. The applicant was apparently
unsuccessful in assuaging the concerns of surrounding property owners. Opponents of
the project cite the increased density, assuaged RUPD standards, and increased traffic.
RUPD The applicant also posted 2 signs along Maryland Ave. and El Mirage Rd. on July
27, 2018. The signs were updated to show the hearing dates on December 17, 2018.
Outstanding Concerns from Reviewing Agencies:
10. N/A.
Staff Analysis:
11. The applicant is requesting variations to the proposed R1-6 zoning district standards. The
site would include approximately 6.6 acres as open space, which accounts for
approximately 18% of the gross acreage. The applicant states the request for smaller lots
is to allow Richmond American Homes to develop the infill site as a high quality residential
community that is in conformance with the County’s Comprehensive Plan. In response to
opposition to the higher density lots, the applicant modified the proposed plat to include
larger lots along the north and west boundaries.
12. The subject site is located approximately a mile outside of the 65 Ldn contour. Luke Air
Force Base’s graduated density concept establishes graduated densities in order to
Z2018068

reduce residential concentrations around the base. The subject site is located within a
graduated density which allows for 6 d.u./ac from ½ mile to 1 mile of the 65 Ldn. Luke Air
Force Base issued a letter dated July 17, 2018 which indicates the request is compatible
and consistent with high noise and accident potential of Luke Air Force Base (LAFB). Due
to LAFB’s letter in support of the proposed change in land use designation staff is
supportive of the request as the proposed 3.43 d.u./ac is well below the graduated
density concept standards.
13. The subject site is within the future municipal planning area of Glendale which has a land
use designation of Medium Density Residential (2.5 – 3.5 d.u./ac). To date, staff has not
received comments from the City on the request. Staff is supportive of the request to
change. Staff notes the reviewing county agencies have no objections to the request.
Recommendation:
14. For the reasons outlined in this report, staff recommends the Commission motion for
Approval of Z2018068, subject to conditions ‘a’ – ‘h’.
a. Development of the site shall comply with the Narrative and Zoning Exhibits
entitled “Seasons at Riverside”, consisting of 8 full-size sheets, and stamped
received December 17, 2018, except as modified by the following conditions.
b. The following R1-6 RUPD standards shall apply:
1. Front Yard: 18’ front facing garage, may be reduced to 10’ for side entry

7. Maximum Height of Subdivision 6’ Monument: 8’ (h) Primary – 6’ Secondary
8. Maximum Subdivision Sign Area: 40 sq. ft. Primary - 32 sq. ft. Secondary
c. The following Planning Engineering conditions shall apply:
1. Right-of-way dedications for perimeter streets will be required as follows
with plat approval, unless otherwise waived by MCDOT:
El Mirage Road: 65 Feet
Maryland Avenue: 40 Feet
2. A Traffic Impact Study to address traffic impacts and (additional) roadway
improvements required to support the proposed development must be
submitted with the Preliminary Plat application.
3. If required, submission of a CLOMR application to the Flood Control District
must be made prior to or concurrent with the application for Preliminary
Plat.

d. The applicant/property owner shall submit a ‘will serve’ letter for fire protection
services for the project site. A copy of the ‘will serve’ letter shall be required as part
of the initial construction permit submittal.
e. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of
Transportation, Drainage Review Division, Planning and Development
Department, or the Flood Control District of Maricopa County may be grounds for
initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance.
f. The property owner/s and their successors waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
conditions.

Rezoning with RUPD Overlay Project Narrative

PURPOSE OF REQUEST
Seasons at Riverside is a proposed residential development of approximately 36.70-gross (33.60 net) acres located
on the southwest corner of El Mirage Road and Maryland Avenue (Parcel number 501-56-008 B, C, D, E, F, H), within
Maricopa County (the "Site"). The purpose of this rezoning (from R1-10 RUFD to R1-6 RUPD) is to allow Richmond
American Homes to develop this infill Site as a high-quality residential community that will be an attractive presence in
the area and in conformance with the County's Comprehensive Plan. Seasons at Riverside is requesting an R1-6
RUPD zoning and is anticipated to have approximately 126 residences for an overall density of approximately 3.43
gross dwelling units per acre (DU/AC) (see Vicinity Map).
DESCRIPTION OF PROPOSAL
To achieve the proposed single-family development, this application is requesting:
• For 36,70 gross acres, "the Site", to be rezoned from R1-10 RUPD to R1-6 RUPD.
As is described above, this rezone requests a change from R1-10 RUPD to R1-6 RUPD (see Site Plan). The project
will follow the County Zoning Regulations as specified in the Maricopa County Zoning Ordinance, with the exception of
the RUPD requested variances as noted within this document. Careful consideration has gone into planning Seasons
at Riverside to create a high-quality community that is attractively designed, lushly landscaped, and provides a new
and diverse opportunity for home ownership in this area of the County.
Seasons at Riverside will feature quality single-family homes that will utilize gated modified private local streets as its
street network, with two access points. Two lot sizes are proposed for this community, one-hundred and seven (107)
45'x115' lots are located along El Mirage Road and interior to the site, and nineteen (19) 90'x115' lots line Maryland
Avenue and the western project boundary to provide a buffer between neighboring properties and the proposed
development. The primary entryway is planned to be located off of El Mirage Road, while the secondary entryway will
be located at the northern end of the development off of Maryland Avenue. A large community amenity area is located
central to the community for each home owner to enjoy, for a total of just under 10 acres of open space. Drainage will
be managed on-site within Landscaped retention areas. A perimeter wall will be designed in terms of community security
and safety, enhanced by a comprehensive landscape character and palette, punctuated by attractive features signifying
arrival to the community. Together, these elements will establish a character that embraces and complements
surrounding deveLopments. The project entry will include complimentary community monumentation (see Landscape
Plan).
RELATIONSHIP TO SURROUNDING PROPERTIES
The Property consists six (6) parcels, is currently undeveloped, zoned R1-10 RUPD (Single Family Residential Zoning
District) and is within the White Tank/Grand Avenue Area Plan designated as Rural Density (0-1), The Property is
surrounded on all sides by Rural Zoning — One Acre Per Dwelling Acre (RU-43) properties (north, east, south, and
west), with the exception of one undeveloped parcel to the west of the Property which is zoned R1-8, and one parcel
to the south of the Property, Wigwam Creek North Phase Two subdivision zoned R1-6 RUPD. To the east of the
proposed development, across El Mirage Road is a mining property zoned RU-43. To the north of the property is a
charter school, two existing single-family residential homes, water tanks, and the existing Streams Christian Church,
all zoned RU-43. On the western border of the proposed development is the previously described R1-8 property and
several existing single-family residential homes all zoned RU-43. The south side of the proposed development is the
previously described Wigwam subdivision zoned R1-6 and the bordered by the existing L Thomas Heck Middle School.

The overall architectural character of the Property will include a variety of home styles with a modern desert landscape
palette that will complement the surrounding architecture and environment. Playing off of the surrounding character of
the area, authentic and natural materials along with a patterned landscape will be utilized. These elements evoke the
County's historical character and lifestyle, while providing diverse housing opportunities, in a suburban environment.
LOCATION AND ACCESSIBILITY
Richmond American Homes is proposing to develop a gated residential community that will consist of single-family
detached homes on individually owned lots with a homeowner's association providing governance for the community.
Primary access to the community will be provided off El Mirage Road. An enhanced entryway (72' tract) and
monumentation are planned for the project to create a sense of arrival into the community. A secondary, resident-only,
access point is also proposed along Maryland Avenue.
CIRCULATION
This project is in close proximity of several major roadways, public transportation, and designated bike routes. In
addition to abutting El Mirage Road and Maryland Avenue, Valley freeways are readily accessible and convenient to
the site. Various Valley Metro bus routes (Route 70 Glendale Av & El Mirage Rd, and Route 41 Indian School Rd &
107th Av) are within five miles of the site. Residents may also choose to use alternative transportation on one of the
many bike routes located near the site, including bike lanes along Glendale Avenue and Camelback Road, and popular
trails such as the New River Trail East located just east of the subject property.
Vehicular traffic for Seasons at Riverside will be served by:
Arterial Roadways: El Mirage Road
Major Collector: Maryland Avenue
According to the Maricopa County Department of Transportation (MCDOT), Major Streets and Routes Plan, Street
Classification Atlas, El Mirage Road is proposed to be an Urban Principal Arterial. A Principal Arterial features a 130-
foot total right-of-way (65-foot half street). Maryland Avenue is to be a Major Collector Street. The Urban Major Collector
features an 80-foot right-of-way (40-foot half street).
Local Streets: A modified private 42' street section (tract) will be utilized within the development, featuring a 16-foot
wide lane in each direction, curb and gutter, and five-foot attached sidewalks located on both sides of the street.
Roadway Improvements: The project anticipated that a Development Agreement between Richmond American Homes
and Maricopa County will establish the required ultimate roadway improvement for the Seasons at Riverside project.
Typically, the project would be responsible for the improvement of a half-street right-of-way, where the arterial or
collector is adjacent to the project.

DEVELOPMENT SCHEDULE / PHASING
It is anticipated that Seasons at Riverside will be developed in two primary north/south phases. The northern portion
of the Site will be developed first, including the amenity area, followed by the southern portion. Phase one (1) consists
of 22.11 net acres and includes sixty-nine (69) lots. Phase two (2) consists of 11.49 net acres and includes the
remaining fifty-seven (57) lots. The model complex will be developed as a part of the first phase of development (see
Site Plan).
COMMUNITY FACILITIES & SERVICES
1. Open Space and Landscape
The open space areas of the development make up 28.33% of the net area of the site and will be maintained by the
community's HOA. The open space has been dispersed throughout the Site to provide efficient retention as well as
visual relief across the development. A centralized, 1.11-acre community amenity area, adjacent to lots 68 and 85, is
prominently featured within the community. This amenity area will be easily accessible to all of the residents of Seasons
at Riverside, supporting recreational activity and social interaction. As a major component of the community's identity,
the amenity area will complement the architectural style of the homes and landscape accents. The amenity area will
integrate components that provide both active and passive recreational opportunities and will include the following
features: lushly landscaped areas, decomposed granite trails/pathways, turf play areas, seat walls, benches, trash
receptacles, picnic tables, outdoor barbeque areas/grills, shaded tree plazas, ramadas, a covered play structure
featuring slides, log steppers, climbing elements, and a raised play area, the amenity area also features an inclusive
spinning seat, and swings. Additionally, the project provides a generous open space corridor along a significant portion
of the western and eastern boundary which connects to the centralized open space and amenity within the middle of
the community. These open space areas are linked by five-foot (5') attached sidewalks (provided on each side of the
street) throughout the community, and various soft trails located within areas of open space throughout the community.
These pedestrian amenities are meant to encourage connectivity throughout the development and to provide an active
street scene.
2. Entry Features and Monumentation
Enhanced entry/gateway monumentation and overall project theming will be provided within Seasons at Riverside and
at each of the two gated entrances. A perimeter wall will be designed to provide community security and safety.
Seasons at Riverside's perimeters will be enhanced by a comprehensive landscape character and palette, punctuated
by attractive features signifying arrival to the community. Together, these elements will be integrated with each other
to establish a character that complements the surrounding area. Decorative perimeter walls will surround Seasons at
Riverside and will mirror the theme and/or view walls provided within and throughout the community. Theme walls and
view walls and fencing will not extend into the front yard building setback or sight visibility triangle on any of the lots in
the community.
3. Existing Schools
The Litchfield Elementary School District (LESD) and the Agua Fria Union High Schools serve Seasons at Riverside.
Students from this project will be served by the Barbara B. Robey Elementary School (1.5 miles from the Project site),

Re: Case #Z2018068, Seasons at Riverside
Dear Mr. Bak
Thank you for the opportunity to comment on the Zone Change with Overlay Application
for Seasons at Riverside. This proposed development is located on 25.74 acres at the southwest
corner of El Mirage Road and Maryland Avenue. The request is to rezone the site from R1-10 to
R1-6 and develop the site into a 144-lot residential community with a density of 4.01 du/ac. This
site is located approximately one mile outside the 1988 JLUS 65 Ldn, "high noise or accident
potential zone" as defined by A.R.& § 28-8461 and is within the "territory in the vicinity of a
military airport," also defined by A.R.S. § 28-8461.
Luke AFB follows the guidelines in the Graduated Density Concept (GDC), The GDC
proposes, in the absence of a more restrictive state, county or municipal general or
comprehensive plan, graduating densities away from the 65 Ldn as follows: a maximum of 2
du/acre from the 65 Ldn to 1/2 mile, a maximum of 4 du/acre from 1/2 mile to 1 mile and a
maximum of 6 du/acre from 1 to 3 miles. With a density of 4.01 du/ac these parcels fall within
the guidelines of the GDC.
This request, as stated in the narrative, will not negatively impact the flying operations at
Luke AFB. If approved this project will be located within the "territory in the vicinity of a
military airport," and will be subjected to approximately 165 over flights a day, with some as low
as 1,500 feet above ground level. We recommend you review the sound attenuation
requirements found in A.R.S. § 28-8482. In addition, a strong notification program on the part
of the applicant is essential to inform potential residents about Luke AFB operations.

If you have any questions, please contact my Community Planner, Ms. Barbara Plante at

PROTEST RE
Rezone for Seasons at Riverside from R1-10 to R1-6 RUPD
CASE # Z2018068
We, the undersigned, hereby protest approval of this rezone request in that it is inconsistent with neighboring properties in regard to density of dwelling
units. There are one acre to two and one-half acre properties to the north, northwest, west, and southwest. In addition, Falcon View, immediately to the
northwest, is zoned R1-10 and lots are in excess of 12,000 sq. ft. Maryland Ridge Estates to the west is zoned R1-8. When similar land uses are not
located next to each other "Maricopa County supports compatible land use planning" and {supports} "appropriate buffers that minimize
potential problems and help sustain property values," (Vision 2030 Comprehensive Plan).
Furthermore, this development does not meet the requirements for an RUPD which Is warranted due to topography, innovative or sustainable
project design, or other considerations." (Zoning Ordinance Article 1002.1) and the "development will not adversely affect adjacent properties...."
(1002.5 (3).
The undersigned hereby respectively request that the Maricopa County Planning and Zoning Commission recommend denial of this request and that
the Maricopa County Board of Supervisors deny same.

Rafael and Dalila Rico
6207 N. 124th Dr.
Litchfield Park, AZ 85340
To Whom It Concerns,
We are opposed to the Seasons at Riverside Development Case #Z2018068. We do protest this
new zoning proposal (R1-6 RUPD). The original zoning (R1-10 RUPD) developed in 2006
contained 80 parcels. The new R1-6 proposal will result in 5,175 square foot parcels, lot sizes of
45' x115' of 144 parcels. This is no where near compatible with the surrounding properties which
include larger lots, many of them being acre lots or larger.
We live in Wigwam Creek North, and our house is within 300 feet of the new development. We
are very concerned with this new proposal for many reasons. We bought our home in 2015. We
previously lived in southwest Phoenix, in a small city named Tolleson. While we lived in this
community, many new developments were built, and it increased traffic near our home
tremendously. More businesses were built, crime increased, and the schools became more
populated. What started as a small community, grew to a heavily populated area.
We moved to this small community with beautifully sized lots to escape the crammed
community. This community is quiet and there is not a lot of traffic on El Mirage leading to our
home. There are large acre lots west of our home.
We feel like this rezoning proposition (R1-6) will have some negative impacts. El Mirage is a
smaller street with one lane traveling both directions. With the addition of more parcels, the
traffic will be increased. There is only 1 street light between Camelback and Glendale (2 miles).
Therefore, all vehicles exiting the neighborhood must wait at a stop for the traffic to clear. With
more cars traveling through El Mirage, this will create more of delay trying to exit the
neighborhood. During spring training baseball games in March, the traffic is diverted to El
Mirage to return back to the 101. Throughout the month of March, the traffic causes a delay in an
already congested commute home.
Another negative outcome of R1-6 proposal involves the schools in our neighborhood. The class
sizes will become much larger which does not benefit the children. There will be competition
within the students because of the larger amount of children and the fewer seats within the
classrooms. The closest high school is Millennium high school.
We also feel like there is no need for an increase in homes within this development. There are
already new developments being built on the northwest corner of El Mirage and Camelback, and
on the northwest corner of El Mirage and Glendale. With these new developments, there is no
need for an increase in the number of homes. These new developments should support all the
incoming families. These developments will also cause in an increase in traffic and class sizes
within our schools. By adding more parcels within the proposed development will increase these
even more.

We hope you understand our concerns and change the proposed plan to the original R1-10
zoning proposal.
Sincerely,
Rafael and Dalila Rico

September 2, 2018
Dear Supervisor Clint Hickman:
We are strongly opposed to the Seasons at Riverside Development Case
#Z2018068. The original Plat Plan developed in 2005, Riverside Estates, had 80
parcels. There has been no change to this neighborhood justifying the rezoning. The
requested rezone from R1-10 to R1-6 RUPD requests: 5,175 SF parcels, 45'x115'
sized lots, 10' minimum front yard, 15' rear yard, 5' side yard setbacks, and a 55% lot
coverage. This is not compatible with the surrounding properties of one acre or larger
lots.
In our area we do not have access to municipal police and fire departments, trash
service, and readily accessible parks and recreation. We do have Maricopa County
Sheriff for police protection but we have to pay for these other services separately,
i.e. Rural Metro and Parks and Sons. Valley Water Utilities, a private water company
provides our water.
According to the Vision 2030 Maricopa County Comprehensive Plan, we are not
located in the Urban Service Area, so we are lacking some necessary infrastructure.
For example, roadway infrastructure is not adequate at this location.
The safe and effective movement of people is not compatible with surrounding
conditions and will create traffic congestion. El Mirage Road, a two-lane roadway is
less than 1/4 mile from the Crown Charter School. Crown Charter School has a
capacity of 500 students and currently they have about 333 enrolled. There are times
when vehicles coming and going from this location make safety and traffic congestion
a major issue. This does not take into effect any additional traffic that will be coming
from new developments that will or are being built now. The significant increase in
traffic flow at this intersection that will result from this rezoning is a notable risk to

students and other pedestrians. According to White Tank / Grand Avenue Area Plan,
Policy T1.2.2: "The construction of new roads that are designed to provide access to
new development should be the responsibility of the developer(s)." Page 71.
The developments listed below will have a significant impact on available capacity
and construction financing for schools, MCSO, fire protection, libraries, parks and
roads serving this community. These developments rapidly increase population that
needs to be serviced by the existing resources. Developers should have the
responsibility to pay the real costs associated with new development and not burden
the existing homeowners with higher taxes or other funding methods needed to serve
this new population. New developments newly constructed, currently under
construction, or in the process of approval in close proximity to our existing
community:
a. Falcon View, R1-10, 64 parcels under construction now, 12,518 SF averaged
lot size
b. Seasons at Riverside — R1-10 requesting rezone to R1-6 RUPD, 144 lots
e. Maryland Ridge Estates, R1-8 RUPD, 60 lots, 8400 SF, not submitted
preliminary plat
d. Marbella Ranch Parcel 'I & 2 Phase 1, #Z2016054, 276 parcels under
construction now with a maximum density of 1260 dwellings, single and multi-
family residential R5- RUPD.
e. Developments 2017 & 2018: Solare Ranch Subdivision, 84 parcels
This magnitude of change will be impacting density dramatically within the area and
this existing development within the neighborhood must be considered. There are
valid reasons why lower density is necessary and should be preserved.
As it stands now, I request that you deny the rezone application and support the
development of this property under the current zoning R1-10. We would like to have a
compatible development that takes all needs, present and future into consideration.
Sincerely,
Mark and Peggy Whiting

Mr. Hickman,
My husband and I own the property at 6321 N 126th Ave, in Litchfield Park. Please let this serve as our formal
complaint against proposed rezoning of the area for the above development.
We bought this house because of the large property zoning. We never wanted to live in a cookie-cutter
neighborhood. We loved the wide open spaces and the fact that we would never have neighbors peering into our
yard from a few feet away.
The proposed rezoning will devalue our property. We will be forced to stare at a the very thing we tried to get away
from - cookie-cutter homes. I would be fine with the developer building on acre lots as the area is zoned for. It is not
right that all the people in our neighborhood to take a hit on our home values because a developer wants to come in
and line his pockets with as much money as possible by stuffing crappy little houses into as little space as possible.
The developer should follow the zoning rules, instead of trying to change them for his own benefit.
I have already written the developer and the attorneys representing them. I feel our neighborhood voices are not
being heard. Please imagine if this was YOUR neighborhood. Would you want tiny little houses bringing down your
property values?
My guess the answer is no.

Please tell the developer to follow the zoning rules. Tell him that you will represent your people's interests instead
of his wallet.

Subject: Seasons at Riverside---Richmond American Homes proceeding with Revised-Plan of 126
Hello Clint,
We are Mark and Kathy Aguilar. We live in the Wigwam Creek North subdivision north of
Bethany Home off of El Mirage Rd.
I have to say I'm very concerned that our voices were not taken seriously in comparison to
this large home builder. This area North of Bethany and West of El Mirage is a very special
area with many very nice large homes. This is one of the primary reasons we moved here.
I moved here with the intent of upgrading to one of the new custom homes or building my
own home on a lot in the area. After what I see the developers intending to do to this area
is disgraceful. Putting a bunch of cookie cutter homes with no kind of real yard really does
not fit into this area of the community. We have already how little houses on tiny lots
affected the neighborhood south of Bethany and north of Camelback. Nobody wants to live
in that subsection because of the crime that ended up there.
I feel really terrible for people who build custom homes in this area, only to have their home
values reduced unnecessarily. I feel this development could seriously impact my home
value as well. 1 currently have no neighbors who can peer in my backyard from a two story
home.
We currently have A rated schools in this area that are already near capacity. Adding a
bunch more students without considering the impact to schools is irresponsible. I work
often in Reno where house prices have skyrocketed and they can't build fast enough and
where families with kids can't get there kids in a public school that is fully functioning. It's
going to kill the development in Reno by not considering the impacts to schools. No
families will move there and pay a ridiculous amount for a home and no schools. In fact,
the schools are SO OVERCROWDED that kids have to take rotate which weeks they can
attend. I urge you to seriously look into this.
I urge you to seriously consider the impact to the neighborhood culture and long-term well-
being of the community.
Consider
• impact to schools

that we have no fire department
• that this area with schools in the immediate area is a traffic hazard
• that this area has draining issues at the bottom of the hill
• that they are building high end home in the immediate area that will also be impacted
by these small non family homes.
Most of all what I'm upset about this that they even still intend to build two stories homes
close to mine. I purposely bought this lot so I didn't have two story windows peering in my
backyard while my young kids swim and play in the backyard. Please consider making
them put single level homes that have a decent lot size, at currently what it was zoned for.
Feel free to reach out to me directly should you wish to discuss.
Best regards,
Mark Aguilar

Dear Mr. Glenn Bak:
Please take a few minutes of your busy day to read below our
concerns, as we oppose the "Seasons at Riverside" development
case #Z2018068. Initially, we were advised that the original
plan was to be 80 parcels R1-10. We feel that the initial R1-10
application is more conducive to our immediate surrounding
community. As with my other fellow neighbors, I too have
signed a petition protesting the rezoning of this project to R1-6
RUPD. My neighbors Robert & Allison Bowns as well as Carrol
and Julia Frison have clearly articulated factual circumstances
citing numerous references and resources as they too amongst
others are opposed to the revisions. As they have already
advised you of such, please note that we concur and adopt the
cited facts and literature that they have provided you.
We live at 12346 W. Maryland Avenue directly across the street
from this proposed development. We have many concerns
pertaining to the rezoning to R1-6 RUPD. Currently our
community consists of custom homes on large lots and/or
acreage with larger size square footage homes. We bought our
properly in 2006. Two years of our sweat and hard work went
into building our home and landscape which was quite an
investment for us. My husband contracted and built our home
with every spare minute of his time after work and weekends and
we were finally able to move into our home in 2008. We chose
to build here as the scenery of the mountains were beautiful,
homes were large as well as the lots which made for much
privacy between us. Additionally, we enjoyed the fact that there
were no HOAs or cluttered street with cars which was the
environment we moved from. I mention this as I feel that the
project should remain R1-10 as us homeowners invested in this
area for such reasons. Reducing the size of lots and homes
would impact us in many ways.

First, as it stands there is much congestion on Maryland Avenue
from El Mirage to the Crown School as it is only two lanes. My
experience is sitting at my gate waiting to leave my home while a
line of cars get backed up going into the school to drop off
children. As there is no bus transportation, every child is
brought in by car. Further, there have been many times that I'm
in the long line of cars on Maryland Avenue trying to get into my
gated home. The rezoning of the project puts an entrance to the
development near the entrance to my home which equates to
additional cars and congestion. Additionally, cars tend to back
up turning either left or right on El Mirage Road as it too is a two
lane road. Just last year while my son was waiting for his school
bus, he witnessed two car accidents as the intersection of El
Mirage and Maryland. I have witnessed many impatient drivers
passing into the opposite lane into oncoming traffic as cars are
attempting to make the turn onto Maryland Avenue. This will
continue not only at the intersection of El Mirage and Maryland
but also at the proposed entrance on El Mirage into this
development.
The congestion is further enhanced when it rains. Flooding
occurs along El Mirage to include Maryland Avenue, When the
rain eventually dries up, it leaves many rocks and debris from the
traffic. I as well as others have experienced our vehicles fishtail
from the loose gravel and rock. I have many times taken a push
broom after the rain to clean up rocks and debris to avoid this
safety hazard.
With these current conditions, which are not being adequately
addressed now, adding even more traffic to this roadway would
cause serious safety issues. Children walking would be at risk.
Speaking of schools, my children attend nearby Barbara B Robey
elementary and L Thomas Heck middle school. For several
years, there have been at least 30 children in a classroom.
There have been times where my children have had to join other
classrooms due to a shortage of teachers. Decreasing the lot
size and increasing the amount of homes would likely put the
schools at either full or over their capacity. I chose these

schools as they were rated as an "A" school. Additional students
with the lack of teachers could negatively impact their education
as well as the school ratings.
We also have safety concerns as the developer is putting in two
story homes. We expressed our privacy concerns to the
developer and our loss of views. If I were to buy a home in a
community with both single and two story homes, I know in
advance that there would be privacy issues. We are being
forced, not given an opportunity to voluntarily waive these issues
as one would when buying a home.
Another concern is the value of our home. In 2008, our home
declined significantly in value when the marked crashed. It has
taken many years to gain back our home's value. We are truly
concerned that the value of our home will again decline due to
the smaller homes and lot sizes of this development. Sheer
number of homes being added to this area alone will skew the
values of everyone's home. The market is based upon
surrounding homes; the homes proposed are not the equivalent
to the long standing current homes here. Not to mention the
rental properties that will likely develop in the community. Let's
face it, no renter or lessee takes care of your home and property
like the homeowner does.
We respectfully request that the "Seasons at Riverside"
development case #Z2018068 application to rezone from R1-10
to R1-6 RUPD be denied in its entirety. Maintaining the existing
R1-10 with 80 parcels more closely blends with the existing
community.
Sincerely,
Gregorio and Victoria Valenzuela

Subject: Opposition of Rezoning at Riverside, Case #Z2018068
Date: Tuesday, November 6, 2018 10:00:02 AM
Supervisor Clint Hickman,
We are submitting this letter protesting the rezoning of Seasons at
Riverside, Case # Z2018068, from R1-10 RUPD to R1-6 RUPD, 126
homes. This development will be located at El Mirage Road and
Maryland Avenue.
We are one of three home owning families that live on the north side of
Maryland Avenue across the street from the proposed Seasons at
Riverside Development. We ask that you deny the latest request to
rezone from R1-10 RUPD to R1-6 RUPD for the following reasons:
1. Density/lot size is not compatible with the housing and lot
sizes that are here now. While we are not pleased with the R1-10
zoning, it is more compatible with our community. Majority of
adjacent properties are RU-43, with the exception of the two
adjacent developments in the area; Falcon View, zoned R1-10,
lots sizes over 12,500 SF and under construction now. Maryland
Ridge Estates that is keeping their R1-8 RUPD zoning with 8,400
SF lots and are in process of submitting their application.
2. The projected traffic with the surrounding new
developments; Falcon View and Maryland Ridge Estates, doesn't
including what Seasons at Riverside will add to an area that
already has traffic safety issues. Maryland Avenue is only a
twenty-five foot paved two lane road. It is currently being used for
three homeowners, their family members and a Charter School
which currently has 333 students. Imaging when events are held
at this charter school where five-hundred cars plus are a real
possibility. There is no separate turn-in lane for the Seasons
development or the school on the Maryland Avenue Road. Traffic
gets so heavy at times that it gets back up on Maryland Avenue
and El Mirage Road creating a bottleneck and accident hazard.
The road at Maryland Avenue and El Mirage Road only has a stop

sign. Traffic that will be generated from Seasons at Riverside on
El Mirage Road will add to a soon to be overburden two lane 66
foot wide El Mirage Road. Construction trucks are constantly
going down El Mirage Road. On the corner of Glendale Avenue
and El Mirage Road, new subdivisions are being built including a
multi-family units just north of this with an R-2 zoning and a
maximum density of no more than 1,260 homes. The traffic that
will be generated from this subdivision alone will overload El
Mirage Road, not to mention the traffic that gets rerouted from the
baseball park during spring training every year and all the events
that take place at Luke Air Force Base.
3. Safety has always been a major concern and with a recent
pedestrian fatality, it's now more than ever a great concern that
this new development will contribute to an even more dangerous
environment due to a significant increase in families! The majority
of traffic on Maryland Avenue is being generated from an
elementary school. There is insufficient road infrastructure at this
location. Maryland Avenue and the nearby intersection simply
cannot handle the dramatic increase in traffic that will occur if the
rezoning is permitted. This street does not function well now and
there have been accidents at the intersection of El Mirage and
Maryland Avenue due to the enormous amount of traffic generated
by the school and none of the developments have been built yet. If
Seasons at Riverside is allowed to be rezoned from R1-10 RUPD
(80 homes) to R1-6 RUPD (Revised 126 homes), the residential
neighborhoods surrounding the property will witness a dramatic
increase in traffic in an already congested area, which will lead to
more accidents, injuries, and fatalities.
4. Property Value is another concern as the existing community
is custom homes on at least one acre lots. The primary and
motivating factor why we purchased this land was to get away
from congested neighborhoods. The proposed rezone of this
property is the type of neighborhood we moved away from; 126
homes on 33.61 acres, Seasons at Riverside's site plan projects
126 lots with 107 of those lots to be 45 1x115', 5,175 SF, which
would be less than an R1-6, this alone should be a reason for

denial of this request for rezoning.
Like our neighbors, we are not anti-growth; we just want the proposed
rezoned property to stay R1-10 RUPD. This would help with the
consistency and transition of the community.
We respectfully ask that no zoning changes take place on these
parcels. Thank you.
Sincerely,

Subject: Opposition to Seasons at Riverside Development Case #Z2018068
Date; Tuesday, September 4, Z018 11:17:01 PM
Dear Glenn,
We are OPPOSED to the SEASONS AT RIVERSIDE Development Case #Z2018068. This
requested rezone from R1-10 to R1-6 RUPD will result in 5,175 SF parcels (45'x115' sized
lots). This is not compatible with the surrounding properties of one acre or larger lots.
The original Plat Plan proposed in 2005 for Riverside Estates contained 80 parcels. This
proposed rezone will contain 144 parcels. We see no change to our neighborhood which
would justify this rezone; in fact, there are numerous arguments against this rezone.
The White Tank / Grand Avenue Area Plan, 2020 Eye to the Future, designates the Planned
Land Use for the area bounded by Bethany Home Road on the south to Glendale Avenue on
the north and by Dysart Road on the west to El Mirage Road on the east as Rural (Figure 4).
The Envision Glendale 2040 General Plan shows our area as 1-2.5 du/ac — Low Density
Residential (Figure 2).
The principal argument for this rezone, as articulated by the counsel for the developer, is as
follows:
As one travels from west to east between Camelback Road and Bethany Home Road,
the density changes from acre parcels to lots less than 6,000 SF. The area between
Bethany Home Road and Glendale Avenue should replicate that, and Seasons at
Riverside is only a small part of that replication.
Actually, the area north of Bethany Home Road is currently developed quite differently from
the way the area to the south of Bethany was developed prior to the build-out of Wigwam
Creek North by Continental Homes. South of Bethany, homes on large lots existed between
Dysart Road and 127th Avenue (one-half mile road).
To the north of Bethany Home Road, homes are built on acre or larger parcels east to 125th
Avenue, which is one-quarter mile further east than south of Bethany. North of Maryland,
homes are on similarly large parcels east to 126th Avenue. Very small parcels occur only in
the extreme north-west corner of this square mile. So, the square mile north of Bethany Home
Road originally developed quite differently from the square mile south of Bethany, with more
acre lots further east. This is where the developer for Seasons at Riverside is requesting the
rezone — without any significant buffer.
Initially, Continental Homes proposed small lots south of Bethany Home Road and east of
127th Avenue adjacent to the large lots of Litchfield Vista Views. The Board of Supervisors
mandated that Continental place two rows of 35,000 SF lots on the east side of 127th Avenue,
from Bethany Home Road to Denton Street, 21 lots in total, to buffer the small lots of
Wigwam Creek from the existing large lots of Vista Views. South of Denton Street an
elementary school acts as a buffer. When similar land uses are not located next to each other
"Maricopa County supports compatible land use planning" and [supports] "appropriate buffers
that minimize potential problems and help sustain property values." (Vision 2030

Comprehensive Plan, p. 27).
Wigwam Creek North was (and is) a very bad idea, and there is no reason to duplicate it!
Continental Homes, in their Narrative for Wigwam Creek North, emphasized that Wigwam
Creek would be a "sustainable neighborhood." However, Continental sold many homes to
investors, and "for rent" signs appeared in front of many brand-new homes. When the housing
bubble hit in 2008, Maricopa County property values rapidly tumbled and many people
walked away from their homes. This occurred in Wigwam Creek North, especially on the
south side of Bethany Home Road, much more so than in areas around us, where homes are
built on large parcels. Banks sold off foreclosures and bad debt to investors in blocks of
homes, and many additional rental and section 8 homes appeared, adversely affecting our
property values.
Across the street on the east side of El Mirage Road are Hanson Aggregate LLC, Three Rocks
LLC, and other construction materials companies. Residences should not be placed across the
street from facilities such as these, which create significant noise crushing rock, especially at
night, and produce considerable truck traffic during the day. If homes are to be placed here,
perhaps horse properties on very large parcels might be the best suited, where homeowners
can integrate noise abatement designs in their homes, and perhaps mitigate sound by planting
large trees, or by employing other measures.
Again, when similar land uses are not located next to each other "Maricopa County [supports]
"appropriate buffers that minimize potential problems and help sustain property values."
(Vision 2030 Comprehensive Plan).
Valley Utilities Water Co., a small private water company, provides our water and will also
supply water to Seasons at Riverside. Valley Utilities draws its water from several wells in the
immediate vicinity of our homes and the proposed Seasons at Riverside. We don't think it's a
good idea to increase the withdrawal by too much, since there are fissures and subsidence and
increased salinity problems in the area (Revisiting Earth Fissures Near Luke Air Force Base,
Central Maricopa County, Arizona: Arizona Geological Survey OFR-13-15 of October 2013,
and White Tank / Grand Avenue Area Plan).
Significant depletion of groundwater has already taken place surrounding Luke Air Force Base
where earth fissures caused drainage reversal of the Dysart Drain and significant flood damage
to Luke. There is an earth fissure underlying Northern Avenue between Dysart Road and El
Mirage Road that will impact the Northern Parkway project.
"Continued land subsidence despite rising groundwater levels indicates basin sediment
compaction due to groundwater withdrawal may continue for years to decades following long
term lowering of groundwater levels, even while recharge occurs. Extension along existing
earth fissure trends and formation of new earth fissures are all possible with continued land
subsidence." (AZGS Survey October 2013, p. 5.)
"Once fissures begin they usually increase in number and length, and spread at uneven speeds
and directions." (Vision 2030 Maricopa County Comprehensive plan, p. 41.) Also, "Although
the Luke Salt Body does not generally yield water, it does have an effect on groundwater
salinity." (White Tank / Grand Avenue Area Plan, p. 44.)
For these, and many other reasons, this change in density is opposed by the surrounding

community and many homeowners have signed a petition in opposition to this request, which
Allison Bowns furnished to you at the TAC meeting on August 21, 2018. We ask the county
to evaluate the signatures as a legal protest.
In summary, we request that the Maricopa County Planning and Development Department
DENY the rezone application for Seasons at Riverside and support the development of this
property under the current R1-10 zoning.

Carroll and Julia Prison

Supervisor Clint Hickman,
We are submitting this letter protesting the rezoning of Seasons at Riverside, case 11Z2018068, from R1-10 RUPD
to R1-6 RUPD, 126 homes. This development will be located at El Mirage Road and Maryland Avenue.
We are homeowners that live on the north side of Maryland Avenue across
the street from the proposed Seasons at Riverside Development. We purchased our property over 21 years ago. At
that time, we were told that the area was all RU-43 zoning of
one dwelling per acre. Sometime in 2005, the proposed property was rezoned from RU-43 to R1-10 RUPD. We ask
that you deny the latest request to rezone from R1-10 RUPD to R1-6 RUPD for the following reasons:
1. Density/lot size is not compatible
with the housing and lot size that
are here now. While we are not
pleased with the R1-10 zoning, it
is more compatible with our
community. Majority of adjacent
properties are RU-43, with the
exception of two adjacent
developments in the area; Falcon
view, zoned R1-10, lots sizes over
12,500 SF and under construction
now. Maryland Ridge Estates that
is keeping their R1-8 RUPD
zoning with 8,400 SF lots and are
in process of submitting their
application.
2. The projected traffic with the
surrounding new developments;
Falcon View and Maryland Ridge
Estates, doesn't include what
Seasons at Riverside will add to
an area that already has traffic
safely issues. Maryland Avenue
is only a twenty-five foot paved
two lane road. It is currently being
used for three homeowners, their
family members and a Charter
School which currently has 333
students. Imagine when events
are held at this Charter School
where five-hundred cars plus are
a real possibility. There is no

separate turn-in lane for the
Seasons Development or the
school on Maryland Avenue.
Traffic gets so heavy at times that
it gets back up on Maryland
Avenue and El Mirage Road
creating a bottleneck and
accident hazard. The road at
Maryland Avenue and El Mirage
Road only has a stop sign. Traffic
that will be generated from
Seasons at Riverside on El Mirage

overburden two lane 66 foot wide
El Mirage Road. Construction
trucks are constantly going down
El Mirage Road, new subdivisions
are being built including a multi-
family units just north of this with
R-2 zoning and a maximum
density of no more than 1,260

generated from this subdivision
alone will overload El Mirage
Road, not to mention the traffic
that gets rerouted from the
baseball park during spring
training every year and all the
events that take place at Luke Air

3. Safety is a major concern. The
majority of traffic on Maryland
Avenue is being generated from
a elementary school. There is
insufficient road infrastructure
at this location. Maryland Avenue
and the nearby intersection
simply cannot handle the
dramatic increase in traffic that
will occur if the rezoning is
permitted. This street does not
function well now and there have
been accidents at the
intersection of El Mirage and
Maryland Avenue do to the
enormous amount of traffic
generated by the school and
none of the developments have
been built yet. If Seasons at
Riverside is allowed to be
rezoned from R1-10 RUPD (80
homes)to R1-6 RUPD (Revised
126 homes), the residential
neighborhoods surrounding the
the property will witness a
dramatic increase in traffic in an

already congested area, which
will lead to more accidents,
injuries, and fatalities.
4. Property Values is another
concern as the existing
community is custom homes on
at least one acre lots, The reason
we purchased our property over
21 years ago was that we wanted
to get away from congested small
compact neighborhoods. We
were looking for rural acre
property. The proposed rezone of
this property is the type of
neighborhood we moved away
from; 126 homes on 33.61 acres.
Seasons at Riverside's site plan
projects 126 lots with 107 of those
lots to be 45'x115';=5,175 SF
which would be less than an R1-6,
this alone should be a reason for
denial of this request for rezoning.
We are not anti-growth; we just want the proposed rezoned property to stay R1-10 RUPD. This would help with the
consistency of the community.
For the foregoing reasons we respectfully ask that no zoning changes take place on these parcels.
Thank you.

Dear Glenn,
We had a neighborhood meeting last Wednesday, 8/15/18, hoping to give community input
and have our concerns addressed. The owner of this property did not come to the meeting.
However, the owner's representative, Jose Castillo, Richmond American and Brennan Ray,
Burch & Crachhiolo, P.A were at the meeting. The representatives present at the meeting said
they did not have authority to incorporate any changes we discussed into this development.
Brennan Ray said, "That we agree to disagree'', and when asked if there would be another
neighborhood meeting, did not respond with a clear answer.
We are proceeding with a legal protest and I will provide the notarized original copies
collected to you at the TAC meeting tomorrow. Will follow up with additional signatures later
but wanted to submit these during the initial review process.
Look forward to meeting you.

RE: Seasons at Riverside Rezone with Overlay
Dear Glenn Bak,
I am a homeowner near the new proposed Seasons at Riverside development. I am
writing this letter to protest the change from an R1-10 to a R1-6 RUPD. I, Tanya Pitts,
MD protest and do not want the development, Seasons at Riverside.
I understand the need to develop this land but I have several concerns with the proposed
change from the already approved R1-10. My first concern is over the lot sizes.
Cramming 144 houses into this area that was attended for no more than 80 houses. With
the addition of 60 houses, the lot sizes are going to be quit small, especially when they
will be surrounded by several houses in acre plus properties. Also, the addition of so
many houses does not give a proper zone of transition to those of us with larger properties
1

and lots.
Secondly, as a homeowner of an acreage property, 1 am very concerned how these
extremely small properties will affect my properties value. I have worked very hard to get
to where I am in life, Buying a home is usually ones biggest investments in life and I do
not want to lose the value of my property due to lower value properties surrounding it.
My third concern is the increased traffic. With 3 new developments near my property and
the other new developments off of Glendale Ave and El mirage, that could easily bring in
an extra 500+ properties with the potential of 1000+ more drivers to this area. With the
proposed 144 houses at Seasons at Riverside that is easily an extra 300+ cars/drivers
using Maryland Ave and El Mirage road. Not only will the extra traffic bring a lot of
extra noise pollution to an area that use to be quiet, it will also bring traffic headaches
daily. In addition to these new drivers, there will be additional traffic from Falcon View,
there is already an influx of cars going to Crown Charter school. Hopefully, you have
thought about this and have plans to help with traffic flow on these roads.
Another concern is emergency services. With the rapid population growth will we have
access to efficient emergency services from the sheriff department, EMS services and
Rural Metro. My one experience with calling for the sheriffs department, the response
time was not very rapid, With the increase in the population, these services most likely
will need to be utilized more resulting in more strain on these departments that may or
may not have enough staff to cover such rapid growth.
2

Thanks for your time and please kindly reconsider your decision before approving the
zoning change. I can be reached at my home address listed above or my email, to2c)
Sincerely,
3

Dear Brennan,
As you can see by the difficulties in communication experienced between just two people, you
can imagine how hard it is for me to receive and forward on communication from
neighborhood members. I have over one hundred families I am communicating with.
We kept our September 11 meeting small due to location, only twelve families attended.
Suggestions and changes were made after this meeting and I sent the new information, Site
Plan October 4, out for input. All respondents told me the density and sizes are not
compatible and they were still not in favor of this development.
This revised site plan I received from you on October 4, still has 58% more homes than the
original R1-10 RUPD zoning the developer was approved for. This development does not
conform to any current land use plans for this specific area nor the adjacent city of Glendale,
their General Plan Land Use, specifically Envision Glendale 2040. The residents are aware that
other developers in our area are honoring their present zoning and are building homes on
larger lots sizes than required by zoning regulations. Richmond American Homes is one of
such builders; presently building 12,500 + SF lots at the nearby Falcon Views R1-10 RUPD
development. We hope that the developer your representing will be guided by how
developers in our area are building now.
All homeowners who live within the 300' perimeter have signed the protest petition and are
not in favor of this development. Residents have articulated that this proposed density (107
lots - 5,175 SF) is not acceptable.
I look forward to hearing from you.

Allison –
My apologies for not responding sooner. As I've communicated to you in the
past, for some reason (and despite my best efforts) your emails continue to
land in my Junk mail folder.
You are correct that during the September 11 meeting the plan we presented
reduced the overall number from 144 to 140. I've attached that Site Plan for
reference. The plan that we presented that night was in response to the
discussion that we had following the TAC meeting in August where you,
without making any promises, suggested that we look at providing larger lots
along our western perimeter to act as a better transition from the adjacent
properties and our Site. The plan that we discussed that night had 60-foot
wide lots along the west and the community's entrance along Maryland Ave.
was push as far east as we could locate it. During the meeting it was suggested
that we increase the lot size even more along the northern, western, and
southern perimeters to 90-foot wide lots, continue to have the Maryland Ave.
entrance as far east as possible, open up the southwest portion of the Site, and
to continue to look at/understand how the offsite drainage would affect the
Site.
In response to those comments, we sent you the attached Site Plan on October
4. This Site Plan responded to the suggestions that we heard during our
September 11 meeting—reducing the number of lots even further to 126, an
overall loss of 18 lots. Richmond increased the lots sizes along the north and
west to 90-feet, opened up the area in the southwest portion of the Site, and
maintained the Maryland Ave. entrance as far east as possible. The only
comment we heard that this updated Site Plan didn't respond to was to
increase the lot size along the south. As we discussed during the September
meeting, we let you and the other neighbors know that increasing the lot sizes
along the south was going to be difficult as that area was adjacent to open
fields for the school. From our perspective, this updated Site Plan provided the
transition area that was requested of Richmond from the adjacent residential
properties.

We are certainly open to continuing the discussions. As Richmond has
demonstrated they have tried to accommodate as many of the neighbors'
concerns as is reasonably practical under the circumstances.
Thanks.

Brennan,
Sorry for the delay in getting back with you, I had family visiting this week.
When we had our meeting at Jim Shields' house on 9/11/18, we kept it small
and only 12 families attended. This is a small percentage of homeowners who
are concerned about this rezone. The site plan you presented that night had only
been reduced 4 homes, from 144 homes to 140 homes. That night you said that
you were open to having another meeting with us so idea exchanges we
believed were ongoing. When we had discussions with another developer, he
incorporated ideas and came back each time until we reached consensus. It was
a process.
During this meeting, people were giving you and Jose ideas on how this plan

could be changed to accommodate us and several people voiced they still
wanted R1-10 zoning.
I waited for your revised site plan which I opened 10/4/18 and distributed it to
families on my list 10/5/18. I also let you know that I would provide feedback
either on 10/19 or 10/22. You sent me an email stating that you were
proceeding with the revised site plan on 10/19/18 before I was able to relay my
feedback on 10/21/18.
My last email correspondence to you indicated that people voted no to this
revised plan. Density, traffic, and property values are still a hard line issues for
our neighborhood. Let me know.
Sincerely,
Allison Bowns

Subject: Richmond American rezone
Date: Sunday, September 2, 2018 8:03:41 AM
Dear Mr Bak,
Today I am writing to voice my concern and disapproval of a proposed zoning change to land
adjacent to my home and community.
Richmond American Homes, is seeking a greater home density for a proposed development,
Seasons at Riverside, located on 127 th Ave and Maryland. There are acre homes to the north,
south and west. Richmond is currently developing Falcon View, which is also adacent to the
property proposed for rezoning. While I am not sure the density of Falcon View, they are
offering RV garages, so they are larger lots.
I do not wish to see homes that are so close you can jump from roof to roof. These homes
have no place in the middle of our community. They are too small and too close, please do not
allow this to happen.
Sincerely,
Gary Grimes

Mr. Bak:
I called Supervisor Clint Hickman's office last week and talked to Michelle Montijo about this
development. Michelle replied and included your email information and contact, please add
me to your list.
The developer is holding his 1st neighborhood meeting this Wednesday, 8/15/18. I
understand you will he having the second round of review about this development three
business days after our community meeting. I am unsure how any issues raised during the
neighborhood meeting would be reflected in this review process.
Homeowners in our area range from having lived here for almost 50 years up to the last home
built on my street was 2014. Many neighbors want input into how this development affects
surrounding homeowners. We are looking for a more compatible development that takes all
homeowners needs, present and future into consideration.
Thank you,
Allison Bowns

Mr. Bak,
My husband and I own the property at 6321 N 126th Ave, in Litchfield Park.
The developer should follow the zoning rules, instead of trying to change them for his own benefit.
have sent a letter to Mr. Hickman, but I feel our collective neighborhood voices are not being heard. Please
imagine if this was YOUR neighborhood. Would you want tiny little houses bringing down your property values?
My guess the answer is no.
Please tell the developer to follow the zoning rules. Tell him that you will represent the current homeowners
interests instead of his wallet.
