Amendment No. 2 to
Right of Entry and Access Agreement for an Air Quality Monitor
At Phoenix Deer Valley Airport

This Amendment No. 2 (“Amendment”) to Right of Entry and Access Agreement for an
Air Quality Monitor at Phoenix Deer Valley Airport, No. 141245, as amended by
Amendment No. 1 dated June 13, 2018 (the “Access Agreement”) is made and entered
into by and between the City of Phoenix, an Arizona municipal corporation (“City”) and
Maricopa County, a political subdivision of the state of Arizona (“County”). This
Amendment is effective when signed by the City.
RECITALS
A. The City owns and operates Phoenix Deer Valley Airport (“Airport”) located at 702
West Deer Valley Road, Phoenix, AZ 85027.
B. On March 11, 2015, the City and County entered into the Access Agreement,
which among other things, granted County the privilege of installing, maintaining
and operating air quality monitors on a portion of the Airport.
C. The City and County desire to mutually agree to exercise the second of two options
to extend the Term of the Access Agreement and update Notice address.
AMENDMENT
NOW, THEREFORE, in consideration of the mutual covenants herein and other valuable
consideration, the Parties hereby agree to amend the Access Agreement as follows:
1. The Parties hereby mutually agree to exercise the second option to extend
the Term for one (1) year from March 11, 2019 through and including
March 10, 2020. The Access Agreement, as amended, is subject to
termination pursuant to the provisions of A.R.S. §38-511.
2. The Recitals set forth above are hereby incorporated into this amendment.
3. Section 20.2 of the Access Agreement is amended as follows:

4. Except as amended herein, all other terms and conditions of the Access
Agreement shall remain the same and in full force and effect.
