Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: January 30, 2019 (continued from January 16, 2019)
Case #/Title: Z2018010 – Acoma Estates
Supervisor District: 4
Applicant / Owner: Adam Baugh, Withey Morris PLC/ KMK, LLC
Request: Zone change from Rural-43 to R1-10 RUPD
Site Location: Generally located at the NWC of 73rd Ave. alignment &
Acoma Dr., in the Peoria area
Site Size: Approximately 15 acres
County Island Status: Yes (Peoria)
Additional
Comments: The proposed Acoma Estates is not in conformance with the
comprehensive plan’s Rural Development Area (RDA) land
use designation but it does further the plan’s goal of orderly
development and land use patterns. The site is within a City
of Peoria county island, the city’s general plan designates the
site and surrounding neighborhood for Residential Estates
land uses of 1-2 du/ac, and the proposed R1-10 RUPD zoning
has a proposed target density of 1.9 du/ac. There are no
outstanding concerns from reviewing agencies.
After the PZ hearing staff received an Appeal to P&Z
Determination for the Board of Supervisor’s Regular agenda.
The BOS at the 1/16 hearing motioned to continue the case
to 1/30. Staff received additional emails in in opposition after
Commission hearing which are attached with this report. Staff
notes these additional correspondence have already
registered opposition. There has been no trigger of the Super
Majority vote on the zone change application.
Commission
Recommendation: On 12/13/2018, the Commission voted 6-0-1 to recommend
approval of Z2018010 subject to conditions ‘a’ – ‘k’:

b. Development of the site shall be in conformance with the Narrative Report entitled
“Acoma Estates”, consisting of 7 pages, dated December 4, 2018, and stamped
received December 4, 2018,except as modified by the following conditions.
c. The applicant/property owner shall submit a ‘will serve’ letter for fire protection
services for the project site. A copy of the ‘will serve’ letter shall be required as part
of the initial construction permit submittal.
d. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article
304.6, and ARS § 11-814 for five (5) years for the initial phase and an additional five
(5) years for each subsequent phase, within which time the final plat for each
phase must be obtained. The applicant shall submit a written report every five years
from the date of Board of Supervisors approval of Z2018010 which details the status
of this project, including progress on obtaining subdivision infrastructure and/or
construction permits. The status report to be administratively reviewed by Planning
and Development with the ability to administratively accept or to carry the status
report to the Board of Supervisors (Board), upon recommendation by the Planning
and Zoning Commission (Commission) for consideration of amendments or
revocation of zoning for undeveloped parcels. Status reports will be required until
completion of the initial subdivision infrastructure and/or construction permits for
each zoning parcel R1-10 RUPD.
e. The following R1-10 RUPD standards shall apply:

of 56’
7. Average Lot Area 17,000 sq. ft.
8. Lot Coverage; 55% only applies to lots within single story homes
f. The following Paradise West community conditions shall apply:
1. Development of the property shall be in substantial conformance with the 28-
lot site plan dated November 2018.
2. There shall be no lots immediately abutting the north property line.
3. Lots 12-19 shall be single story only.
4. Streetlights within the development shall be installed at street intersections
only.
g. The zone change is applied to restrict the use of the site. Until such time as the site
is served by sewer, uses on the site shall only be those acceptable to the Maricopa
County Environmental Services Department (MCESD).
h. Prior to approval of the initial final plat or precise plan of development approval,
the applicant shall provide the Maricopa County Planning and Development
Department with a signed and recorded pre-annexation agreement with the City
of Peoria that identifies the detail for when the proposed project will be annexed.
This pre-annexation agreement shall be approved by City of Peoria.

i. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this zone change as set forth in the Maricopa County
Zoning Ordinance.
j. The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, does not reduce any rights that existed
on the date of application to use, divide, sell or possess the property and that there
would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the zone change. The zone change
enhances the value of the property above its value as of the date the zone change
is granted and reverting to the prior zoning results in the same value of the property
as if the zone change had never been granted.

Project Summary:
1. The request is to rezone approximately 15 acres of vacant land generally located at the
northwest corner of 73rd Ave. alignment and Acoma Dr. from Rural-43 to R1-10 RUPD in
order to permit a 28-lot residential community. The requested R1-10 RUPD zoning will allow
a new residential subdivision with lot sizes that are compatible with other built subdivisions
in the general area. The Peoria General Plan Land Use map designation is Residential
Estate which permits up to two homes per acre (2 du./ac.).

Adopted Plans:
6. Maricopa County Comprehensive Plan Vision 2030 (adopted January 2016): Designates
the site as Rural Development Area as the site is outside of County area plans. The
proposed rezone is not in concert with the land use designation.
7. City of Peoria General Plan 2010: The Peoria General Plan 2010 designates the subject
property Residential/Estate (2 du./ac.). The proposed rezone appears consistent with that
General Plan. The City has not provided comment as of the writing of this report.
Public Participation Summary:
8. The applicant complied with the Maricopa County Public Participation Process with the
required posting of the property and notification by first class mail to the adjacent
property owners within 300’ of the subject site and interested parties. The subdivision
Paradise West, to the north of the subject site has provided an email with six (6) signatures
of support. There have been significant opposition received regarding the proposal. The
opposition objects to the proposed density of the proposal giving reasons such as
increased traffic and density. There are thirty-six (36) emails as attachments.
9. A letter in support from residents in the Paradise West community located to the north of
Acoma Estates was received. The letter indicates development of the vacant land would
address issues with weeds, dumping and deter theft from abutting residential properties.
The applicant and residents worked together to establish conditions for a compatible
development. The conditions shall be included as part of the zoning conditions of
approval and address development with the conceptual layout, no residential lots along
the north adjacent to the Paradise West community, lots 12-19 shall be single story.
Outstanding Concerns from Reviewing Agencies:
10. N/A.
Staff Analysis:
11. According to the requested proposal, the R1-10 RUPD zoning will allow the residential
subdivision with lot sizes that are compatible with other built subdivisions in the immediate
area. The applicant proposes a residential community providing 28 lots an average
12,000 square feet (80’ x 150’). The gross density of the site of approximately 1.9 du/acres.
The proposed development will be accessed from Acoma Drive. The proposal is a lower
density project relative to the established subdivision developments in the surrounding
area; its density could be considered further suitable for the larger lots in the area.
12. The subject site is located adjacent to higher density residential land uses to the north
(City of Peoria jurisdiction). The applicant made mention of annexing to Peoria as
evidenced by the attached email, and as such the City doesn’t require a second access
for the subdivision, per the applicant. There are thirty-six (36) emails of opposition
regarding the proposal. Per an email from the applicant, received November 26, 2018, a
pre-application meeting was held with the City of Peoria discussing annexation. The
applicant states that the City confirmed the proposed plan was acceptable. The
Z2018010
applicant informs staff that annexation will be pursued after zoning is secured. Staff is in
support of the request for a zone change with overlay to R1-10 RUPD.
Recommendation:
13. For the reasons outlined in this report, staff recommends the Commission motion for
Approval, subject to conditions ‘a’ – ‘k’.
a. Development of the site shall comply with the Site Plan entitled “Acoma Estates

Zone Change Narrative
Executive Summary
The purpose of this request is to rezone approximately 14.1 acres of vacant land generally
located east of the northeast corner of 75th Avenue and Acoma Drive in Maricopa County (the
"Property"). Attached at Tab 'I is an aerial map of the Property.
The Property is currently zoned Rural-43 (RU-43) in the Maricopa County Zoning
Ordinance. Attached at Tab 2 is a zoning map of the area. The Property is bounded by Acoma
Road on the south, county island properties to the west, east, and south and a Peoria residential
subdivision to the north.
This application submittal requests a Single Family Residential (R1-10) Residential Unit
Plan of Development (RUPD) zoning district to permit the development of a 28-lot planned
residential community. See site plan at Tab 3. The underlying zoning will be changed from RU-43
to R1-10 RUPD. The proposed density and lot sizes are consistent with the R1-8 zoning to
northwest, R1-8 to the southwest, and the R1-12 further north as shown on the area zoning map at
Tab 2.
The Property is located in unincorporated Maricopa County, within the City of Peoria
planning area. The Peoria General Plan Land Use map designation is Residential Estate which
permits up to two homes per acre (2 DU/AC). Attached at Tab 4 is the Peoria general plan map of
the Property. The proposed density of this project (1.84 du/ac) is consistent with the Peoria
General Plan land use map designation.
This proposal will provide for a vibrant residential community that is compatible with the
surrounding area and development patterns.
Background
This property was originally owned by the Peoria Unified School District (PUSD) and was
once intended for a future school site. Overtime, the school population demands changed and this
site became excess property.
Recently, the school district took ownership of new land and buildings currently housing
the Challenge Space Center. On August 17, 2017, PUSD Governing Board approved a land swap
for the Challenger Space Center, adjacent to Sunrise Mountain High School in Peoria. In
exchange, PUSD traded two undeveloped parcels of land that are not needed for school sites: one
at 75th Avenue and Acoma Drive in Peoria and another at 89th Avenue and Emil Rovey Parkway in
Glendale. Since a school site is no longer needed at this location, the new property owner intends
to develop the site for residential homes.

Request
This request is to rezone the Property from RU-43 to R1-10 RUPD. A RUPD is requested
to modify some of the development standards in order to create a better designed community
which will be compatible with the area development. Overall, 28 units are planned at an overall
density of 1.9 home per acre, consistent with the Peoria General Plan.
The proposed zone change will enable the developer to develop and market the Property
to a homebuilder who desires a premium product but wishes to avoid the expense and
maintenance associated with acre lot homes. The existing zoning (one home per acre) does not
provide adequate housing options for the area and does not reflect the change in the housing
market over the past few years.
The requested R1-10 RUPD zoning will allow a new residential subdivision with lot sizes
that are compatible with other built subdivisions in the immediate area. The developer is proposing
a high- end product with homes that will be well maintained. These improvements will benefit the
surrounding homeowners and raise property values in the area.
Proposed Development
The applicant proposes a residential community providing 28 lots averaging roughly
12,000 square feet (80' x 150). The overall gross density of the site is roughly 1.9 du/acres. The
community is accessed from Acoma Drive and a variety of community open space is provided
throughout the development including buffers on the north and east side. Attached at Tab 3 is a
conceptual lot layout which will be further defined during the rezoning process.
Residential Unit Plan of Development (RUPD1
The requested zoning district development standards are as follows:

The proposed modifications within the R1-10 RUD create the ability to plat the single-
family lots on the Property with a product consistent to other residential communities in the
surrounding neighborhood. Given the shape of the property, some of the lots require less street
frontage than the minimum lot width required by the R1-10 zoning ordinance; however, each lot
meets the minimum lot width requirement when measured from the back of the lot. The
modifications to the side and rear yard setbacks are consistent to the City of Peoria's development
standards for the equivalent zoning.
Relationship to Surrounding Properties
The Property is located in an area that is suitable for the residential development proposed
by this application. It is surrounded by primarily residential uses with some agricultural uses and
commercial nodes at intersections nearby. See City of Peoria Zoning Map Enclosed at Tab 5.
As indicated above, the Peoria General Plan identifies the Property as a Residential/Estate
(0-2 du/ac) use within its future planning area. The proposed residential development is only 1.84
du/ac which is consistent with the designated uses under the County Comprehensive Plan and the
Peoria General Plan. Additionally, it is a density similar to the majority of the subdivisions along
75th Avenue. For example, the proposed development is less dense than the following
subdivisions which are zoned R1-8 (Thunderbird Vista, Lion's Gate, Arrowhead Shadows) R1-10
(Tierra Norte, Tierra Buena) and R1-12 (Teresita).
To the north of the Property is a residential subdivision zoned R1-18 and beyond that is
land zoned R1-12 with lot size similar to our proposal (12,000). In the general area to the west are
multiple subdivisions zoned R1-8 and R1-10. To the south and east are residential homes in
Maricopa County zoned RU-43.
Aeoma Estates
Directly to the west and south of the Property, are a mix of large, dirt lots and some
scattered single-family homes. To the north and east of the Property are single family detached
homes. The homeowners in the surrounding area would be positively impacted by the
improvements the Applicant plans to make to the subject Property. The vast majority of residential
subdivisions in this area have similar densities to what is proposed through this application.
Finally, a number of higher density projects have been proposed in the Property's general
vicinity in the past year. For example, the Bungalows on Thunderbird, which proposes 8-15
dwelling units per acre, was approved by the Peoria City Council in May 2016. In July 2016, an
application proposing 13 dwelling units per acre was proposed at 67th Avenue and Thunderbird.
The Applicant has proposed a much lower density project relative to trends in the surrounding area
and a density that is much more suitable for the larger lots in the area.
It is not anticipated that this proposal will have any detrimental impact on neighboring
properties due to the compatibility with the surrounding zoning and actual land uses in the area.
Location and Accessibility
The Property is 1.5 miles east of the 101 Freeway, which provides prime regional access.
75th Avenue and Thunderbird Road (.5 miles to the south) are major thoroughfares providing ease
of access to the proposed subdivision. The Property is also near ballparks, restaurant, and
entertainment uses at P83, a designated entertainment district to the north within the City of
Peoria,
Maricopa County Comprehensive Plan Consistency
The Maricopa County 2030 Comprehensive Plan (the "Plan") is aimed at maintaining a
high quality of life as Maricopa County continues to undergo substantial growth. To that end, the
Plan prioritizes "supporting safe communities and neighborhoods...by supporting compatible land
uses; environmental quality; and safe, efficient and practical development patterns."
This application presents an opportunity for the County to establish a use that encourages
growth by planning for a residential community that provides for an appropriate density that
maintains compatibility with adjacent properties. This proposal will enhance the quality of life in the
region and will encourage responsible growth and development. This type of cohesive land use
will ensure this area of the west valley continues to thrive consistent with the intent and goals of the
County's Comprehensive Plan.
The proposed rezone is consistent with the following specific goals and policies contained
within the Comprehensive Plan:
Land Use Goal #1: Promote efficient land development that is compatible with adjacent
land uses, is well integrated with the transportation system, and is sensitive to the natural
environment.
The proposed rezoning provides for a density that mirrors the single-family home
developments along 75th Avenue and Thunderbird. Furthermore, this application provides for
Page 5 of 7
Acoma Estates
appropriate residential land use near a designated commercial corner within the City of Peoria with
convenient access to the regional freeway network. The Property's location is connected via
arterials and Loop 101 Freeway providing an appropriate integration with the transportation
system.
Land Use Policy #18:
Growth Area Objective #3: Continue to solicit input from municipalities regarding future
growth in unincorporated Maricopa County.
The Property is located within the planning area of the City of Peoria. The applicant has
met with the City of Peoria and determined the use is consistent with the Peoria General Plan Map.
The applicant will continue to work with the City throughout the rezone process to ensure the plan
provides benefits to surrounding communities with minimal impacts.
Community Facilities and Services
The Property is located within the area of the Peoria Unified School District.
Public Utilities and Services
1. Water: The City of Peoria will provide water to the Property from water lines in
Acoma Drive (upon annexation).
2, Wastewater: The City of Peoria will provide wastewater service to the Property
from wastewater lines in 75th Avenue (upon annexation).
3. Electrical: Salt River Project will provide electricity to the Property.
4. Gas: Southwest Gas Corporation will provide natural gas service to the Property.
5. Refuse: The City of Peoria will provide refuse collection to the Property (upon
annexation).
6. Phone: Century Link/Cox Communications will provide telephone service to the
Property.
7. Fire: The City of Peoria will provide fire protection to the Property,
8. Police: The City of Peoria will provide police protection to the Property.
Drainage
Acoma Estates
A preliminary drainage report is not required with this application. Retention will be based
on the gross acres of the site. Retention basins may be at a depth of 3 feet, however will require
that side slopes be no steeper than a 4:1 side slope.
Conclusion
The proposed rezone request allows for compatible development with the surrounding
developments and area character. It creates the appropriate mix of development standards to
develop a successful community that can cater to established homeowners. The RUPD overlay
provides for additional flexibility as this project develops over time. The request is consistent with
the City of Peoria General Plan and Maricopa County Comprehensive Plan. Most important, the
request follows the development trends represented in this area and is compatible with existing
uses and zoning.

Re: Proposed Residential Development /Acoma Estates Z20180101
To Whom It May Concern:
We live in the Paradise West community north of the proposed Acoma Estates residential
subdivision proposed at Acoma Drive and 75th Avenue in Peoria. We are homeowners that abut the vacant dirt lot
today and we have a special interest in what happens behind us. W6 have seen this vacant land for years and
recognize that residential development is expected. We also understand the development is consistent with
Peoria's General Plan land use map designation. New residential homes should help address issues with weeds,
dumping, and deter theft from abutting this vacant property.
We support the proposed residential neighborhood trust it will be done in a manner that is
compatible with our existing homes. We reviewed the plans with the developer and worked together to draft certain
stipulations that create a more compatible development. We request these items be attached to the zoning case to
ensure these conditions run with the land and are enforceable:
1. Development of the property shall be in substantial conformance with the 28-lot site plan dated
November 2018 (see attached).
2. - There shall be no lots abutting the north property line.
3. Lots 12-19 shall be single story only.
4. Development of the property shall implement the City of Peoria Rural Streetlighting Standards.
The proposed development is compatible for the area, less traffic than the prior planned school, and a good
use of a vacant, infil dirt lot. Based on the applicant's plan and their willingness to agree to stipulations, we are
supportive of the proposed rezone application. We appreciate the developer's willingness to work together on this
plan and we urge the County Planning & Zoning Commission to adopt these above-referenced stipulations as part
of the zoning approval.

I am writing this letter concerning the rezoning from RU-43 to R1-10 at East of
75th Avenue and Acoma Drive. The case number is Z2018010. As a homeowner
in this area having homes that reside on at least 1/2 acre lots adds to the charm
of this neighborhood. I am opposed to this development if it is going to have
homes on lots smaller than 1/2 acre.
Here are the reasons I do not want homes built with smaller lots:
There will be more traffic on Acoma Drive which is a safety concern,Having
several starter homes in this location will create more noise. Our neighborhood
is very quiet and the multiple homes will destroy that.Starter homes in my
neighborhood will affect mine and my neighbor's property values, Depending on
the demographic who would purchase these starter homes could increase crime
in our area.
I sold a house in this area five years ago and Loved the neighborhood so much
bought the home next to my old house. I am very passionate about keeping the
charm of this neighborhood and I voice my objection to this project if it is going
to build homes on less than 1/2 acre lots.

I am writing to oppose the re zoning of the 14 acre parcel east of 75 th Avenue on the north side of Acorna to R1-10
multiple housing from the existing RU-43 (1 house per acre).
Having been a homeowner for 30 years in the county island, we don't need more traffic and congestion.
We moved to that area specifically because of its rural atmosphere and lack of congestion, irrigation and horse
privileges.
Since moving there, I have watched the traffic on Acoma increase, mainly because the county decided to make the road
from 71' Ave to 75th Ave more user friendly by paving it. Now, it's used as a shortcut for commuters to bypass
Thunderbird to get to 75t h Ave. I can sit drinking my coffee in the mornings and count approximately 20 cars per minute
using Acorna.
I was the guy who petitioned all involved to install speed humps since it was becoming a race track back there. We got
that done but it really doesn't help, most just run down the markers and go around so they can do "Spin Outs" on the
dirt shoulder.
I understand that the developer would have one exit/entrance to the subdivision and that would be on Acoma. This
sounds to me like a nightmare. I wouldn't be as opposed if the only exit/entrance were to be on 75 th Ave. Maybe that
would discourage more people from using Acoma. Also, the addition of more tract type homes would tend to add more
votes to annex, since they would be
Inconvenienced by the smell of livestock, occasional tractors running around, etc.
I am sure that the other property owners, like myself absolutely DO NOT want to be annexed by Peoria.
Thank you for the opportunity to vent. Please consider the ramifications for the long term folks that already live there!

In reference to case # Z2018010, my family searched three years to obtain a home in this sub division, We love the
minimum of one acres and not street lights, no side walks and no CITY. If this developer is allowed, his plan will bring
chaos to the traffic. We already have installed speed bumps to slow non residents from using Acoma as a short cut. The
number of people this would bring in will cause a heavy load of traffic in an area that currently needs not lights for traffic
control. This will also bring in a multitude of people that do not have the same family ideas of country living as the
current residents. Keeping the current one acre per home with animal privileges is best for the community. Please be
considerate of the residents that have lived in this area for several decades and those still looking for a chance to
relocate in this area. Homes do not stay on the market for a week.
Thank you for your considerations.

lam not opposed to progress however I cannot support the proposed development as planned.I am greatly opposed to

Eric, I am writing to voice my opposition to rezone the 14 acre parcel on

advise on any up and coming meetings regarding this case as I would like

Dear Mr. Eric R. Smith:
My name is Everett R. Lucas, Jr. and I live at 7232 W Hearn Rd, Peoria, AZ 85381. I am very unhappy that
there is a plan to change the character and look of our neighborhood to put in a new neighborhood on Acoma
Drive.
It is my understanding that a developer plans to re-zone the 14+ acre site from horse property (RU-43) to 28
regular size residential lots that will be roughly 10,000 square feet. This change would in fact decrease our
current home values as most of the lots are in excess of a half acre each. The entrance/exits for the proposed
neighborhood will be on Acoma Drive (an already busy street) and will increase the amount of traffic on Acoma
and in our surrounding neighborhood streets.
I am not opposed to developing the land in question, but I am adamant that the the developer maintain the
character and look of our neighborhood that is currently our oasis in the middle of this city.
Thank you for your consideration

Subject: Development at 73rd Ave arid Acoma Drive
Dear Mr. Smith,
I am corresponding with you as the result of a notice posted at 7300 West Acoma Drive. The notice advised of
a housing development being considered for permitting on the previously listed property. I am opposed to such
a development being constructed on the lot at 7300 west Acoma Dr. The reasons for this include added traffic,
noise, congestion and property value decline.
Acoma drive has a long history of traffic drive-through and accidents which preceded the addition of the traffic
calming devices (speed humps) being added to slow traffic. The levels of vehicle traffic are already critical to
safety and adding several houses to the mix will most certainly increase the likelihood of increased traffic
collisions with fixed objects as well as other vehicles, pedestrians or horses. Yes, this is a rural setting
including horse property and it is not uncommon to see horses riding down Acoma. Several homes even have
hitching posts in the yard.
In summation, I am opposed to the suggested use of the property as a high density residential development and
request my comments be added to the list of detractors concerning this posting.
Sincerely,
Philip L. Haller

Hello. I am a member of the community in which this development is proposed. I have owned property here since 2011
and have invested significantly in this neighborhood. My family enjoys the quietness and open space very much.
The proposed development does not fit well into this community. I have two major concerns as do the other residents of
the community.
1. The lot size is too small. Right now most properties in this community are at least 1 acre. Smaller homes and lots will
only decrease the rest of our property values.
2. The roads in this area are not suited for the increased traffic flow that this will produce. Acoma has no traffic lights or
stop signs going east or west between 75th and 67th. The county just installed road humps to deal with traffic that was
moving too fast. Acoma is already too small of a road to place a median. I believe traffic will also flow from Thunderbird
Rd to this community via 73rd Ave if there is access into the development on Acoma. You may not be aware but 73rd
Ave may be the worst stretch of road in the county! Neither Maricopa County nor the city of Peoria claim that they are
required to maintain 73rd Ave south of Acoma and the road has severely deteriorated.
However, I am interested in promoting more community development that would increase property values and
neighborhood beautification. In that respect I would propose that this development bring some benefits to the
neighborhood that we can all support such as;
1. Larger lot size, at least 1/2 arce.
2. Community green spaces, playgrounds, walking paths, that everyone can have access to off of Acoma.
3. Limit vehicle access to this development to and from 75th ave only.
Otherwise some guarantee in road improvements will be needed for Acorna (including a stop light at 75th and Acoma
and median) and major improvements on 73rd Ave south of Acoma).
Please keep me informed.
Thanks

Good afternoon Mr. Smith,
I live in a very friendly neighborhood, where everyone knows each other and we are concerned about
a sign just recently posted on W Acoma Drive of 75th Avenue.
As an effected small community of all custom homes, we are requesting neighborhood meeting and a
developer plans. We have all of our neighbors phone numbers and we will effectively communicate,
as needed. We do not want to jeopardize our property values and safety of our community. I would
like to let you know that we are oppose the idea of a small home track community or condos that
enter and exit off Acoma Drive. It will be a nightmare! As of right now, we already experiencing a
huge traffic impact from W Thunderbird Road and 67th Avenue cutting through traffic with a traffic jam
during the pick hours and due to accidents on the main streets. I also would like to inform you that
perpendicular to Acoma there is a 73 Avenue that is partially a private road that maintained only by
residence. Both city and a county denied their help in our road maintains. Additionally, it took us
many years to approve speed bumps on Acoma Drive. All of us have very young children playing
outside and we would like to keep our neighborhood traffic to a minimum. Plus, it took my husband
and I years to find a one acre lot in a city, which is a dream of many people in Arizona. We also have
a horse property that is extremely valuable to us and we do not wish to lose such privilege. We would
like to see all one acre lots in our neighborhood. Please advise how we can assist in further decision
making in regards to case #Z2018010.
I appreciate your assistance in this matter.

Dear Mr. Smith,
As someone who lives in this neighborhood, I am writing to you to express my extreme opposition to
the proposal of KMK, LLC to rezone the lots in this case from RU-43 to R1-10. This neighborhood is
quiet and peaceful. The serenity we enjoy is the direct result of being on one acre lots, resulting in a
low population density and rendering comparative silence. This proposal would dramatically increase
the noise pollution and completely transform traffic patterns within our neighborhood.
It is my belief that rezoning from RU43 to R1-10 will bring more people into the neighborhood and
force property values down. Reducing the zoning level will allow developers to build smaller homes in
among the older family homes already here. This will clearly bring more people into the neighborhood
— increasing traffic, noise and crime.
The value of my house is its value as life insurance for my children and my retirement fund. If it
declines in value, so does the security of my family. In addition, more crowding, more traffic, more
noise and crime would be extremely upsetting to all of the residents in the neighborhood.
We purchased our home to get away from the noise and tumult of our previous environments. The
sign posted on the proposed site specifies a single driveway for a 28 unit development. How could
the Fire Department ever address emergencies with such a design? One point of egress is always a
recipe for tragedy. What other shortcomings of planning can we anticipate?
Thank you for your consideration in this matter,

Hello Erie,
Reference Case AZ2018010 Request for zoning change permit.
Concerning the 14 acres off Acoma Drive & close to 75th Avenue. This area surrounding this 14 acre parcel
is predominately one (1) house per acre. It is a very unique county, country like island engulfed between the
cities of Glendale and Peoria. We have cows, horses, chickens, pigs, goats and a large aray of other livestock.
We like our evening dark, no street lights. We also do not want the added traffic twenty eight (28) homes
would bring, double what the R-43 land would produce. The land on your south, east and west sides are all
one (1) house per acre except the land on your north side is a custom home area approximately 1/2 acre per
house. That may work for us, but a subdivision like your are purposing would in my opinion hurt our lifestyle
and our property values. We do no want this property rezoned to R1-10.

Subject: Email of Concern: Rezoning Proposal 75th Avenue and Acoma
Hello,
We recently saw the sign posted in our neighborhood for the purposes of the rezoning request off of 75th Avenue and
Acoma Drive. I was shocked and saddened to see that this request is for a plan of 28 lots. I believe the reference case
on this is #Z2018010.
We moved into this neighborhood and paid the appropriate amount to do so for the aesthetics and environment it has to
offer. The large lot sizes and big neighborhood feel gives our family with small children a place to feel safe and our kids a
place to play outdoors and ride bikes. Adding a development like what is being proposed changes everything. This does
not even come close to matching our neighborhood developments look, feel, and would create many issues. I ask that
you and anyone involved in this decision look at it from the perspective of if they had purchased a 1+ acre lot to raise their
family in and then next to you someone was looking to completely change the look and feel for their benefit and this
changes the quality of life for you. How would this make you feel? The problems that this could cause of course should
be considered which is the increased traffic to Acoma (which is already quite high), and the increased noise to a quite
rural neighborhood. I hope these issues along with all of the others that adding 28 homes to a small area in which should
only have 8 homes on it should do should be carefully considered and the families that have been living in this
neighborhood for years should have their voices and issues heard.
Will you please let me know that you received my email and that I have addressed it to the correct person handling this
situation?
Thank you for your time.

Eric,
I live directly to the South of this proposed project on Acoma. I have number of concerns and strongly object to
the rezoning of this property.
I have lived and owned my home since 1993. Prior to that my family has owned and lived along this road sine
1957. We enjoy the rural setting and horse privileges and farm environment of this little pocket. Despite
development surrounding us we have maintained this island in the County precisely because we do not want to
see this eroded into a typical subdivision dense housing environment. We do not want to see this zoning
change
My front door faces this patch, this proposed zoning change and development will bring more traffic in front of
my home and disrupt our lifestyle. The current configuration of Acoma Rd. most likely will require widening
and may impact our irrigation as well as my property configuration. I currently irrigate under non-subdivision
agricultural privileges through SRP which may also be negatively impacted.
Those of us residing in this County Island have fought off numerous attempts by the City of Peoria to annex our
island. We do not wish to be annexed. it is highly likely this development will annex into the City at some point
after completion. Further more this development will impact property valuations and taxes presenting a
financial burden/impact on myself and other older residents.
I have children and grandchildren who live adjacent to this proposed development, I have grave concerns for
their safety due to the density of this development and increase traffic on Acoma. This is a relatively quite street
as it does not serve as a feeder street for the most part. It runs from 67 to 83. This development will add more
traffic to the street daily as it will have only one single point of entry (Acoma).
The previous landholders sold their property to the Peoria Unified School District which at some point had been
using it as a site for the Future Farmers program which I suppose is no longer funded. However they saw fit to
ensure the School District could not sell this property and could only trade it. It was never their intention to
allow this property to become zoned for residential use and see tract homes built on it.
I ask on behalf of my family and the generations whom have lived in this Section, deny zoning changes to the
parcels for this proposal. Rural lifestyles and settings such as this are getting more rare and should be preserved
as part of the cultural history of the County.
Please keep me posted on this situation. I would like to address the Board if this should progress to that stage.
Thank You,
Craig Lewis

Mr. Smith,
A rezoning sign was put up in the Weedville neighborhood yesterday to rezone some land from RU-43 to R1-10. The case
number is itZ2018010. At this time my family opposes this change and I know many others in the neighborhood do too.
The Weedville community is an agricultural/horse property community. The land requesting to be rezoned is not
situated on the perimeter of this neighborhood but the interior of it. This development would change the dynamic and
feel to our neighborhood. Currently. Weedville does not have sidewalks or street lights, it feels like ones in the country
but still within the city limits. This is part of the reason this neighborhood is so sought after. When we personally went to
get a variance to enhance our property some day we were told a variance should be given only if it betters the
neighborhood. I am not sure how this rezoning will better community.
I did contact Adam Baugh with Withey Morris to express that the Weedville Community has lots of concerns and are not
happy about a rezoning. I requested if he would be able to share master plans but was unable to at this time.
Please let me know if there is a meeting that our community needs to attended as the sign says TBD as I will be happy to
share it with everyone as we hand out yearly block/neighborhood party flyer.

Dear Mr. Smith,
I own and live in a home in the effected area of Case #Z2018010 (Acoma Dr. between 75th ave and 73rd
ave). I am writing to communicate my opposition to rezoning the plot of land to develop a small tract home
community.
Our neighborhood is made up of acre + lots. Our neighborhood is very desirable as
1) There is no HOA
2) It is on a County Island
3) The majority of the homes are custom
4) We have our own small town/ farm type feel to the neighborhood
A tract home development would
1) Drastically reduce our property value
2) Increase traffic on an already highly traveled road (Acoma Dr.) due to cut-through traffic
3) Create the potential for conflict from the residents of the tract development concerning the various animal
noises and smells that they may not understand is already in the area.
4) Completely alter the feel of the neighborhood which is why we all live here.
The plot of land does need to have something on it but Pm certain the push back from the current residents is
going be great for a small home tract development. I feel a compromise would be a development with lots not
under 1/2 acre.
In closing, I strongly oppose such a development and hope my concerns are taken into consideration.
Thank you for your time and attention.

I am a resident of the county island of which a developer wants to change the zoning of a parcel to R1-10 to
accommodate several houses per acre on this 14 acre parcel. This will increase the traffic and disrupt our unique
country feel and way of life. I am voicing that I am not in favor of this change. The City of Glendale approved the Legacy
school on the NE corner of Thunderbird and 67th avenue with no convenient streets crossing the SRP canal and flood
diversion canal to travel East on and no exits convenient to travel West causing extreme traffic hazards already on
Acoma. The only convenient street available is Thunderbird Avenue and just the Thunderbird exit from the school is
able to utilize it. With the addition of traffic from the subject parcel all using Acorna, a extremely dangerous situation
will occur. Our property values will also be affected very negatively by this high density project.
It seems that often authorities do not take into consideration how projects affect the overall community in all ways
other than MONEY to the coffers. Please do not authorize this zoning change.

Subject: STRONGLY OPPOSED TO REZONING Case#: Z2018010
- Please confirm receipt of this email -
Dear Mr. Smith,
My name is Angela Horst. This email is to serve as notice of my opposition to rezoning of
the acreage near Acoma Drive and 73rd Avenue, Case# Z2018010. I am a homeowner very
close to the proposed rezoning location. I purchased my property as my primary place of
residence, with the intention of it being my home for the remainder of my life.
At age 30 I lost everything I had worked for up to that point, including a house, vehicles,
boat, atvs, etc. This was due to my own naivete in property and debt ownership, titles,
etc. I worked for years to reestablish a vehicle, residence, self sufficiency and to pay off the
debt I was stuck with rather than file bankruptcy. I bring this up because after that I
sacrificed a lot of my life to work in order to purchase this home on my own. I then
searched for over three years to find this very unique property. Location, no street
lights/dark skies, rural character, quiet, horse privileges, horse trails from property, large
acre sized lots, less traffic, slower pace were the main factors for this property choice.
Flood irrigation was also a prime factor for me in this location. Homeowners have no
control over water delivery times or dates. Water is often delivered in the middle of the
night and safety is a great concern. Currently, neighborhood residents know one another
and watch for outsiders. We know who belongs and who does not as of now.
Adding so many houses and people to our neighborhood will greatly affect the financial and
personal value of our homes. There is a list of concerning items that this type of rezoning
would greatly affect and detract from our rural neighborhood and current zoning. I can
provide a more detailed list of items at your request. For now, a couple of items are: Light
pollution from street lights, noise pollution from the condensed amount of homes, traffic
issues, danger to horse and rider, innaccessible horse trails due to increased traffic and
potential road changes, neighborhood degradation, increased crime and personal safety
concerns due to population density.
Please let me know what I need to do to address these concerns timely. Most, if not all, of
my neighbors and surrounding homeowners in this entire rural area will also want to
participate and see that these concerns are addressed.
I appreciate your help and time.

Hello Mr. Smith,
I am writing you to inform you of my strong opposition to rezone the property on the
North side of Acoma Drive West of 73rd Avenue. This is at the end of our road and
would be a negative change to this entire neighborhood. We moved to this area
because it is a county island with large lots, less people, less traffic, less crime, it is
quiet, no street lights, private roads and the country character of the neighborhood. We
know most of the people that live in this area. We also moved here because it is horse
friendly. We can currently ride our horses down Acoma and throughout the
neighborhood without much traffic. Many of the current homeowners in this area also
have horses and/or understand their behavior so they are courteous as to not spook
them. Increased traffic from those that don't understand could be a very dangerous
situation. Even if a trail for horses was accounted for, the increased traffic would be a
big safety concern. All routes for horseback riding need to be considered so we have
safe access to our surrounding neighborhoods and areas to ride (Example: Heading West
on Acoma crossing 75th Avenue is a big concern). Changing the zoning would be a
detriment to our neighborhood and this entire area.
All of my neighbors would like to address the proposed changes as well. Please let me
know how we can keep this from ruining our neighborhood.
I look forward to hearing from you.

Eric, 1 am writing to voice my opposition to rezone the 14 acre parcel on
W Acoma drive. By rezoning from RU-43 to smaller lots it will congest
Acoma drive as well as devalue the existing homes in the area. Please
advise on any up and coming meetings regarding this case as 1 would like
to be present.

Dear Mr. Smith,
As someone who lives in this neighborhood, I am writing to you to express my opposition to the proposal of KMK, LLC to
rezone the lots, in this case from RU-43 to R1-10.
I bought this house many years ago, with the understanding that the entire neighborhood was zoned for one house on
an acre. I do not discount the rights of the developer, however, they should have been aware of the zoning ordinances
when they acquired the property. One house per acre. The existing neighborhood shouldn't be forced to acclimate to
noise, traffic and reduced home values because someone doesn't want to stay within current zoning.
The development would not benefit the greater good. It would hurt existing homeowners period. The value of my
house is factored into my retirement fund. If it declines in value, I have to work longer.
I sincerely hope that the County would recognize the negative impact this rezoning would have on the neighborhood.
Please do not allow this proposed rezoning.
Thank you for your consideration in this matter,
Karol Qualrnan

I object to this rezoning request. Traffic on the main access road is already too heavy in the morning and
afternoons. Children in the neighborhood use Acoma Dr. to walk to and from school, and Acoma has no
sidewalks! Our neighborhood is now almost country-like, with large lots, quiet streets, slower traffic, and lots of
farm animals. A subdivision on this parcel with a large number of homes would ruin our quiet neighborhood.

I am writing to let you know that it is not in the best interest of the County Island residents to allow a developer to put in
a subdivision that would be Re-zoned from RU-43 (one acre lots with livestock privileges) to
R1-10 (multi home w/ street lights and sidewalks - no livestock) in the area intended just off of Acoma and 75th Ave.
People would not like the livestock surrounding them (smells), the animal noises, and it would de-value the property
that we all own by taking away from style of living. We have a unique island of County Property that is sought after by
many and a residential multi-home development just doesn't fit with the "country style" lifestyle that we have.
The multi family style homes should stay out of County property areas and keep the lots to 1 acre for best of all involved.
Many people want the larger properties and would love to buy those. The developer needs to take all of this into
account.
Please help us to save the lifestyle of living that we have
Thank You!

Mr Eric Smith, Adarn@WitheyMorris, hello Sirs, my name is Randy Franzmeier. I am sending you this email
regarding Zoning Case #Z2018010. As a 24 year resident of this neighborhood, I am opposed to this zoning
change allowing so many homes to be built on such a small amount of land. Also, with a zoning of R1-10,
livestock would not be allowed in such a subdivision. Our ability to own and keep livestock is a very important
part of our lifestyle here. Almost assuredly, non-livestock owning home-owners would soon be filing
complaints about livestock noise, livestock traffic, livestock odors, dust, etc. Also, the increased traffic
resulting from a subdivision of this size, in an area as small as ours, will certainly be a negative issue that we
current residents will have to deal with. There are residents who ride horses throughout our neighborhood
daily, There are younger children who lead sheep, goats and cattle throughout the neighborhood. Slow
moving livestock and/or trailers, and hurried, distracted automobile drivers make for a bad combination. I have
personally had 3 instances where speeding or distracted drivers has resulted with cars in my irrigation
ditch. Our neighborhood streets, Acoma Drive specifically, cannot safely accept the increase in traffic from a
projected subdivision of this size. A multi-home per acre subdivision is not a "fit" in this unique area where my
neighbors and I have lived for so many years. For these and more reasons, I am opposed to the zoning change
being requested. Thank you.

Sir: My wife, Barbara, and I reside at 6722 West Evans Drive, Peoria. We are a short distance from this
planned subdivision. The road from 75th avenue and Acoma to 67th avenue and Acorna is a two lane road. As
it is now during the morning hours traffic backs up from 67th and Acoma to 68th avenue. This is due to drivers
trying to go North and South on 67th avenue. This intersection is NOT signaled, so Acoma traffic is at the
mercy of N/S bound 67th ave traffic. The same problem exists at 75th avenue and Acoma. The road system
through here is not set up to handle the increased volume of traffic the subdivision would generate. This does
not take into account the school bus traffic for the children of the new residents.
I wonder if the new residents would enjoy the smells that are associated with cattle, horses, and other livestock
that are located in the area due to its current zoning. We DO NOT want to change OUR lifestyle to confolin to
another's lifestyle. The City of Peoria would require the new subdivision either go into the city, or promise to
go into the city for water and sewer service. There is no sewer system in the area, we are all on septic
systems. There is also no Fire Protection provided. In short, my wife and I oppose this rezoning as we do not
wish to change the lifestyle we have enjoyed since living at our residence since 1977, nor the increased traffic
problem the subdivision would generate.
Thank You

I am opposed to the rezoning of this property based on multiple houses per acre, increased lights, increased car traffic,

for the rural lifestyle it provides with livestock. This rezoning would also create a large number of property owners and
monetary value owners that could vote for annexation into Peoria city limits and drag the rest of us in with them. Again,
I strongly oppose the rezoning of this property to R 1-10 for the above reasons.

Dear Maricopa County Planning and Development Department:
On the behalf.of my dear_neighbors, I would like to_ write_you.personally as our neighborhood strongly
objected Rezoning. I would like to address my neighborhood multiple concerns regarding Zone
Change from Rural-43 to R1-10 RUPD Approximately 15-acre site generally located at the NWC of
73rd Ave & Acorna Dr., in the Peoria area.
Today, I've have received my very first notice regarding this matter by mail, because my property is
listed in my name and is located within 300 feet of the site noted above. I've also would like to
express an extreme interest in this case by supporting all other neighbors. However, as an important
taxpayer, I am working in extremely busy mental health clinic and regret to inform you that I am not
being able to leave my clinic in such a short notice in order to attend Planning & Zoning Commission
on Thursday, December 13, 2018 at 9:30 AM. Also, it is impossible for me to leave my work for
Board of Supervisors on Wednesday, January 16,2018 at 9:30 AM.
I am desire to file with the Planning & Development Department today to protest rezoning request.
It is my duty to protect our very unique County Island as the last gem and very rare animals preserve
alive in the seventh largest city of the United States. Our neighborhood desired to preserve our wild
life here for our growing generation, who is our future and our children. Our treasure of wild life here
included Barn owls, White Tale hawks, bob cats, coyotes, rabbits, bees and squirrels. Our first
concern, that in a heavily populated by people area, we forget to consider the wild life needs and it
Eco system of animal survival. As of right now, all of our neighbors have at least 1-acre properties
with privileges of irrigation, which is required a strong neighborhood collaboration. Also, all of our
neighbors have farm animals like cows, horses, chickens, ducks, peacocks, bulls, lamas, alpacas,
ponies, dogs, cats and some even exotic pets. Often times, we walk our pets proudly in the
neighborhood with only local traffic, but population naturally already grows daily due to building of
new houses in an empty 1 & 2-acre lots near by. To our surprise by adding just one family house
next to my property, it is significantly decreased appearance of coyotes in my backyard and over
populated with number of rabbits that now destroying our garden together with our landscaping. This
is 9ne example of Eco system imbalance in our growing neighborhood. The main attraction of our
neighborhood is it rural and country feel.
It is important to take to consideration that the big majority of our neighbors are young working class
people with young children, who allows our children to play with each other in the front of our houses
and ride their bikes on the neighborhood streets. However, being surrounding by very busy and major
streets like Thunderbird, 75th and 67th, we already experiencing daily a cut through traffic that
endanger our children safety, which is the second huge concerns of our quiet neighborhood. In
regards to such concerns and history of multiple crashes on Acoma Drive, we now have speed
bumps, which have slowed down, but not prevented cut through major streets traffic. Besides due to
any weekly crashes on Thunderbird, that car traffic re-routed to drive through N 73rd Ave. I also
would like to inform with you that on several occasions, I was not able to leave my private Crocus
Driveway to get on 73rd Avenue due to the traffic gem appeared on 73rd Avenue due to cars accident
on Thunderbird and N 75th Ave. There is no other way for me to leave my house to get to any main
streets like Acoma, Thunderbird, 75th or 67th, other than taking 73rd Avenue.
I also would like to point out that none of the neighborhood streets have being ever maintained by city
or county. I have personally made several calls to both the county representatives and the city of
Peoria officials with request and complains regarding the street maintenance of 73rd Avenue without
any success. As of right now North 73rd Avenue has deep none paved wholes about every ten
feet. Our neighbors personally attempted to repair 73rd Avenue several times without much progress
due to already heavy daily car traffic. Now, the idea of building an additional 26 small houses on the
NWC of 73rd Ave &-Acoma Dr, which is on average will include three car family drivers and adding
(3X26=78) 78 daily commuters by car. Plus, giving the fact that each person have at least one
visiting friend and two extended family members such grandparents, cousins, aunts and uncles
increasing car traffic on Acoma Dr and N 73rd Ave by simple math of 78X3=234 cars! Who is
responsible or able to maintain N 73rd Avenue, which claimed to be private. Shall we consider a toll
booth to assist us with our maintenance of N 73rd Avenue? Besides, adding population of 234
people will by chance and probability increase crime rate, accidents, noise, light, pollution, traffic and
naturally decrease the wild life in our neighborhood.
Please remember, that it is very rare to find very desirable an 1-acre property to build a custom made
house in the city of Peoria without HOA rules and fees. I believe, it would not be hard to find 15
people, who will easily develop 15-acre site into multi millions mansions. Let say on average each
house could be build for the cost of one million dollars totaling 15 millions dollars adding to economy
and preserving our rural community. This way decreasing neighborhood traffic, crime and street
maintenance.
Acoma Estates Subdivision located behind and West of couple of private properties that prevent
Subdivision exit straight to 75th Avenue. This way the only exit will be directly on Acoma Drive. As of
right now on average with three person in the family per every 1-acre or spaced between 2-acres, car
traffic exist bumper to bumper during the pick working hours. I can't even imagine allowing 234
additional drivers in such a cozy neighborhood. I am not looking forward being forces to fence my
property and make an iron cast gates due to huge increase of my neighborhood population.
2
If you only need 20% of the surrounding property owners (by both number and land area) submit a
protest letter. I can assure you that 100% of the surrounding property owners against Zone Change
from Rural-43 to R1-10. I've already talk each and every one of them.
Sincerely,
Oksana Kostroski,

Subject: Acoma Estates rezoning matter
Dear Mr. Smith,
I am a resident at 7144 west Crocus Dr. As such I have followed this rezoning matter with great interest. One
of my main concerns deals with traffic density from the zoning change. I do not feel this change in density is
accommodated for in your plan. This addition traffic will simply be rerouted onto already busy streets as
evidenced by the traffic calming devices currently in place.
The proximity to Centennial high school as well as the higher density residential housing west of 75th Ave has
caused a large amount of cut through traffic on Acoma as well as 73rd Ave. This area is already absorbing a
huge anticipated increase in traffic density due to the high density housing development being built at 71st Ave
and Thunderbird.
Without further infrastructure improvements (widening/paving) to 73rd Ave as well as additional exit street/s
onto 75th Ave I view this as an unacceptable, additional burden on the existing streets/infrastructure currently in
place.

Good morning. I want to voice my strong opposition to the Acoma Estate rezoning request. I was born and raised in the
west valley and remember the days or citrus orchards and cotton fields. When looking for our home, we intentionally
went into those areas that hard larger lots, agricultural zoning and a "country" feel. Frequently when people visit my
home they exclaim that it is amazing that such neighborhoods still exist.
The majority of those living on the county island in question do so for a way of life. The requested rezoning will further
increase density of traffic, detract from the rural nature of our neighborhood (which is what attracted us in the first
place), and there has clearly been little effort on the part of the zoning applicant to respect or recognize these
concerns/issues. Please respect that wishes of those already living in the area who chose the area specifically to avoid
"development" living.

Dear Mr. Smith,
My husband and I own a property just east of the land in question. (14646 N 72nd Ave) I have emailed you once before,
although I did not see my comments in the project paperwork. We have spent countless hours preparing plans for our
property and have worked with P&Z to do so in accordance with SRP on the irrigation issues related to our property as
well as the property in question.
While we are very concerned about the congestion that this potential new development would cause, I have serious
questions about the irrigation plans for this property as well.
I would like you to consider the irrigation system as it is today and that whatever decision is made regarding this
property, any new owners of this property NOT be allowed to change the irrigation system from as it stands today.
Leave in tact and usable as is.
The irrigation is crucial to our neighborhood where animals are being raised and grass is grown to feed them.
The CC&R's for our neighborhood state the Inland Ranchos properties shall remain no less than one acre per parcel.
This, I also feel should be adhered to. This land was meant to be irrigated and should stay conducive to the rest of the
neighborhood.
Thank you for allowing us the opportunity to voice our concerns. Your consideration is greatly appreciated.

Subject: Acoma Estates rezoning Issue
Dear Mr Smith,
I live in the Weedville neighborhood and vehemently oppose the rezoning of the land at 75th and Acoma for a
master planned community. I moved from Gilbert to this neighborhood just a little over a year ago and the main
reason why I moved to this particular house is because of the rural nature. We love the neighborhood as it is,
with acreage with all trees and grass. It is on average 10 degrees cooler on my street just because we don't have
all the concrete, tile roof homes cramped together. If I wanted to live in a master planned community I wouldn't
have left all my friends and 25 years of my life in Gilbert to come to Weedville. I like sitting on my porch and
having horses and tractors come by, my dog being able to greet the neighbors unleashed, at night being able to
see the stars because we aren't being bombarded with street lights.
One of the other things I have noticed being on the crime watch lists is that all the crime, burglary, cars being
broke into, vandals stealing things from the fronts of homes etc. is all happening all around us in all the planned
communities but not in our neighborhood because no one knows we are back here. We are a hidden gem in the
middle of the city and our friendly neighborhood and outright safety is being threatened by yet another master-
planned community wanting to take over our beautiful area.
I already have to hear the constant noise starting at 7 am from the building going on at 71st and Thunderbird for
what the next 2 years until all those tiny homes are built. They said at first those homes were going to be larger
lots and expensive homes now that isn't happening either. All the attention from those home being built and the
traffic from all those cars is going to bring all kinds of crime to our area and good luck getting out of our
neighborhood on 71st anymore it takes forever at that light already now with 100+ more cars trying to all get
out onto 71st as an only exit is going to be a nightmare. They want to do the same with all the traffic onto
Acoma. Too much, too many homes, too much crime associated, to much noise, too much negative light.
As I said before / vehemently oppose the rezoning of the land at 75th and Acoma. It needs to remain rural to
save our community.

Dear Darren and Eric,
Thank you for your notice. However, I need to know what are expectations from neighborhood? So
far, all of neighborhood complains have being overheard and not followed. We just planning not to
vote again for those current board crew members in upcoming election. You already aware that all
neighbors are against such zone change development. We are desired to keep our neighborhood as
County Island with one acre custom housing as it is a last unique gem in Phoenix Valley for a dream
one level housing. There are so much cut through traffic via Acoma as it is and we are experiencing
it already daily. Why would board care about us, people who live in here as you are not part of our
neighborhood. You just put your signatures under an eye pleasing numbers, but for us it is reality of
maintaining our private road of 73rd Avenue that both County and City refuse to fix it.
Our neighborhood is working class, who is working during the week and times of your board
meeting. Of course, my job is important to me as I have to pay my bills and have enough to maintain
73rd Avenue, therefore, I would not be able to attend public hearing. Please keep my vote heard via
this email.
Thanks,
Oksana Kostroski.

Subject: case # Z20188010 Acoma Estates Subdivision
Dear Mr. Hickman and Maricopa County Board of Supervisors,
I am writing to urge you to oppose the rezoning request Case #
Z20188010 Acoma Estates Subdivision.
I am an AZ citizen, voter and home owner living one block from the proposed rezoning site. I chose to live in this
community for the agrarian culture, large lot sizes and county island privileges. The proposed rezoning is too dense for
this neighborhood. The proposal would bring unwelcome traffic and light pollution, and does not fit with the existing
zoning of adjacent land. I ask that you please recognize the burden this places on the surrounding neighborhood
considering that the proposed subdivision would enter and exit only on Acoma road which makes this subdivision more
integrated with the neighborhood. It will not be able to be walled off and isolated as it were (entering and exiting only
on a major arterial street). Instead, this parcel should retain the current zoning or a zoning requiring larger lots more
consistent with the neighborhood in which it resides.
Thank you for your consideration and service to the county.
Sincerely,
Aaron Greeley

Subject: Acoma Estates Subdivision --- Case #Z20188010
Supervisors,
\.
-
My name is Randy Franzmeier. ,,47 address is 7211 West Acoma Dr., Pei, AZ, 85381. I am writing
you to ask that you deny the developer's zoning change request for case #Z20188010. I believe that you are
receiving numerous requests from my neighbors who are also asking that you deny this zoning change. My
property has frontage on Acoma Drive, approximately 350 feet from this proposed subdivision. I have lived in
my home for over 25 years. I searched a long time specifically for this type of property. My property was an
acre of alfalfa at the time I purchased it in 1994. I spoke with the adjacent owners who would soon become my
new neighbors and explained to them the type of home I was going to build and I was welcomed to this area by
all of them. My neighbors and myself chose these irrigated county properties for the very unique and less-
crowded lifestyle that only one acre lots/neighborhoods can provide. I personally designed and drew my own
house plans and built my home by myself I worked with the Maricopa County Building Department and their
Inspectors and I used very little sub-contract labor. It took me approximately 4 years to complete my home. I
have an enormous amount of time, effort and money invested in my property. I am sure you are receiving
letters from my neighbors explaining the lifestyle we share here with the somewhat lower traffic, (traffic used to
be a lot lower, it is now congested at times), the livestock that are on our streets everyday, the fact that we
enjoy the quietness and the darkness with no streetlights or sidewalks, our open irrigation ditches, our luxury to
see coyotes, bobcats, raccoons, owls, quail, rabbits, hawks and many other Arizona wildlife quite often. All of
that is true and truly enjoyed by those of us who choose this lifestyle. A zoning change that would allow 28
homes on 15 acres of land, would absolutely devastate the lifestyle that my neighbors and myself have worked
very hard to achieve and maintain, as well as destroy the natural habitat of the wildlife that live and roam on the
proposed development site.
As you may be aware by now, our lifestyle is precious to us. As you may or may not be aware, there is also
the very serious issue of public safety that you as Supervisors need to consider and in fact, is your duty to
consider. I have been a fireman for nearly 25 years. I have seen the safety issues and the trauma, up close,
when too much traffic is diverted to residential streets. I personally have had 4 vehicles, 3 operated by young,
inexperienced and speeding drivers and the 4th operated by an elderly senior citizen, who have managed to
crash their vehicles into my open irrigation ditch in front of my property. It is an everyday occurrence in our
neighborhood to see horses, mules, sheep, goats and various other domestic livestock on our streets. Acoma
Drive, being a half-mile "collector street", already has a problem with too much traffic. Myself and my
neighbors who operate and haul construction and agriculture machinery on trailers, and those of us who haul
and deliver livestock via trailers have most certainly and definitely been honked at and sped past by
inconsiderate and hurried drivers. I personally have had impatient drivers pass me on both sides of my truck
and trailer, absolutely in violation of state law. I have witnessed impatient and very inconsiderate drivers speed
past and honk at people who are riding their horses. I witnessed a driver honk at some of our 4H and FFA
students who were walking their sheep and steers to prepare for the Maricopa County Fair competition. To
allow more traffic on Acoma Drive and the surrounding streets is exponentially increasing the probability that
an accident will occur. As a fireman, I have seen enough accidents and trauma, all caused by human error,
impatience and believe it or not, absolute intent to cause harm. I am not embellishing anything.
Regarding Acoma Drive being classified as a "collector street", what you as Supervisors may not be aware
of, is the length of Acoma Drive is only 2 miles long in this area. Acoma Drive dead-ends into a Maricopa
County Flood Control canal at 67th Avenue, just 3/4th's of a mile East of this proposed subdivision of 28
houses. Traffic already, today, bottlenecks at 67th Avenue. Acoma Drive dead-ends into the Skunk Creek
watershed at 83rd Avenue. Acoma Drive will NEVER be extended East of 67th Avenue or West of 83rd
Avenue. There is nowhere for it to go. It is absolutely dangerous to increase the traffic on a 2 mile stretch of a
rural area and neighborhood where pedestrians and domestic livestock are the normal, everyday occurrence. A
traffic increase of the size that will come with 28 houses is an accident waiting to happen. If you as our County
Supervisors approve this proposed zoning request, thereby allowing 28 houses to be built in a subdivision that,
we have been told, will have only one means of entry and exit, I believe that you are not only making a
decision that will absolutely destroy our lifestyle but you are also increasing dramatically the probability of
2
accidents occurring and the very L.ifortunate trauma and family hardship tiialways goes hand-in-hand with
such accidents.
Supervisors, please consider the positives that our neighborhood will be losing and the absolute negatives
that will be gained if such a zoning change for a subdivision of 28 houses, with an average of 2-3 vehicles per
house, with only one entry/exit is granted. Arizona is and always has been a rural state. My neighbors and
myself are very fortunate to live in this still-rural area. We intentionally chose this lifestyle. Please do not
destroy an entire, long-established, multi-generational neighborhood, for 28 houses. As our County
Supervisors, you represent all of us that are county residents and taxpayers. So called "progress" is not always
in the best interest of the residents and the Arizona wildlife. An additional 28 houses is not going to make or
break the City of Peoria and/or Maricopa County.
Please deny this developer's zoning request of more than 2 houses per acre and all of the hazards, traffic and
destruction/harm/harassment to wildlife that come with that. Please consider allowing one home per 1-2 acre
lot, which is the long-established norm for this area. 6-10 homes on a 1-2 acre lot size will still bring
"progress" to the area if that is your goal and you, as our County Supervisors, will be best-serving the longtime
and long-established residents of this area,. as well as protecting and providing for the local wildlife. Please
consider the lifestyle and livelihood of your longtime, generational residents.
Thank you for reading/listening and hopefully hearing.
