GJ-11, Serious Injury, Illness, or Death of a Prisoner GJ-2 (07-17-98)
or Inmate
,
PURPOSE
The purpose of this Policy is to establish guidelines that shall be uniformly applied to promote the proper handling
of a critical incident and its resulting investigation following a critical incident.
POLICY
It is the policy of the Office to investigate all critical incidents. Such investigations are conducted to ensure Office
Policy was adhered to, determine if Office Policy needs to be updated, and to ensure that State and Federal laws
were not violated.
DEFINITIONS
Critical Incident: Any incident that involves the use of force by an employee resulting in death or serious
physical injury, the intentional discharge of a firearm by an employee in the performance of his lawful duties, or
the death of a prisoner or inmate, by any means, while in the custody of the Office. This does not include the
following:
1. The natural death of a prisoner or inmate.
2. The necessary dispatch of an animal.
3. The use of a specialized firearm by the Tactical Operations Unit in order to enhance officer
safety, dispense chemical agents, or as an entry device, when no serious physical injury or death
to any person occurs.
Critical Incident Investigation Team (CHT): Selected members of the administrative section of the Internal
Affairs (IA) Division who are responsible for investigating critical incidents strictly for administrative purposes.
The investigation shall be used by the Critical Incident Review Board to determine if there were any violations of
Policy.
Critical Incident Review Board: A group of members from the Office who are responsible for reviewing the
report prepared by the CIIT to determine whether the actions of the involved employees were within Office
Policy.
Inmate: An individual who has been accepted for confinement in an Office jail.
Prisoner: An individual deprived of his liberty and kept under involuntary restraint, confinement, or custody,
prior, to being accepted into an Office jail.

Policy GJ-2, Critical Incident Investigations Effective Date: 03-22-11
Serious Physical Injury: Injury which causes death or creates a reasonable risk of death, severe and permanent
disfigurement, severe impairment of health, or loss or protracted impairment of the functions of any bodily organ
or limb.
PROCEDURES
1. Serious Injury or Death of a Person: The following shall apply to all critical incidents involving an
employee who seriously injures, or causes the death of, a person:
A. As soon as practical, the supervisor will remove the involved employee from the immediate area
of the incident. The supervisor will, if possible, remain with the employee until the initial
investigation is complete.
B. Only minimal, preliminary questions shall be asked about the incident. The employee shall be
advised that a more detailed interview will be conducted at a later time.
C. The employee shall be advised not to discuss the incident with anyone except Office investigators
until the conclusion of the preliminary investigation. Inquiries from the media shall be directed to
the Media Relations Unit.
D. The involved employee will not become a participant in the investigation of the incident, except
for related report writing or Office interviews necessary to the investigation.
E. The case agent or the detective supervisor shall be responsible for taking the employees' duty
weapon for laboratory analysis, if the employee discharged his firearm. During the analysis
period, the employee shall be provided a replacement weapon. This shall be coordinated with the
Range Section and the weapon should be of a similar make and model.
F. Until the investigation is complete and has been reviewed by the Critical Incident Review Board,
the bureau commander, with the concurrence of the Sheriff, shall determine whether the involved
employee remains on duty, is reassigned to administrative duties, or placed on administrative
leave.
G. The employee's supervisor shall contact the Behavioral Health Services Unit (BHSU) within 48
hours of the critical incident to arrange an appointment for the involved employee. This
psychological debriefing will be held within five working days of the critical incident, and is not
optional.
1. The psychological debriefing is an opportunity for the employee to discuss feelings
surrounding the incident and is not an investigation to assess the employee's fitness for
duty.
2. Any employee involved in a psychological debriefing is assured of confidentiality. No
personnel shall have access to any information regarding an employee's participation in
these programs unless the psychologist believes there is an immediate danger to the
employee or others. In this event, the Sheriff will be notified and appropriate action taken
to ensure the safety of those concerned.
a. BHSU shall not be responsible for fitness evaluations. However, the staff
psychologist may recommend to the Sheriff that the employee be placed on
administrative leave when, in the psychologist's opinion, continued duty is
inadvisable.
2

Policy GJ-2, Critical Incident Investigations Effective Date: 03-22-11
b. The Sheriff may then order a fitness evaluation to be performed by a professional
psychiatrist or psychologist not associated with the Office.
1) The Human Resources Bureau shall be responsible for ensuring that an
outside professional is available for such evaluations.
2) The Human Resources Bureau may, at its discretion, use the County's
contracted professional.
2. Critical Incident Notifications: The shift supervisor shall notify the appropriate division commander,
who shall ensure that the IA Commander and the respective bureau commander are notified.
A. Notification to the Police Liaison Deputy County Attorney of the Maricopa County Attorney's
Office shall be made only on the authority of the IA Commander or the Investigations
Commander responsible for the investigation.
B. A member of the County Attorney's Office may respond to the scene of a critical incident to act
in an advisory capacity.
3. Responsibilities of IA and CIIT: The CIIT shall investigate the incident strictly for administrative
purposes, and shall not be involved in the criminal investigation surrounding the incident. Upon
completion of the criminal investigation, the CIIT will prepare a written report of its findings and forward
the report to the IA Commander, who will report to the Sheriff.
A. The information and findings contained in the CIIT report may be used as a basis for
administrative sanctions, civil litigation, management decisions, or training.
B. IA shall cooperate with the County Attorney's Office and the Compliance Division in any civil
litigation resulting from a critical incident.
C. The IA Commander shall also ensure that the CIIT report is forwarded to the Critical Incident
Review Board.
4. Criminal Investigations of Critical Incidents: A parallel but distinct criminal investigation of the
critical incident shall be conducted. If it is unclear as to who shall assume an investigation, the Sheriff
shall make the final decision.
A. The following types of critical incidents may also involve criminal investigation by the General
Investigations Division (GID) when they occur within Office jurisdiction.
1. Any critical incident resulting in the serious physical injury or death of any person.
2. Any critical incident involving the intentional discharge of a firearm which results in
injury or possible injury to any person.
3. Any critical incident occurring within the jail system or County facilities located outside
of the uniform patrol districts.
4. Any other critical incident at the direction of the Sheriff.
B. District detectives will normally investigate incidents involving the discharge of a firearm where
there are no known injuries.
3

Policy GJ-2, Critical Incident Investigations Effective Date: 03-22-11
C. Upon completion of a jail crimes inmate death investigation or prisoner death investigation, an
entire copy of the investigation shall be provided to IA for administrative review.
5. Critical Incident Stress Management (CISM): Employees involved in critical incidents in which no
injuries are sustained may be allowed to remain in their normal duty assignment or assigned
administrative duties at the discretion of the bureau commander.
A. Any employee who is not directly involved in a critical incident, but feels that he is, or may be,
negatively affected as a result of it, is strongly encouraged to take advantage of CISM Program by
contacting the Communications Division, as specified in Policy GC-22, Critical Incident Stress
Management Program.
B. Each CISM team includes a mental health professional who can make counseling services
available. The counseling program is also open to the spouses or immediate families of any
involved employees.
6. Critical Incident Review Board: The review board shall be comprised of five members, including the
Chief Deputy, two bureau commanders selected by the Chief Deputy, and two rotating members.
A. The Chief Deputy shall be the chairman and the only permanent member.
B. A bureau commander may be an alternate chairman when the Chief Deputy is unavailable or
when a conflict of interest exists.
C. The chairman shall select rotating members from the Office at large. One member shall be a
command officer and the other shall be a peer of the involved employee.
D. The Critical Incident Review Board shall conduct a review as soon as possible after receiving
CIIT' s written report and the County Attorney's review letter, when applicable.
1. The Board shall review the entire investigative process, and the facts and circumstances
surrounding the incident, and determine whether the actions of the involved employees
were within Office Policy.
a. The Board may request further investigation by the CIIT.
b. The Board may make their findings on the basis of the original or any additional
reports.
2. The Board may request a member of the County Attorney's Office to provide legal
assistance and advice. However, the attorney shall not sit as a member of the Board.
3. All reports, photos, documents, or other evidence shall be made available to the Board for
the review.
4. At the conclusion of the review, the Board shall direct the CIIT to supplement the report
with the findings.
a. The Board will have determined whether the incident involved any violations of
Policy. Such violations will be referred to the appropriate supervisor for further
disposition, as specified in Policy GC-17, Employee Disciplinary Procedure.
4

Policy GJ-2, Critical Incident Investigations Effective Date: 03-22-11
b. The Board may recommend Policy revisions which may be deemed necessary to
maintain effective accountability, control, and integrity within the Office.
C. The employee who is the subject of the investigation will receive a letter
notifying him of the findings of the Board.
E. The findings of the Board shall be made a permanent part of the CIIT report and shall be filed in
IA.
F. The information contained in the CIIT report is confidential, as allowed by law, but may be made
available in abstract form to the involved employee's bureau commander, and if appropriate,
forwarded to the Training Division.
7. Checklists: Checklist addendums are provided for use by sworn, detention, and supervisory personnel to
serve as a guideline when a critical incident has occurred.
