As long as there is proper shelter, food and water supply they will be safe. (C-19-18-060-G-00) Motion to approve by Supervisor Gates, seconded by Supervisor Barney Ayes: Barney, Chucri, Gates, Hickman, Gallardo Formal Meeting Minutes Wednesday, June 27, 2018 Page 8 of 72 Elections - Elecciones 11. CANCEL ELECTIONS FOR PRECINCT COMMITTEEMEN AND APPOINT TO OFFICE Approve Maricopa County Elections Department request to cancel elections for precinct committeemen in all precincts which are uncontested pursuant to A.R.S. §16-410 and appoint the precinct committeemen to fill the term of office. Also, declare vacant those positions where no nomination petitions for a candidate and no nominations for a write-in candidate have been filed to fill the position for which the election is being held. Such position shall be filled in accordance with laws governing the filling of those vacancies. The Arizona Legislature offers an alternate procedure for electing precinct committeemen (A.R.S. § 16-410). If the total number of persons who file a nomination petition as of May 30, 2018, or write in nomination paper as of June 13, 2018, is equal to or less than the number of positions to be filled for each office to be elected at the Primary Election, the County Board of Supervisors is authorized to cancel the election. The Board of Supervisors is also authorized to appoint those persons who filed a nomination petition or write in nomination paper to serve as a precinct committeemen for the respective term. A person who is appointed pursuant to this section is fully vested with the powers and duties of the offices as if elected to that office. The list of precinct committeemen whose elections are cancelled and appointed to office is on file with the Clerk of the Board of Supervisors. This will allow the County to not print candidates on ballots for committeemen in those precincts which are uncontested. (C-21- 18-007-M-00) Chairman Chucri asked the Clerk to explain the special circumstances. Fran McCarroll, Clerk of the Board of Supervisors, stated four (4) Board members have conflict of interest letters because they are running for Precinct Committeemen subject to this particular agenda item. She noted the necessity to use Arizona Revised Statute 38-508, which contains a provision called the rule of impossibility if the quorum of the Board has to be conflicted out and as long as it is made known at the meeting that there is a conflict and the letters are on file then they may go ahead and vote. Chairman Chucri stated this is a first for this Board. Motion to approve by Supervisor Barney, seconded by Supervisor Gallardo Supervisor Gallardo stated there was previous discussion of cancellation of precinct committeemen elections due to specific reasons. He asked if there has been consideration of not cancelling the elections. He understands the general election and perhaps school boards due to space on the ballot but in this particular case it is on a primary election ballot, there is no space issue and for the most part it is not a money issue anymore. In the past, each name had to be entered and proofread but with today’s technology it is much easier. He asked Election’s staff on their thoughts for 2020 of leaving the precinct committeemen on the ballot for an election. Adrian Fontes, County Recorder, referred the question to Kristine Passarelli, Assistant Director of Services, to explain the details. The current process is what has been done in the past. Ms. Passarelli explained what the main focus of the cancellation does and what will happen if the precinct committeemen election is not cancelled. She further explained Formal Meeting Minutes Wednesday, June 27, 2018 Page 9 of 72 that not cancelling the election will create an entirely separate ballot for those parties. Independents are not eligible to vote for precinct committeemen and there is a separate ballot created for each party if that precinct has an election. She stated there are currently 16 precincts that are contested. Supervisor Gallardo asked how many different ballot styles are currently being utilized with and without precinct committeemen. Ms. Passarelli responded there are 4,000 without precinct committeemen and for each precinct that has a precinct committeemen election there would be a separate ballot for each party. Mr. Fontes stated because there are several ballot styles in many of the precincts. The number of ballot styles required would multiply significantly if uncontested races were added. Supervisor Gallardo requested dialog for the Board in the future 2020 elections. Regardless of the status of the office it is a public office which circulates petitions, gets on the ballot, and the voters have the right to vote. If the intent is to always cancel the election then the County must go to Legislature to take the petition requirement off to not make it more of a party type office where the political parties deal with it. He asked that there be further discussion to possibly change this in the future. Chairman Chucri acknowledged Supervisor Gallardo’s request for further discussion on changing the statute is valid. He then thanked Supervisor Gallardo, Mr. Fontes and Ms. Passarelli. Ayes: Barney, Chucri, Gates, Hickman, Gallardo 12. BUDGET ADJUSTMENT FOR ELECTION COSTS FY18 In accordance with A.R.S. §42-17106(B), approve the following: 1. The increase in expenses is offset by an increase in revenues from the Cities or Schools for holding their elections. AGREEMENT FOR OUTPATIENT SAMPLE PROGRAM WITH JANSSEN PHARMACEUTICALS, INC Adopt a Resolution which authorizes an Agreement between Janssen Pharmaceuticals, Inc. and Maricopa County through the Department of Correctional Health Services, for the purpose of a free medication program for psychiatric patients. Approve and authorize, by Resolution, Maricopa County by and through its Department of Correctional Health Services (MCDCHS), to process an non-financial Outpatient Sample Program (OSP) form (1050041-SUS170114941) with Janssen Pharmaceuticals, Inc., for free samples of INVEGA SUSTENNA (paliperidone palmitate), up to six (6) units per dosage, 156 mg and 234 mg. This Agreement is non-financial and is effective from June 27, 2018 until June 27, 2023. Long acting injectable (LAI) antipsychotic medications are used frequently in the community for psychiatric conditions, including schizophrenia, schizoaffective disorder, and bipolar disorder. Given the large number of jail inmates with psychiatric conditions who get treated with LAI medications in the community, best practices dictate that these medications be continued in jail for patients who are stable and compliant on LAIs. The cost of LAIs is significant. On average, 200 patients per month are receiving injectable antipsychotic medications in Maricopa County Jails. This comprises 20% of the monthly pharmacy budget for a jail population of 7500. Fortunately, pharmaceutical companies understand the burden that LAIs have on county budgets and have programs designed specifically to provide medications, free of charge, to incarcerated populations. Creating a partnership with these companies will allow for continuity of care on patients, while in jail, who are stable and compliant in the community with LAI medications. MARICOPA COUNTY EMPLOYEE MERIT SYSTEM ELIGIBILITY GUIDELINES REVISION Approve the amended Maricopa County Employee Merit System Eligibility Guidelines, originally adopted on June 24, 2015 (C-31-15-042-6-00). Over the past several years, the County has been working to mirror best practices in order to have an engaged and exemplary customer service focused workforce. Some of the major enhancements include: • Revisions to the Employee Merit System Resolution to promote lean and efficient government and eliminate antiquated practices • Updating personnel policies to build a high performing workforce • Automating the onboarding process through system enrichments • Forming workforce transformation teams to streamline and improve personnel processes and timeliness • Restructuring the employee performance management and employee discipline procedures The following amendments have been made to the Guidelines including certain positions removed by appointed departments and positions which are eligible for removal by Elected Offices from the Maricopa County Employee Merit System: Effective July 3, 2015: • County Manager, Deputy County Managers, and Assistant County Managers • Chief Deputies of Elected Officials • Department Directors and Deputy Directors • One position in each department that reports to the Director or Deputy Director • Certain FLSA exempt level administrative positions (later clarified to include: 1) Managers, 2) Deputy Constables pursuant to ARS 22-131(C), 3) Personal staff of elected officials, executive county management, and department directors) • Contract and temporary positions Effective April 24, 2017: • “Other positions approved by the Board” (added to Guidelines) • County Appraiser Supervisor positions Effective February 12, 2018: • Supervisors Formal Meeting Minutes Wednesday, June 27, 2018 Page 28 of 72 • Professionals and above (typically requires a bachelor’s degree or higher) Effective July 16, 2018: Approve amended Guidelines to add to the current Guidelines these positions that will no longer be covered by the Merit rules to include: • All non-sworn and non-detention positions The Merit System Eligibility Guidelines were originally approved by the Board on June 24, 2015 (C-31-15-042-6-00) and revised on April 26, 2017 (C-31-15-042-6-01) and February 7, 2018 (C-31-15-042-6-02). (C-31-15-042-6-03) Monica Pimentel, stated she has been a County employee for 16 years. She worked 15½ years with Adult Probation in pre-trial services and the last six months at Animal Care & Control. She noted the following concerns: wording of the item too vague; unsure of the benefit for employees to be removed from current Merit System and made an at-will employee; and current employee retention problems. She noted there are great benefits for working for the County and she is concerned with retaining employees if they are changed to at-will employees. Chairman Chucri thanked Ms. Pimentel for attending and noted the items will bring the County up-to-date with personnel issues. Many of the Board are from private sector background and bring a business mindset to government. This is intended to make the County more competitive. This action will achieve much needed changes in the 4th largest County in America. Jan Plank, Human Resources Director, stated no current employees are effected unless they choose to be or move to a new position. There is a sick leave benefit that would double for classified employees who choose to move to unclassified status. She stated that during the past year significant policies have been passed by the Board that have increased protection for all employees such as the employee discipline policy. The County is going in the direction of greater protection for all employees. Chairman Chucri stated the plan is not perfect but it is making the County more competitive. He noted this is a capstone of overall employee reform. Motion to approve by Supervisor Gates, seconded by Supervisor Barney Supervisor Gallardo stated the provision applies to newly hired employees, however, he still has concerns noting there is a level of guarantee to the employees of due process that no one is going to be fired for an unjust cause. The Merit System is all about a level of comfort for employees. He noted his own experience as a previous County employee of 14 years and understands the comfort of this coverage. He said this is something that new potential employees will look at and turn away. He will not support the item and knows the importance of having a Merit System. The Board should be trying to protect it and strengthen it not take it away from new hires as it is not a way to recruit the best talent. It is not a good way to send a message to future employees. He asked Ms. Plank if he is correct in his assumption that when a current employee moves or is promoted to a different position they will no longer be protected by the Merit System. Ms. Plank confirmed that Supervisor Gallardo is correct. Supervisor Gallardo stated there are some unintended consequences that as a Board they need to think about. He appreciates the efforts being made to update the personnel policies but he has strong concerns about this item. SUPERVISORS'/COUNTY MANAGER'S SUMMARY OF CURRENT EVENTS Resumen de temas de actualidad de los Supervisores/Administrador del Condado Supervisor Gallardo noted that a community resource fair was recently held at a public swimming pool where parents were able to receive information for service eligibility from non-profit providers, County programs and City of Phoenix programs while their children were able to swim and have fun. He stated it was held in South Phoenix and more than 200 individuals participated. He announced that the next collaborative community resource fair will be held on Saturday, June 30, 2018. There is no swimming pool available at the park but there will be activities, inflatables, water balloon fights, a DJ, food and drinks. This is another opportunity to get families connected to services that they would otherwise not be aware of. For the event, District 5 has partnered with City of Phoenix, Cartwright School District and the Phoenix Suns who graciously donated basketballs. There will also be a three-on-three tournament at the site. He then asked that everyone travel safely during the break between meetings and during the holiday. Chairman Chucri commended Supervisor Gallardo for his work in organizing a community resource fair. Supervisor Hickman asked that everyone travel safely during the break between meetings and during the holiday. He reported that he and Scott Isham, District 4 Chief of Staff, had a recent meeting with Brigadier General Todd D. Canterbury at Luke Air Force Base (LAFB) where they were briefed on LAFB collaborations with County, Municipal, State and Federal governments. He was told that the County was given glowing remarks on how helpful the County has been on offering services. He noted Brigadier General Canterbury used to be the life guard at the LAFB swimming pool while his dad was the Commanding Officer at LAFB during Desert Storm. Supervisor Gates reminded everyone that it is Flood Awareness Week and thanked everyone at Flood Control for the great work they do. He noted that monsoon season is approaching which will bring rain that may create flash floods. He explained the dangers of crossing flooded water in washes and the dangers of lightening as well. He wished everyone a happy and safe 4th of July holiday. Supervisor Barney noted some significant personnel changes with Carol Johnson, Planning & Development Director, leaving the County after a year of service and he wished her well. He announced that Jennifer Pokorski would be stepping in as the new Director to carry on the workload as there is much to be done. He thanked Joy Rich, County Manager, and Reid Spaulding, Deputy County Manager, for their leadership and Ms. Pokorski’s willingness to step in. He noted the Board is excited to continue to move forward on making improvements in the Planning & Development area. Supervisor Barney then wished Brian Hushek, Deputy Budget Director, good luck in his retirement and noted Mr. Hushek has been with the County for nearly 25 years. Mr. Hushek has been a tremendous resource and his wealth of institutional knowledge will be missed. Supervisor Barney offered Mr. Hushek his appreciation for being a part of the budget team that provides support to the Board in managing a $2.5 billion dollar budget. With Formal Meeting Minutes Wednesday, June 27, 2018 Page 65 of 72 thousands of line items it could not be done without great support and assistance from individuals such as Mr. Hushek. Reid Spaulding, Deputy County Manager, noted he is humbled to sit on the dais and had no further comments. Chairman Chucri thanked Ms. Monica Pimentel for her attendance and her presence is an example of what represents Maricopa County. She saw something and said this is my family, my home and he understands that. He stated it represents what the Board is trying to do as we rise together as a County. We sometimes unfortunately might fall but at the end of the day we are one and we will continue to be the fastest growing county in America. He thanked his colleagues and wished everyone a happy 4th of July holiday. REQUEST FOR QUALIFICATIONS AND AWARD FOR CONSTRUCTION MANAGER AT RISK FOR MCMICKEN DAM PHASE 2 REHABILITATION PROJECT Authorize the Flood Control District of Maricopa County (District) to issue a Request for Qualifications for a qualified construction manager/general contractor to provide Construction Manager at Risk (CMAR) services under Contract (2018C006) for the McMicken Dam Phase 2 Rehabilitation Project (Project) and award a Pre-Construction services contract to the successful respondent not to exceed $500,000. The Flood Control District of Maricopa County has initiated design work for rehabilitation of two of five construction phases for McMicken Dam under a consultant contract with AECOM. The Arizona Department of Water Resources (ADWR) identified dam safety improvements required to bring the dam up to current safety standards. Phase 1 of the improvements is the construction of a structural emergency spillway and principal outlet under a separate contract. Phase 2 construction will consist of new dam embankment north and south of the new emergency spillway, a dike to capture flows from Picacho Wash, a soil cement drop structure on Picacho Wash, a low flow channel to carry flows to the new outlet and construction of a realigned outlet channel. Outlet channel dikes will also be constructed on the left and right sides of the emergency spillway to direct emergency spillway flows downstream. The Phase 2 construction contract may also include safe and proper abandonment of up to five existing CMP (corrugated metal pipe) outlets located within/through the existing dam located further to the south. Dam projects are complex and the Construction Manager At Risk contracting method allows the District to select a contractor based upon qualifications to provide input during design prior to going to construction. The Phase 2 construction cost is currently estimated to be $25 million. This Agenda Item impacts Supervisorial District 4. DISSOLUTION OF LIBRARY DISTRICT CITIZEN'S ADVISORY COMMITTEE Effective July 1, 2018, dissolve the Maricopa County Library District Citizen's Advisory Committee. (C-65-18-037-M-00) Formal Meeting Minutes Wednesday, June 27, 2018 Page 71 of 72 Supervisor Gallardo questioned the benefit of dissolving the advisory committee. The Board values public input and participation. He asked what will be in place for public input. Cindy Kolaczynski, Library District Director and County Librarian, explained that in order to be more efficient and effective community conversations will be held within diverse communities instead of having four to five committee members who meet once a month. She noted those that live in the areas such as Gila Bend and Yuma will have a voice as well. Supervisor Gallardo suggested that the advisory committee hold the monthly meetings in different locations within the county. He noted his support of getting community members more involved. Ms. Kolaczynski responded that the committee held monthly meetings in different locations within the county. She noted the participating committee members have diminished to four to five active members without much community input. If community meetings are held it would give the public a chance to contribute to input. Supervisor Gallardo if the advisory board membership is not participating then it is upon the Board to replace those members to make sure there are active participants. He spoke about the importance of the Board appointing committee members who are active participants. He stated his concern in dissolving the Citizen’s Advisory Committee and how it will effect citizen input. Chairman Chucri thanked Ms. Kolaczynski for her comments. Motion to approve by Director Barney, seconded by Director Hickman Supervisor Barney noted his appreciation of Supervisor Gallardo’s comments and stated it is imperative that the Board hears from the community. He noted his appreciation of the effort that Ms. Kolaczynski and her team have gone through in terms of outreach. This new approach is more dynamic and if it does not work then another plan will need to be found. He said Candice Copple, District 1 Chief of Staff, has attended a number of meetings and noted it has become more of a reporting meeting rather than an advisory meeting. The new format is exactly what Supervisor Gallardo is talking about on getting more community input to adjust programming and target the needs of the constituencies that we serve. He stated it is about the County being the best in class and the County needs to be dynamic in change. If this plan does not work then the Board will need to make another change to the plan.
