Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: November 28, 2018 (continued from October 10, 2018)
Case #/Title: Z2018051 – White Tank Vistas
Supervisor District: 4
Applicant/Owner: David Bohn, Westwood Professional Services / Verma MD2
Sonoran Ridge Estates 195/Northern
Request: Zone Change from Rural-43 RUPD to R1-6 RUPD
Site Location: Generally located 2,900’ west from the corner of Perryville Rd.
and Northern Ave. in the Waddell area
Site Size: Approximately 109 acres
County Island Status: N/A
Additional
Comments: There are no outstanding concerns from reviewing agencies.
Staff received a total of 60 documents of opposition
(attached) to the zone change request. It should be noted
most of these were received after the Commission hearing
and include duplicate individuals. There were several people
in opposition that attended and spoke at the Commission
hearing where many of these people are owners of properties
within the Sonoran Ridge Estates Unit 4 subdivision north of
the subject site. The opposition states issues with traffic,
increased density, drainage issues, street lighting impacting
the desert environment, among others.
Staff has also received 3 support letters (attached) after the
Commission hearing. The letter from Richard D. Schust states
that they are the owner of lots (11 total within 300’ of the
subject site) in the existing Sonoran Ridge Estates Unit 4
subdivision located north of the subject site. The ownership is
listed under First American Title Trust 8702 (First American Title
Insurance Company TR). The letter from Binu Verma states
that they are the owner of 9 lots within Sonoran Ridge Estates
Unit 4 subdivision (1 within 300’ of the subject site). The
ownership is listed under Sonoran Ridge Investments 7 LLC.
The last support letter received is from Mohini Ahuja (Mohini
Properties LLC) where they have 1 lot located within the
Sonoran Ridge Estates Unit 4 subdivision (not within 300’ of the
subject site).

The opposition/support map is provided as an attachment to
this report. The map shows 9.26% parcel area and 18.75%
parcels by number within the 300’ area are opposed to the
request. There are 48 eligible parcels where 12 are in support
and 9 are opposed. This does not trigger a super majority
vote.
It’s important to note that the western boundary of Sonoran
Ridge is adjacent to the Jackrabbit Trail alignment and
Arizona State Land Department (ASLD) land. ASLD land will
eventually be disposed to private property for development.
It’s 1 plus miles further west to the preservation land of the
White Tank Regional Mountain Park.
Lastly, since the P&Z hearing on 9/6/18 and 10/10/18 BOS
hearing, staff has reviewed the concerns from the
surrounding community and has worked with the applicant
on updating and adding recommended conditions. The
following recommended changes to conditions ‘a’ and ‘c’
are provided for the Board to consider with changes
provided in red and underlined:
a. Development and use of the site shall comply with the
Narrative Report entitled “White Tank Vistas”,
consisting of 10 pages, dated stamped received July
13, 2018, except as modified by the following
conditions. Within 30 days the narrative, including site
plan, shall be revised in accordance with the
conditions of approval identified herein.
c. The following R1-6 RUPD standards shall apply:
1. Minimum Lot Area: 4,950 6,000 sq. ft., except a
minimum of 18,000 sq. ft. for all lots immediately
adjacent to the open space setback along the
entire boundary with Sonoran Ridge Estates.
2. Minimum Lot Width: 45’ 60’
3. The zoning district shall be limited to a maximum
of 290 lots.
4. Minimum 100’ open space setback along the
entire boundary with Sonoran Ridge Estates.
Commission
Recommendation: On 9/6/18, the Commission voted 7-0 to recommend
approval of Z2018051 subject to conditions ‘a’ – ‘e’:
a. Development and use of the site shall comply with the Narrative Report entitled
“White Tank Vistas”, consisting of 10 pages, dated stamped received July 13, 2018,
except as modified by the following conditions.

b. The following Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development
approval is inferred by this review, including, but not limited to drainage
design, access and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further
review and/or entitlement.
2. Right-of-Way dedications for perimeter streets will be required as follows
with plat approval, unless otherwise waived by MCDOT:
Northern Avenue: 65 feet
Jackrabbit Trail: 70 feet
191st Avenue: 40 feet
3. Development of the site will require offsite right-of-way acquisition and
roadway improvements to provide a minimum two (2) paved points of
access. Road improvements shall meet the minimum requirements of
MCDOT for each respective road classification.
4. A Traffic Impact Study to address traffic impacts and (additional) roadway
improvements required to support the proposed development must be
submitted with the Preliminary Plat application.
5. If required, submission of a CLOMR application to the Flood Control District
must be made prior to or concurrent with the application for Preliminary
Plat.
c. The following R1-6 RUPD standards shall apply:
1. Minimum Lot Area: 4,950 sq. ft.
2. Minimum Lot Width: 45’
d. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article
304.6, and ARS § 11-814 for five (5) years for the initial phase and an additional five
(5) years for each subsequent phase, within which time the subdivision
infrastructure permit or construction permit for each phase must be obtained.
e. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, does not reduce any rights that existed
on the date of application to use, divide, sell or possess the property and that
there would be no diminution in value of the property from the value it held on the
date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.

Project Summary:
1. The request is for a zone change from Rural-43 RUPD to R1-6 RUPD for a future 330 lot
single-family subdivision known as White Tank Vistas on approximately 109 acres. The
subject site is located west of the corner of Perryville Rd. and Northern Ave. in the Waddell
area. A related Preliminary Plat (S2018021) is pending for the subject site. The site currently
consists of two separate parcels - APN's 502-09-011Q and 502-09-011T.
Aerial Map of Subject Site and Surrounding Area
2. The subject site was originally zoned Rural-43 RUPD with case Z99-26 and subsequently
amended with Z00-188. These cases were for 310 acres which included the already
platted Sonoran Ridge Estate Unit 4 to the north of the subject site. The applicant is
requesting that the site be changed to include smaller lots under the R1-6 zoning district.
With this change in the current zoning, the applicant is also requesting a Residential Unit
Plan of Development Overlay (RUPD) to request deviations in minimum lot area and lot

Public Participation Summary:
4. The applicant complied with the requirements for notification to the property owners
within 300' of the subject site and postings of the subject property. The applicant has also
provided staff with a Citizen Participation Final Report detailing the public process
(summary attached). There was a neighborhood meeting held on July 10, 2018 in which
approximately 24 attendees from the public joined. The results report includes details
about the meeting and the discussion points. To date, staff has received 2 documents of
opposition and 1 document of support (attached). There is stated concerns with traffic
and increased density. The support mentioned having developed unoccupied vacant
land than the current conditions.

Outstanding Concerns from Reviewing Agencies:
9. N/A
Staff Analysis:
10. Staff is in agreement with the request as proposed for the zone change of the subject
site for a future maximum 330 lot residential subdivision. Even though the proposed zone
change and future preliminary plat would be a higher density of the area with smaller
lots, the change would result in an approximate density of 3 d.u./ac. which would be
within the White Tank/Grand Ave. Area Plan designation density of 2-5 d.u./ac. The
Zanjero Trails DMP across the 191st Ave. alignment to the east already has various single-
family zoning districts already approved at a higher density. It should be noted that a
water provider is still being determined which would need to be resolved during the
platting process.
The proposed RUPD overlay to decrease the minimum lot area from 6,000 sq. ft. to 4,950
sq. ft. and to decrease the minimum lot width from 60' to 45' is justified. The lots would
still meet the required setbacks for R1-6 zoning and minimum lot area per dwelling unit is
required to maintain 6,000 sq. ft. on average. This would equate to the future
development providing a minimum of 34.8% of open space area with a layout to be
determined at the time of platting. There would also be future amenities for the
proposed subdivision community to include such features as tot-lots, clubhouses,
ramadas, etc.
Z2018051

12. Staff recognizes the concerns and issues by the public regarding this request. The
applicant has provided good examples of how the future development would include
landscaped buffer areas and generous open space. Also, there is no proposed access
to the Sonoran Ridge Estates subdivision other than emergency access. MCDOT is
requiring a Traffic Impact Study and right-of-way dedication for the three public
roadways adjacent to the site to see potential impacts and if additional improvements
are required to support the proposed development. Lastly, and as previously
mentioned, the density proposed would be less than the area plan maximum for Small
Lot Residential land use designation.
13. County engineering and environmental reviewers have provided memos with no
objections to the request. Engineering conditions are included within the
recommendation by staff. Luke Air Force Base (LAFB) and Maricopa County Sheriff's
Office (MCSO) provided no objection memos and emails.
14. As part of the recommendation, staff includes a condition for the requested zone change
which falls under the "Conditional Zoning" regulations within Article 304.6 of the Maricopa
County Zoning Ordinance (MCZO) and ARS § 11-814. This is for a 5 year period to allow for
obtaining a Final Plat/Infrastructure Permit for the initial phase of development of the
proposed subdivision.
Recommendation:
15. For reasons outlined in this staff report staff recommends the Commission motion for
approval with conditions 'a' - 'e' of Z2018051.
a. Development and use of the site shall comply with the Narrative Report entitled
"White Tank Vistas", consisting of 10 pages, dated stamped received July 13, 2018,
except as modified by the following conditions.
b. The following Engineering conditions shall apply:
1 Without the submittal of a precise plan of development, no development
approval is inferred by this review, including, but not limited to drainage
design, access and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further
review and/or entitlement.
2. Right-of-Way dedications for perimeter streets will be required as follows
with plat approval, unless otherwise waived by MCDOT:
Northern Avenue: 65 feet
Jackrabbit Trail: 70 feet
191si Avenue: 40 feet
3. Development of the site will require offsite right-of-way acquisition and
roadway improvements to provide a minimum two (2) paved points of
Z2018051

access. Road improvements shall meet the minimum requirements of
MCDOT for each respective road classification.
4. A Traffic Impact Study to address traffic impacts and (additional)
roadway improvements required to support the proposed development
must be submitted with the Preliminary Plat application.
5. If required, submission of a CLOMR application to the Hood Control District
must be made prior to or concurrent with the application for Preliminary
Plat.
c. The following R1-6 RUPD standards shall apply:
1. Minimum Lot Area: 4,950 sq. ft.
2. Minimum Lot Width: 45'
d. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article
304.6, and ARS § 11-814 for five (5) years for the initial phase and an additional
five (5) years for each subsequent phase, within which time the subdivision
infrastructure permit or construction permit for each phase must be obtained.
e. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval
allows the property to enjoy uses in excess of those permitted by the zoning
existing on the date of application, subject to conditions. In the event of the
failure to comply with any condition, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value if held on the date of application due to such
revocation of the Zone Change. The Zone Change enhances the value of the
property above its value as of the date the Zone Change is granted and
reverting to the prior zoning results in the same value of the property as if the
Zone Change had never been granted.

Purpose of Request
This application is being filed on behalf of the property owner, Vermaland, LLC, in order to rezone the vacant
109-acre property located at the northwest corner of 191st Avenue and Northern Avenue in the
unincorporated portion of Maricopa County, Arizona (the "Property"). See Aerial Map at TAB A. The Property
consists of two parcels: Maricopa County Assessor Parcel No(s): 502-09-011Q and 502-09-011T.
The Property is currently zoned Rural-43 (RU-43) Residential Unit Plan of Development (RUPD). See Zoning
Map at Tab B. The Property is designated within the White Tank/Grand Avenue Area Plan for "Small Lot
Residential 2-5 du/ac." See Area Plan Map at TAB C.
This request seeks to rezone the Property from RU-43 RUPD to R1-6 RUPD in order to accommodate a 330-
unit single-family subdivision named, "White Tank Vistas." The proposed project will allow the applicant to
move forward with a development on a site that has remained vacant since it was first zoned for one-acre
residential lots over 19 years ago. The proposed zoning will accommodate a variety of lot sizes ranging from
a minimum of 4,950 square-feet up to 18,000 square-feet as shown in the table below:

Description of Development Proposal
Location and Site History
As noted above, the Property is generally located at the northwest corner of 191st Avenue and Northern
Avenue in the unincorporated portion of Maricopa County, Arizona, It was first zoned RU-43 RUPD as part
of the Sonoran Ridge Estates RUPD in 1999. The original zoning case established the RUPD overlay for
approximately 310.89 acres at the northwest corner of 191st Avenue and Northern Avenue. Roughly two-
thirds of the original site was platted for single-family home development, with 153 lots ranging in size from
approximately 30,000 square feet to over one acre. In the last two decades, approximately 77 of these lots
have been developed. The rest of the lots — along with the Property — remain vacant and undeveloped.
The location of this community and the minimum lot size available under the existing entitlements creates an
extremely small niche market, illustrated by the fact that homes have only been constructed on half of the
available platted lots in the last 19 years, In order to encourage continued growth, investment, and
development in this area, a range of housing options must be available. The substantial inventory of large,
acre-plus undeveloped lots on the platted portion of the Sonoran Ridge Estates subdivision provides
White Tank Vistas Page 13

adequate justification for additional density on the Property that aligns with the White Tank/Grand Avenue
Area Plan.
Project Description
The applicant is requesting to rezone the Property from RU-43 RUPD to R1-6 RUPD for the development of
White Tank Vistas, a 330-unit single-family gated community. The proposed project will offer a broad range
of lot sizes and housing types for single-family living in a unique desert environment near the base of its
namesake, the White Tank Mountains. This new community of quality-built, single-family detached homes
with a variety of open space areas will add to the housing options available in the area and enhance
employment attractiveness with quality living environment at a range of approachable price points. In order
to tailor the development to the unique conditions of the site and create an appropriate transition in residential
density between the proposed project and the existing Sonoran Ridge Estates development, the applicant is
requesting an RUPD overlay in conjunction with the underlying R1-6 zone change.
The requested RUPD overlay provides an alternative to the traditional development standards found in the
underlying zoning district. This allows the applicant to create development standards that are responsive to
the unique site topography and contextual circumstances in the area or otherwise promote a creative and
efficient approach to land development (such as a tailored list of permitted uses or modified development/bulk
standards). In this instance, the applicant is requesting an RUPD overlay to address the irregular shape of
the Property, its unique topography (including an existing wash that runs along the eastern border of the
Property), and develop the site in an efficient manner by employing a range of lot sizes to accommodate
several housing types.
The uniquely shaped site has topographical constraints, but the overall design approach creates a more
naturally scenic environment. The residential development has nearly 35% of the site area dedicated for
common open space. See Conceptual Site Plan at TAB D.
The community offers adequate open space for onsite retention, landscape buffers from the adjacent right-
of-way, and landscape tracts adjacent to all corner lots, as well as open space corresponding to natural
washes. White Tank Vistas is designed to complement existing land uses and provide appropriate buffers
and transitions in response to the existing built environment, including the following:
1 Maximum density of 330 homes is less than that allowed under the current General Plan designation.
This application does not propose to increase density over that allowed under the current General
Plan designations, and incorporates strategic landscape buffers, trails and other community
amenities within the site plan to create a truly livable and walkable community.
2. 80 min Landscape and Open Space Buffer along the southern, western and eastern project
boundaries. A landscape buffer outside of the Property's perimeter wall that will include enhanced
landscaping and trees for visual buffering.
3. Generous Open Space Commitments. A minimum of 34.8% of the net land area within the project,
approximately 37 acres, will be strategically set aside for community open space and buffers. This
amount far exceeds the 10% open space required by the Maricopa County Zoning Ordinance. Open
space will be meaningfully located within (10) large amenity/recreation areas. Other paseos and
pedestrian areas will be used to ensure easy access for residents to traverse the entire project site
White Tank Vistas Page I 4

and to reach amenities outside of the Property. See the Conceptual Landscape Plan for details and
overview of landscape and open areas.
White Tank/Grand Avenue Area Plan
As noted above, the Property falls within the Maricopa County White Tank/Grand Avenue Area Plan (the
"Plan"), which designates the Property as Small Lot Residential (2-5 dwelling units/acre). The proposed
White Tank Vistas subdivision will offer 330 single family detached units across an area of approximately
109.45 acres — an overall density of 3,02 dwelling units per acre. The proposed density aligns with the
County's vision for future residential development in this area, and the project furthers important goals and
objectives identified in the Plan:
• Goal Ll : Promote efficient land development that is compatible with adjacent land uses, is well integrated
with the transportation system, and is sensitive to the natural environment,
o Objective L1.2: Encourage the use of planned communities that provide a variety of land uses,
housing types, employment opportunities, and offer a safe and pleasant living and working
environment.
Policy L1.2.4: Encourage the use of flexible planning and design techniques.
White Tank Vistas advances an important overall goal and specific objective within the Plan. The RUPD
option allows the applicant to configure varying levels of internal residential density in a manner that is
sensitive to the larger homes and lots to the north, providing appropriate transitional density between the two
neighborhoods. This design consideration is responsive to specific concerns raised by neighbors in Sonoran
Ridge Estates regarding residential density and intensity adjacent to their homes. To improve the
compatibility between the two developments, 18,000 square-foot lots have been placed along the northern
end of White Tank Vistas, providing a density buffer between the larger rural homes in Sonoran Ridge Estates
and the higher densities within the proposed project.
Additionally, White Tank Vistas has been designed with a significant amount of open space and landscaping
to remain sensitive to the surrounding desert environment. The flexibility afforded by the proposed RUPD
allows the applicant to adjust the lot sizes in a manner that balances appropriate levels of density with the
provision of open space sufficient to match the character of the area and adjacent neighborhoods. In short,
White Tank Vistas is precisely the type residential development envisioned by Maricopa County for this area.
Development Standards
Due to the irregular shape of the Property, the unique topography, open space considerations, and the Area
Plan goal of providing a range of housing types, the applicant is requesting an RUPD overlay along with the
underlying zone change in order to provide flexibility in the R1-6 development standards. Accordingly, the
applicant is proposing the following development standards for White Tank Vistas:

Relationship to Surrounding Properties
The Property is flanked on three sides by vacant land that is rural in character. To the north of the Property
is the platted portion of Sonoran Ridge Estates, which contains 153 lots between 30,000 and 50,000 square
feet. Approximately 77 of the lots are developed with single-family homes.

Location and Accessibility
Two full-access driveways are proposed along the southern border of the Property adjacent to Northern
Avenue which provides access to 191st Avenue. Infrastructure within the area that will provide accessibility
to the site will also be Perryville Road as well as Olive Avenue. Both will potentially share the load for trips
generated by the development. The property is also conveniently located approximately three miles west of
the Loop 303 where a major interchange is located at the intersection of Northern Avenue.
Development Schedule
It is feasible that various home builders will construct separate parcels over time. However, the property
owner intends to have the Property fully entitled and ready for construction by June 2019.
Circulation System
Onsite - Onsite circulation and accessibility shall be provided by internal local streets and corridors, The
developer will propose minimum 50 foot right of way for all internal traffic conveyance. Onsite roads will be
constructed to reflect the County's minimum cross-section for a local street. There will be two access points
along Northern Avenue to the south of the subdivision. It is anticipated that the interior roads will be
developed to the County's minimum local road standards.
White Tank Vistas Page l 6

Offsite — Offsite circulation and improvements will include all roadway improvements for Northern Avenue
and Beardsley Avenue as they correspond to the proposed development. In addition to the adjacent offsite
improvements, it is anticipated that the developer will improve Northern Avenue from Perryville Road to
Beardsley Avenue, approximately one mile total distance, to Maricopa County minimum road standards to
allow a paved access to the property. It is anticipated that the offsite roads will be developed to minimum for
collectors and/or arterial half-streets.
Community Facilities and Services
Although the property is currently located within unincorporated Maricopa County, the Property falls within
the City of Buckeye planning area. The development is also within the Dysart Unified School District. The
County will provide emergency services such as Fire and Police.
Open Space - Due to the topographic conditions and constraints, the property will have a significant amount
of open space (currently proposed 34.8%). Open space is intended to be utilized to maintain the existing
desert rugged appeal of the area. There are several washes that will continue to flow through the property
that will maintain the existing vegetation and landscaping. In addition to that, the developer will include
pedestrian walkways and passages that interconnect throughout the site, linking the individual subdivisions
together as well as the adjacent State Land. As part of the open space package, community amenities will
be proposed that may include tot-lots, clubhouses, barbeques, ramadas, etc. All amenities, walkways, and
landscaping associated with the open space will be finalized as the property proceeds through the preliminary
plat and final engineering / final plat processes.
With its location adjacent to the White Tank Mountain Regional Park, the landscaping along the exterior of
the site will consist of a plant palette that will complement the natural Sonoran Desert setting. Plants will
consist of Palo Verdes, Ironwoods, Mesquites, Ocotillos, Barrel Cactus, Brittle Bush, Globe Mallow, Desert
Spoon, Jojoba, Triangle-leaf Bursage, and others.
For the Interior areas of the site, there will be lawn areas for recreation and plants that accommodate this
purpose while still respecting the desert climate. Plants for these areas will include Oaks, Desert Willows,
Baja Ruellias, Fairy Dusters, Deer Grass, Lantana, Mexican Bird of Paradise, Sage, Valentine Emu,
Chuparosa, Yellow Bells.
Perimeter and interior fencing will be a variation of split face wall, masonry wall, and view fencing. See the
attached fencing details.
Public Utilities and Services
Electricity will be provided by APS, sanitary sewer will be provided by Liberty Utilities, and potable water will
be supplied by either EPCOR, Liberty, or the City of Surprise. Discussions have been initiated between all
three potential providers and the developer is determining which of the three will be the more cost effective
option. The developer and his representative(s) shall coordinate with all utility and service providers for
service agreements, extensions, etc.

Summary
The proposed project is consistent with the character of the area and approved residential development
patterns. White Tank Vistas aligns with the several specific goals and policies of the White Tank/Grand
Avenue Area Plan and meets the target density for this area identified on the Comprehensive Plan Land Use
Map. The Conceptual Site Plan establishes a general framework that supports the evolving needs of future
residents, Due to the topography and special geography (including an existing wash that runs along the
eastern border of the Property), the requested R1-6 RUPD zoning is appropriate to tailor the development
standards to the unique circumstances of the site.
Approval of this request will allow the applicant to move forward with a development that meaningfully
improves the range of housing options in the area while remaining respectful of existing residential
development in the area and sensitive to the surrounding desert habitat. White Tank Vistas will bring new
growth to an area targeted by the County for additional residential density, and will allow the applicant to
develop a site that has sat vacant and unutilized since it was first rezoned almost twenty years ago.

Hi Raymond: I have reviewed the attached rezone application for the 109 acre site and have no comments.
In overview, the single family development is within the Sheriff's Office District III substation location at 13063 West Bell
Road, and I believe falls within Supervisorial District 4. This proposed development of about 109 acres will add 330
homes and a population of about 880 residents on completion. So overtime during the phasing and on completion of
this development it will have an impact on calls for service as well as Patrol beats and staffing which will need to be
addressed at some point through the budgeting process.

Re: Case 14Z2018051, White Tank Vistas
Dear Mr. Banker
Thank you for the opportunity to comment on the Zone Change Application for White
Tank Vistas. This development is located on 109.45 acres at the northwest corner of 191th
Avenue and Northern Avenue in the unincorporated portion of Marieopa County. The request is
to rezone the site from Rural-43 Residential Unit Plan of Development to R1-6 RUPD and
develop the site into a 330-lot single family residential community with an overall all density of
3.02 du/ac. This site is located approximately 2.09 miles outside the 198/i JLUS 65 Ldn, "high
noise or accident potential zone," as defined by A.R.S. § 28-8461 and is within the "territory in
the vicinity of a military airport," also defined by A.R.S. § 28-8461,
Luke AFB follows the guidelines in the Graduated Density Concept (GDC). The GDC
proposes, in the absence of a more restrictive state, county or municipal general or
comprehensive plan, graduating densities away from the 65 Ldn as follows: a maximum of 2
du/acre from the 65 Ldn to 1/2 mile, a maximum of 4 du/acre from 1/2 mile to 1 mile and a
maximum of 6 du/acre from 1 to 3 miles. With a density of 3.02 du/ac this development falls
within the guidelines of the GDC.
This request, as stated in the narrative, will not negatively impact the flying operations at
Luke AFB. If approved it will be located within the "territory in the vicinity of a military
airport," and will be subjected to approximately 165 over flights a day, with some as low as
1,500 feet above ground level. We recommend you review the sound attenuation requirements
found in A.R.S. § 28-8482. In addition, a strong notification program on the part of the applicant
is essential to inform potential residents about Luke AFB operations.

Hello. I wanted to forward my comments on the proposed development to those involved. Good luck with the project
and as I stated, it will help the overall area of Sonoran Ridge and the state land to the west. The vagrants and other
associated problems along the flood canal and that unoccupied vacant land is also an issue. Any development is better
than the current conditions and will certainly help!
I do hope it is above average quality and fits the theme of Sonoran Ridge a bit.

Thanks Brian for the info. I like the idea of larger lots against Sonoran Ridge. Having this be developed and somewhat
controlled, with the enhancement to Northern Ave will benefit Sonoran Ridge. I feel there is a high degree of trespass
into Sonoran Ridge and the illegal OHV access to the state lands to the west through the proposed land and Sonoran
Ridge. This could virtually eliminate that.

All,
1

Pardon me if you get two of these notes. 1 have two similar looking neighbor lists in my address book and so I sent this to
both lists to try to catch as many neighbors as possible.
The attachment relates to the land south of Sonoran Ridge Estates where the property owner Verma Land is seeking a
zoning change to enable them to develop a 300+ home development. There is an open house Q&A meeting scheduled
for July 10 (details in attachment) which will be "interesting" I'm sure. A month or so ago AmyRae Mullins and I were
invited to a meeting with First United, Verma Land, and Verma's law firm in which they shared the plans you will see in
the attachment. We opposed the zoning change but requested that if they are successful in their zoning change
endeavors that the development be "out of the ordinary" in that it retain a true Sonoran Desert flavor in its entry and
common areas, and that it have high quality design homes on the albeit small lots. Sonoran Ridge Estates has no official
or legal link to the subject land so that small meeting was just for them to get a reading on the prevailing sentiment and
potential push-back they might experience from SRE folks.
Please attend the July 10 meeting if you have thoughts on this.

Subject: help understanding zoning
I am grateful that the county offers this opportunity of an ombudsmen to help residents. Clearly there is much of the
county government process that I do not understand and welcome any help you can give me!
I was told by the owner of Vermaland that the undeveloped property that is part of my development was rezoned some
time ago to no longer allow septic. And because of this rezoning it was no longer feasible to build homes on the acre
lots. Now I have received an email stating that Vermaland is seeking approval to rezone the site from RU-43 to R1-6 so
they can place 330 homes on the site. I live in Waddell and the jurisdiction we are under is the county. I feel scared and
frustrated that the largest land owner in Arizona is coming into a rural area and developing high density housing. Not
only is this area rural it is also at the base of the White Tank Mountains. Our neighborhood, Sonoran Ridge Estates,
currently encourages and has rules to respect the desert environment. A low percentage of our lot can be developed in
order to preserve the area around us. Homeowners have worked tirelessly and had much personal expense to ensure
that their homes preserve the property.
Vermaland asked my neighbor and I who try to work with and support our HOA (it is not managed by the actual
homeowners) to a meeting to discuss this in April of this year. I cannot understand why the owner of Vermaland sought
this meeting at his lawyers office. I also do not know if this meeting somehow checked off a county requirement for due
diligence. If so we certainly were not told of this. It was also mentioned in this meeting that this was the second law firm
Vermaland had hired to work on this situation.
I would like to find out if it is true that this land was rezoned to no longer allow septic and if so why weren't residents of
the same development told of it. And was it the Whitney Morris law team that had it approved? Also what can we do as
rural residents to fight against high density housing. Obviously the people who live in this county area chose to do so
because they sought out the rural area. Otherwise it would not be worth the extra miles and time it takes us to drive
into work and shop.
I sadly feel like our desires and reasoning for living in a rural county area won't matter to the county in comparison to
the power of Vermaland. How do we fight for our rural area against a corporation that is the largest Arizona land owner
and obviously has the finances and employees multiple law firms to push thru whatever they desire? We can only plead
our case with the county which likely will be feeble in comparison to Vermaland's law firm. We are small in number and
will not be able to fund a law team let alone a lawyer.
Thank you for your time and any advice you can offer us.
Attached is the document I received from the Whitney Morris law firm about the zoning request for high density
housing.

Our input that may be used is as follows, please use or discard as you feel.
1. County does not wish and have rejected the preplat 1 acre lots that were approved earlier when
this subdivision was approved. Our several efforts to get this approval again has been denied.
2. County feels the current size of one acre lots with septic tank possibly contaminate the ground
water, so they are not allowing that anymore. County does not like the septic tanks.
3. If the county did approve the 1 acre lots, there will be 85 more lots developed and it will add
to an already existing lot supply for over 12 years now, bringing the lot prices down further and
bringing the house price down.
4. Both the entry exit for this will be from northern, and no interconnection to the existing
Sonoran Ridge estate. This should not create any traffic impact on olive.
5. This Guys 1st complaint was it will lower his house value at 6 pm today and by 10 pm he
changed his tune and brought up traffic from school which I don't believe has any material issue
for this subdivision. I feel his big concern is his property value.
Please let us know who will be the best person to handle this and what to do.

Anita;
After further thought I have come up with some questions for the
proposed zoning change and the building of 330 houses south of
my home. According to the map of the community it looks like the
exits are only onto northern avenue. My question for you is how do
you expect a two lane road to handle over 600 vehicles driving
down northern. When school is in session there will be a backup of
traffic for 1/2 mile on Olive starting at Cotton lane with all of the
vehicles leaving Shadow Ridge High School. The proposed zoning
changes would cause that same backup on Northern Avenue. In my
neighborhood we have only Olive and Northern to drive east as
Peoria doesn't go through. I'm against the proposed zoning change
due to the density of the housing per acre and the limits that our 2
lane roads will impose on all of the traffic. Please respond to me
regarding the solutions to these issues that your company will
implement to make this a good outcome for everyone not just your
companies bottom line.

Anita;
After further thought I have come up with some questions for the proposed zoning change and the building of 330
houses south of my home. According to the map of the community it looks like the exits are only onto northern avenue.
My question for you is how do you expect a two lane road to handle over 600 vehicles driving down northern. When
school is in session there will be a backup of traffic for 1/2 mile on Olive starting at Cotton lane with all of the vehicles
leaving Shadow Ridge High School. The proposed zoning changes would cause that same backup on Northern Avenue. In
my neighborhood we have only Olive and Northern to drive east as Peoria doesn't go through. I'm against the proposed
zoning change due to the density of the housing per acre and the limits that our 2 lane roads will impose on all of the
traffic. Please respond to me regarding the solutions to these issues that your company will implement to make this a
good outcome for everyone not just your companies bottom line.

Zoning Case Number Z2018051

Summary
This application for the property owner, Vermaland, LLC, is being requested in order to rezone the vacant
The
Property is currently zoned Rural-43 (RU-43) Residential Unit Plan of Development (RUPD). The Property
is designated within the White Tank/Grand Avenue Area Plan for "Small Lot Residential 2-5 du/ac."
This request seeks to rezone the Property from RU-43 RUPD to R1-6 RUPD in order to accommodate a 330-
unit single-family subdtvision named, 'White Tank Vistas," The proposed project will allow the applicant to
move forward with a development on a site that has remained vacant since it was first zoned for one-acre
residential lots over 19 years ago. The proposed zoning will accommodate a variety of lot sizes ranging from
a minimum of 4,950 square-feet up to 18,000 square-feet (See Site Plan, TAB B).
Details and Techniques Used to Involve the Public
Withey Morris PLC sent out first class letters on June 25, 2018 to the stakeholders including area residents
/ property owners list, Interested Parties List, and Maricopa County Planning and Development Department
in accordance with the 300-foot notification requirement (see Notification Letter, Mailing Lists, Posting
Information, and Neighborhood Meeting Sign-In Sheet at TAB C) Further, the property was posted in (2)
places on either side of the project at the end of Echo Lane just north of the northern property line regarding
the request and details of the upcoming hearings for the case.
Summary of Concerns, Issues and Problems
Since the first notification letter was mailed out on June 25, 2018, we have received two inquiries regarding
the rezoning case. Anita met one on one with Mr. Mark Ruthem and had a phone call with Amy Rae. Anita
was able to answer Mr. Ruthem's questions and by the end of the meeting he was understanding of the need
of development in the area and the overall plans of this development. Mrs. Rae had some concerns about
the value of her property, however by the end of the discussion, she gave Anita feedback as to what type of
construction she would like to see for the row of lots the developer has left as larger lots in between Sonoran
Ridge and White Tank Vistas,
A neighborhood meeting was held on July 10, 2018 regarding the zoning proposal in the multi-purpose room
of the Cotton Baptist Church located at 6240 North Cotton Lane in Waddell, AZ. There were four development
team members present to explain the proposed residential development and answer questions. There were
a total of approximately (24) attendees who either lived nearby or owned property within close proximity of
the subject rezone area. The sign-in sheet received from the attendees and the neighbor notification letter
are attached to this memorandum, The main points discussed are as follows:
• Several color site plan exhibits were placed at each of the (4) planning stations around the multi-
purpose room where development team members provided information about the proposal to rezone

the Property from RU-43 RUPD to R1-6 RUPD for a new gated 330-lot community of single-family
homes known as, "White Tank Vistas," The team explained early on that there is no builder proposed
at this time. Although there were various comments/concerns and questions raised during the
meeting, a majority of attendees discussion generally focused on the following areas:
1,) The proposed sizes of the single-family lots which are compatible with the adjacent zoning
patterns and character of the area. The development team provided details in order to show the
strategic placement of larger lots along the northern boundary of the property that is shared with
the existing Sonoran Ridge Estates single-family community.
2.) Further, the team explained that the project will offer a broad range of lot sizes and housing types
for single-family living in a unique desert environment. The team pointed out that the proposed
density is less than that allowed under the current General Plan designation.
3.) Attendees were interested to know about the strategic landscape buffers, the potential to provide
a future horse trail along Northern Avenue and other community amenities within the site plan to
create a truly livable community.
4.) A few attendees were interested to know if the development would be served by septic or public
sewer systems. The team expressed that the proposal would be served by public sewer.
5.) Some were pleased with the proposal for single-family homes which they had anticipated would
be built on this vacant property that is already zoned for single-family use.
6.) Questions were raised about the circulation plan and the overall connectivity to the area.
Generally, many interested in the proposed access for the project and noticed that there was no
connection between the proposed project and Sonoran Ridge to the north. Many attendees were
supportive of the intent to not have any vehicular access to the Sonoran Ridge Estates.
7.) A few neighbors who live adjacent to the project asked the team to consider maligning/adjusting
a few of the proposed 18,000 sq.ft. lots located at the northwest corner of the property in hopes
to improve the overall compatibility with their lots. The development team is committed to
exploring that option with the neighbors and the County.
8.) In response to questions raised about the future conditions of Jackrabbit Trail, the team
explained that the County would determine if the adjacent perimeter would need to be widened
and improved. It was noted that Sonoran Ridge Estates did not complete their half of the
roadway which would have connected to Olive Avenue. The development team is committed to
exploring the access needed with the County.
9.) Finally, some expressed that they would like to participate in focus meetings with the applicant
in order to discuss potential options and the finer details of the development plan. The
development team offered to meet one-on-one or in group settings.

The team explained at that the maximum density which is allowed by the General Plan, the significant open
space/landscape buffers and generous open space commitments ensure a community of homes that are
commensurate with the adjacent neighborhoods will have a positive impact on the area.
Three days after this meeting, Anita met with five of the neighbors who have homes which will be the closest
to White Tank Vistas (their names and addresses are attached), this group had concerns about the row of
larger lots in between Sonoran Ridge and White Tank Vistas. As a compromise, Vermaland agreed to keep
that row all single story as to avoid obstructing neighboring views and agreed to combine five lots into three
lots as to leave more open space behind Sonoran Ridge. This group was happy with the compromise
Vermaland was making and did not have any further objections.
This concludes the Citizen Participation Final Report for the White Tank Vistas. If there are any questions
concerning the content of this report, please contact Anita Verma at (602) 274-0770 or Kirste Kowalsky at

Dear Planning and Zoning Commission:
Log Out I strongly oppose the zoning change for Case # Z2018051 White Tank Vistas
request. The current zoning was in place I believe at time of acquisition. The
claim that the acre lots are not possible due to an inability to place septic
systems Is entirely inaccurate as Sonoran Ridge Estates is entirely on septic's at
acre sites. The proposed development would have street lights and would
Impact the desert environment we now enjoy and would impact the adjacent
White Tank Mountains Regional Park. The grading and drainage has also been an
issue in this area regarding the adjacent washes.
I respectfully request that The Planning and Zoning Commission deny the
requested zoning change.

Dear Planning and Zoning Commission:
I strongly oppose the zoning change for Case #72018051 White Tank Vistas request. When Verma
Land purchased the land in question they knew about the current zoning. The current desire for
rezoning is simply for enhanced return on investment. Verma Land claimed that the acre lots are not
possible due to an inability to place septic systems, and that a sewer system is not financially viable for
a small number of homes. A homeowner in Sonoran Ridge has researched this at some length and
finds that the argument is not correct. Septic systems are fine for those acre lots. The proposed
development would have street lights and would impact the desert environment we now enjoy. The
grading and drainage has been an issue in this area regarding the flood plain, please consider these
aspects in this area.

SUBJECT: Case #Z2018051 White Tank Vistas, Zoning change from Rural-43 RUPD to R1-6 RUPD
Dear Planning and Zoning Commission:
I strongly oppose the zoning change for Case # Z2018051 White Tank Vistas request. When Verrna
I passionately request that The Planning and Zoning Commission deny the requested zoning change.

I feel we need to preserve the natural beauty and desert terrain of the White Tank Foothill
area. To level the land and build such a large number of houses would negatively impact this
part of the Sonoran Desert. This is a decision that will affect not just us, but future
generations.

It was brought to our attention several days ago that there was a possibility that our neighborhood that we
have worked so hard for years to afford, that is bordered by one acre lots may be rezoned to be subdivided
into small portions with large, inexpensively built houses. This happening disturbs us for several reasons:
-The values of our custom homes on large lots will be reduced.
-The traffic that our existing roads will be backed up even more with such homes.
-Our schools are already plagued with high class sizes.
-Wildlife and our beautiful dark starry. skies will be negatively impacted.
-Few retail stores to support lots of population growth.
We are definitely AGAINST our desert being divided into small lots!
Thank you for considering our point of view as you are making this important decision that will affect us so
greatly!

I strongly oppose the zoning change for Case # Z2018051 White Tank Vistas request.

I write in request that you vote to stop with NO zoning change.
The current zoning is set for 1 acre lots. The lots were zoned as 1 acre lots when
purchased by Verma. This is comparable to the lots in Sonora Estates and will retain
the desert environment. The requested change is going to create a "stuffy" 300 homes
bundled mess with all kinds of street lights. It will simply destroy the environmental
desire and beauty. I am asking to please don't allow Verma to destroy the value of the
present properties.
Thank you in advance to your careful consideration to this issue.

Maricopa County Planning and Zoning Committee:
When we built our home in Sonoran Ridge in 2006 we were sold by the fact that the
neighborhood would be acre lots. We felt that it would be a good investment and a nice place to raise
our family. We were told by Sonoran Ridge development that the lots would always be an acre. We
were told that this community would be like many of those in Scottsdale and the east valley. Now with
these small track homes being proposed it will hurt our home values and also take away from the
beauty of the mountain and desert. I would ask, do we need another track neighborhood in the west
valley? I am in the east valley all the time and there is a good mix of custom and tracks. With the custom
homes in the area it helps the track home sustain their values and ultimately makes for a nicer part of
town. We strongly object to this development and Verma has gone back on what they have sold us. Let's
make the west valley a place that is comparable to the east valley. With another track home
development this will just be another money grab for a corporation that is already financially well off.
Let's do the right thing and get the west valley going in the right direction. Also, Verma has been
unethical in the things that they have done and have said about what type of houses should be in our
neighborhood. We have been lied to time and time again. We have been treated as if we are ignorant
Waddell residents. We have been duped. They have given us false hope and we will not stand for it. We
support our community and our board members as long as it is in accordance to what we have been
promised. However, we have been given false hope. That is disappointing.

Maricopa County Planning and Zoning Committee:
I believe the largest land owner in Arizona along with their law team has tried to dupe
the County residents of Waddell. Lawyers from the Withey Morris team reached out to
Brian Cotrell and Ito meet back in April. During this meeting the law team and Kuldip
Verma told us that the county had already rezoned the area that is in question today —
the southern portion of Sonoran Ridge Estates Community. This county decision of
rezoning forced Vermaland to change the housing plan from 110 houses to 330 plus
units. They also told us that the county rezoning banned septic systems in this area.
Mr. Verma himself made a point to tell Brian and I that if the county would allow septic
systems then he would be happy to develop the area into the 110 acre lots as
"previously planned". In fact Mr. Verma even went on to say that he would prefer to
develop the acre lots but due to the county's supposed rezoning his only viable option
is to put in higher density housing.
MARICOPA COUNTY HAS NOT REZONED ANY OF THIS LAND!
Vermaland owners and representatives continued to swindle us into believing that they
have a respect for this desert area and had incorporated amenities and green spaces
to cause as little disturbance as possible. In reality the new development only contains
space for water retention. Flood plains and washes will be leveled and redirected to
suit the new 330 homes.
In July Anita Verma reached out to me several times and on July 9, 2018 we spoke on
the phone. She started the conversation saying how she "hates to be in this position"
and that this 330-home neighborhood is not what Vermaland wanted to do with the
property but because of the "county dictating what it is zoned for" and "market
demand they have no other choice". Ms. Verma continued to speak on the diatribe
against the county for several minutes.
I informed her of the good news of not having to hate this situation because the county
has not rezoned the area. And that her dad could deliver what he promised in April that
he would be thrilled to develop the acre lot homes. Even though Ms. Verma told me
she is not legally allowed to lie I believe that both Vermaland and their law team lied to
us when telling us the area had been rezoned.
Ms. Verma's argument then turned to the housing market of 2006. When Sonoran
Ridge Estates was developed in 2006 over twice the number of housing permits were
submitted compared to 2018. So Venmaland needs to develop the area with as many
units as possible to make money on the property like in 2006. However, as a Maricopa
County resident half the number of housing permit submittals in 2018 versus 2006 is
good news as obviously the market was not able to withstand the growth of 2006. And
I am hopeful that developers and the county have learned from that experience.
RECEIVED SEP 5 2016

Next I was told because other higher density neighborhoods going in close to the area
justified another one. I strongly disagree with his line of thought as I believe Maricopa
County had forethought and was thinking long term when they zoned the
area at the base of the White Tank Mountains. The area is currently zoned to limit
disturbance in order to maintain the natural landscape along the perimeter of lots for
the purpose to maintain natural drainage. The area they are now asking to be rezoned
is next to the WhiteTank Mountain Regional Park. This park is enjoyed by thousands of
Maricopa County residents and is a place of refuge from the bustling suburbs.
Maricopa County chose to zone this neighborhood to preserve the area and the park
and certainly shouldn't choose to change their minds so a wealthy
developer can profit.
We as county residents do not have the dollar power to fight Vermaland and their legal
teams in court. We are at the mercy of this board. We hope that the County will take
into account the business practice of untruths that Vermaland has used to manipulate
county residents. We also hold out faith that when the County designated this area it
was committed to the desert landscape and not causing disturbance. Current residents
of Sonoran Ridge have not only gone to great expense but also taken massive
amounts effort to follow the county's guidelines. Please don't allow Vermaland to
manipulate the county as it has been doing to the Waddell residents.

I strongly oppose the zoning change for Case # Z2018051 White Tank Vistas request. When Verma la nd
purchased the land in question they knew about the current zoning. The current desire for rezoning is
simply for enhanced return on investment. Vermaland claimed that the acre lots are not possible due
to an inability to place septic systems, and that a sewer system is not financially viable for a small
number of homes. A homeowner in Sonoran Ridge has researched this at some length and finds that
the argument is net correct. Septic systems are fine for those acre lots. The proposed development
would have street lights and would impact the desert environment we now enjoy. The grading a nd
drainage have been an issue in this area regarding the flood plain and overflowing washes.
There will only be one way into and out of the development on Northern Road, which will cause a lot
of congestion of 330 homes and possible 2 cars per home. With the White Tank Foothills
development, which is in progress between Olive and Northern, the traffic in our area will be
overwhelming our streets. Please consider these aspects in our area to make the West Valley a livable,
family friendly community without overcrowding, and respect for our beautiful desert of Sororal
cactus.
I passionately request that The Board of Supervisors deny the requested zoning change.

Dear Board of Supervisors:
I strongly oppose the zoning change for Case # Z2018051 White Tank Vistas request. When Verma land
purchased the land in question they knew about the current zoning. The current desire for rezoning is to
generate a greater return on investment. Please consider the existing and future residents also, and deny
this change. Vermaland claimed that the acre lots are not possible due to an inability to place septic
systems, and that a sewer system is not viable for a small number of homes. After some research, I
believe this is incorrect. Septic systems are fine for those acre lots. The proposed development would
displace wildlife and forever disrupt the desert environment that we moved here for. It would also add a
greater number of street lights than current zoning requires. The grading and drainage are already an
issue in this area and another highdensity development will simply compound the problem.
The main entry to White Tank Vistas will be Northern Road, which will add significant traffic from the
proposed 330 homes (at possibly 2 cars per home.) Furthermore, Northern borders Clearwater Farms
where there are many animals. The increased traffic on Northern from the White Tank Foothills
development under development), in addition to the traffic that would generated by this zoning change
would likely overwhelm our existing roads and infrastructure. Please consider these aspects and keep this
area of the West Valley a livable, family friendly community by voting against the rezoning request.
I passionately request that The Board of Supervisors protect the wonderful Sonoran Desert nature of this
area by denying the requested zoning change.

Dear Board,
We strongly appose the zoning change for case 42.2018051 White Tank Vistas request!
We live on horse property in the "country" out here in Clearwater Farms and zoning
anything bordering our community to be more than 1 acre lots impedes on our peaceful way
of life, is a detriment to our animals and livestock and will severely impact our
community!
Builders have promised to honor the "easing" into your crowded planned "city life"
communities with the buffering of greenways, trails, and one acre single level home lots,
we will not stand for bait and switch tactics that will severely impact our community and
peaceful way of life due to builder greed.
The roads will not support it, the flooding and environment will not support it and the
Property owners will not support it.
Please consider that people live differently and choose different ways of living and not
every community needs 6-8 homes per acre!
The air pollution and noise pollution caused from the increased traffic, due to the
proposed rezoning of number of homes on those acres bordering Northern and in the future
bordering Perryville is unacceptable and harmful to our animals well being and our
elderly and children well-being.
The flooding of property and fleeing of animal life into our community will impact us
dangerously and negatively, snakes, bobcats, scorpions, coyotes, wild boar willbe
searching for homes as these builders doze their habitats.
Any artificial lighting and increased levels of light at night will negatively affect our
animals, natural wildlife and country living out here.
Our children who are learning about life and nature living out here with animals and
Natural Desert will lose the enrichment this community provides. Have you ever read The
Last Child in the Woods by Richard Louv? Many of us moved out here by the White Tanks to
provide the opportunity of experiencing nature away from the city for our children and to
avoid what is now being termed as "nature-deficit disorder" so many children are
experiencing across the country in big city sprawls.
Please join us and oppose this proposal of overcrowding our community!
We implore you to deny the request for rezoning the White Tank Vistas.

SUBJECT: Case #Z2018051 White Tank Vistas, Zonin g change from Rural-43 RUPD to R1-6 RUPD Dear
Board of Supervisors:
I strong ly oppose the zonin g chan ge for Case # Z2018051 White Tank Vistas re quest. The proposed
development would have street li ghts, 6' walls and would impact the desert environment we now enjo y.
The grading and draina ge have been an issue in this area re garding the flood plain and overflowin g
washes which would be filled in and all ve getation removed, we have seen this in all the development in
our community .
As a community we are very concerned of the increase of traffic con gestion of 330 homes with onl y one
way into and out of the development on Northern Ave and possible 2 cars per home. With the White
Tank Foothills development, which is in pro gress between Olive and Northern, the traffic in our area will
be overwhelming our alread y congested streets. Other concerns are police, fire department and first
responders not able to respond to our communit y in a timely manner. If Northern Ave would be closed
for any reason the people livin g in this area would be trapped with no wa y out. Please consider these
aspects in our area to make the West Valle y a livable, family friendly community without overcrowdin g,
and respect for our beautiful desert of Sororal cactus.
We would like to see a development with lar ger lots and sin gle-story upscale homes, no streetli ghts,
and protect the natural environment.
I passionately refiluest that The Board of Supervisors deny the re quested zonin g change of R1-6.

Dear Board of Supervisors:
I strongly oppose the zoning change for Case # 72018051 White Tank Vistas request, When Vermaland
purchased the land in question they knew about the current zoning. The current desire for rezoning is
simply for enhanced return on investment. Vermaland claimed that the acre lots are not possible due
to an inability to place septic systems, and that a sewer system is not financially viable for a small
number of homes. A homeowner in Sonoran Ridge has researched this at some length and finds that
the argument isnot correct. Septic systems are fine for those acre lots. The proposed development
would have street Sights and would impact the desert environment we now enjoy. The grading and
drainage have been an issue in this area regarding the flood plain and overflowing washes.

RE: Re-zoning Proposal for the NWC Beardsley Canal and Northern Avenue
Sonoran Ridge Estates (APN(s): 502-09-011T; 502-09-011Q; 502-09-0118)
Dear Ms. Johnson:
As the First Beneficiary of First American Title Trust 8702, the owner of several lots in Sonoran Ridge
Estates Unit 4, which is located immediately adjacent to the north of the above-referenced property,
support the change of zoning which will result in a new, 330-lot single4amily subdivision. I have reviewed -
the apPlibant'S rtOpesal to re-zerie the aboVe-referenced 10-acre Pareel from RU -43 RUPD R1 -6
RU PD, which will allow for a variety of lot sizes to be developed,
I believe this project has convenient vehicular access using the adjacent arterial roadways. This will insure
that there is no need for access through Sonoran Ridge Estates, there will be no access for cut through
traffic and no negative traffic impact on the existing private roads and the residences in Sonoran Ridge
Estate located to the north of this project.
I am aware that the owners of the property applying for re-zoning have revised their plan several times to
accommodate the larger lots adjacent to their property, including limited homes built on the _ lots _ adjacent _ to
the Sbn-oran Ridge EstateS Unit 4 stibdiviSion to single-story fidrnes,
If you have any questions, please feel free to contact me at (602-264-0000) or via email at

Respectfully,

RE: Re-zoning Proposal for the NWC Beardsley Canal and Northern Avenue
Sonoran Ridge Estates (APN(s): 502-09-011T; 502-09-011Q; 502-09-011S)
Dear Ms. Johnson:
We own (9) lots in Sonoran Ridge Estates, (APN(s): 502-09-018; 502-09-019; 502-09-037; 502-09-051; 502-09-
066; 502-09-084A; 502-09-091; 502-09-095; 502-09-115) which are located north of the above-referenced
property, I strongly support the change of zoning which will result in a new, 330-lot single-family subdivision.
I have reviewed the applicant's proposal to rezone the above-referenced 109-acre from RU-43 RUPD to R1-6
RUPD in order to allow a variety of lot sizes that will be developed. I believe this project has convenient
vehicular access to the adjacent arterial roadways so there will be no cut through traffic and no negative traffic
impact on the existing residences which are located north of this project.
I am aware that the current owners of the proposed property for rezone has revised their plan several times
to accommodate larger lots adjacent to our property. I also understand that the adjacent lots will allow only
single story homes.
We are supporting this strongly for 2 major reasons. First we don't want additional (90+) one acre lots, which
will totally depress the lot values and the home values. The lots that were selling close to $300,000/lot in 2006
came down to $30,000/lot in 2011 because of the oversupply. Currently they are selling around $90,000/lot
and_slowly recovering. Adding (90+) lots to the current inventory will be a total disaster.
Our second strong reason is, we do not want additional septic tanks in our subdivision that has potential of
contaminating the ground water. We do not see any down side to approve the proposed 330 lots subdivision.
If you have any questions, please feel free to contact me at 480-812-5550 or via email at

Dear Ms. Pokorski:
We own 1 Lot in Sonoran Ridge Estates, APR 502-09-058 which is located north of the above-referenced property. I
support the change of zoning which will result in a new, 330-lot single-family subdivision. I have reviewed the
applicant's proposal to rezone the above-referenced 109-acre from RU-43 RUPD to RI-6 RUPD in order to allow a
variety of lot sizes that will be developed. I understand this project has convenient vehicular access to the adjacent
arterial roadways so there will be no cut through traffic and no negative traffic impact on the existing residences which
are located north of this project.
I am aware that the current owners of the proposed property for rezone has revised their plan several times to

We support this strongly because we don't want additional one acre lots, which will significantly depress the
lot values and the home values. The lots that were selling close to $300,000/lot in 2006 came down to
$30,000/ lot in 2011 because of the oversupply. Adding more lots to the current inventory will be depress
the values.
Furthermore, we do not want additional septic tanks in our subdivision that has potential of contaminating
the ground water. We do not see any down side to approve the proposed 330 lots subdivision.
