AMENDMENT No. 1 TO IGA AGREEMENT
BETWEEN
TOWN OF GILBERT, GILBERT
AND
MARICOPA COUNTY, COUNTY
RECITALS:
A. GILBERT and COUNTY are parties to an Intergovernmental Agreement (“IGA”)
No. G-30161 approved by the Maricopa County Board of Supervisors on
September 11, 2013, (the “Agreement”). The Agreement is for a Justice Court
facility at 55 East Civic Center Drive, Gilbert, AZ, consisting of approximately
11,186 square feet of area (the “Premises”).
B. The initial term of the Agreement expires on December 31, 2018.
C. GILBERT and COUNTY now mutually desire to enter into this amendment
(“Amendment”) to extend the term of the Agreement, adjust the Facilities Use Fee,
adjust the annual court security costs and update the COUNTY notice address.
AGREEMENT
NOW THEREFORE, in consideration of the foregoing and other good and
valuable consideration, the sufficiency and adequacy of which are hereby
acknowledged, COUNTY and GILBERT agree to amend the Agreement as
follows:
1. The Recitals, by this reference, are hereby incorporated into this Amendment.
2. The annual security costs in the second sentence of Section 1.3.3 Court Security of
the Agreement is revised, and COUNTY shall be responsible for paying $35,000.00
per year to GILBERT for security costs.
3. The term of the Agreement is hereby extended for five (5) years (the “Renewal
Term”), commencing January 1, 2019, and expiring on December 31, 2023. During
the Renewal Term of the Agreement, COUNTY shall pay GILBERT from
appropriated funds a Facilities Use Fee for the Renewal Term of the Agreement
based on the use of 11,186 square feet of space in the Premises. The Facilities Use
Fee shall be as follows:
Years 1 through 3 $19,256 per month plus applicable tax
Year 4 $19,834 per month plus applicable tax
Year 5 $20,429 per month plus applicable tax

4. The COUNTY notice address in Section 3.3 of the Agreement is hereby revised as
follows:

4. The effective date of this Amendment is the date last signed below.
5. This Amendment is subject to termination pursuant to the provisions of A.R.S. 38-
511. Either party may terminate the Agreement, as amended, by giving at least 180-
days prior written notice to the other.
6. The foregoing paragraphs contain all the changes made by this Amendment. All
other terms and conditions of the original Agreement remain the same and in full
force and effect.
