In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that such change due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such change. Half width right-of-way dedications (with future entitlement application(s)) will be required (unless otherwise waived by MCDOT) as follows: Happy Valley Road: 65 feet 2. A Traffic Impact Study to address traffic impacts and roadway improvements required to support the proposed development must be submitted with the Plan of Development application. 3. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. Due to the conditions of the approval for the previous cases (CPA2007003 & Z2007036) development would not be allowed to occur without a proposed zone change request. In the event of the failure to comply with any condition, the property shall revert to the original zoning of Rural-43. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. AQ-2017-003-RULE 317 (HOSPITAL/MEDICAL/INFECTIOUS WASTE INCINERATORS) AQ-2017-004-RULE 325 (BRICK AND STRUCTURAL CLAY PRODUCTS (BSCP) MANUFACTURING) AQ-2017-005-RULE 334 (RUBBER SPORTS BALL MANUFACTURING) AQ-2017-006-RULE 339 (VEGETABLE OIL EXTRACTION PROCESSES) Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of proposed rescission of Maricopa County Air Pollution Control Regulations Rule 317 (Hospital/Medical/Infectious Waste Incinerators), Rule 325 (Brick and Structural Clay Products (BSCP) Manufacturing), Rule 334 (Rubber Sports Ball Manufacturing) and Rule 339 (Vegetable Oil Extraction Processes) and the associated proposed revision to the State Implementation Plan (SIP). Following the public hearing, the Board is requested to approve the proposed rescission of Rules 317, 325, 334 and 339 and the proposed rescission of Rules 325, 334 and 339 from the SIP. Upon Board approval, this item will become effective 12/13/2017. The Maricopa County Air Quality Department (MCAQD) is proposing to rescind Rules 317, 325, 334 and 339 and is proposing to rescind Rules 325, 334 and 339 from the SIP. Rule 317 (Hospital/Medical/Infectious Waste Incinerators) Rule 317 was adopted to control emissions of air pollutants from hospital/medical/infectious waste incinerator(s) (HMIWI). There are currently no HMIWI in Maricopa County and the department’s records indicate the last HMIWI permit was closed (source was removed) in 1998. Most hospital/medical/infectious waste is now treated using alternative technologies such as thermal treatment (microwave technologies), steam sterilization (autoclaving) and chemical and mechanical treatment. The department does not anticipate any new HMIWI will locate to Maricopa County. Rule 325 (Brick and Structural Clay Products (BSCP) Manufacturing) Rule 325 was originally adopted on August 10, 2005. The purpose of the rule is to limit particulate matter emissions from the use of tunnel kilns for curing in the brick and structural clay product (BSCP) manufacturing processes. Maricopa County currently has no sources subject to the rule and does not anticipate any new brick or structural clay product manufacturers will locate to Maricopa County. Rule 334 (Rubber Sports Ball Manufacturing) The purpose of the rule is to limit emissions of volatile organic compounds (VOCs) from natural and synthetic rubber adhesives used in the manufacture of non-inflatable rubber balls. Only one source has been subject to the rule since it was adopted in 1993 and that source ceased operations in 2009. Due to the uniqueness of this type of manufacturing and the lower costs of labor and raw materials in the Far East, the department does not anticipate any new rubber sports ball manufacturers will locate to Maricopa County. Rule 339 (Vegetable Oil Extraction Processes) Rule 339 was adopted to limit the emissions of VOCs from the extraction of vegetable oil using solvents (hexane). Maricopa County currently has no vegetable oil production facilities subject to the rule and the department’s records indicate the only issued permit was closed (source was removed) in 1999. Since the adoption of Rule 339, hexane, the primary solvent used in vegetable oil extraction processes is now regulated as a hazardous air pollutant (HAP), not as a VOC. In 2001, the EPA promulgated national emission standards for hazardous pollutants (NESHAP) for the use of hexane in vegetable oil production facilities. The vegetable oil Formal Meeting Minutes Wednesday, December 13, 2017 Page 10 of 58 production NESHAP has been incorporated into the county’s air quality regulations through Rule 370 (Federal Hazardous Air Pollution Program); therefore, Rule 339 is obsolete. Permit fees are not changing due to this action. (C-85-18-003-M-00) Motion to approve by Supervisor Chucri, seconded by Supervisor Hickman Ayes: Barney, Chucri, Gates, Hickman, Gallardo 10. AQ-2017-001-INCORPORATION BY REFERENCE 2016-2017 Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of incorporating federal standards into Maricopa County Air Pollution Control Regulations: Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Following the public hearing, the Board is requested to adopt the incorporations into the Maricopa County Air Pollution Control Regulations. Upon Board approval, this item will become effective 12/13/2017. The Maricopa County Air Quality Department (“MCAQD”) is proposing to revise 360, 370, 371, and Appendix G by incorporating federal regulations and documents promulgated by the U.S. Environmental Protection Agency (“EPA”): New Source Performance Standards (“NSPS”), National Emission Standards for Hazardous Air Pollutants (“NESHAP”), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2016, to July 1, 2017, in each of the rules and appendix to remain current with federal regulations. The adoption of the proposed amendments to Maricopa County Air Pollution Control Regulations Rules 360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of authority to the MCAQD for the implementation and enforcement of the federal regulations and documents. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rules or laws were proposed and adopted. Permit fees are not changing due to this action. The MCAQD did not receive any public comments during the public comment period. A Notice of Final Rulemaking will be distributed per normal procedures once approved. REVISIONS TO COUNTY POLICY HR2435 PRE-EMPLOYMENT BACKGROUND INVESTIGATIONS IN SUPPORT OF MARICOPA COUNTY BECOMING A “SECOND CHANCE EMPLOYER” As a way to lower recidivism rates and provide increased opportunity to individuals who have served their time, approve revisions to County Policy HR2435 Pre-Employment Background Investigations. The change would remove the criminal conviction question from the standard employment application and prohibit County departments from inquiring about an applicant’s criminal history prior to a decision to make an offer. Some county departments, primarily those dealing with law enforcement, have more stringent rules and/or must comply with federal or state statutes related to the criminal history of employees. These departments will continue to include criminal background questions on employment applications. This policy takes effect on January 1, 2018. (C-92-17-004-6-01) Motion to approve by Supervisor Gallardo, seconded by Supervisor Chucri Supervisor Gallardo noted a “kudos” on the item. Supervisor Chucri stated he likes where the County is going with the item. He noted Governor Ducey is going in the same direction on behalf of the State of Arizona. However, he asked that next year the County look at not completely doing away with check the box as the idea was to delay it. He noted there should still be some form of action the County should take in the final process of hiring someone where they have to say yes or no to a criminal background. He is not comfortable with getting rid of the box entirely. Chairman Barney asked Jan Plank, Director of Human Resources, to look into Supervisor Chucri’s request. He thanked Ms. Plank and Andy Mesquita, Deputy Director of Human Resources, for their work on the item. The County is following the lead of Governor Ducey, as Supervisor Chucri mentioned. It is an exciting initiative that is rolling out at the State level that the County is excited to participate. The County will continue to have the check in place for jobs that require elevated levels of security. The County is excited to join in the initiative and include those that will no longer be categorically excluded because of past convictions or actions. Supervisor Chucri noted it is about progress and not perfection. He thanked the Chairman for having his request looked into. Supervisor Hickman noted the importance of getting inmates back into society. He said Formal Meeting Minutes Wednesday, December 13, 2017 Page 26 of 58 the County does need to be diligent in the approach in regards to County jobs. He noted his gratitude of the work on the item and the Board will be following the progress closely. It is nice to start taking the steps because it is the right thing to do, but the County needs to make sure it is done in the correct way. Supervisor Gallardo noted he understands the concerns, but he would like the County to take it a step further to reduce recidivism and help those that have made mistakes. He is a strong proponent on redemption and if individuals are willing to get on the right track then the County should assist them in the process. He noted there are ideas and best practices taking place throughout the United States that the County should be utilizing. The item is a nice step forward. If a business mindset is going to be brought to the County, then more projects such as this item should be considered. The County should be looking into finding ways to help reduce the cost of incarceration since a large portion of the County budget pertains to criminal justice. The criminal justice budget can be reduced if the County can focus on recidivism and great practices. The County should look into what other agencies, States and government entities are utilizing instead of reinventing the wheel. Supervisor Gallardo noted the item may not be perfect so maybe the Board should revisit the item at a later date but this is a step into the right direction. The item will move the County forward in the right direction. He noted his gratitude to the State for starting the initiative and stated he introduced items such as this in the past while part of the Legislature. The item is an effort to reduce criminal justice costs and helping individuals. Chairman Barney stated the item is a blessing to the community and not just the families involved in the criminal justice system. The goal is to help elevate everyone through the process and the combined efforts is part of smart justice and practices that work towards recidivism and lower the incarceration population. The item will have generational impacts on the community. This is a small step in signaling County support of Governor Ducey and the County’s desire to continue to press forward with the business mindset to make sure the County is making a difference. IGA WITH CITY OF PHOENIX FOR MANDAN STREET DRAINAGE IMPROVEMENTS Adopt IGA FCD 2017A019 with the City of Phoenix for the Mandan Street Drainage Improvements, (the PROJECT), authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to advertise, select, negotiate, and award contracts for Project engineering and construction services; acquire Project rights-of-way; and include Project funding in the District’s Five-Year Capital Improvement Program. The Mandan Street Drainage Improvements will provide a flood mitigation solution for the 100-year storm event to 17 homes along South Mandan Street between East Sacaton Street and East Mandan Street, in which many of the homes have been flooded several times. The estimated total project cost is $1,200,000. An application for state and federal grant funding has been made for this project. Such funding would reduce the use of District and City tax dollars for the project. The City will be responsible to maintain the completed project. The District and the City of Phoenix believe that this project has significant merit to move forward in the District’s FY18 Capital Improvement Program. This Agenda Item impacts Supervisorial District 1 and 5. (C-69-18-019-3-00) Motion to approve by Director Chucri, seconded by Director Hickman Ayes: Barney, Chucri, Gates, Hickman, Gallardo F-5. AMENDMENT TO IGA WITH THE CITY OF MESA FOR 63RD AND BROADWAY RD DRAINAGE IMPROVEMENT PROJECT Approve Amendment No.1 to Intergovernmental Agreement (IGA) FCD 2016A003 for the 63rd Street and Broadway Road Drainage Improvement Project (Project [#699]) between the City of Mesa (City) and the Flood Control District of Maricopa County (District). This Amendment shifts the project construction and funding from Fiscal Year 2017 to Fiscal Year 2018. The estimated total Project cost is $425,070. The District’s estimated share of the Project cost is $250,000 and is limited to $250,000; the City’s estimated share of the Project cost is $175,070. The City will operate and maintain the completed Project. The IGA shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire two years from the date or upon Project completion, whichever occurs first. This delay in construction has been necessitated by a delay in a street transportation fog seal project at 63rd Street and a pending legal issue. This delay will not increase the FY18 expenditures, as the City also plans to shift their previously approved FY18 small project Lazona Drive and Broadway Road from FY18 to FY19. The Project was recommended, scoring 5th among 15 submittals by various municipalities. This IGA is proposed in accordance with the terms of the Small Project Assistance Program, adopted by the Board under Resolution FCD 2009R003A (C-69-09-062-6-01).
