Re: Cancellation of the Annual Election of the Board of Directors of Queen Creek
Irrigation District Pursuant to A.R.S. 5 16-410(A)
Dear Sir or Madam:
This firm represents Queen Creek Irrigation District ("QC1D"), an irrigation district
organized and existing under Title 48, Chapter 19 of the Arizona Revised States (A.R.S. 55 48-
2901 through -3256) comprised of lands located in Maricopa County, Arizona. On July 10,
2018, the QCID Board of Directors ("Board") called an election to fill one (1) vacancy on the
Board created by the expiration of the term of Director Michael Gantzel.
The qualified electors of QCID filed a petition nominating Michael Gantzel for the
office of Director of QCID and requesting that his name be placed on the official ballot for the
election to be held on November 13, 2018. Michael Gantzel also filed a nomination paper
announcing his candidacy for the office of Director of QCID. QCID received no additional
nomination petitions, no other candidates filed nomination papers requesting that their names
appear on the ballot, and no individual filed a nomination paper within the time frame to be an
eligible write-in candidate. Therefore, the number of candidates for the office of Director is
equal to the number of vacancies on the Board to be filled at the election on November 13,
2018. Because Michael Gantzel will be running unopposed for the office of Director at the
election on November 13, 2018, QCID requests that the Board of Supervisors of Maricopa
County approve the cancellation of the election and appoint Michael Gantzel to the office of
Director to fill the vacancy on the Board for a term of three (3) years beginning on January 1,
2019 pursuant to A.R.S. ยง 16-410(A).
If you need any additional information to process this request, please let us know.
Because QCID will need to continue with ongoing preparations and incur additional expenses to
hold an election, we would appreciate a response to this request at your earliest convenience.
