September 27, 2017, except as modified by the following conditions.
b. The following IND-1, Military Airport and Ancillary Military Facility Overlay Zoning District
Military Compatibility Permit standards shall apply:
1. Maximum Building height: 40’
2. Minimum Front Yard Setback: 10’
3. Maximum Lot Coverage: 60%
4. Parking: Per MCZO, Chapter 11, Section 1102
5. Lot Area: 35,000 sq. ft.

County takes action to rescind approval due to noncompliance with conditions.
i. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the zoning that existed on the date of application. It is, therefore,
stipulated and agreed that either revocation due to the failure to comply with any
conditions, does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation of the Military
Compatibility Permit. The Military Compatibility Permit enhances the value of the property
above its value as of the date the Military Compatibility Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Military Compatibility

18-045-M-00)
Darren Gerard, Deputy Director of Planning and Development, reviewed the item and
noted the purpose of the special use permit request is to allow for the cutting of steel
piping in an enclosed building. He noted the unanimous vote of the Planning
Commission to approved this item, and 14 residents that were in opposition of the
special use permit.
Supervisor Gates thanked Mr. Gerard for the report.
Lydia Peirce Linsmeier, Corral Kraft, LLC representative, said an error was made when
the original special use permit request was made in 2015. She noted the pipe cutting
process has been a family business since 2004. She commented on the parameters of
pipes being cut at 20 minutes per week, the equipment that is used and the location of
the pipe cutting within an enclosed building which was built to help with the noise
concerns. A map was displayed which indicated the neighbors in favor and against the
special use permit request.
Billie Stolworthy, resident in opposition of the item, has lived at her property since 2002
and it is an area that has many horse owners. She spoke about her issues with the item
such as loud noises which startle horses and those riding in the area, the location is not
an ideal place for an industrial area, the disruption it causes within the community and
the sound traveling through both ends of the building where the pipe cutting is being
done.
Supervisor Gates asked the exact location of where Ms. Stolworthy’s property is located
in proximity to the applicant and when she started hearing the noises. Ms. Stolworthy
stated she is two streets away yet within 1,500 feet of the property and she hears the

pipes dropping which started around Christmas 2017.
Anne Smith, resident in opposition of the item, stated she is adjacent to the applicant’s
property. She noted the applicant has been operating in violation for two years. The
noises that disturb her are the dropping of pipes, welding and whining from the sawing.
She said her work as a veterinarian relies on peace and quiet with the animals. Upon
hearing the noise the horses run madly in circles for hours, one horse has lost eyesight
from puncturing its eye and she has encountered several injuries from the horses when
they are startled. She noted the horses have been easier to handle the past six months
since the sawing has ceased on the property.
Supervisor Gates asked the exact location of where Ms. Smith’s property is located in
proximity to the applicant. Ms. Smith said she lives north of the property.
Valerie Crail, resident in opposition of the item, stated she lives on 44th Street and
Pinnacle Vista which is south of the proposed applicant location and has lived there
since 1989. She is not opposed to industry or the family business but she is opposed to
the noise that is created from the business which has been in violation for two years.
She is a friend of Ms. Smith and she is unaware of how to mitigate the noise created
from pipes dropping on the applicant’s property. She recommended the cutting of pipes
only be done for 20 minutes per week, and for it to be done between 12:00 p.m. to 1:00
p.m. each day.
Tom Chauncey, resident in opposition of the item, noted the community is a square mile
with people of all ages riding horses within the neighborhood. He noted the disruptive
noise that comes from the cutting of steel pipe and the damage it does to those who
own or care for horses in the area.
The following individuals were registered in favor of the item:
Robyn Overstreet
William Barron
Roger Page, resident in favor of the item, has lived north of the property for over 14
years and is the property located between Ms. Smith and the applicant. He lives within
100 feet of the property and the noises from the applicant’s storage facility or property
have never affected his home or horses.
Supervisor Gates requested Mr. Gerard to give background information on the special
use permit request and issues that have been presented.
Mr. Gerard explained that a special use permit was approved in October 2015. The
business operated without complaint for over a year. The Planning and Development
Department opened a violation due to complaints in regard to the steel pipe cutting.
The property owner was contacted and there was a disagreement of whether cutting
pipe was allowed with the original special use permit. That is considered a type of
fabrication and the original special use permit was for storing of pipe and other materials
and staging of offsite construction throughout the community. He noted changes in
state statute for home based businesses. The applicant’s original intention was to allow
for steel pipe cutting. Mr. Gerard stated the owner was then made aware that an
amendment must be obtained to allow steel pipe cutting within an enclosed structure.
The business started building the structure without a proper permit but have since been
given a permit to build the structure. They may still be building the structure whether or
not the amendment is approved. In order for steel pipe cutting to take place as part of
the business the amendment is required. There are allegations that the proprietor is not
living on the site and that is a requirement as part of this particular special use permit. If
Formal Meeting Summary

that is not the case then another type of special use permit or other zoning would be
required. If the amendment is denied the business operation for the storing and
shipping of pipe on the property will still continue because it was permitted with the
special use permit approved in October 2015.
Supervisor Gates questioned the intent of the sawing and is it to be within a building.
Ms. Linsmeier responded that Corral Kraft LLC constructed the building without the
benefit of a permit. It is a soundproof building. The County may perform a sound test at
their convenience. All future cutting will take place within the building. Corral Kraft LLC
understands there was an issue and they have taken responsibility of the issue to move
forward. It is 20 minutes a week of steel pipe cutting.
Supervisor Gates asked if there is an issue of pipes falling on the ground. Ms.
Linsmeier responded that Corral Kraft LLC has been performing the same activity since
2004 and the pipes have continued to be delivered in the same manner to the property.
The pipes are not intentionally being dropped. The pipes are brought in by a truck and
put on the ground which is part of the original special use permit.
Supervisor Hickman stated he is knowledgeable of the use of heavy construction
equipment and questioned how the straight pipe is delivered and stored. Ms. Linsmeier
explained that another entity delivers the pipe in bulk, it is stored on the property and a
fork lift is then used to move the pipe around.
Supervisor Hickman asked if the pipe is strapped upon delivery and what is in place
when the strapping is cut. Mark Tiensvold, Corral Kraft LLC owner, responded that the
pipe is banded upon delivery. It is then unloaded onto wood planking. The piping is
transported by forklift for cutting and again onto a trailer for delivery.
Supervisor Hickman questioned if there is a sound abatement or training of employees
for the pipes being placed upon the forklift and onto the delivery truck. Mr. Tiensvold
stated the employees are trained to reband the pipes after they have been cut. In the
process of rebanding, the pipes are stacked on top of each other as they are cut and
rebanded before transporting to the delivery truck bed. The only noise would be from
stacking the piping onto the forklift.
Supervisor Gates noted his gratitude to those who spoke on the item. He was able to
meet with the applicant and residents on their concerns. He stated there is a need for
more discussion on the item to make sure the residents’ concerns are appropriately
addressed. He noted his appreciation on the efforts made so far.

MARICOPA COUNTY RIGHT-OF-WAY
Approve the Amendment to Maricopa County Resolution 2001-01: Permits to Work in
Dedicated Maricopa County Right-of-Way. The amendment to the Resolution followed the
Enhanced Regulatory Outreach Process and the additional language was approved by the
Board of Supervisors on November 8, 2017. This request formalizes the inclusion of the
additional language as part of Resolution 2001-01.
HB 2365 requires the County to establish rates, fees, and terms for the installation,
modification, or replacement by a wireless provider of a utility pole located in a right-of-way;
the collocation of a small wireless facility in a right-of-way; and the collocation of a small
wireless facility on a county utility pole.
Currently the permit fees charged for small cell wireless follow the permit fees outlined in
Resolution 2001-01 (Permits to Work in Dedicated Maricopa County Right-of-Way). The
average cost for installation of a utility pole with small wireless is currently $414. HB 2365
limits the amount charged to a maximum fee of $100 and a maximum rate of $175.
HB 2365 also requires the rate be based on the average fair market value of the County
right-of-way that is suitable for the deployment of wireless facilities and utility poles. It
requires an ordinance establishing time frames for processing small wireless facility
permits. This is accomplished by current Ordinance No. P-30.
HB 2365 also requires the County to establish an administrative waiver process for height
limitations, undergrounding requirements, and spacing requirements. Supervisory District

AGENDA DE DISTRITO DE CONTROL DE INUNDACIONES
The Board of Directors of the Flood Control District of Maricopa County, Phoenix, Arizona,

F-1. IGA AMENDMENT WITH CITY OF PHOENIX FOR TRANSFER OF OPERATION AND
MAINTENANCE OF THREE AUTOMATED FLOOD WARNING STATIONS
Approve Intergovernmental Agreement Amendment (IGA) FCD 2014A017B to transfer
operation and maintenance of three (3) Automated Flood Warning Stations from PHOENIX
(City) to FCDMC (District) for joint use in flood response efforts. The IGA is funded by the
District through secondary property tax monies and by the City through its General Fund
monies. The District’s contribution to this program is the rehabilitation, installation and
perpetual maintenance of the flood warning stations and associated electronics. The cost of
rehabilitation and installation is estimated at $500 per station, for a total cost of $1,500.
Additionally, both parties are requesting that all Flood Warning Stations located on property
owned or managed by the City be included in this IGA. This will alleviate the often tedious
task of renewing land-use permits for the Stations through multiple departments within the
City.
The District and several cities (Scottsdale, Fountain Hills, Phoenix, and Mesa) have in the
past shared in the funding of Flood Warning Stations considered outside the FCDMC
backbone system using similar IGAs. As in this proposed IGA Amendment, each City paid
for the initial equipment, with the District providing installation, long-term maintenance and
data access. This Agenda Item impacts Supervisorial District 3. (C-69-15-055-3-02)
