Donation funds are not local revenues for the purpose of the constitutional expenditure limitations and therefore expenditures of these revenues are not prohibited by the budget law. The approval of this action requested does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. This donation is being funded for the purpose of treating animals suffering from, or showing signs of, Streptococcus Zooepidemicus, a transmittable disease of the respiratory system, which can be fatal if left untreated, and which is currently affecting the East MCACC shelter location. (C-79-18-111-D-00) Mary Martin, Director of Animal Care and Control, explained that a dangerous bacteria, Streptococcus Zooepidemicus, was found at the East Valley Shelter by Veterinarian Dr. Leo Eggar and Kelly Bastar, Supervisor of East Valley Shelter. She introduced and thanked Two Pups Wellness Fund Representatives Bib Haley, Melody Furcini and Nancy Silver. Chairman Chucri said he had a chance to meet the representatives and thanked them on behalf of the Board. The donation means a lot, particularly in this case as it saved the lives of so many animals but also in the aggregate as the donations help the County shine in a special way. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. This item was continued from the February 7, 2018 meeting. (C-44-18-056-M-00) Supervisor Barney noted the item was continued at his request. He thanked the applicant for meeting with him on the unique conditions and relocation caused by the section of Loop 202 being installed around South Mountain. They have worked hard to find a reasonable accommodation that is suitable and makes sense. He commented on the use of taxpayers’ dollars and his aversion to billboards. He said the operator of “Clear Channel Outdoor” has proven to him that billboards can work in an appropriate way within the community. Motion was made by Supervisor Barney to concur with Planning Commission recommendation to approve subject to conditions ‘a’ – ‘g’. Motion seconded by Supervisor Gates. PROPOSED REVISIONS OF MARICOPA COUNTY PARKS AND RECREATION DEPARTMENT USER FEE SCHEDULE Pursuant to A.R.S. §11-251.08 and 11-251.13, convene the scheduled public hearing, to solicit comments and consider the adoption of the proposed changes to the Maricopa County Parks and Recreation Department User Fee Schedule. Upon Board approval, this item will become effective April 1, 2018. The Maricopa County Parks and Recreation Department, with consultation from the Parks and Recreation Commission, has determined the necessity to revise its user fee schedule in order to bring the user fees more closely in line with typical fees for similar systems and to recover fees for services. This will enable the Department to apply any changes in fees to daily park operations and maintenance and needed repairs to parks facilities. The Parks and Recreation Commission held a public meeting regarding the revised fees on November 14, 2017 and no comments were received from the public. The meeting was advertised on the Parks website, through social media and in the parks. The Board must set this matter for public hearing pursuant to statutory requirement. (C-30-18-011-M-00) Chairman Chucri asked the Clerk if there were any registered speakers regarding item 7 and there were none. Motion to approve by Supervisor Barney, seconded by Supervisor Gallardo Supervisor Barney said the County has one of the finest, most incredible and beautiful park systems in the United States. He noted his appreciation to RJ Cardin, Director of Parks and Recreation and his staff their leadership and vision. Revising fees is always a difficult task and it has not been considered for quite some time. There are other possible considerations such as non-resident fees that may come to the Board in the Formal Meeting Minutes Wednesday, February 21, 2018 Page 8 of 44 future. Chairman Chucri noted the Board understands that it is not getting cheaper to operate the parks and they would like to continue to keep it affordable for all to enjoy. ES-2017-001/PET GROOMERS & SHOPS PROPOSED REVISIONS TO CHAPTERS I AND XI OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (MCEHC) Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), set a public hearing for March 21, 2018 to solicit comments and consider the adoption of proposed revisions to MCEHC Chapters I and XI (EROP Case ES-2017-001/Pet Groomers & Shops). Upon Board approval, this item will become effective 03/21/2018. The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC Chapters I and XI (ES-2017-001/Pet Groomers & Shops) as an EROP expedited case at a public meeting held on Friday, February 2, 2018, at the Board of Supervisors Auditorium, 205 West Jefferson Avenue, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at https://www.maricopa.gov/3563/Active-Regulatory-Process. This proposal revises MCEHC Chapters I and XI by removing non-mandated animal related functions regarding kennels, pet shops, veterinary clinics, veterinary hospitals and pet groomers and two “odor” references. Revisions will increase opportunities for business owners while ensuring public health is maintained. Maricopa County Animal Care and Control issues kennel permits, and the Veterinary Medical Examining Board has the authority to investigate veterinary clinics and veterinary hospitals on a complaint basis. The Department does not have a record of a zoonotic disease occurring from a kennel, pet shop, veterinary clinic, veterinary hospital or groomer in Maricopa County. Pima, Coconino, and Pinal counties do not license groomers. In addition, the Department has not responded to “odor” related complaints since 2004 when Air Quality and Environmental Services were one department.
