CANVASS THE ELECTION RETURNS FOR THE FEBRUARY 27, 2018 CONGRESSIONAL DISTRICT 8 PRIMARY SPECIAL ELECTION Canvass the election returns for the February 27, 2018 Congressional District 8 Primary Special Election in accordance with the Official Results prepared by the Maricopa County Elections Department. The Maricopa County Elections Department has prepared the Official Results from all precincts, declaring the vote for the Congressional District 8 primary Special Election held on February 27, 2018. The Elections Department requests the Board of Supervisors canvass these results and approve the Official Canvass for this election pursuant to A.R.S. 16-642 through 16-645. The Board of Supervisors is required to canvass these returns within fifteen days following the election. The Official Canvas is on file with the Clerk of the Board of Supervisors. (C-21-18-004-7-00) Adrian Fontes, Maricopa County Recorder, presented to the Board the canvass of the Primary Special Election. His office had only 81 days to prepare and execute the special election. He thanked Supervisor Hickman and his team for their involvement in the planning for this election. Supervisor Hickman thanked Mr. Fontes and his staff for their hard work during the election. He stated it was a short time frame to prepare and pointed out the residents of his District were appreciative of the extra polling places. He asked if the expenses would be submitted at this time or after the General Election. Mr. Fontes responded that they are able to give the Board estimates at this point, but, the labor cost will have to be factored in at a later date. In response to a question about the use of ballot-on-demand printers, Rey Valenzuela, Elections Director, explained that they have been reaching out to voters asking them to complete a survey. The initial response has been positive. He added that there were 531 provisional ballots and 447 of them were valid. Additionally, 366 of those ballots were out-of-precinct ballots. In the past, those ballots would not have been counted. He stated 8,000 voters voted in person and 236 were able to update their address without completing a provisional ballot. In April, at the General Election during the check-in process a comment card will be available for voters to give on-the-spot comments. This will allow them to capture real-time data. In an effort to be more transparent for the public, the Recorder’s Office now offers detailed reports online for free. Supervisor Gates concurred with Supervisor Hickman’s comments, and thanked the Recorder’s Office and Supervisor Hickman’s staff for their hard work. He asked how many mail ballots were dropped at voting locations. Mr. Fontes responded that 8,000 voters were in-place voters and 64,000-65,000 “mail- ballot” voters dropped off their ballots either at the Recorder’s Office or at precinct locations. He stated out of 115,000 voters 108,000 were early voters. Supervisor Barney congratulated everyone, for their hard work on the election. He Formal Meeting Minutes Wednesday, March 07, 2018 Page 11 of 38 commented that the early voting was at 93% for this election. He noted that 8500 ballots were cast on election day which is about 150 voters per location. He acknowledged that some polling places will be busier than others. However, many of the polling places were overstaffed. He suggested in the future sorting through the issues and deciding how to allocate resources. Supervisor Gallardo concurred with comments made by the Board. He stated the election was tremendous success. The participation rate was at 25% for the special election. He noted that only 84 provisional ballots were not able to be counted due to various reasons. The overall of 531 provisional ballots cast shows the tremendous efforts made to make residents aware of where to go to vote. He stated that the over/under vote was minimal. According to the numbers the diagram did not have an impact on voters, and voters understood that they could only vote for one candidate. He commented that he would like to see the County and Legislature work together to improve the timing of the election to see if it could not make the time so compressed. Mr. Fontes explained out of the 55 sites, 19 sites had fewer than 100 voters and 22 sites had fewer than 200 voters. Motion to approve by Supervisor Barney, seconded by Supervisor Hickman Ayes: Barney, Chucri, Gates, Hickman, Gallardo Recorder - Registradora 9. Supervisory District No. 5 (C-64-18-100-5-00) Motion to approve by Supervisor Gates, seconded by Supervisor Gallardo Ayes: Barney, Chucri, Gates, Hickman, Gallardo 38. ROAD ABANDONMENT: ROAD FILE NO. AB-311 Pursuant to A.R.S. §28-7214, adopt Resolution AB-311 to abandon a portion of the 42nd Street alignment in the vicinity of Dynamite Boulevard by extinguishing a portion of the easement which was conveyed to Maricopa County by means of an Easement and Agreement for Highway Purposes on April 14, 2005 and recorded by the Maricopa County Recorder as recorded by the Maricopa County Recorder in Instrument no. 2005-0473361. Abandon a portion of the road at the request of the property owner. General Vicinity of the 42nd Street Alignment and Dynamite Boulevard at 28232 N. 42nd Street, Cave Creek, AZ 85331 and known as Assessor parcel 211-39-006J. Supervisory District No. 3 (C-64-18-098-M-00) Tom Marco, resident, stated his opposition to this agenda item regarding the abandonment of an easement. He stated that there was supposed to be action to bring this into compliance 15 years ago. There was a hearing with the City of Phoenix regarding the property next to the easement, and it was agreed upon that the fence would be moved back. It was considered a rush to move the fence back because a housing community was being developed. Now Dynamite Horse Supply is wanting to abandon the road but it is used by the City and County for access. He stated at Station 49 it shows the easement is open access for fire and rescue vehicles. He explained the 30 feet that was taken away has hindered residents from going in and out. He mentioned the Dynamite Horse Supply is illegally dumping horse and cow manure on the adjacent property and semi-trucks are unloading supplies on private properties rather than the store’s property. Rod Jarvis, attorney for the applicant, stated 15 years ago a special use permit was submitted and a dedication was made to have the fences moved back. The fences were never moved as there was no need to widen the road. MCDOT has explained that they don’t need the right-of-way due to the addition of 25 feet of pavement added by the developer. The 25 feet is adequate for a right-of-way. He stated they don’t want to encourage it to be a through road bringing more traffic through the area. He stated the Formal Meeting Minutes Wednesday, March 07, 2018 Page 26 of 38 reason they are applying for the abandonment is due to Maricopa County not needing the land and his client could benefit from the property. Supervisor Gates asked Mr. Jarvis if he could address Mr. Marco’s concerns of animal waste being dumped and the land being used for emergency vehicles. Rod Jarvis stated that Dynamite Horse Supply follows all the standard requirements and does not illegally dump waste. He explained how Dynamite Horse Supply is one of the few types of stores that supplies items for rodeos and special events. He stated the existing right-of-way is more than adequate access for fire trucks. Motion to approve by Supervisor Gates, seconded by Supervisor Gallardo Ayes: Barney, Chucri, Gates, Hickman, Gallardo 39. EASEMENT, RIGHT-OF-WAY, AND RELOCATION ASSISTANCE DOCUMENTS Approve easements, right-of-way documents, and relocation assistance for highway and public purposes as authorized by road file resolutions or previous Board of Supervisors’ action. (Comentario público es a discreción del Presidente.) Robert Betsko, resident, stated since April 2014, the Sun Lakes Community has tried to work with the Gila River Indian Community to reach a solution for the dust coming from roads on the reservation. He explained the dust is unbearable and is causing serious health issues to nearby residents. The Indian Community has said that they will close the road when Hunt Highway is paved. However, Hunt Highway is in Pinal County. The Sun Lakes Community is requesting that the Maricopa County Department of Transportation (MCDOT) install a barrier along the South side of Riggs Road from Sun Lakes property to the gas station located on I-10 highway. The barrier is often referred to as guiderails. According to MCDOT Riggs Road is frequently busy. These guiderails would block off the only entrance along this entire stretch of road. Finally, Mr. Betsko mentioned he has a letter from the Homeowners Association along with a petition from residents regarding this issue. Dianne Barker, resident, spoke about the January 23, 2018, special meeting and the need to make the government more open to the public. She suggested some options regarding speaker’s slips. She thanked the Board for the letter she received about this topic. 57. SUPERVISORS’/COUNTY MANAGERS SUMMARY OF CURRENT EVENTS Resumen de temas de actualidad de los Supervisores/Administrador del Condado Supervisor Gallardo explained in November 2017, he received a call regarding Abrazo Hospital closing in Maryvale at the end of the year. Supervisor Gallardo expressed his gratitude to MIHS for moving forward to serve the needs of residents in the community. Supervisor Hickman spoke regarding a recent invitation to the Sun City Posse Open House who were celebrating 45 years of service. He stated the Posse discontinued their partnership with Maricopa County Sherriff’s Office but the MASH Unit and other departments within the Sherriff’s Office were at the event to support the Sun City Posse. He stated the Posse has embraced their new role and are continuing to provide community service. Supervisor Gates congratulated all the individuals who participated in the regional high school mock trial tournament recently held at the South Court Tower. RESOLUTION FOR LAVEEN AREA DRAINAGE MASTER STUDY/PLAN UPDATE Adopt Resolution FCD 2018R006 for the Laveen Area Drainage Master Study/ Plan Update as the drainage mitigation plan for Laveen watershed, and; authorize the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to advertise, select, negotiate, and award contracts for Project engineering and construction services; negotiate Project Intergovernmental Agreements for design, construction, construction management, operation and maintenance, including appropriate District participation in landscape and multi-use improvements ; acquire Project rights-of-way; and include Project funding in the District’s Five-Year Capital Improvement Program. The purpose of the Laveen ADMS/P U is to quantify the extent of drainage and flooding problems, sources, and hazards in the area. The study area is within the City of Phoenix and unincorporated Maricopa County and is bounded by the Salt River to the north, the western boundary of the Hohokam ADMS to the east, South Mountain to the south, and the limits of the Gila River Indian Community to the west. With the new developments in the study area since the completion of the original study in 2002, the Laveen ADMS/P U identified drainage and flooding problems not identified previously using new 2 foot contour mapping and two dimensional analysis that better depicts the level of flooding. The Laveen ADMS/P U also re- examined the past proposed recommended plans and proposed changes to existing plans and recommended new drainage master plan features for this area. This Agenda Item impacts Supervisorial District 5. (C-69-18-024-6-00) Director Gallardo expressed his thanks to the Flood Control staff for their work on this updated plan. The residents of Laveen are very grateful for this new plan. Motion to approve by Director Gallardo, seconded by Director Hickman Ayes: Barney, Chucri, Gates, Hickman, Gallardo Chairman Chucri took this opportunity to recognize Bill Wiley, the Director and General Manager of the Flood Control District of Maricopa County. He acknowledged that Bill is retiring and that his work at the District has been excellent. Director Barney expressed his highest regards for Mr. Wiley and noted how he is an example of an outstanding public service employee. He noted Bill’s ability to handle some very difficult meetings with respect and decorum. Director Gates explained he first met Mr. Wiley while he was serving on the Air Quality Board. At that time Bill was the Director of the Air Quality Department where he did a great job. He stated that Mr. Wiley is an individual that can break through government barriers and wished him the best in his retirement. Formal Meeting Minutes Wednesday, March 07, 2018 Page 37 of 38 Director Hickman concurred with Chairman Chucri’s comments and thanked him for his service to the County. He commented that Bill had the ability to make all involved become team players. Director Gallardo shared a story of how two major storms flooded the Laveen area in 2014. He explained residents were asking questions and he had little knowledge of Flood Control. Eventually he met with Mr. Wiley who helped him to understand their functions. He expressed his gratitude on how well Mr. Wiley could handle issues and answer any questions that he had. He thanked Mr. Wiley for his service to the County. Bill Wiley, Director, Maricopa County Flood Control District, thanked Joy Rich, County Manager for taking a chance on him. He explained he came from Arizona Public Service to the Air Quality department, which was a real challenge for him. The department needed structure, the stakeholders were upset and within 6 months of being at the department he laid off 37 people from the department. He explained the largest dust storm on record occurred on his watch, and the County worked with The Environmental Protection Agency to approve a dust plan although we had been out of attainment for 40 years. In June 2014, he transferred to the Flood Control District where later that year the worst rainfall on record occurred. He stated through all the extreme events that happened every time he transferred to a new department, that the Board, stakeholders, staff, and even other agencies all came together to achieve positive results. Bill jokingly added that he would not accept an appointment to the Board of Health. He appreciated everyone’s support and commented that he looks forward to retirement.
