Project Summary:
1. On July 2, 2003 the Board of Supervisors (BOS) approved case Z99-31, a 4.7 acre Special
Use Permit (SUP) in the Rural-43 zoning district for a riding and roping arena and RV park
known as Dave’s Arena and Horse Camp (formerly Ken’s Arena and Horse Camp) on
parcel 506-40-159. There was also a Variance case approved by the Board of Adjustment
on December 11, 2002 under BA2002113 to allow for:
 An existing building housing animals to setback 16 feet from the side (south)
property line where 100 feet is the minimum required,
 An existing building housing animals to setback 36 feet from the side (north)
property line where 100 feet is the minimum required, and
 An existing building housing animals to setback 91 feet from the rear (east)
property line where 100 feet is the minimum required.
2. Condition ‘k’ of Z99-31 set the SUP validity period/expiration date at July 2, 2018. The
applicant requests the SUP to be of an indefinite period. The proposed modification is
shown below in leg-edit form:
k. This Special Use Permit shall expire fifteen (15) years from the date of approval of
this request may continue until either abandoned by the property owner or
revoked by the Board of Supervisors. Upon termination of this Special Use Permit,
the use of the property must be consistent with the underlying zoning district.
Public Participation Summary:
3. The applicant complied with the requirements for notification to the property owners
within 300’ of the subject site and postings of the subject property. The applicant has also
provided staff with a Citizen Participation Final Report detailing the public process. The
applicant has included as part of an attachment to the narrative the signed petition (23
signatures) of support which also includes a map of the signees. There has been no public
response as of writing of this staff report.

Outstanding Concerns from Reviewing Agencies:
6. N/A
Staff Analysis:
7. The applicant and staff are in agreement with the requested modification of condition
‘k’ of Z99-31 to allow for permanence of this SUP. The existing riding and roping arena and
RV park use fits with the rural/equine land uses to which the surrounding area and
Tonopah are largely accustomed. There are adjacent like land uses to the north where
there is an existing SUP (Z99-52) for an equine (boarding and training) facility and RV park,
there are also residential and equine uses to the south, and a vacant parcel to the east.
The applicant also has support from the community for this SUP that has been in existence
for 15 years. This support includes the immediate owners to the north and south of the
subject site. There are no concerns from reviewing agencies and there have been no
violations on the subject property. From staff review, the site (using 2018 aerial
photography) remains in substantial conformance with the approved Z99-31 site plan.
Staff could not find a status report as required per stipulation ‘j’ of Z99-31, however, the
narrative report for Z2018047 has mentioned that there are no changes to the original
plan. The RV park as mentioned is considered accessory to the subject training and
roping arena where screening is not required per condition ‘d’ of Z99-31 (nor
requirements of RV Park SUP standards of Article 1301.1.17 of the MCZO). The land use
and development patterns for this area are established for large lots and equestrian uses.
The SUP is compatible with these patterns and will be until the foreseeable future.
8. Note the original SUP was approved subject to conditions ‘a’ – ‘m’. With this amendment,
staff has proposed to delete conditions ‘d’, ‘f’, ‘g’, and j and revise condition ‘c’ of Z99-
31 for the current scenario. These proposed changes to conditions will be reflected within
the recommendation with conditions in paragraph 9 of this report. It should be noted that
the original conditions of Z99-31 are provided within the applicant’s narrative report and
as an attachment of this narrative report with a copy of the original approval letter.
Recommendation:
9. Staff recommends the Commission motion for approval of case Z2018047 subject to
conditions ‘a’ – ‘i’:
a. Development and use of the site shall be in substantial conformance with the
untitled site plan consisting of one 11” x 17” sheet with a second 8-½” x 11” reference
page, un-dated but stamped received April 15, 2003, except as modified by the
following stipulations.

b. Development and use of the site shall be in general conformance with the
narrative report entitled “Runner’s Arena and Horse Camp”, consisting of two
pages, stamped received March 30, 1999, as amended by the two-page memo
from The Harcuvar Company dated July 20, 2001, except as modified by the
following stipulations.
c. The property owner shall maintain Trailer Coach Park license as required by the
Maricopa County Health Code.
d. The property owner shall take the necessary steps to ensure that dust emissions
emanating from the property do not exceed the maximum levels allowed. The
property shall be subject to a two-year review period to monitor intensity of said
dust emissions. After the two-year review period, the property owner shall make
improvements necessary to mitigate said dust levels. A status report to this effect
shall be submitted by the applicant to the Planning and Development
Department.
e. There shall be no signage other than what is otherwise allowed in the underlying
zoning district. No signs shall be placed within the MCDOT right-of-way. Said
signage shall comply with all zoning regulations with respect to size and location.
f. The property owner shall clean all horse stalls once every other day and shall keep
said manure within a tightly closed container. This container shall be hauled from
the site on a weekly basis.
g. This Special Use Permit may continue until either abandoned by the property
owner or revoked by the Board of Supervisors. Upon termination of this Special Use
Permit, the use of the property must be consistent with the underlying zoning
district.
h. Major changes to the Plan of Development (site plan and narrative) shall be
processed as a revised application, with approval by the Board of Supervisors
upon recommendation of the Planning and Zoning Commission. Minor changes
may be administratively approved by the Planning and Development
Department. For purposes of this Special Use Permit, revisions arising out of the
deletion of the RV Parking spaces as discussed in stipulation “c” above may be
considered administrative.
i. Noncompliance with the Plan of Development (site plan and narrative report) or
the conditions of approval will be treated as a violation in accordance with the
Maricopa County Zoning Ordinance. Further, noncompliance of the conditions
of approval may be grounds for the Planning and Zoning Commission to take
action to reconsider this zoning approval.

Background & Request
Pew and Lake, PLC on behalf of David and Holly Burtenshaw, submit this request for a
modification of Stipulation "k" of Zoning Case No. Z99-31, a Special Use Permit (SUP)
for Dave's Arena and Horse Camp, a riding and roping arena and RV park (formerly
known as Runner's Arena). The site is roughly 4.7 acres and located at 3713 N 395th
Avenue (APN: 506-40-159) in the Tonopah area.
Purpose of Request: Time extension of the Special Use Permit of Case No. Z99-31 for
the equestrian center, riding and boarding stable with roping arena and RV Park.
Description of Proposal: Modification of Stipulation "k" to grant a time extension for
the existing Special Use Permit which, absent an extension, would expire on July 2,
2018. There are no other necessary stipulation modifications.
Relationship to Surrounding Properties: The properties north and south of the
subject property have riding arenas with horses and RV's; across the street to the West
is single family housing; and to the East is vacant agricultural land. The majority of the
neighbors are horse owners and do not oppose the roping arena. Please see Exhibit A:
Neighbors-in-Support Map for illustration of surrounding properties in support. The
Maricopa County Tonopah/Arlington Area Plan designates the subject property and
surrounding property for rural uses with densities ranging from 0-1 d.u./ac. As such, the
proposed use is consistent with the Maricopa County Tonopah/Arlington Area Plan.
Location and Accessibility: The property is generally located six miles north of 1-10,
thirty-five miles south of the Town of Wickenburg on Vulture Mine Road and seven
miles east of Tonopah.
Circulation System: 28-foot-wide driveway enters from 359th Avenue.
Development Schedule: This does not apply as there is no additional development
occurring for this site.
Community Facilities and Services: Ruth Fisher Elementary School and Tonopah
Valley High School.
Public Utilities and Services: Electric APS; Tonopah Valley Fire District; Police
Maricopa County; Trash USA Waste; Waste Septic (2); Water private well.
Analysis: The Maricopa County Board of Supervisors (Board) should approve
modification of the existing SUP because the use remains viable and vibrant and it
remains a benefit to the residents in the area and the County as a whole. Moreover,
there have been no significant changes to the use or surrounding area since the
Board's original SUP approval on July 2, 2003 and Dave's Arena and Horse Camp (fka
Runner's) has operated without any code violations since the Board's SUP approval
(See Exhibit B: Original Approval Letter & Site Plan).
2

1. There have been no changes to the Plan of Development.
There are no changes to the use or site plan. The site has been maintained as a riding
and roping arena with an associated RV park. There will be no changes to the plan of
development if an extension of the SUP is approved. The use of the property would be
consistent with the underlying RU-43 zoning absent an extension of the SUP.
Figure 1: Existing Site
Map
• •
•
'V
2. There have been no major changes in the surrounding area.
The underlying zoning of the subject property and surrounding properties is RU-43. The
three neighboring properties to the south and the neighboring property to the north
operate similar roping arenas. The SUP does not conflict with the single-family housing
located to the west because the use is rural and agricultural in nature and the majority
of the residents signed the petition in support.
3

Notable changes in the area during the past 15 years include the building of single
family homes to the west of the subject property and the addition of a solar panel
reserve located approximately 2,500 feet to the northeast of the property. All other
surrounding uses have remained largely the same and no changes to underlying zoning
has occurred in the area.

3. Dave's Arena and Horse Camp (fka Runner's) has operated without
incident since its July 2, 2003 SUP approval.
No violations have occurred related to the subject property and the owner has complied
with the stipulations stated in the July 2, 2003 approval.
This facility brings revenue into the local community for gasoline, restaurants,
entertainment, and school fund raisers. Land values are positively affected by its
continued use and adjacent neighbors are horse enthusiasts who approve of the use.
There are several trees and shrubs which provide screening between neighbors and the
private residence, winter RV's, and arena. All horse pens, arena, entrance fence, and
signs are steel. The RV's, residence, and horse pens are situated on slightly elevated
grounds, per the approved plans, providing adequate water drainage.
Additionally, the existing site and use complies with the current requirements of
Maricopa County Zoning Ordinance Article 1301.1.14 Public riding and boarding
stables. Setback requirements under 1301.1.14 were altered under BA2002113. The
existing site and use also meets the requirements of the current requirements of Article
1301.1.17 Travel trailer or recreation vehicle (RV) parks.
4. Proposed changes to stipulations.
The only change to the existing conditions is the time extension modification of
Stipulation "k". The other stipulations remain the same because there has not been a
change to the site plan or the condition has been fulfilled. Below are the approved
conditions with our proposed changes in legislative format:
a. Development and use of the site shall be in substantial conformance with the
untitled site plan consisting of one 11" x 17" sheet with a second 8-1/2" x 11"
reference page, undated but stamped received April 15, 2003, except as
modified by the following stipulations.
b. Development and use of the site shall be in general conformance with the
narrative report entitled "Runner's Arena and Horse Camp", consisting of two
pages, stamped received March 30, 1999, as amended by the two-page memo
from The Harcuvar Company dated July 20, 2001, except as modified by the
following stipulations.
c. Within six months of approval of this Special Use Permit by the Board of
Supervisors and prior to zoning clearance, the property owner shall become a
licensed Trailer Coach Park as required by the Maricopa County Health Code. If
the property owner elects not to become a Trailer Coach Park, a revised site plan
indicating the deletion of the RV Parking spaces will be required, said revision to
be processed administratively under a separate case.
5

d. Within six months of approval of this Special Use Permit by the Board of
Supervisors and prior to zoning clearance, the property owner shall obtain a
Variance to waive the screening requirement along the north side of the RV
Parking Spaces. If it is decided that the RV Parking spaces are to be eliminated
from the site plan as discussed in stipulation "c" above, this stipulation shall not
apply.
e. The property owner shall take the necessary steps to ensure that dust emission
emanating from the property do not exceed the maximum levels allowed. The
property shall be subject to a two-year review period to monitor intensity of said
dust emission. After the two-year review period, the property owner shall make
improvements necessary to mitigate said dust levels. A status report to this effect
shall be submitted by the applicant to the Planning and Development
Department.
f. Should it be deemed that additional paving or similar impervious surfaces are
required for this site, a drainage report in conjunction with a site plan, grading
and drainage plan, and paving plans shall be submitted and approved prior to
issuance of drainage clearance and building permit.
g. The property owner shall obtain all necessary permits prior to commencing
construction of any structures on the property. Any permit required as a condition
of approval of BA2002113 shall be obtained within six months of approval of this
Special Use Permit by the Board of Supervisors.
h. There shall be no signage other than what is otherwise allowed in the underlying
zoning district. No signs shall be placed within the MCDOT right-of-way. Said
signage shall comply with all zoning regulations with respect to size and location.
i. The property owner shall clean all horse stalls once every other day and shall
keep said manure within a tightly closed container. This container shall be
hauled from the site on a weekly basis.
A Status Report outlining the status of development shall be submitted prior to
the second anniversary of the approval of the Special Use Permit by the Board of
Supervisors. This Status Report may be approved by staff, or forwarded to the
Commission for further action if it is deemed that the conditions of approval have
not been met.
k. This Special Use Permit shall expire fifteen (15) years from the datc of approval
of this requcst may continue until either abandoned by the property owner
or revoked by the Board of Supervisors. Upon termination of this Special Use
Permit, the use of the property must be consistent with the underlying zoning
district.
I. Major changes to the Plan of Development (site plan and narrative) shall be
processed as a revised application, with approval by the Board of Supervisors
6

upon recommendation of the Planning and Zoning Commission. Minor changes
may be administratively approved by the Planning and Development Department.
For purposes of this Special Use Permit, revisions arising out of the deletion of
the RV Parking spaces as discussed in stipulation "c" above may be considered
administrative.
m. Noncompliance with the Plan of Development (site plan and narrative report) or
the conditions of approval will be treated as a violation in accordance with the
Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of
approval may be grounds for the Planning and Zoning Commission to take action
to reconsider this zoning approval.
