ORDINANCE NO. 4348
AN ORDINANCE OF THE COUNCIL OF THE CITY OF SCOTTSDALE,
MARICOPA COUNTY, ARIZONA, INCREASING THE CORPORATE
LIMITS OF THE CITY OF SCOTTSDALE, PURSUANT TO ARIZONA
REVISED STATUTES SECTION 9-471.N, BY ANNEXING CERTAIN
COUNTY RIGHT-OF-WAY ADJACENT TO THE PRESENT
CORPORATE LIMITS OF THE CITY OF SCOTTSDALE, ON APPROVAL
BY THE MARICOPA COUNTY BOARD OF SUPERVISORS.

WHEREAS, the City Council has determined it to be in the best interest of the City of
Scottsdale for certain territory specifically described in the attached Exhibit A and shown on the
map attached as Exhibit B of this Ordinance ("Territory") to be annexed to the City of Scottsdale;
and
WHEREAS, the Territory consists solely of County right-of-way or roadway with no
taxable real property; and
WHEREAS, the Territory is adjacent to the corporate boundaries of the City of
Scottsdale for the entire length of the Territory; and
WHEREAS, A.R.S. § 9-471.N provides for the annexation of county right-of-way or
roadway from an unincorporated area within the county to a municipality by mutual consent of
the governing bodies of the County and City; and
WHEREAS, the City and Maricopa County have entered into intergovernmental
agreement number 2017-076-COS to design and construct east bound left turn lanes at
Mountainside Drive and at Arroyo Road on the Carefree Highway, including the annexation of
the County's right of way.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Scottsdale, as
follows:
Section 1. That the City Council hereby determines that the Territory is as legally
described in the attached Exhibit "A", and as shown on the map attached as Exhibit "B", both
incorporated herein by this reference, and further finds that the Territory is County right-of-way
or roadway with no taxable real property and that the Territory is adjacent to the corporate
boundaries of the city for the Territory's entire length.

Section 2. That the City Council hereby expresses its intention to annex the Territory
with the consent of Maricopa County and hereby declares the annexation to have occurred and
the present corporate limits of the City of Scottsdale modified and increased to include the
Territory upon approval of the annexation by the Maricopa County Board of Supervisors as a
published agenda item at a regular public meeting and upon compliance with A.R.S. § 9-471.N.
Section 3. That the City Clerk is hereby authorized and directed to forward a
certified copy of this Ordinance and the attached map to the chairman and the Clerk of the
Board of Supervisors of Maricopa County, Arizona, evidencing its successful passage on the
day and date written below.

July, 2018.
