MCDOT Systems Planning Review
According to Section 5f of the Maricopa County Patent Easement Abandonment Ordinance P-34, “A request for
abandonment of a patent easement shall only be granted when the Board of Supervisors determines in its discretion that
the patent easement is not being used by the public at the time of the request or that said patent easement is no longer
necessary.
Staff reviewed historical aerial photography from 1976 to 2016, in ten year time frames, as shown in the below images. It
was discovered in 1986 a path of travel was established by the public along 103rd Avenue from Avenida Del Sol to Mariposa
Grande and has continued to the present. Based on this information the patent easement was determined to be in use by
the public at the time of the request.
Staff further looked at the travel demand for the area and it was discovered the roadway is functioning as a local roadway
and will continue into the future. MCDOT’s minimum half-width for a local roadway is 25 feet. The current patent easement
is 33 feet. MCDOT would support abandonment of the excess 8 feet. This will allow the property owner additional land for
his/her use and will accommodate the local roadway.

Other Patent Easement Abandonments along 103rd Avenue
In April of 2017, the Board of Supervisors approved the full abandonment of PAB-0040 which is located north PAB-
0055 along 103rd Avenue, as shown in the below image. During the abandonment process for PAB-0040, it was
discovered parcels to the north are taking access from Calle Lejos and south are taking access from Mariposa Grande
and 103rd Avenue. Based on aerial photography, PAB-0040 has not been in use for connected access between Calle
Lejos and Mariposa Grande and MCDOT has no plans to construct a future roadway. This analysis resulted in a “no
objection” from MCDOT Systems Planning for PAB-0040.
Note: No objections were received from Arizona State Trust Land.
