Agreement No. G-30158 Amendment No. 1 C-18-13-016-3-01 AMENDMENT No. 1 TO INTERGOVERNMENTAL AGREEMENT FOR THE USE OF REAL PROPERTY GLENDALE WIC FACILITY This Amendment No. 1 (this “Amendment”) to Intergovernmental Agreement for Use of Real Property is made and entered into as of the date last signed below, is by and between Maricopa County Special Health Care District, a tax-levying special improvement district of the State of Arizona (“District”) and Maricopa County, a political subdivision of the State of Arizona, (“County”), together the “Parties”. RECITALS: A. District and County are parties to that certain Intergovernmental Agreement No. G-30158, approved by the Maricopa County Board of Supervisors and the Maricopa County Special Health Care District Board of Directors on December 12, 2012 (the “Agreement”). The Agreement is for use of premises at 5141 West Lamar Road, Glendale, AZ (the “Glendale FHC”). B. The term of the Agreement expires on June 30, 2018. C. District and County now mutually desire to amend the Agreement to extend the term as provided for in the Agreement, amend the termination notice requirements and update County notice address. AGREEMENT NOW, THEREFORE, in consideration of the foregoing and other valuable consideration, the receipt and sufficiency of which are hereby acknowledged, District and County agree to amend the Agreement as follows: 1. The Recitals are incorporated herein by this reference. 2. The term of the Agreement is hereby extended five (5) years, to commence July 1, 2018 and expire June 30, 2023. This Amendment is subject to termination pursuant to the provisions of A.R.S. § 38-511. Either party may terminate the Agreement upon 360-day written notice to the other. 3. The County notice address is updated as follows: Maricopa County Real Estate Department Attn: Director 2801 West Durango Street Phoenix, AZ 85009 1 4. The effective date of this Amendment is the last date of execution by both Parties. 5. The foregoing paragraphs contain all the changes made by this Amendment. All other terms and conditions of the original Agreement as amended shall remain the same and in full force and effect.
