AMENDMENT NO. ONE
TO
INTERGOVERNMENTAL AGREEMENT
BETWEEN
THE STATE OF ARIZONA
AND
THE MARICOPA COUNTY DEPARTMENT
OF PUBLIC HEALTH
THIS AMENDMENT NO. ONE to INTERGOVERNMENTAL AGREEMENT (the “Amendment No.
One”), is entered into this date ______________________________, pursuant to Arizona Revised Statutes §§
11-951 through 11-954, as amended, between the STATE OF ARIZONA, acting by and through its
DEPARTMENT OF TRANSPORTATION (the "State") and the MARICOPA COUNTY, acting by and
through its DEPARTMENT OF PUBLIC HEALTH (the “County”). The County and State are
collectively referred to as the “Parties.”
WHEREAS, the INTERGOVERNMENTAL AGREEMENT, IGA/JPA 16-0006062-I, A.G. Contract No.
P0012016003057, was executed on November 1, 2016, (the “Original Agreement”);
WHEREAS, the State is empowered by Arizona Revised Statutes § 28-401 to enter into this
Amendment No. One and has delegated to the undersigned the authority to execute this
Amendment No. One on behalf of the State;
WHEREAS, the County is empowered by Arizona Revised Statutes § 11-251 to enter into this
Amendment No. One and has by resolution, a copy of which is attached and made a part of, resolved
to enter into this Amendment No. One and has authorized the undersigned to execute this
Amendment No. One on behalf of the County; and
NOW THEREFORE, in consideration of the mutual terms expressed herein, the purpose of
this Amendment No. One is County’s deadline to expend funds for this Project. The Parties
desire to amend the Original Agreement as follows:

I. RECITALS
Section I, Paragraph I. 3., is revised as follows:
3. The Safe Routes to School Program (SRTS) was established in August 2005 as part of SAFETEA-
LU, Section 1404 of this legislation provides funding (for the first time) for State Departments of
Transportation to create and administer SRTS programs. This is a non-infrastructure project in
which the recipient has until June 30, 2019, to expend the funds programmed for this Project.
The State and the County have identified programs within the County as eligible for this
funding.
II. SCOPE OF WORK
(NO CHANGES)
III. MISCELLANEOUS PROVISIONS
Section III, Paragraph 18., and 19., are added as follows:
18. The County acknowledges and will comply with Title VI of the Civil Rights Act Of 1964.
19. The Parties shall ensure that all contractors comply with the applicable requirements of
Arizona Revised Statutes §35-393.01.
EXCEPT AS AMENDED, ALL OTHER terms and conditions of the Original Agreement remain in full
force and effect.
THIS AMENDMENT NO. ONE shall become effective upon signing and dating of the Determination
Letter by the State’s Attorney General.
IN ACCORDANCE WITH Arizona Revised Statutes § 11-952 (D) attached and incorporated in this
Amendment No. One is the written determination of each Party’s legal counsel that the Parties are
authorized under the laws of this State to enter into this Amendment No. One and that the
Amendment No. One is in proper form.

to the County under the laws of the State of Arizona.
No opinion is expressed as to the authority of the State to enter into this Amendment No. One.
