SUBJECT: Mineral Evaluation for 16-114720, Deer Valley Road Extension — Finley Lease
The Maricopa County Department of Transportation (MCDOT) submitted Right of Way Application 16 -
114720 for the proposed Deer Valley Road Extension (DVRE) on March 9, 2010. The proposed route of
the DVRE spans the Ague Fria River, connecting Deer Valley Road on the east side of the river to Williams
Drive on the west side.
The route of the proposed DVRE resulted in a use conflict between the route and existing Mineral Materiai
Lease 04-105556, operated by Richard and Michael Finley. MCDOT, the Arizona State Land Department
(ASLD), and the Finley's conducted multiple meetings to resolve the use conflict. To accommodate
MCDOT's plans and schedule, the Finley's ceased mining operations on May 1, 2014, and allowed Lease
04-105556 to expire on September 20, 2015, confirming the decision in an e-mail sent the same day.
MCDOT's pursuit of the proposed DVRE led to the early termination of Mineral Materials Lease 04-
105556, Consequently, the early termination of the lease eliminated mineral royalty revenue to the State
Trust because reserves were not mined, converted to sized rock products, then sold commercially. ASLD
and the State Trust fund received royalty revenue at the rate of $0.60/ton for sized rock products sold
under the Finley Lease.
ASLD's Minerals Section calculated minable reserves of 693,550 tons remained on the Finley Lease
Parcel 04-105556, approximately three years' worth of mining at the rate achieved over the ten years of
operation. The resulting lost revenue to the State Trust was $554,84P-, based on the royalty rate of
$0.80/ton. in addition, ASLD did not receive the associated administration fee of $16,645 2-° (3% of the
royalty), plus $50,5500- for three years of rent ($16, 850 per year).
