RELATED TO PRIVATE DEVELOPMENTS
Approve the Intergovernmental Agreement between Maricopa County and the City of
Surprise for the coordination of roadway standards related to private developments. The
Agreement shall become effective as of the date it is approved by the Maricopa County
Board of Supervisors and will not exceed five (5) years unless extended by appropriate
actions by the County and City. Either Party may terminate this Agreement at any time
prior to the expiration date by furnishing the other Party with a thirty (30) day written notice.
The purpose of this Intergovernmental Agreement is to identify and define the Parties’
respective roles in the application of City standards on development-related roadways in
County jurisdiction under certain circumstances. The need for this Agreement was
identified by a taskforce of the Department of Transportation manager, other County
departments, and private sector development interests in an effort to reduce regulation and
streamline government processes.
There are instances where a development site is located in a city’s jurisdiction and
adjacent roadways to be constructed by the developer are located in the county’s
jurisdiction, and the city is planning to annex the development area and its roadways. In
such cases, it may be reasonable to allow the roadways within the county jurisdiction to be
designed and constructed to city standards. Each instance must be authorized by a Letter
of Agreement (LOA) approved and signed by the County Department of Transportation
Director and the City Manager, or their designees. Supervisory District No. 4 (C-64-18-049-

30, 2022 unless extended by appropriate actions by the County and City. Either party may
terminate this Agreement at any time prior to the expiration date by furnishing the other
party with a thirty (30) day written notice.
This Agreement will allow for traffic control permit fees to be waived when the City has a
project adjacent to or near County right-of-way, the County is not a partner to the project,
and the City needs to place traffic control in County right-of-way for appropriate notice and
safety. The traffic control permit fees would be waived for County projects meeting the
same conditions. Both parties are required to submit traffic control plans and follow
standard permitting requirements. The review of the traffic control permit application plans

Academy Projects), Series 2017, in one or more tax-exempt and/or taxable series in an
aggregate principal amount not to exceed $34,000,000. (C-18-18-004-4-00)
Leonard Clark, resident, stated his reservations due to holes in Arizona laws that allow
charter schools to do things financially that a public school cannot do. He stated the
charter schools are able to come to government entities and receive millions of dollars
tax free. Mr. Clark mentioned that public schools try to get bond overrides that require
the parents going around knocking on doors for signatures just to try to get the bond
override passed for funds. He stated there is an ongoing litigation with Heritage and
Great Hearts Academy. The City of Phoenix recently passed a vote for $100 billion for
the charter schools. He stated public schools are in need of help too.
Supervisor Gallardo stated he is familiar with the school and comments that have been
made. He stated there are many other projects in the community that could benefit from
the money. He explained that the school is already built and the money is going to be
used for expanding the school. He stated the Industrial Development Authority should
think twice about sending the funding to charter schools and allocate money for other
schools.
Supervisor Gates noted every time the I.D.A gives funding to the charter schools it
creates funds to be used for various projects in the County. He mentioned programs
such as Work Force Development was created due to the funds and that the money
does go beyond helping charter schools.
Chairman Barney stated these are not grant funds and Maricopa County is simply acting
as a statutory financing portal. He stated he knows Jared Taylor, proprietor, who is
focused on educating future generations.

141. ADOPTION OF AQ-2017-001-INCORPORATION BY REFERENCE 2016-2017
Pursuant to A.R.S. §49-479(b), set a public hearing for December 13, 2017 to solicit
comments and consider the adoption of incorporating federal standards into Maricopa
County Air Pollution Control Regulations: Rule 360 (New Source Performance Standards),
Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix
G (Incorporated Materials). Following the public hearing, the Board is requested to adopt
the incorporations into the Maricopa County Air Pollution Control Regulations. Upon Board
approval, this item will become effective December 13, 2017.
The Maricopa County Air Quality Department (“MCAQD”) is proposing to revise 360, 370,
371, and Appendix G by incorporating federal regulations and documents promulgated by
the U.S. Environmental Protection Agency (“EPA”): New Source Performance Standards
(“NSPS”), National Emission Standards for Hazardous Air Pollutants (“NESHAP”), Acid
Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will
include amending the incorporation by reference date from July 1, 2016, to July 1, 2017, in
each of the rules and appendix to remain current with federal regulations. The adoption of
the proposed amendments to Maricopa County Air Pollution Control Regulations Rules
360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of
authority to the MCAQD for the implementation and enforcement of the federal regulations
and documents.
These amendments should not have an economic impact on businesses in Maricopa
County and should not impose additional costs on the regulated community, small
businesses, political subdivisions, and members of the public beyond that already incurred
by reason of federal or state rule or law. The costs of compliance with these rules have
already occurred and were considered when the federal and state rules or laws were
proposed and adopted. Permit fees are not changing due to this action.
The MCAQD did not receive any public comments during the public comment period. A
Notice of Final Rulemaking will be distributed per normal procedures once approved. (C-

(VEGETABLE OIL EXTRACTION PROCESSES)
Pursuant to A.R.S. §49-479(b), set a public hearing for December 13, 2017 to solicit
comments and consider the adoption of proposed rescission of Maricopa County Air
Pollution Control Regulations Rule 317 (Hospital/Medical/Infectious Waste Incinerators),
Rule 325 (Brick and Structural Clay Products (BSCP) Manufacturing), Rule 334 (Rubber
Sports Ball Manufacturing) and Rule 339 (Vegetable Oil Extraction Processes) and the
associated proposed revision to the State Implementation Plan (SIP). Following the public
hearing, the Board is requested to approve the proposed rescission of Rules 317, 325, 334
and 339 and the proposed rescission of Rules 325, 334 and 339 from the SIP. Upon Board
approval, this item will become effective December 13, 2017.
The Maricopa County Air Quality Department (MCAQD) is proposing to rescind Rules 317,
325, 334 and 339 and is proposing to rescind Rules 325, 334 and 339 from the SIP.
Rule 317 (Hospital/Medical/Infectious Waste Incinerators)
Rule 317 was adopted to control emissions of air pollutants from hospital/medical/infectious
waste incinerator(s) (HMIWI). There are currently no HMIWI in Maricopa County and the
department’s records indicate the last HMIWI permit was closed (source was removed) in
1998. Most hospital/medical/infectious waste is now treated using alternative technologies
such as thermal treatment (microwave technologies), steam sterilization (autoclaving) and
chemical and mechanical treatment. The department does not anticipate any new HMIWI
will locate to Maricopa County.
Rule 325 (Brick and Structural Clay Products (BSCP) Manufacturing)
Rule 325 was originally adopted on August 10, 2005. The purpose of the rule is to limit
particulate matter emissions from the use of tunnel kilns for curing in the brick and
structural clay product (BSCP) manufacturing processes. Maricopa County currently has
no sources subject to the rule and does not anticipate any new brick or structural clay
product manufacturers will locate to Maricopa County.
Rule 334 (Rubber Sports Ball Manufacturing)
The purpose of the rule is to limit emissions of volatile organic compounds (VOCs) from
natural and synthetic rubber adhesives used in the manufacture of non-inflatable rubber
balls. Only one source has been subject to the rule since it was adopted in 1993 and that
source ceased operations in 2009. Due to the uniqueness of this type of manufacturing and
the lower costs of labor and raw materials in the Far East, the department does not
anticipate any new rubber sports ball manufacturers will locate to Maricopa County.
Rule 339 (Vegetable Oil Extraction Processes)
Rule 339 was adopted to limit the emissions of VOCs from the extraction of vegetable oil
using solvents (hexane). Maricopa County currently has no vegetable oil production
facilities subject to the rule and the department’s records indicate the only issued permit
was closed (source was removed) in 1999.
Since the adoption of Rule 339, hexane, the primary solvent used in vegetable oil
extraction processes is now regulated as a hazardous air pollutant (HAP), not as a VOC. In
2001, the EPA promulgated national emission standards for hazardous pollutants
(NESHAP) for the use of hexane in vegetable oil production facilities. The vegetable oil
production NESHAP has been incorporated into the county’s air quality regulations through
Rule 370 (Federal Hazardous Air Pollution Program); therefore, Rule 339 is obsolete.
Permit fees are not changing due to this action. (C-85-18-003-M-00)

A-1. CONFLICT WAIVER REQUEST FROM JENNINGS, STROUSS & SALMON, P.L.C.
Approve request for conflict of interest waiver requested by Jennings, Strouss and Salmon
to represent condemning authorities in these condemnation cases in Superior Court: City
of El Mirage v. Dobos, et al., CV2015-006955; City of El Mirage v. Garza, et al., CV2015-
007681; and City of El Mirage v. Taylor, et al., CV2015-012406; and in future case in which
Maricopa County is a nominal party-defendant in which Jennings, Strouss and Salmon do
not oppose the County’s right to compensation or the amount of the County’s claim.
Because Jennings, Strouss and Salmon also has a contract to represent Maricopa County
in unrelated matters, a conflict of interest results between two clients of the firm.
This waiver is only for these cases and the future similarly situated condemnation cases in
which Jennings, Strouss and Salmon does not oppose the County’s claim nor amount of
the claim. This waiver does not extend to any matter in which the firm contests the
County’s right to compensation or the amount of the County’s claim. This item was

Saluador Reza, resident, noted his concerns and is opposed for the property to be used

already has multiple challenges. He noted in the past there was an issue of toxic waste.
He stated the Rescue Mission is located in the area and has current lawsuits with the
City of Phoenix. Mr. Reza stated he has a letter from Councilmember Nowakowski who
opposes the Letter of Intent. He stated the Board should reconsider due to the
opposition from the community and business owners.
Supervisor Gallardo noted he supports programs that help offenders become
reproductive individuals and reduce recidivism. He understands that this is just a Letter
of Intent. He stated if the program is such a success than there is no need to move it
somewhere else. The community already faces many challenges. Phoenix Police, as
well as community leaders, are trying to reduce the criminal activity in that area. He
mentioned that he is not happy about how the project unfolded. He questioned why the
site was selected, justification for transportation, and how it’s the same as the other
programs. He wanted to know why the working group met yesterday to create a letter
and now they are in a hurry to pass the letter. He wanted to remove the Durango
Complex language and the statutory deadline to January 1, 2018 to pass the Letter of
Intent. He stated he is opposed to approving the letter and wants to get the community
involved to give them a chance to voice their concerns and questions. He recommended
to slow the process down and do this the right way.
Supervisor Chucri mentioned today is Supervisor Gallardo’s Birthday. Supervisor Chucri
stated the Board has never rubber stamped any item. He stated the Board was elected
to figure out how to make government operate at the speed of business. Mosaic

program is a drug rehabilitation program that will work well with the Governor’s plan and
is a start to get individuals to be productive citizens. He stated this is a step forward to
start the dialogue for this issue and make sure everyone’s concerned voice is heard.
Supervisor Hickman stated he has some of the same concerns as his colleagues. He
stated over the last 21 years Hickman Farms has employed inmates and they currently
have 400 inmates working for them. Farming tax payers is the program their company
created to give individuals a chance to become economical. Hickman Farms is in the
process of creating housing to help individuals get back into the workforce. He stated
the Letter of Intent is a chance for government entities to work together for a solution.
Supervisor Gates stated District 3 has a reentry center just like District 5. He stated the
issue seems to be a dollar and cents issue. If you have more productive citizens it leads
to more taxpayers and reduces incarceration of individuals.
Supervisor Gallardo appreciated the Board’s commitment to not rubber stamp this. He
stated the ideal reentry program is to have smaller communities and spread them out.
Supervisor Hickman thanked Joy Rich, County Manager, and Reid Spaulding, Assistant
County Manager, for their involvement. He stated in the future they will look at the
proximity with other inmates. He asked Ms. Rich to keep him up-to-date on the cost
shifts. He would like to compare what the County and State each contribute.
Chairman Barney echoed the same concern for financials between the County and
State. He noted his gratitude for all the individuals involved. He stated everyone has the
same goal that all individuals in state custody should have a second chance to be
productive citizens.

Gina Swoboda, Maricopa County Precinct Committeemen for Legislative District 23,
stated on July 25, 2017 the Maricopa County Recorder, Adrian Fontes, notified all
Precinct Committeemen that, “The regular rules for Permanent Early Voting List voters
now apply to all voters.” She stated Maricopa County now has a de facto all-mall
elections procedure. She stated the result of the changes to the election process is out
of compliance with several Federal and State statutes. She continued to list the statutes
that are out of compliance.
 HAVA 107-252-USC: 20901-21145 (Help America Vote Act 2002) requires all
voters registered using the Federal Voter Registration form provide Proff of
Citizenship at the polls the first time they cast a ballot. These voters are
statutorily ineligible for PEVL for their initial vote. The forms of Proof of
Citizenship are specific and signature verification is not accepted for these
voters at their first time voting.
 ARS 16-544 (B) voters must enroll in PEVL and given the opportunity to remove
themselves from PEVL.
 ARS 16-572 (c) Prohibits ballots taken from the polling place on Election Day
and is enacted to prevent fraud. The current systems has no controls to prevent
a voter from taking their ballot and mail envelope and leaving the polling place.
There is no control to prevent these ballots from being counted after the fact.
 ARS 16-579 (A)(1)(a) Proposition 105 (1998) Requires proof of identity
presented at the polling place. The statue is specific as to acceptable forms of
ID. Under Recorder Fontes’ expansion of mail/PEVL rules being applied to all
(nonPEVL) voters, the County Recorder is using signature verification done at
the MCTEC Processing Center as the sole ID verification. The State of Arizona
spent considerable taxpayer fund defending Proposition 105, we ask the Board
to uphold it as it was passed by the voters.
We request that the Board of Supervisors issue a new Memorandum of Understanding
instructing the County Recorder to bring the Maricopa County elections process back
into compliance with all existing election laws, both Federal and State. This will restore
the polling place procedures, including voter ID requirements, at the polling place for the
2018 and 2020 Legislative Elections and for all elections going forward.
Jim O’Connor, elected President of Arizona Republic Assembly, noted his outrage to the
actions of Adrian Fontes, Maricopa County Recorder. On September 26, 2017 while
speaking at Fountain Hills High School to the senior class Mr. Fontes made the
following comment, “The POTUS was elected by 12 percent of the Country when taking
into account the electoral college.” Mr. O’Connor stated he was one of the 11 privileged
elector voters to cast his vote for the President and Vice President. He stated Mr.
Fontes was at the school to educate the students on how to vote and took advantage of
his position. Mr. O’Connor said Mr. Fontes went on to say “Without your participation
students we see an x-game host who bankrupted casinos could be the POTUS and

that’s who we have as a president.” He stated this is not acceptable behavior for an
elected official.
John Rusinek, resident, held up a map of his property and surrounding area. He pointed
out the area he wanted to be dustproof and the actual area that was dustproof. He
explained that it was dustproofed three times and each time it was done incorrectly. He
stated the City, County or State has had no involvement into resolving the issue.
Dianne Barker, resident, stated she was glad to come to the meeting to learn new
information. She stated Supervisor Gallardo did an exceptional job stating his concerns.
She stated for transportation there should be an open mind for innovation and would like
to see more private money being used for transportation.
158. SUPERVISORS’/COUNTY MANAGER’S SUMMARY OF CURRENT EVENTS
Resumen de temas de actualidad de los Supervisores/Administrador del Condado
Supervisor Gates mentioned the kickoff of 100 miles in 100 days event. He invited
everyone to join him on November 1, 2017 for a hike at the Andy Kunasek Trailhead at
Spear S Ranch at 6:30 a.m. He said starting November 2, 2017 at 8:00 a.m. is the
County Coffee talks at Scott’s Generation Deli and Bruce Liggett, Human Services
Director, will be attending the meeting.
Supervisor Gallardo noted the kickoff of the CSA Summit and luncheon. He wished
everyone a Happy Halloween.
Supervisor Hickman wished Supervisor Gallardo a Happy Birthday. He stated that the
Clean Start Program is an innovative Smart Justice project with Human Services, Adult
Probation and the Sheriff’s Office. The program is for women with a medium to high risk
to recidivate and are referred by the Probation Department to the Human Services
Smart Justice Employment team. The women participate in a 12 week paid work
experience program which allows them to learn transferable employment skills as well
as taking behavioral courses. The women that complete the program are placed into
jobs. Over the past 18 months 160 individuals have participated and 67% have
successfully completed the program or have been employed. The preliminary data
shows that the program is a success as the women receive jobs and recidivism is
reduced. Supervisor Hickman stated in June one of the participants was receiving her
performance review when she slumped over in her chair, unconscious. The Human
Services and MCSO staff immediately administered CPR prior to the medics arriving.
Phoenix Fire arrived and transported her to St. Joseph’s Hospital. They reported she
had suffered a heart attack. The individual was placed on life support and the County
staff stayed close by until she regained consciousness. She has recovered physically
but still struggles with the aftermath of such a serious event. Supervisor Hickman
wanted to recognize the four County employees who jumped into action during the
traumatic event to save the individual’s life.
 Amy Brown, previous employee of Human Services Department
 JakinDee Kosaka, Human Services Department
 Maria M. Reyes, Maricopa County Sherriff’s Office
 Jason Rybacki, Maricopa County Sherriff’s Office
He stated their effective and compassionate response during a crisis shows great
teamwork and professionalism. As a result, the staff was awarded the “Heart Saver
