Commission
Recommendation: On 03/22/2018, the Commission voted 7-0 to recommend
approval of Z2017104 subject to conditions ‘a’ – ‘f’:
a. Development of the site shall comply with the Zoning Exhibit entitled “D & R
Construction Office” consisting of full-size sheets, dated March 2, 2018 and
stamped received March 2, 2018 except as modified by the following conditions.
b. Development of the site shall be in conformance with the Narrative Report entitled

2. Front Yard: 10’
3. Side Yard: 1’5”
4. Street-side Yard: 1’5”
5. Rear Yard: 3’
6. Lot Area: 6,000 sq. ft. minimum

11. Uses shall be limited to those acceptable to the Maricopa County
Environmental Services Department for wastewater service via on-site septic
system until such time as the site is effectively annexed or served by sewer.
d. The following Planning and Engineering Comments shall apply:
1. Roadway reviews of planning and/or zoning cases are for conceptual design
only and does not represent final design approval nor shall it entitle applicants
to future designs that are not in conformance with current County Design
Standard.
2. Prior to approval of the Building Permits, the applicant must provide
verification from the Town of Gilbert as to the requirements for any offsite
improvements (half street construction) and/or permit requirements for
access to Nunnelley Road.
3. Drainage review of planning and/or zoning cases is for conceptual design
only and does not represent final design approval nor shall it entitle applicants
to future designs that are not in conformance with Section 1205 of the
Maricopa County Zoning Ordinance and the Maricopa County Drainage
Policies and Standards.
4. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance and current
engineering policies, standards and best practices at the time of application
for construction.
e. The property owner/s and their successors waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
conditions.
f. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowners. The granting of this approval allows
the property owners to enjoy uses in excess of those permitted by the zoning
existing on the date of application, subject to conditions. In the event of the failure
to comply with any condition, a hearing shall be scheduled with the Board of
Supervisors for consideration to revert to the zoning that existed on the date of
application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, does not reduce any rights that existed
on the date of application to use, divide, sell or possess the property and that
there would be no diminution in value of the property from the value it held on the
date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.

Existing On-Site and Adjacent Zoning/Land Use:
5. On-site: AD-2/ Industrial construction yard
North: AD-2/ Industrial construction yard
South: RC (Town of Gilbert)/ Big box commercial
East: AD-2/ Industrial truck storage
West: LI (Town of Gilbert)/ unknown industrial use
Utilities and Services:
6. Water Well
Wastewater: Onsite Septic (future)
Fire: Gilbert County Island Fire District
Police: Maricopa County Sheriff's Office (MCSO)
Adopted Plans:
7. Maricopa County Comprehensive Plan Vision 2030: Designates the site as Rural
Development Area as the site is outside of County area plans. The proposed rezone is not
in concert with the land use designation.
8. Town of Gilbert General Plan 2012: Staff notes that the Town of Gilbert General Plan 2012
designates the subject property as Light Industrial. The proposed rezone will be consistent
with the Town's General Plan. As of the writing of this report the City has not provided
comments on the proposal to staff.
Public Participation Summary:
9. The applicant has complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
within 300' of the subject parcels and interested parties. To date, the applicant has not
received opposition to the proposal during the public participation process. Staff has not
received opposition or support for the project.
Outstanding Concerns from Reviewing Agencies:
10. N/A
Staff Analysis:
11. The applicant is seeking to establish industrial zoning in order to develop the site with a
5,600 square foot office and warehouse, with ancillary storage buildings, to
accommodate the property owner's construction business.
12. The subject site is located within a county island surrounded by the Town of Gilbert
(annexing municipality). Per Arizona Revised Statutes, which require that the County use
the Town of Gilbert General Plan 2012, and related standards, as guidelines when
evaluating requests for zoning changes and land subdivisions, staff believes the proposed
rezone meets the Town's Light Industrial land use designation. The Town has not
commented.
13. The County's "Vision 2030" Comprehensive Plan designates the site as a Rural
Development Area as it is located outside of any designated County Area Plan location.
As such, the proposed rezone is inconsistent with the Comprehensive Plan. However, the
site is currently zoned AD-2 under the site's governing Military Airport _Zoning Ordinance
and equivalent zoning under of the County's comprehensive Zoning Ordinance is IND-2
Light Industrial, which is what is proposed.
14. The County's "Vision 2030" Comprehensive Plan under the land use element "Urban
Solutions for Urban Development," only permits development at urban densities where
urban services are provided. In this instance, urban water services are currently available to
the site through the Town of Gilbert, but are not intended to be used as the site will continue
using well water service. Additionally, waste water services are available through the Town
of Gilbert, but are also not intended to be used as the site will have wastewater services
provided by on-site septic. The proposed lUPD limits the use of the site to the specifically
proposed use and intensity of use as designated in the Precise Plan of Development, which
can be accommodated on the proposed well water and septic systems. The Maricopa
County Department of Environmental Services has reviewed the proposal and has not
raised objections to the proposal.
Recommendation:
15. For the reasons outlined in this report, staff recommends the Commission motion for
Approval, subject to conditions 'a' - 'f'.
Provided the following conditions are met:
a. Development of the site shall comply with the Zoning Exhibit entitled "D & R
Construction Office" consisting of full-size sheets, dated March 2, 2018 and
stamped received March 2, 2018 except as modified by the following conditions.
b. Development of the site shall be in conformance with the Narrative Report entitled
"H & H Properties, LLC - D & R Construction Office", consisting of 4 pages, dated
March 2,2018, and stamped received March 2,2018 except as modified by the
following conditions.
c. The following IND-2 RUPD standards shall apply:
1. Height: 40'
2. Front Yard: 10'
3. Side Yard: 1'5"
4. Street-side Yard: 1'5"
5. Rear Yard: 3'
6. Lot Area: 6,000 sq. ft. minimum
7. Lot Width: 60' minimum
8. Lot Coverage: 60% maximum
9. Screening: 6' wall (waiver of view obstructing for north and east side fencing)
10. Sight Visibility Triangle: 2' (h) mason block with 4' (h) wrought iron fence on
top
11. Uses shall be limited to those acceptable to the Maricopa County
Environmental Services Department for wastewater service via on-site septic
system until such time as the site is effectively annexed or served by sewer.
d. The following Planning and Engineering Comments shall apply:
1 Roadway reviews of planning and/or zoning cases are for conceptual
design only and does not represent final design approval nor shall it entitle
applicants to future designs that are not in conformance with current
County Design Standard.
2. Prior to approval of the Building Permits, the applicant must provide
verification from the Town of Gilbert as to the requirements for any offsite
improvements (half street construction) and/or permit requirements for
access to Nunnelley Road.
3. Drainage review of planning and/or zoning cases is for conceptual design
only and does not represent final design approval nor shall it entitle
applicants to future designs that are not in conformance with Section 1205
of the Maricopa County Zoning Ordinance and the Maricopa County
Drainage Policies and Standards.
4. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance and current
engineering policies, standards and best practices at the time of
application for construction.
It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, does not reduce any rights that existed
on the date of application to use, divide, sell or possess the property and that
there would be no diminution in value of the property from the value if held on the
date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.

PURPOSE OF REQUEST
The purpose of this application is to request a Zone Change for approximately .89
acres of land located just west of S. Power Rd. on the north side of E. Nunnelley Rd.
This parcel is owned by H&H Properties LLC - APN 304-29-050. The parcel is currently
zoned as Airport District 2 (AD-2), Maricopa County has 2 zoning ordinances the
regular and the airport AD-2 is in the airport. The requested zone change is Light
Industrial 2 with an Industrial Unit Plan of Development (IUPD) (IND-2 IUPD). Included
with this application will be a Precise Plan of Development as well as building plans
for a proposed industrial business office. The proposed industrial uses on the property
will be consistent with the current and future uses near the Loop 202 Freeway and the
immediate vicinity.
The zone change will allow the property owner to construct a 5,600sf (2-story) office
building (2,800sf footprint) in the southwest corner of the property to manage their
growing business. The owner currently does business out of a small trailer and
warehouse on parcel 304-29-013W-just north of and connected to the property.
Constructing a new office building with access from E. Nunnelley Rd. will help
increase the company's visibility and add to the improvement of the surrounding
area.
Access from E. Nunnelley Rd. has been granted by the owner of parcel 304-29-013X
(American Furniture Warehouse Co.) by a Grant of Easement (recordation number
20170772429).
DESCRIPTION OF PROPOSAL
It is proposed that this property be used primarily for running the day-to-day
operations of D&R Construction through the proposed on-site administrative office
building, providing adequate parking for the employees of D&R Construction, and as
storage for supplies and materials related to the business of D&R Construction.
The site will be in use during normal business hours on weekdays - Monday through
Friday, 7am-5pm. The company currently has eight employees.
The proposed office building will be two stories with a shallow sloped roof, stucco
exterior, stacked stone veneer base, and steel accents. The building will be located
in the southwest corner of the lot and will utilize steel-framed construction with wood
sheathing on the walls/floors. The color palette will be beige and brown. No stand-
alone sign is planned, and no additional screening is proposed.
There is one storage building existing on the site at the southeast corner of the lot. This
building sits slightly skewed from the east property line and therefore the SW corner of
the building is only 1 1-5" from the property line where 3'-0" is required. The owner is
requesting a waiver to allow the building to remain as-built. (see IUPD chart for
details)
The south and west boundaries of the lot are screened with a 6-0" CMU block wall,
and the north and east boundaries are secured with chain-link fence which we seek
a waiver to keep it non view obstructing. The property will not contain any outdoor
use of an industrial nature - nor does the property border any residential or rural
zoning on any side - therefore, there is no additional screening required. Note there is
a 2' block wall with 4 wrought iron that will also require a waiver for the svt.

RELATIONSHIP TO SURROUNDING PROPERTIES
All of the surrounding properties are located within either the City of Gilbert or
Maricopa County jurisdictions and zoned as AD-2 or Ll - Airport District 2 or Light
Industrial. Property Use Codes are predominantly 1040 or 0031 - Miscellaneous
Industrial or Vacant Industrial Urban Subdivided. The requested zone change is
consistent with surrounding zoning and uses. (See Site Plan for details.)
Though a number of the lots surrounding the property are vacant or used mainly for
industrial storage or manufacturing, the properties to the east along E. Nunnelley Rd.
have become more developed in recent years. At the corner of Nunnelley and
Power, there is now a Mattress Firm showroom - and to the west of that, a new
restaurant is under development. To the south of the property is American Furniture
Warehouse. A well-designed industrial office building on the property will add to the
improvement of this area and may help bridge the gap between the surrounding
industrial properties to the west and the growing commercial development
happening to the east.
LOCATION AND ACCESSIBILITY
The property is accessible from E. Nunnelley Road to the south and is just north of the
Loop 202 Freeway. Since the proposed office building will typically house eight
employees and various clients, it will not draw enough traffic to adversely affect the
local motorways.
Access from E. Nunnelley Rd. has been granted by the owner of parcel 304-29-013X
(American Furniture Warehouse Co.) by a Grant of Easement (recordation number
20170772429).
CIRCULATION SYSTEM
The property will consist of an entry off of E. Nunn&ley Road. There are 27 parking
spaces provided (w/ 2 accessible; and 5 guest).
DEVELOPMENT SCHEDULE
The property owner intends to construct the proposed office building as soon as the
Zone Change is approved and is submitting plans for a building permit in tandem with
this application. All construction will happen simultaneously - no phasing.
COMMUNITY FACILITIES AND SERVICES
The property falls into the Higley Unified School District. Most of the surrounding area is
under-developed, there are retail stores and restaurants just south of the Loop 202 at
Gilbert Gateway Town Center. Just south of that, there is a Walmart and Gilbert
Hospital, with Toca Sticks Golf Course and Chandler-Gilbert Community College to
the east.
