OFFICIAL RECORDS OF MARICOPA COUNTY RECORDER ADRIAN FONTES 20180175410 03/08/2018 11:04 ELECTRONIC RECORDING 44286S-4-1-1-- Yorkm ORDINANCE S-44286 AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF PHOENIX, ARIZONA, PURSUANT TO THE PROVISIONS OF ARIZONA REVISED STATUTES, SECTION 9-471(N), BY ANNEXING THERETO A CERTAIN TRACT OF LAND CONTIGUOUS TO AND NOT EMBRACED WITHIN THE PRESENT LIMITS OF THE CITY OF PHOENIX, CONTINGENT UPON APPROVAL BY THE MARICOPA COUNTY BOARD OF SUPERVISORS; DESIGNATED AS ROW TERESA LANE ANNEXATION, NO 490. http://recorder.maricopa.gov/recdocdata/verifycert.aspx?id=195833 WHEREAS, the City of Phoenix desires to annex certain property, consisting of public right of way outside the City, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX AS FOLLOWS: SECTION 1. That the corporate limits of the City of Phoenix be, and they are hereby, increased so as to include within the corporate limits of the City of Phoenix the unincorporated right of way of Teresa Lane from the Black Canyon Highway east to 1207.7', more particularly described in Section 2 hereof, and that said territory is hereby annexed and [201801 declared to be a part of the City of Phoenix contingent upon the fulfillment of the conditions of A.R.S. That the City Council hereby determines that the territory to be annexed is described as follows: That part of the North half of Section 10, Township 6 North, Range 2 East, G&SRB&M, Maricopa County, Arizona, described as follows: BEGINNING at a point in the city limits line of the City of Phoenix as established in Ordinance No. G-4913, recorded in Document No. 2007-0665330, records of Maricopa County, Arizona, said point being the intersection of the West line of the East 120.20 feet and the South line of the North 660.34 feet of said Northwest quarter of Section 10; thence Westerly along said South line of the North 660.34 feet of said Northwest quarter and the city limits line to a point in the Easterly right of way line of the Phoenix-Cordes Junction Highway (Interstate 17) and to a point in a non-tangent circular curve concave Easterly, the radius point of which bears North 87° 33'40" East a distance of 22,714.32 feet; thence Northerly along the arc of said curve, being also the Easterly right of way line of the Phoenix-Cordes Junction Highway (Interstate 17), through a central angle of 00° 03' 47", a distance of 25.00 feet to a point in the city limits line of the City of Phoenix as established in Ordinance No. G-4995, recorded in Document No. 2007-1125458, records of Maricopa County, Arizona, being also a point in the South line of the North 635.34 feet of said Northwest quarter of Section 10; thence Easterly along said South line of the North 635.34 feet to a point in the East line of the West 131.55 feet of the Northeast quarter of said Section 10; thence Southerly along said East line to a point in said South line of the North 660.34 http://recorder.maricopa.gov/recdocdata/verifycert.aspx?id=195833 feet of said Northeast quarter of Section 10; thence Westerly along said South line of the North 660.34 feet to a point in the city limits line and the POINT OF BEGINNING. SECTION 3. That the map or plat attached to this ordinance is an accurate map of the territory annexed, and the same is hereby adopted as the official map of the territory hereby annexed, which said map and plat show the legal boundaries thereof, together with the avenues, streets, alleys and lanes and the locations thereof. SECTION 4. That the Mayor of the City of Phoenix be, and he hereby is, authorized and directed to certify that said map is an accurate map of the territory annexed under the provisions of this ordinance. That a copy of this ordinance, together with the attached official map, shall be filed with the Board of Supervisors of Maricopa County, State of Arizona, for 5 their consideration pursuant to A.R.S. That the annexation of the above-described territory is contingent upon the approval of the annexation by the Board of Supervisors, Maricopa County, State of Arizona. SECTION 7. That, approval of the County Board of Supervisors pursuant to A.R.S. Section 9-471(N), a copy of this Ordinance, together with an accurate map of the territory hereby annexed to the City of Phoenix, certified by the Mayor of said City, shall be filed and recorded in the office of the County Recorder of Maricopa County, Arizona. SECTION 8. If any provisions of this ordinance shall be held invalid, its http://recorder.mari invalidity shall not affect any other provision, and for this purpose the provisions of this ordinance are hereby declared to be severable.
