ORDINANCE C-06-18-338-7-00 WHEREAS, A.R.S. § 9-471.02 and 9-471.03 provide a method for deannexation of land from a municipality to a county; and WHEREAS, pursuant to A.R.S. § 9-471.03(C), the Town of Wickenburg passed and adopted Ordinance No. 1178 declaring the deannexation of the territory described as follows: THE WEST 40.0 FEET OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER AND THE WEST 40.0 FEET OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 15, TOWNSHIP 7 NORTH, RANGE 5 WEST OF THE GILA AND SALT RIVER BASE AND MERIDIAN, MARICOPA COUNTY ARIZONA. TOGETHER WITH THE EAST 15 FEET OF THE WEST 55.00 FEET OF A PORTION OF THE NORTH HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 15, TOWNSHIP 7 NORTH, RANGE 5 WEST, OF THE GILA AND SALT RIVER BASE AND MERIDIAN, MARICOPA COUNTY ARIZONA FURTHER DESCRIBED AS FOLLOWS: COMMENCING AT THE WEST QUARTER CORNER OF SAID SECTION 15; THENCE NORTH 00°03'00" EAST TO THE SOUTHWEST CORNER OF SAID NORTH 1/2 A DISTANCE OF 330.08 FEET, ALSO BEING THE TRUE POINT OF BEGINNING; THENCE NORTH 00°03'00" EAST ALONG THE WESTERLY LINE TO THE NORTHWEST CORNER OF SAID NORTH 1/2 A DISTANCE OF 330.07 FEET; THENCE SOUTH 89°44'51" EAST ALONG THE NORTHERLY LINE OF SAID NORTH 1/2 A DISTANCE OF 250.00 FEET; THENCE SOUTH 00°03'00" WEST TO A POINT ON THE SOUTHERLY LINE OF SAID NORTH 1/2 A DISTANCE OF 330.01 FEET; THENCE NORTH 89°44'51" WEST ALONG SAID SOUTHERLY LINE A DISTANCE OF 250.00 FEET TO THE TRUE POINT OF BEGINNING. TOGETHER WITH THAT PORTION OF SAID SECTION 15 FURTHER DESCRIBED AS FOLLOWS: COMMENCING AT THE WEST QUARTER OF SAID SECTION 15; THENCE SOUTH 00°03'15" WEST, 626.98 FEET ALONG THE WESTERLY LINE OF SAID SECTION 15; THENCE SOUTH 89°46'32" EAST, 40.00 FEET TO THE INTERSECTION POINT OF THE EAST 40.00 FEET RIGHT-OF-WAY LINE OF STEINWAY DRIVE AND THE NORTH 33.00 FEET RIGHT-OF-WAY LINE OF MANRAD ROAD AND THE POINT OF BEGINNING; THENCE CONTINUING ALONG THE NORTH RIGHT-OF-WAY LINE OF MANRAD ROAD SOUTH 89°46'32" EAST, 196.00 FEET; THENCE SOUTH 00°03'15" WEST, 33.00 FEET TO THE CENTERLINE OF MANRAD ROAD; THENCE NORTH 89°46'32" WEST, 196.00 FEET ALONG SAID CENTERLINE TO A POINT ON THE EAST 40.00 FEET RIGHT-OF-WAY LINE OF STEINWAY ROAD; THENCE NORTH 00°03'15" EAST, 33.00 FEET TO THE POINT OF BEGINNING. CONTAINING 2.08 ACRES +/- WHEREAS, it is the desire of Maricopa County to receive the certain deannexed territory now within the corporate limits of the Town of Wickenburg; and WHEREAS, the territory proposed to be severed and returned to Maricopa County meets the conditions outlined in A.R.S. § 9-471.03, and WHEREAS, Maricopa County Department of Transportation conducted an analysis of the impact of the Deannexation as follows: MCDOT and the Town of Wickenburg have reviewed the request and determined this deannexation to be in the best interest of the public to more effectively use public resources. Deannexing the half street will allow for a better use of resources for one agency to more efficiently maintain the roadway, and WHEREAS, after such notice as was appropriate and legally required, the Maricopa County Board of Supervisors scheduled a hearing on the matter on Wednesday, April 11, 2018; and WHEREAS, it was determined at such hearing that requirements pursuant to A.R.S. § 9-471.03 (C, D and E) have been satisfied; and WHEREAS, it is the determination of the Board of Supervisors that the public interest is served by the deannexation; and WHEREAS, no protests were filed before the Board of Supervisors, NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Maricopa County, Arizona, that the territory earlier described in Town of Wickenburg Ordinance No. 1178 is hereby declared to be returned to Maricopa County contingent on the remaining requirements of A.R.S. § 9-471.03 including the final public hearing scheduled for Wednesday, May 23, 2018.
